Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION I — DEFINITIONS AND SCOPE
Article 1
For the purpose of this Agreement:
1. “Territory” shall mean:
– for the Benelux States: the combined territory in Europe of the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands;
– for the Kyrgyz Republic: the territory of the Kyrgyz Republic;
2. “Person having entered and/or residing without authorisation” shall mean any person who does not, or no longer, fulfil the conditions in force for entry or residence;
3. “Readmission” shall mean the return by the competent authority of the Requesting Party and admission by the competent authority of the Requested Party of an own national of the Requested Party, respectively of a third-State national or of a stateless person, who does not, or no longer, fulfil the conditions for entry into or residence on the territory of the Requesting Party, under the conditions provided for in this Agreement;
4. “Own national” shall mean any person who holds the nationality of one of the Benelux States or of the Kyrgyz Republic;
5. “Third State” shall mean any State which is neither a Benelux State nor the Kyrgyz Republic;
6. “Third-State national” shall mean any person who holds a nationality other than that of one of the Benelux States or of the Kyrgyz Republic;
7. “Stateless person” shall mean any person who has no nationality as defined by the Convention of 28 September 1954 relating to the Status of Stateless Persons;
8. “Requesting Party” shall mean the Party on whose territory a person having entered and/or residing without authorisation is present and which requests the readmission of this person or his transit, under the conditions provided for in this Agreement;
9. “Requested Party” shall mean the Party which is asked to readmit a person having entered and/or residing without authorisation on the territory of the Requesting Party or to allow his transit over its territory, under the conditions provided for in this Agreement;
10. “Diplomatic or consular representation of the Requested Party” shall mean the diplomatic or consular representation of the Requested Party accredited to the Requesting Party;
11. “Residence permit” shall mean an official permit of any type issued by one of the Parties entitling a person to reside on its territory. This shall not include temporary permission to remain in connection with the processing of an asylum application or an application for a residence permit.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION II — READMISSION OBLIGATIONS
Article 2
1 Each Party shall readmit, upon application by the other Party and without further formalities other than those provided for in this Agreement, any person to its territory who does not, or no longer, fulfil the conditions for entry into or residence on the territory of the Requesting Party provided that it is proved, or may be validly assumed on the basis of prima facie evidence furnished, that the person has the nationality of the Requested Party.
2 The readmission obligation in paragraph 1 also applies in the case of a person who, after entering the territory of the Requesting Party, has forfeited or renounced the nationality of the Requested Party, unless the person concerned has at least been admitted to the procedure of naturalisation by the Requesting Party.
3 Each Party shall also readmit:
1. minor children of the persons mentioned in paragraph 1 of this Article, regardless of their place of birth or nationality, unless they have an independent right of residence on the territory of the Requesting Party. Parties shall take into account the best interests of the minor child before applying for the readmission.
2. spouses, holding another nationality, of the persons mentioned in paragraph 1 of the present Article, provided that they have the right to enter and permanently reside or receive the right to enter and/or permanently reside in the territory of the Requested Party, unless they have an independent right of residence on the territory of the Requesting Party.
4 Upon application by the Requesting Party, and in accordance with the provisions of Article 7(5), the Requested Party shall immediately issue the travel documents required for the return of the persons to be readmitted.

Article 3
1 Each Party shall readmit, upon application by the other Party and without further formalities other than those provided for in this Agreement, any third-State national or stateless person to its territory who does not, or no longer, fulfil the conditions for entry into or residence on the territory of the Requesting Party provided that it is proved, or may be validly assumed on the basis of prima facie evidence furnished, that this person:
1. holds a valid residence permit issued by the Requested Party; or
2. holds a valid visa, other than a transit visa, issued by the Requested Party.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION III — READMISSION PROCEDURE
Article 4
1 A readmission application on the basis of Article 2 of the present Agreement or Article 3 shall be submitted in writing to the competent authority of the Requested Party.
2 Each readmission application shall contain the following information:
1. the particulars of the person concerned (surname, given names, any previous names, nicknames and pseudonyms, aliases, sex, date of birth and, if possible, place of birth and last place of residence on the territory of the Requested Party);
2. copies of the means of evidence as referred to in Article 5 or 6.
3 No readmission application is required in cases where the person to be readmitted is in possession of any valid document giving the right to cross the state border, and if it concerns a third-State national or stateless person, is also in possession of a valid visa or a valid residence permit of the Requested Party.
4 In case of readmission applications on the basis of Article 3 of this Agreement, the Requesting Party will submit a readmission application to the person’s country of origin while submitting the application to the Requested Party.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION III — READMISSION PROCEDURE
Article 5
1 Proof of nationality pursuant to Article 2 of the present Agreement can be furnished through the documents listed in the Implementing Protocol to this Agreement. If such documents are presented, the Parties shall recognise the nationality without further formalities.
2 Prima facie evidence of nationality pursuant to Article 2 of the present Agreement can be furnished through the documents or elements listed in the Implementing Protocol to this Agreement. If such documents or elements are presented, the Parties shall deem the nationality to be established, unless the Requested Party can prove otherwise.
3 If none of the documents or elements mentioned in paragraph 1 or 2 of this Article can be presented, but the Requesting Party believes that a presumption exists with regard to the nationality of the person to be readmitted, the competent authorities of the Requested Party shall take the necessary measures to establish the nationality of the person concerned. If it is deemed necessary by the Requesting Party, an interview with the person concerned shall be conducted in order to establish, inter alia on the basis of the language in which the person communicates, whether the person is one of its own nationals.
4 The interview mentioned in paragraph 3 of this Article shall be performed by the diplomatic or consular representation of the Requested Party, or a delegation of the Requested Party invited by the Requesting Party, or by any other expert appointed by mutual agreement.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION III — READMISSION PROCEDURE
Article 6
1 Proof of the conditions for the readmission of third-State nationals or stateless persons laid down in Article 3 of this Agreement can be furnished through the means of evidence as mentioned in the Implementing Protocol to this Agreement. These means of evidence shall be recognised by the Parties without further formalities.
2 Prima facie evidence of the conditions for the readmission of third-State nationals or stateless persons laid down in Article 3 of this Agreement can be furnished through the means of evidence mentioned in the Implementing Protocol to this Agreement. Where such prima facie evidence is presented, the Parties shall deem the conditions to be established, unless the Requested Party can prove otherwise.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION III — READMISSION PROCEDURE
Article 7
1 The readmission application for a Party’s own national can be submitted at any time by the competent authority of the Requesting Party, if it has been established that the person concerned does not fulfil, or no longer fulfils, the conditions for entry into or residence on the territory of the Requesting Party.
2 The readmission application for a third-State national or a stateless person shall be submitted by the competent authority of the Requesting Party within a maximum of one (1) year after the Requesting Party has gained knowledge that this person does not fulfil, or no longer fulfils, the conditions for entry into or residence on the territory of the Requesting Party. Where there are legal or factual obstacles to the application being submitted in time, the time limit shall be extended upon request, but only until the obstacles have ceased to exist.
3 A readmission application shall be replied to immediately, and in any event no later than within thirty (30) days, and every refusal shall be substantiated. This time limit begins to run from the date of receipt of the readmission application. If there is no reply within this time limit, the transfer shall be deemed to have been agreed to.
4 After agreement to the readmission, or after expiry of the time limit, the Requesting Party shall transfer the person whose readmission has been agreed to immediately, and in any case no later than within six (6) months. Upon request, this time limit may be extended by the time taken to deal with legal or practical obstacles. The Requested Party shall readmit the person whose readmission has been agreed to without further formalities.
5 At the request of the Requesting Party, the Requested Party shall provide immediately, and in any case no later than within five (5) working days, the travel document required for the return of the person to be readmitted, bearing his name and with a period of validity of at least one (1) month. If the Requested Party cannot provide the requested travel document within five (5) working days after the date of agreement to the readmission, the Requested Party shall be deemed to accept the use of a travel document provided by the Requesting Party. If, for legal or factual reasons, the person concerned cannot be transferred within the period of validity of the travel document that was initially issued, the Requested Party shall, within two (2) working days, issue a new travel document or extend the initial one with a period of validity of the same duration.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION III — READMISSION PROCEDURE
Article 8
1 Before transferring a person, the competent authorities of the Requesting Party shall notify in writing the competent authorities of the Requested Party regarding the date and the modalities of the transfer, the designated border crossing point, the possible use of escorts and other relevant information concerning the transfer.
2 The notification concerning the transfer will, where applicable, also contain the following information:
1. data concerning the health of the person, provided that the person concerned has explicitly agreed to this;
2. assistance which the transferee may require;
3. all other protection or security measures which may be necessary for this transfer.
3 Transfers generally take place by air, but may also be carried out by land or sea. Transfer by air may take place by using both scheduled and government flights.
4 Transfers of third-State nationals or stateless persons will not take place in case the validity of the visa or residence permit has expired on the date of the transfer.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION III — READMISSION PROCEDURE
Article 9
1 The Requesting Party shall take back any person readmitted by the Requested Party if within a period of three (3) months after the transfer, it is established that the requirements laid down in Articles 2 and 3 of this Agreement are not met.
2 In the cases mentioned in paragraph 1 of this Article, the procedural provisions of this Readmission Agreement shall apply mutatis mutandis and all available information relating to the actual identity and nationality of the person to be taken back shall be provided.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION IV — TRANSIT OPERATIONS
Article 10
1 The Parties shall allow the transit of third-State nationals through their territory if another Party so requests, if the onward journey in possible other States of transit and the readmission by the State of destination is assured.
2 The Parties shall do whatever is necessary to restrict the transit of third-State nationals to cases where such persons cannot be transferred to the State of destination directly.
3 Transit can be refused by the Parties:
1. if the third-State national runs the real risk of being subjected to torture or to inhuman or degrading treatment or punishment or the death penalty or of persecution because of his race, religion, nationality, membership of a particular social group or political conviction in the State of destination or another State of transit;
2. if the third-State national shall be prosecuted under the criminal law or subject to the enforcement of criminal sanctions on the territory of the Requested Party.
4 The Parties may revoke any authorisation issued if circumstances referred to in paragraph 3 of this Article subsequently arise, interfering with the transit operation, or if the onward journey in possible States of transit or the readmission by the State of destination is no longer assured. In these cases, the Requesting Party shall take the person concerned back to its territory without delay.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION IV — TRANSIT OPERATIONS
Article 11
1 An application for transit operations shall be submitted to the competent authorities in writing and shall contain the following information:
1. type of transit (by air, land or sea), possible other States of transit and the State of destination;
2. the particulars of the person concerned (surname, given names, date of birth and – if available – place of birth, nationality, type and number of travel document);
3. envisaged border crossing point, time of transit and possible use of escorts;
4. a declaration that in the view of the Requesting Party the conditions pursuant to Article 10(1) and (2) of this Agreement are met, and that no reasons for a refusal pursuant to Article 10(3) of the present Agreement are known of.
2 The competent authority of the Requested Party shall immediately inform the competent authority of the Requesting Party in writing of the admission, confirming the border crossing point and the envisaged time of admission, or inform it of the admission refusal and of the reasons for such refusal.
3 If the transit operation takes place by air, the necessary amenities shall be provided to the person in transit and possible escorts with a view to accessing the national or international zone of the airport of the Requested Party.
4 The competent authorities of the Requested Party shall, subject to mutual consultations, assist in the transit operations, in particular through the surveillance of the person in transit and the provision of suitable amenities for that purpose.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION V — COSTS
Article 12
Without prejudice to the right of the competent authorities to recover the costs associated with the readmission from the person to be readmitted or from third parties, all costs incurred in connection with readmission and transit operations or return of persons admitted by mistake pursuant to this Agreement to the border of the State of final destination, shall be borne by the Requesting Party.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION VI — DATA PROTECTION AND NON-AFFECTION CLAUSE
Article 13
The communication of personal data shall only take place if such communication is necessary for the implementation of this Agreement. The processing, the treatment and the use of personal data by the competent authorities of the Kyrgyz Republic in a particular case shall be subject to the national laws of the Kyrgyz Republic and, where the data is treated and used by a competent authority of a Benelux State, to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC of 24 October 1995 (General Data Protection Regulation) and of the national legislation of the respective Benelux States adopted pursuant to this Regulation. Additionally, the following principles shall apply:
1. Personal data shall be processed lawfully, fairly and in a transparent manner in relation to the data subject (“lawfulness, fairness and transparency”);
2. Personal data shall be collected for the specified, explicit and legitimate purpose of implementing this Agreement and not further processed by the communicating authority nor by the receiving authority in a way incompatible with that purpose; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes (“purpose limitation”);
3. Personal data shall be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed (“data minimization”) and not excessive in relation to the purpose for which they are collected and/or further processed; in particular, personal data communicated may concern only the following:
1. the particulars of the person to be readmitted (surname, given name, any previous names, nicknames or pseudonyms, date and place of birth, sex, current and previous nationality);
2. identity card or passport (serial number, period of validity, date of issue, issuing authority and place of issue);
3. stop-overs and itineraries;
4. other information needed to identify the person to be readmitted or to examine the readmission requirements pursuant to this Agreement;
4. Personal data shall be accurate and, where necessary, kept up-to-date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay (“accuracy”);
5. Personal data shall be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes and subject to implementation of the appropriate technical and organizational measures in order to safeguard the rights and freedoms of the data subject (“storage limitation”);
6. Both the communicating and the receiving authority shall take every adequate step to ensure as appropriate the rectification, erasure or blocking of personal data where the processing does not comply with the provisions of this Article, in particular because those data are not adequate, relevant, accurate or they are excessive in relation to the purpose of processing. This includes the notification of any rectification, erasure or blocking to the other Party;
7. Upon request, the receiving authority shall inform the communicating authority of the use of the communicated data and of the results obtained therefrom;
8. Personal data may only be communicated to the competent authorities. Further communication to other bodies requires the prior consent of the communicating authority;
9. The communicating and the receiving authorities are obliged to make a written record of the communication and receipt of personal data;
10. Personal data shall be processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures (“integrity and confidentiality”).
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION VI — DATA PROTECTION AND NON-AFFECTION CLAUSE
Article 14
This Agreement shall be without prejudice to the rights, obligations and responsibilities of the Parties arising from international legal norms.
Agreement between the Benelux States (the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands) and the Kyrgyz republic on the readmission of persons having entered and/or residing without authorisation (Readmission Agreement) › SECTION VII — IMPLEMENTATION AND APPLICATION
Article 15
1 The Parties shall provide one another with mutual assistance in the application and interpretation of this Agreement. To this end, they shall set up a Committee of Experts which will, in particular, have the following tasks:
1. to monitor the application of this Agreement;
2. to make proposals to resolve issues relating to the application of this Agreement;
3. to propose amendments and supplements to this Agreement;
4. to elaborate and recommend appropriate measures to combat illegal immigration.
2 The Parties reserve the right to approve or to reject the measures proposed by the Committee of Experts.
3 The Committee shall be composed of one representative for the Kingdom of Belgium, one representative for the Grand Duchy of Luxembourg, one representative for the Kingdom of the Netherlands and three (3) representatives for the Kyrgyz Republic. The Parties shall designate therein the chairperson and the deputy chairperson. Deputy members shall be appointed. If necessary, other experts may be involved in the Committee´s activities.

Article 16
Issues on the implementation of the present Agreement, as well as disputes between the Parties concerning the interpretation or the application of the provisions of the present Agreement shall be solved in a mutual consent between the Parties through consultations.

Article 17
This Agreement may be amended and supplemented by mutual consent of the Parties. Amendments and supplements which shall form an integral part of this Agreement shall be drawn up in the form of separate protocols and enter into force in accordance with the national law of the Parties.

Article 18
All necessary practical provisions for the implementation of this Agreement shall be laid down in the Implementing Protocol. The Implementing Protocol shall regulate inter alia:
1. the designation of the competent authorities of the Parties;
2. the designation of border crossing points;
3. the establishment of the means of evidence;
4. the conditions under which and the manner in which persons to be readmitted or in transit are escorted.
The Implementing Protocol forms an integral part of this Agreement.

Article 19
With regard to the Kingdom of the Netherlands, the application of this Agreement can be extended to parts of the Kingdom which are situated outside Europe through a notification to the General Secretariat of the Benelux Union, which shall inform the other Parties thereof.

Article 20
The General Secretariat of the Benelux Union shall be the depositary of this Agreement. The depositary shall provide a certified true copy to all Signatory States.

Article 21
1 This Agreement shall enter into force on the first day of the second month following the date of receipt by the depositary of the last notification by the Signatory State that the internal formalities required for entry into force have been observed.
2 Notwithstanding paragraph 1, should the last notification be deposited before the entry into force of the Agreement between the Benelux States and the Kyrgyz Republic on the exemption from visa requirements for holders of valid diplomatic and service/official passports, this Agreement shall not enter into force until the date of the entry into force of the aforementioned Agreement.
3 With regard to any other Benelux Signatory State, this Agreement shall enter into force on the first day of the second month following the date of receipt by the depositary of the notification to the effect that the internal formalities required for entry into force have been observed.
4 The depositary shall inform each of the Signatory States of the notifications referred to in paragraphs 1 and 2 of this Article and of the dates of the entry into force of this Agreement vis-à-vis the Parties.

Article 22
1 This Agreement is concluded for an indefinite period.
2 Each Party may suspend this Agreement, after notification to the depositary, which shall inform the other Party thereof, for serious reasons, including relating to the protection of state security, public order, or public health. With regard to the withdrawal of such a measure, the Parties shall immediately inform one another through diplomatic channels.
3 The suspension of this Agreement shall take effect on the first day of the first month following the month in which the notification referred to in paragraph 2 of this Article is received by the depositary.
4 Each Party may for serious reasons, denounce this Agreement, after communication to the depositary, which shall inform the other Party thereof.
5 The agreement shall cease to apply on the first day of the sixth month following the month in which the notification referred to in paragraph 4 of this Article is received by the depositary.

Article 1
1 Thirty (30) days after the conclusion of this Protocol, the Parties shall exchange lists of the authorities competent to implement the Agreement and of their diplomatic or consular representations accredited to the other Parties.
2 The Parties shall immediately inform one another of any change to the lists referred to in paragraph 1 of this Article.

Article 2
1 The border crossing points used for the application of this Agreement are listed in Annex 1 to this Protocol.
2 The Parties shall immediately inform one another of any change to the list of the border crossing points mentioned in Annex 1 to this Protocol.
3 The competent authorities can agree to use other border crossing points for the application of this Agreement on an ad hoc basis.

Article 3
1 A readmission application shall be submitted in writing by e-mail or other means of electronic communication directly to the competent authority of the Requested Party.
2 The readmission application shall be submitted using the form attached as Annex 2 to this Protocol.
3 For providing as well as for receiving more detailed information with regard to the submitted readmission application, the Requesting Party shall turn to the competent authority of the Requested Party.

Article 4
1 Proof of nationality pursuant to Article 2 of the Agreement can be furnished through any of the following documents:
1. a valid national passport or replacement travel document with photo (laissez-passer);
2. a valid national identity card;
3. a valid military identity card or other armed forces personnel identity card with a photo of the holder;
4. a seaman’s identity card;
5. other official documents indicating the nationality of the person concerned, issued by the Requested Party and bearing a photo;
6. a document, as described above, which is no longer valid on the date on which the readmission application is sent;
7. confirmation of identity as a result of a search carried out in the Visa Information System.
2 Prima facie evidence of nationality pursuant to Article 2 of the Agreement can be furnished through the following documents or elements:
1. a copy of one of the documents mentioned in paragraph 1 of this Article;
2. other documents or data, including biometric data, which may help to establish the nationality of the person concerned (seaman´s book, driving licence, etc.);
3. a document indicating consular registration, a certificate of nationality or a certificate issued by the authorized registry of births, marriages and deaths;
4. a company identity card;
5. copies of the documents mentioned in points 2 to 4 of this paragraph;
6. a reliable witness statement;
7. the statement made by the person concerned.

Article 5
1 Proof of the conditions for the readmission of third-State nationals or stateless persons laid down in Article 3 of the Agreement can be furnished through valid visas or residence permits issued by the Requested Party as means of evidence.
2 If no documents mentioned in paragraph 1 can be presented, but the Requesting Party seriously presumes that a third-State national or stateless person falls under the conditions for the readmission as laid down in Article 3 of the Agreement, prima facie evidence can be furnished through the following means of evidence:
1. copies of the documents mentioned under paragraph 1;
2. any document, information or statement which supports the presumption that the third-country national or stateless person is in possession of a valid visa or residence permit issued by the Requested Party.

Article 6
1 The reply to a readmission application shall be sent in writing by e-mail or other means of electronic communication to the competent authority of the Requesting Party. A copy of this reply is simultaneously provided to the diplomatic or consular representation of the Requested Party.
2 The readmission application shall be replied to using the form attached as Annex 2 to this Protocol and used for submitting that application.

Article 7
1 In the event of a positive reply to the readmission application, the travel document required for the return pursuant to Article 7(5) of the Agreement, shall be issued in the name of the person to be readmitted and delivered immediately, and in any case not later than within five (5) working days, by the diplomatic or consular representation of the Requested Party to the competent authorities of the Requesting Party.
2 The travel document shall have a period of validity of one (1) month.
3 If the diplomatic or consular representation of the Requested Party has not provided the requested travel document within five (5) working days after the date of the positive reply, the Requested Party shall be deemed, on the basis of Article 7(5) of the Agreement, to accept the use of a travel document provided by the Requesting Party. The documents that the Parties shall use for this purpose are attached as Annexes 3 and 4 to this Protocol.

Article 8
1 If the interview is performed by the diplomatic or consular representation of the Requested Party, the interview shall be held without delay, and in any case at the latest within seven (7) days from the date of receipt of the readmission application.
2 Where the interview is conducted by a delegation of the Requested Party, or by any other expert appointed by mutual agreement, the planning of the interviews may be mutually agreed so another Requesting Party may use the services of the delegation of the Requested State.
3 The Requested Party shall inform the Requesting Party immediately, and in any case at the latest within three (3) working days after the interview about the result thereof.

Article 9
1 The competent authority of the Requesting Party shall notify in writing by e-mail or other means of electronic communication at least three (3) working days in advance the competent authority of the Requested Party regarding the planned transfer. For this purpose, it shall use the form attached as Annex 5 to this Protocol. A copy of this form shall be provided to the diplomatic or consular representation of the Requested Party.
2 If the Requesting Party is unable to transfer the person to be readmitted within the period of six (6) months referred to in Article 7(4) of the Agreement, it shall immediately inform the competent authority of the Requested Party thereof. As soon as the actual transfer of the person concerned can take place, the competent authority of the Requesting Party shall inform the Requested Party thereof, making use of the form referred to in paragraph 1 of this Article and in compliance with the time limits applicable for the transfer.
3 If the Requesting Party is of the opinion that the transport must take place by road or sea, the competent authorities of the Requesting Party shall make special mention thereof on the form referred to in paragraph 1 of this Article.
4 The diplomatic or consular representation of the Requested Party delivers without delay visas to the escorts, if required, allowing them access to its territory during their official duties in the framework of this Agreement.

Article 10
1 A transit application shall be submitted at least seven (7) working days before the planned transit in writing by e-mail or other means of electronic communication by the Requesting Party to the competent authority of the Requested Party. The application shall be submitted using the form attached as Annex 6 to this Protocol.
2 The competent authority of the Requested Party shall communicate immediately and in any case not later than within four (4) working days, in writing by e-mail or other means of electronic communication, whether it consents to the transit and the time for which it has been scheduled, the border crossing point, the modes of transportation and the use of escorts. For this reply the form referred to in paragraph 1 of this Article shall be used.
3 In principle, transit shall take place by air.

Article 11
1 If the Requesting Party deems it necessary to have the support of the authorities of the Requested Party for the transit, it shall report the type and content of the desired support under point 4 of the form attached as Annex 6 to this Protocol.
2 In the reply to the transit application, the Requested Party shall state whether it can provide the requested support.
3 In so far as the person concerned is escorted on the territory of the Requested Party, guarding and the possible embarkation shall be effected under the authority and, in so far as possible, with the support of this Party.

Article 12
1 Escorts are designated by the Requesting Party and are responsible for accompanying the person to be readmitted or in transit.
2 Within the territory of the Requested Party, escorts shall under all circumstances comply with the law of the Requested Party.
3 In the implementation of the readmission and transit, in so far as this takes place on the territory of the Requested Party, the powers of escorts are limited to self-defense. In addition, in the absence of any officials of the Requested Party who are authorized to take the necessary action or in order to support such officials, escorts may respond to an immediate and serious threat in a reasonable and proportionate manner in order to prevent the person concerned from fleeing, injuring himself or third parties or causing damage to property.
4 Escorts shall perform their task unarmed and in civilian dress. They shall be in possession of an escort authorisation, the consent for readmission or transit, and an identity card.
5 The authorities of the Requested Party shall grant the same protection and assistance to escorts, while the latter are performing their duties within the framework of the Agreement, as they grant to their own officials who are authorised to take such action.

Article 13
1 Costs incurred by the Requested Party in connection with readmission and transit operations that are to be borne by the Requesting Party pursuant to Article 12 of the Agreement, shall be compensated by the Requesting Party upon submission of an invoice. This invoice shall also mention the banking details of the Requested Party.
2 The Requesting Party shall pay all costs to the Requested Party within thirty (30) days after receipt of the invoice.

2 Any modification of the Annexes to this Protocol shall be agreed in writing between the Parties and shall enter into force on a date to be determined by the Parties.

Overeenkomst tussen de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden) en de Kirgizische Republiek betreffende de terug- en overname van onregelmatig binnengekomen en/of verblijvende personen (terug- en overnameovereenkomst) › DEEL I — DEFINITIES EN WERKINGSSFEER
Artikel 1
Voor de toepassing van deze Overeenkomst betekent:
1. „Grondgebied”:
– voor de Benelux-Staten: het gezamenlijke grondgebied in Europa van het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden;
– voor de Kirgizische Republiek: het grondgebied van de Kirgizische Republiek;
2. „Onregelmatig binnengekomen en/of verblijvende persoon”: elke persoon die niet of niet meer voldoet aan de voorwaarden voor binnenkomst of verblijf;
3. „Terugname”: de verwijdering door de bevoegde autoriteit van de Verzoekende Partij en de toelating door de bevoegde autoriteit van de Aangezochte Partij van een eigen onderdaan van de Aangezochte Partij, respectievelijk van een onderdaan van een derde Staat of van een staatloze persoon, die niet of niet meer voldoet aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van de Verzoekende Partij, onder de in deze Overeenkomst bedoelde voorwaarden;
4. „Eigen onderdaan”: elke persoon die de nationaliteit heeft van één der Benelux-Staten of van de Kirgizische Republiek;
5. „Derde Staat”: elke Staat die noch een Benelux-Staat noch de Kirgizische Republiek is;
6. „Onderdaan van een derde Staat”: elke persoon die de nationaliteit heeft van een andere Staat dan van één der Benelux-Staten of van de Kirgizische Republiek;
7. „Staatloze persoon”: elke persoon zonder nationaliteit zoals bepaald door het Verdrag van 28 september 1954 betreffende de Status van Staatloze personen;
8. „Verzoekende Partij”: de Partij op wiens grondgebied een onregelmatig binnengekomen en/of verblijvende persoon zich bevindt en die om de terugname van deze persoon dan wel zijn doorgeleiding verzoekt, onder de in deze Overeenkomst bedoelde voorwaarden;
9. „Aangezochte Partij”: de Partij die wordt verzocht een onregelmatig binnengekomen en/of verblijvende persoon op het grondgebied van de Verzoekende Partij terug of over te nemen dan wel zijn doorgeleiding over haar grondgebied toe te staan, onder de in deze Overeenkomst bedoelde voorwaarden;
10. „Diplomatieke of consulaire vertegenwoordiging van de Aangezochte Partij”: de bij de Verzoekende Partij geaccrediteerde diplomatieke of consulaire vertegenwoordiging van de Aangezochte Partij;
11. „Verblijfstitel”: een door een van de Partijen afgegeven officiële vergunning die een persoon het recht geeft om op haar grondgebied te verblijven. Hieronder valt niet de tijdelijke vergunning om in verband met de behandeling van een asielverzoek of de aanvraag van een verblijfsvergunning op het grondgebied te verblijven.

Artikel 2
1 Elke Partij neemt op verzoek van de andere Partij en zonder verdere formaliteiten, andere dan bedoeld in deze Overeenkomst, elke persoon op haar grondgebied terug of over die niet of niet meer voldoet aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van de Verzoekende Partij, mits er kan worden aangetoond, of aannemelijk kan worden gemaakt op basis van een begin van bewijs, dat de persoon de nationaliteit van de Aangezochte Partij heeft.
2 De terugnameplicht uit lid 1 geldt ook voor een persoon die na binnenkomst op het grondgebied van de Verzoekende Partij de nationaliteit van de Aangezochte Partij heeft verloren of er afstand van heeft gedaan, tenzij die persoon ten minste een naturalisatietoezegging van de Verzoekende Partij heeft ontvangen.
3 Elke Partij neemt ook de volgende personen terug en over:
1. minderjarige kinderen van de in lid 1 van dit artikel vermelde personen, ongeacht hun geboorteplaats of nationaliteit, tenzij zij een zelfstandig verblijfsrecht voor het grondgebied van de Verzoekende Partij hebben. De Partijen houden rekening met de belangen van het minderjarige kind voordat ze de terugname aanvragen.
2. echtgenoten van de personen vermeld in lid 1 van dit artikel die een andere nationaliteit bezitten, mits zij het recht hebben of krijgen om op het grondgebied van de Aangezochte Partij binnen te komen en/of permanent te verblijven, tenzij zij een zelfstandig verblijfsrecht voor het grondgebied van de Verzoekende Partij hebben.
4 Op verzoek van de Verzoekende Partij, en conform de bepalingen van artikel 7, lid 5, verstrekt de Aangezochte Partij onverwijld de met het oog op de teruggeleiding van de terug of over te nemen personen vereiste reisdocumenten.

Artikel 3
1 Elke Partij neemt op verzoek van de andere Partij en zonder verdere formaliteiten, andere dan bedoeld in deze Overeenkomst, elke onderdaan van een derde Staat of staatloze persoon op haar grondgebied terug of over die niet of niet meer voldoet aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van de Verzoekende Partij, mits er kan worden aangetoond, of aannemelijk kan worden gemaakt op basis van een begin van bewijs, dat deze persoon:
1. in het bezit is van een geldige verblijfstitel afgegeven door de Aangezochte Partij; of
2. in het bezit is van een geldig visum, anders dan een transitvisum, afgegeven door de Aangezochte Partij.

Artikel 4
1 Een verzoek om terugname op grond van artikel 2 of 3 van deze Overeenkomst wordt schriftelijk ingediend bij de bevoegde autoriteit van de Aangezochte Partij.
2 Elk verzoek om terugname bevat de volgende inlichtingen:
1. de personalia van de betrokkene (naam, voornamen, eventueel vroegere namen, bijnamen en pseudoniemen, aliassen, geslacht, geboortedatum en, indien mogelijk, geboorteplaats en laatste verblijfplaats op het grondgebied van de Aangezochte Partij);
2. een kopie van de bewijsmiddelen als bedoeld in artikel 5 of 6.
3 Er is geen terugnameverzoek vereist wanneer de terug of over te nemen persoon in het bezit is van een geldig document dat het recht geeft de staatsgrens over te steken en, indien het een onderdaan van een derde Staat of een staatloze persoon betreft, tevens in het bezit is van een geldig visum of een geldige verblijfstitel van de Aangezochte Partij.
4 In het geval van een verzoek om terugname op basis van artikel 3 van deze Overeenkomst dient de Verzoekende Partij tegelijkertijd een verzoek om terugname bij het land van herkomst en bij de Aangezochte Partij in.

Artikel 5
1 Het bewijs van de nationaliteit overeenkomstig artikel 2 van deze Overeenkomst kan worden geleverd door middel van de documenten genoemd in het Uitvoeringsprotocol bij deze Overeenkomst: Indien dergelijke documenten worden overgelegd, erkennen de Partijen de nationaliteit zonder verdere formaliteiten.
2 Het begin van bewijs van de nationaliteit overeenkomstig artikel 2 van deze Overeenkomst kan worden geleverd door middel van de documenten of elementen genoemd in het Uitvoeringsprotocol bij deze Overeenkomst. Indien dergelijke documenten of elementen worden overgelegd, nemen de Partijen de nationaliteit als vaststaand aan, tenzij de Aangezochte Partij het tegendeel kan bewijzen.
3 Indien geen van de in de leden 1 en 2 van dit artikel genoemde documenten of elementen kan worden overgelegd, doch er naar de mening van de Verzoekende Partij een vermoeden bestaat met betrekking tot de nationaliteit van de terug of over te nemen persoon, treffen de bevoegde autoriteiten van de Aangezochte Partij de vereiste maatregelen om de nationaliteit van de betrokkene vast te stellen. Indien de Verzoekende Partij het nodig acht, vindt er een gesprek met de betrokkenen plaats teneinde onder meer op basis van de taal waarin de persoon zich uitdrukt vast te stellen of het een eigen onderdaan betreft.
4 Het in lid 3 van dit artikel vermelde gesprek wordt gevoerd door de diplomatieke of consulaire vertegenwoordiging van de Aangezochte Partij, of een door de Verzoekende Partij uitgenodigde afvaardiging van de Aangezochte Partij, of door een andere in onderling overleg aangestelde deskundige.

Artikel 6
1 Het bewijs dat is voldaan aan de in artikel 3 van deze Overeenkomst vermelde voorwaarden voor terugname van onderdanen van een derde Staat of staatloze personen kan worden geleverd door middel van de bewijsmiddelen genoemd in het Uitvoeringsprotocol bij deze Overeenkomst. Deze bewijsmiddelen worden door de Partijen zonder verdere formaliteiten erkend.
2 Het begin van bewijs dat is voldaan aan de in artikel 3 van deze Overeenkomst vermelde voorwaarden voor terugname van onderdanen van een derde Staat of staatloze personen kan worden geleverd door middel van de bewijsmiddelen genoemd in het Uitvoeringsprotocol bij deze Overeenkomst. Wanneer dit begin van bewijs is geleverd, nemen de Partijen aan dat aan de voorwaarden is voldaan, tenzij de Aangezochte Partij het tegendeel kan bewijzen.
Overeenkomst tussen de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden) en de Kirgizische Republiek betreffende de terug- en overname van onregelmatig binnengekomen en/of verblijvende personen (terug- en overnameovereenkomst) › DEEL III — TERUGNAMEPROCEDURE
Artikel 7
1 Het verzoek om terugname van een eigen onderdaan van een Partij kan op ieder ogenblik door de bevoegde autoriteit van de Verzoekende Partij worden ingediend, wanneer is vastgesteld dat de betrokkene niet of niet meer voldoet aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van de Verzoekende Partij.
2 Het verzoek om terugname van een onderdaan van een derde Staat of van een staatloze persoon moet door de bevoegde autoriteit van de Verzoekende Partij worden ingediend binnen een termijn van ten hoogste één (1) jaar nadat de Verzoekende Partij kennis heeft gekregen van het feit dat deze persoon niet of niet meer voldoet aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van de Verzoekende Partij. Indien er juridische of feitelijke belemmeringen zijn waardoor het verzoek niet tijdig kan worden ingediend, wordt de termijn, op verzoek, verlengd doch uiterlijk totdat de belemmeringen zijn opgeheven.
3 Een verzoek om terugname moet onverwijld en in elk geval uiterlijk binnen een termijn van dertig (30) dagen worden beantwoord en elke afwijzing moet worden gemotiveerd. Deze termijn begint te lopen vanaf de datum van ontvangst van het verzoek om terugname. Wanneer niet binnen deze termijn wordt geantwoord, wordt aangenomen dat met de overdracht wordt ingestemd.
4 Nadat de instemming met het verzoek om terugname is gegeven, of nadat de termijn is verstreken, draagt de Verzoekende Partij de persoon met wiens terugname werd ingestemd onverwijld en in elk geval uiterlijk binnen een termijn van zes (6) maanden over. Deze termijn kan op verzoek worden verlengd met de tijd die nodig is om de juridische of praktische belemmeringen op te heffen. De Aangezochte Partij neemt de persoon met wiens terugname werd ingestemd zonder verdere formaliteiten over of terug.
5 Op verzoek van de Verzoekende Partij verstrekt de Aangezochte Partij onverwijld, en in elk geval uiterlijk binnen een termijn van vijf (5) werkdagen, het voor de terugkeer van de terug of over te nemen persoon noodzakelijke reisdocument op diens naam en met een geldigheidsduur van ten minste één (1) maand. Kan de Aangezochte Partij het gevraagde reisdocument niet binnen vijf (5) werkdagen na de datum van instemming met de terugname verstrekken, dan wordt aangenomen dat zij instemt met het gebruik van een door de Verzoekende Partij verstrekt reisdocument. Indien de betrokkene om juridische of andere redenen niet binnen de geldigheidstermijn van het oorspronkelijk afgegeven reisdocument kan worden overgedragen, verstrekt de Aangezochte Partij binnen twee (2) werkdagen een nieuw reisdocument of verlengt ze het oorspronkelijke document met eenzelfde geldigheidsduur.

Artikel 8
1 Voordat een persoon wordt overgedragen, stellen de bevoegde autoriteiten van de Verzoekende Partij de bevoegde autoriteiten van de Aangezochte Partij schriftelijk in kennis van de datum en de modaliteiten van de overdracht, de aangewezen grensdoorlaatpost, het eventuele gebruik van begeleiders en elke andere informatie omtrent de overdracht.
2 De kennisgeving omtrent de overdracht bevat indien van toepassing tevens de volgende informatie:
1. gezondheidsgegevens van de persoon, mits de betrokkene hier uitdrukkelijk mee heeft ingestemd;
2. begeleiding die de over te dragen persoon nodig heeft;
3. alle andere beschermings- of veiligheidsmaatregelen die voor deze overdracht nodig kunnen zijn.
3 Overdrachten geschieden in de regel door de lucht, maar kunnen ook over land of over zee worden uitgevoerd. De overdracht per vliegtuig kan plaatsvinden met gebruikmaking van lijn- of regeringsvluchten.
4 Overdrachten van onderdanen van een derde Staat of van staatloze personen vinden niet plaats als de geldigheidsduur van het visum of de verblijfstitel op de datum van de overdracht verstrijkt.

Artikel 9
1 De Verzoekende Partij zal elke door de Aangezochte Partij teruggenomen persoon terugnemen als er binnen de drie (3) maanden na de overdracht wordt vastgesteld dat er niet wordt voldaan aan de vereisten uit hoofde van de artikelen 2 en 3 van deze Overeenkomst.
2 In de in lid 1 vermelde gevallen zijn de procedurevoorschriften van deze Terug- en overnameovereenkomst van overeenkomstige toepassing en worden tevens alle beschikbare gegevens met betrekking tot de werkelijke identiteit en nationaliteit van de terug te nemen persoon meegedeeld.
Overeenkomst tussen de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden) en de Kirgizische Republiek betreffende de terug- en overname van onregelmatig binnengekomen en/of verblijvende personen (terug- en overnameovereenkomst) › DEEL IV — DOORGELEIDINGEN
Artikel 10
1 De Partijen staan de doorgeleiding van onderdanen van een derde Staat over hun grondgebied toe indien een andere Partij daarom verzoekt, wanneer de verdere reis in eventuele andere Staten van doorreis en de terugname door de Staat van bestemming verzekerd zijn.
2 De Partijen doen het nodige om doorgeleiding van onderdanen van een derde Staat te beperken tot gevallen waarin die personen niet rechtstreeks aan de Staat van bestemming kunnen worden overgedragen.
3 Doorgeleiding kan door de Partijen worden geweigerd:
1. indien de onderdaan van een derde Staat een reëel risico loopt te worden onderworpen aan foltering, onmenselijke of vernederende behandeling, bestraffing of de doodstraf, of te worden vervolgd op grond van zijn ras, godsdienst, nationaliteit, het behoren tot een bepaalde sociale groep of zijn politieke overtuiging in de Staat van bestemming of een andere Staat van doorreis;
2. indien de onderdaan van een derde Staat op het grondgebied van de Aangezochte Partij strafrechtelijk zal worden vervolgd of de tenuitvoerlegging van strafrechtelijke sancties zal ondergaan.
4 De Partijen kunnen elke verleende toestemming intrekken indien zich later omstandigheden als bedoeld in lid 3 van dit artikel voordoen die de doorgeleiding belemmeren of indien de verdere reis in eventuele Staten van doorreis of de terugname door de Staat van bestemming niet meer verzekerd is. In die gevallen neemt de Verzoekende Partij de betrokkene onverwijld op haar grondgebied terug.
Overeenkomst tussen de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden) en de Kirgizische Republiek betreffende de terug- en overname van onregelmatig binnengekomen en/of verblijvende personen (terug- en overnameovereenkomst) › DEEL IV — DOORGELEIDINGEN
Artikel 11
1 Een doorgeleidingsverzoek moet schriftelijk worden ingediend bij de bevoegde autoriteiten en moet de volgende inlichtingen bevatten:
1. type van doorgeleiding (door de lucht, over land of zee), eventuele andere Staten van doorreis en de Staat van bestemming;
2. de personalia van de betrokkene (naam, voornamen, geboortedatum en – indien beschikbaar – geboorteplaats, nationaliteit, aard en nummer van het reisdocument);
3. beoogde grensdoorlaatpost, tijdstip van doorgeleiding en eventueel gebruik van begeleiders;
4. een verklaring waarin wordt gesteld dat volgens de Verzoekende Partij is voldaan aan de voorwaarden vermeld in artikel 10, leden 1 en 2, van deze Overeenkomst, en dat er geen redenen bekend zijn voor een weigering op grond van artikel 10, lid 3.
2 De bevoegde autoriteit van de Aangezochte Partij brengt de bevoegde autoriteit van de Verzoekende Partij onverwijld schriftelijk op de hoogte van de toelating, met bevestiging van de grensdoorlaatpost en het beoogde tijdstip van toelating, of van de weigering van de toelating en de redenen voor die weigering.
3 Indien de doorgeleiding door de lucht plaatsvindt, worden aan de door te geleiden persoon en eventuele begeleiders de noodzakelijke voorzieningen met het oog op toegang tot de nationale of internationale zone van de luchthaven van de Aangezochte Partij verleend.
4 De bevoegde autoriteiten van de Aangezochte Partij steunen, mits in onderling overleg, de doorgeleiding, met name door toezicht op de door te geleiden persoon en de terbeschikkingstelling van daartoe geschikte voorzieningen.

Artikel 12
Onverminderd het recht van de bevoegde autoriteiten om de aan de terugname verbonden kosten van de terug of over te nemen persoon of van derden terug te vorderen, komen alle kosten in verband met terugname en doorgeleiding of terugkeer van verkeerdelijk toegelaten personen uit hoofde van deze Overeenkomst tot aan de grens van de Staat van eindbestemming ten laste van de Verzoekende Partij.

Artikel 13
Persoonsgegevens worden alleen verstrekt wanneer dit nodig is voor de tenuitvoerlegging van deze Overeenkomst. De verwerking, de behandeling en het gebruik van persoonsgegevens door de bevoegde autoriteiten van de Kirgizische Republiek in een bepaald geval zijn onderworpen aan de wetgeving van de Kirgizische Republiek en, wanneer de behandeling door een bevoegde autoriteit van een Benelux-Staat wordt uitgevoerd, aan de bepalingen van Verordening (EU) 2016/679 van het Europees Parlement en de Raad van 27 april 2016 betreffende de bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens en betreffende het vrije verkeer van die gegevens en tot intrekking van Richtlijn 95/46/EG van 24 oktober 1995 (algemene verordening gegevensbescherming) en van de krachtens deze Verordening vastgestelde nationale wetgeving van de respectieve Benelux-Staten. Daarnaast zijn de volgende beginselen van toepassing:
1. Persoonsgegevens moeten worden verwerkt op een wijze die ten aanzien van de betrokkene rechtmatig, behoorlijk en transparant is („rechtmatigheid, behoorlijkheid en transparantie”);
2. Persoonsgegevens moeten voor welbepaalde, uitdrukkelijk omschreven en gerechtvaardigde doeleinden worden verzameld en mogen vervolgens niet verder op een met die doeleinden onverenigbare wijze worden verwerkt; de verdere verwerking met het oog op archivering in het algemeen belang, wetenschappelijk of historisch onderzoek of statistische doeleinden wordt niet als onverenigbaar met de oorspronkelijke doeleinden beschouwd („doelbinding”);
3. Persoonsgegevens moeten toereikend zijn, ter zake dienend en beperkt tot wat noodzakelijk is voor de doeleinden waarvoor zij worden verwerkt („minimale gegevensverwerking”) en niet bovenmatig uitgaande van de doeleinden waarvoor zij worden verzameld en/of vervolgens worden verwerkt; de verstrekte persoonsgegevens mogen met name uitsluitend betrekking hebben op:
1. de personalia van de terug of over te nemen persoon (naam, voornaam, eventuele vroegere namen, bijnamen of pseudoniemen, geboortedatum en -plaats, geslacht, huidige en vorige nationaliteit);
2. een identiteitsbewijs of paspoort (serienummer, geldigheidstermijn, datum van afgifte, afgevende autoriteit, plaats van afgifte);
3. verblijfplaatsen en reisroutes;
4. andere voor identificatie van de terug of over te nemen persoon of voor het onderzoek van de terugnamevereisten uit hoofde van deze Overeenkomst dienstige gegevens;
4. Persoonsgegevens moeten juist zijn en zo nodig worden geactualiseerd; alle redelijke maatregelen moeten worden genomen om de persoonsgegevens die, gelet op de doeleinden waarvoor zij worden verwerkt, onjuist zijn, onverwijld te wissen of te rectificeren („juistheid”);
5. Persoonsgegevens moeten worden bewaard in een vorm die het mogelijk maakt de betrokkenen niet langer te identificeren dan voor de doeleinden waarvoor de persoonsgegevens worden verwerkt noodzakelijk is; persoonsgegevens mogen voor langere perioden worden opgeslagen voor zover de persoonsgegevens louter met het oog op archivering in het algemeen belang, wetenschappelijk of historisch onderzoek of statistische doeleinden worden verwerkt, mits de passende technische en organisatorische maatregelen worden getroffen om de rechten en vrijheden van de betrokkene te beschermen („opslagbeperking”);
6. Zowel de mededelende als de ontvangende autoriteit treffen alle passende maatregelen om in voorkomend geval te zorgen voor de correctie, uitwissing of afscherming van persoonsgegevens wanneer de verwerking niet in overeenstemming is met de bepalingen van dit artikel, met name omdat deze gegevens niet toereikend, ter zake dienend of nauwkeurig zijn, of omdat zij bovenmatig zijn in verhouding tot het doel van de verwerking. Dit behelst de kennisgeving van elke correctie, uitwissing of afscherming aan de andere Partij;
7. Op verzoek stelt de ontvangende autoriteit de mededelende autoriteit in kennis van het gebruik van de meegedeelde gegevens en van de daardoor verkregen resultaten;
8. Persoonsgegevens mogen uitsluitend aan de bevoegde autoriteiten worden verstrekt. Voor de mededeling aan andere instanties is de voorafgaande goedkeuring van de mededelende autoriteit vereist;
9. De mededelende en ontvangende autoriteiten zijn verplicht de mededeling en ontvangst van persoonsgegevens schriftelijk te registreren;
10. Persoonsgegevens moeten door het nemen van passende technische of organisatorische maatregelen op een dusdanige manier worden verwerkt dat een passende beveiliging ervan gewaarborgd is, en dat zij onder meer beschermd zijn tegen ongeoorloofde of onrechtmatige verwerking en tegen onopzettelijk verlies, vernietiging of beschadiging („integriteit en vertrouwelijkheid”).

Artikel 14
Deze Overeenkomst doet geen afbreuk aan de rechten, verplichtingen en verantwoordelijkheden van de Partijen die voortvloeien uit internationale rechtsnormen.

Artikel 15
1 De Partijen verlenen elkaar onderling hulp bij de toepassing en uitlegging van deze Overeenkomst. Daartoe stellen zij een Comité van deskundigen in dat met name:
1. de toepassing van deze Overeenkomst volgt;
2. voorstellen doet om vraagstukken in verband met de toepassing van deze Overeenkomst op te lossen;
3. wijzigingen van en aanvullingen op deze Overeenkomst voorstelt;
4. passende maatregelen ter bestrijding van illegale immigratie uitwerkt en aanbeveelt.
2 De Partijen behouden zich het recht voor om de door het Comité van deskundigen voorgestelde maatregelen al dan niet goed te keuren.
3 Het Comité bestaat uit één vertegenwoordiger voor het Koninkrijk België, één vertegenwoordiger voor het Groothertogdom Luxemburg, één vertegenwoordiger voor het Koninkrijk der Nederlanden en drie (3) vertegenwoordigers voor de Kirgizische Republiek. De Partijen wijzen daarin de voorzitter en de plaatsvervanger van de voorzitter aan. Plaatsvervangende leden worden benoemd. Indien nodig kunnen andere deskundigen bij de werkzaamheden van het Comité worden betrokken.
4 Het Comité komt bijeen op verzoek van één van de Partijen.

Artikel 16
Vraagstukken in verband met de uitvoering van deze Overeenkomst alsook geschillen tussen de Partijen ten aanzien van de interpretatie of toepassing van de bepalingen van deze Overeenkomst worden in onderlinge overeenstemming tussen de Partijen door middel van overleg geregeld.

Artikel 17
Deze Overeenkomst kan in onderlinge overeenstemming tussen de Partijen worden gewijzigd en aangevuld. Wijzigingen en aanvullingen, die een integrerend onderdeel van deze Overeenkomst vormen, worden opgesteld in de vorm van afzonderlijke protocollen en treden in werking volgens de nationale wetgeving van de Partijen.

Artikel 18
Alle nodige praktische bepalingen voor de uitvoering van deze Overeenkomst worden in het Uitvoeringsprotocol vastgelegd. In het Uitvoeringsprotocol wordt onder andere geregeld:
1. de aanwijzing van de bevoegde autoriteiten van de Partijen;
2. de aanwijzing van de grensdoorlaatposten;
3. de vaststelling van de bewijsmiddelen;
4. de voorwaarden waaronder en de wijze waarop begeleiding plaatsvindt van terug of over te nemen of door te geleiden personen.
Het Uitvoeringsprotocol is een integrerend onderdeel van deze Overeenkomst.

Artikel 19
Wat het Koninkrijk der Nederlanden betreft, kan de toepassing van deze Overeenkomst tot buiten Europa gelegen gebiedsdelen van het Koninkrijk worden uitgebreid door een kennisgeving aan het Secretariaat-Generaal van de Benelux Unie, die de overige Partijen hiervan in kennis stelt.

Artikel 20
Het Secretariaat-Generaal van de Benelux is depositaris van deze Overeenkomst. De depositaris bezorgt een voor eensluidend gewaarmerkt afschrift aan alle Ondertekenende Staten.

Artikel 21
1 Deze Overeenkomst treedt in werking op de eerste dag van de tweede maand die volgt op de datum van ontvangst door de depositaris van de laatste kennisgeving van de Ondertekenende Staat, waarbij ervan kennis wordt gegeven dat de voor de inwerkingtreding vereiste interne formaliteiten zijn nageleefd.
2 Indien de laatste kennisgeving wordt ingediend vóór de inwerkingtreding van de Overeenkomst tussen de Benelux-Staten en de Kirgizische Republiek inzake de vrijstelling van de visumplicht voor houders van geldige diplomatieke paspoorten en officiële/dienstpaspoorten, treedt deze Overeenkomst, in afwijking van het eerste lid, pas in werking na de datum van inwerkingtreding van voornoemde Overeenkomst.
3 Ten aanzien van iedere andere Ondertekenende Benelux-Staat treedt deze Overeenkomst in werking op de eerste dag van de tweede maand die volgt op de datum van ontvangst door de depositaris van de kennisgeving dat de voor de inwerkingtreding vereiste interne formaliteiten zijn nageleefd.
4 De depositaris stelt ieder der Ondertekenende Partijen in kennis van de in lid 1 en 2 van dit artikel bedoelde kennisgevingen en van de data van de inwerkingtreding van deze Overeenkomst ten aanzien van de Partijen.

Artikel 22
1 Deze Overeenkomst wordt voor onbepaalde tijd gesloten.
2 Elke Partij kan deze Overeenkomst, na kennisgeving aan de depositaris, die de andere Partij hiervan in kennis stelt, om ernstige redenen, met name in verband met de bescherming van de staatsveiligheid, de openbare orde of de volksgezondheid, schorsen. Wat betreft de intrekking van een dergelijke maatregel, brengen de Partijen elkaar onverwijld via diplomatieke weg op de hoogte.
3 De schorsing van deze Overeenkomst wordt van kracht op de eerste dag van de eerste maand die volgt op de maand waarin de in lid 2 van dit artikel bedoelde kennisgeving door de depositaris is ontvangen.
4 Elke Partij kan deze Overeenkomst, na kennisgeving aan de depositaris, die de andere Partij hiervan in kennis stelt, om ernstige redenen opzeggen.
5 De opzegging van deze Overeenkomst wordt van kracht op de eerste dag van de zesde maand die volgt op de maand waarin de in lid 4 van dit artikel bedoelde kennisgeving door de depositaris is ontvangen.

Artikel 1
1 Dertig (30) dagen na afsluiting van dit Protocol wisselen de Partijen lijsten uit met daarin de autoriteiten die bevoegd zijn om de Overeenkomst uit te voeren en hun bij de andere Partijen geaccrediteerde diplomatieke of consulaire vertegenwoordigingen.
2 De Partijen brengen elkaar onverwijld op de hoogte van elke verandering aan de in lid 1 van dit artikel bedoelde lijsten.

Artikel 2
1 De voor de toepassing van deze Overeenkomst gebruikte grensdoorlaatposten worden opgesomd in Bijlage 1 van dit Protocol.
2 De Partijen brengen elkaar onverwijld op de hoogte van elke verandering aan de in Bijlage 1 van dit Protocol vermelde lijst van grensdoorlaatposten.
3 De bevoegde autoriteiten kunnen ad hoc overeenkomen om andere grensdoorlaatposten te gebruiken voor de toepassing van deze Overeenkomst.

Artikel 3
1 Een verzoek om terugname wordt schriftelijk via e-mail of andere elektronische communicatiemiddelen rechtstreeks ingediend bij de bevoegde autoriteit van de Aangezochte Partij.
2 Het verzoek om terugname wordt ingediend met behulp van het formulier dat als Bijlage 2 aan dit Protocol is gehecht.
3 Teneinde meer gedetailleerde informatie over het ingediende verzoek om terugname te verstrekken of te ontvangen, richt de Verzoekende Partij zich tot de bevoegde autoriteit van de Aangezochte Partij.

Artikel 4
1 Bewijs van de nationaliteit krachtens artikel 2 van deze Overeenkomst kan worden geleverd door middel van een van de volgende documenten:
1. een geldig nationaal paspoort of vervangend reisdocument met foto (laissez-passer);
2. een geldig nationaal identiteitsbewijs;
3. een geldig militair identiteitsbewijs of een ander identiteitsbewijs van het personeel van de strijdkrachten met een foto van de houder;
4. een identiteitsbewijs voor zeevarenden;
5. andere officiële documenten waaruit de nationaliteit van betrokkene blijkt, afgegeven door de aangezochte Partij en voorzien van een foto;
6. een document, zoals hiervoor beschreven, waarvan de geldigheidsduur is verstreken op de datum waarop het verzoek om terugname wordt verzonden;
7. bevestiging van de identiteit na raadpleging van het Visuminformatiesysteem.
2 Begin van bewijs van de nationaliteit krachtens artikel 2 van deze Overeenkomst kan worden geleverd door middel van de volgende documenten of elementen:
1. een kopie van één van de in lid 1 van dit artikel genoemde documenten;
2. andere documenten of gegevens, met inbegrip van de biometrische gegevens, die kunnen bijdragen tot het vaststellen van de nationaliteit van de betrokkene (zeemansboekje, rijbewijs, e.a.);
3. een document waaruit een consulaire inschrijving blijkt, een nationaliteitsbewijs of een bewijs van de erkende burgerlijke stand;
4. een bedrijfspas;
5. kopieën van de onder 2 tot en met 4 van dit lid genoemde documenten;
6. een betrouwbare getuigenverklaring;
7. de verklaring van de betrokkene.
Uitvoeringsprotocol bij de overeenkomst tussen de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg, het Koninkrijk der Nederlanden) en de Kirgizische Republiek betreffende de terug- en overname van onregelmatig binnengekomen en/of verblijvende personen (terug- en overnameovereenkomst)
Artikel 5
1 Het bewijs dat is voldaan aan de in artikel 3 van de Overeenkomst vermelde voorwaarden voor terugname van onderdanen van een derde Staat of staatloze personen kan worden geleverd door middel van geldige visa of verblijfstitels afgegeven door de Aangezochte Partij als bewijsmiddelen.
2 Indien er geen enkel van de in lid 1 genoemde documenten kan worden overgelegd, maar de Verzoekende Partij een ernstig vermoeden heeft dat een onderdaan van een derde Staat of staatloze persoon onder de in artikel 3 van de Overeenkomst vermelde voorwaarden voor terugname valt, kan het begin van bewijs worden geleverd door middel van de volgende bewijsmiddelen:
1. kopieën van de onder lid 1 genoemde documenten;
2. alle documenten, informatie of verklaringen die het vermoeden ondersteunen dat de onderdaan van de derde Staat of staatloze persoon in het bezit is van een geldig visum of geldige verblijfstitel afgegeven door de Aangezochte Partij.

Artikel 6
1 Het antwoord op een verzoek om terugname wordt schriftelijk via e-mail of andere elektronische communicatiemiddelen rechtstreeks ingediend bij de bevoegde autoriteit van de Verzoekende Partij. Een kopie van dit antwoord wordt tegelijkertijd bezorgd aan de diplomatieke of consulaire vertegenwoordiging van de Aangezochte Partij.
2 Op het verzoek om terugname wordt geantwoord met behulp van het formulier dat als Bijlage 2 aan dit Protocol is gehecht en dat ook wordt gebruikt om dat verzoek in te dienen.

Artikel 7
1 In geval van een positief antwoord op het verzoek om terugname, wordt het voor terugkeer noodzakelijke reisdocument krachtens artikel 7, lid 5, van de Overeenkomst in naam van de terug of over te nemen persoon overhandigd en onverwijld, en in elk geval uiterlijk binnen een termijn van vijf (5) werkdagen, door de diplomatieke of consulaire vertegenwoordiging van de Aangezochte Partij aan de bevoegde autoriteiten van de Verzoekende Partij bezorgd.
2 Het reisdocument heeft een geldigheidsduur van één (1) maand.
3 Indien de diplomatieke of consulaire vertegenwoordiging van de Aangezochte Partij het gevraagde reisdocument niet binnen vijf (5) werkdagen na de datum van het positieve antwoord verstrekt, wordt op basis van artikel 7, lid 5, van de Overeenkomst aangenomen dat zij instemt met het gebruik van een door de Verzoekende Partij verstrekt reisdocument. De documenten die de Partijen voor dit doel zullen gebruiken, zijn als Bijlage 3 en 4 aan dit Protocol gehecht.

Artikel 8
1 Indien het gesprek door de diplomatieke of consulaire vertegenwoordiging van de Aangezochte Partij wordt gevoerd, vindt het onverwijld en in elk geval uiterlijk binnen een termijn van zeven (7) dagen vanaf de datum van ontvangst van het verzoek om terugname plaats.
2 Wanneer het gesprek door een afvaardiging van de Aangezochte Partij, of door een andere in onderling overleg aangestelde deskundige, wordt gevoerd, kan de planning van de gesprekken in onderling overleg worden vastgelegd, zodat een andere Verzoekende Partij gebruik kan maken van de diensten van de vertegenwoordiging van de Aangezochte Partij.
3 De Aangezochte Partij brengt de Verzoekende Partij onverwijld, en in elk geval uiterlijk binnen de drie (3) werkdagen na het gesprek, op de hoogte van het resultaat van dit gesprek.

Artikel 9
1 De bevoegde autoriteit van de Verzoekende Partij stelt de bevoegde autoriteit van de Aangezochte Partij schriftelijk via e-mail of andere elektronische communicatiemiddelen, minimaal drie (3) werkdagen vóór de geplande overdracht in kennis van haar voornemen om daartoe over te gaan. Daartoe wordt gebruikgemaakt van het formulier dat als Bijlage 5 aan dit Protocol is gehecht. Een kopie van dit formulier wordt bezorgd aan de diplomatieke of consulaire vertegenwoordiging van de Aangezochte Partij.
2 Indien de verzoekende Partij niet in staat is de terug of over te nemen persoon binnen de in artikel 7, lid 4, van de Overeenkomst genoemde termijn van zes (6) maanden over te dragen, stelt zij de bevoegde autoriteit van de Aangezochte Partij daarvan onverwijld in kennis. Zodra de effectieve overdracht van de betrokkene kan plaatsvinden, stelt de bevoegde autoriteit van de Verzoekende Partij de Aangezochte Partij daarvan in kennis met behulp van het in lid 1 van dit Artikel bedoelde formulier en met inachtneming van de voor deze overdracht geldende termijnen.
3 Indien de Verzoekende Partij van mening is dat het vervoer over de weg of over zee moet plaatsvinden, vermelden de bevoegde autoriteiten van de Verzoekende Partij dit op het in lid 1 van dit artikel bedoelde formulier.
4 De diplomatieke of consulaire vertegenwoordiging van de Aangezochte Partij verstrekt zo nodig onverwijld visa aan de begeleiders, zodat zij tijdens hun officiële taken in het kader van deze Overeenkomst toegang hebben tot haar grondgebied.

Artikel 10
1 Een verzoek om doorgeleiding wordt minstens zeven (7) werkdagen vóór de geplande doorgeleiding schriftelijk via e-mail of andere elektronische communicatiemiddelen door de Verzoekende Partij ingediend bij de bevoegde autoriteit van de Aangezochte Partij. Het verzoek wordt ingediend met behulp van het formulier dat als Bijlage 6 aan dit Protocol is gehecht.
2 De bevoegde autoriteit van de Aangezochte Partij deelt onverwijld en in elk geval uiterlijk binnen de vier (4) werkdagen schriftelijk via e-mail of andere elektronische communicatiemiddelen mee of ze akkoord gaat met de doorgeleiding, met bevestiging van het tijdstip waarop de doorgeleiding gepland is, het grensdoorlaatpunt, de wijzen van vervoer en het gebruik van begeleiders. Voor dit antwoord wordt gebruikgemaakt van het in lid 1 van dit artikel bedoelde formulier.
3 Doorgeleiding geschiedt in beginsel door de lucht.

Artikel 11
1 Indien de Verzoekende Partij ondersteuning van de doorgeleiding door de autoriteiten van de Aangezochte Partij noodzakelijk acht, vermeldt zij de aard en inhoud van de gewenste ondersteuning onder punt 4 van het als Bijlage 6 bij dit Protocol gehechte formulier.
2 In het antwoord op het doorgeleidingsverzoek bericht de Aangezochte Partij of zij kan voorzien in de gevraagde ondersteuning.
3 Indien de betrokkene wordt begeleid op het grondgebied van de Aangezochte Partij, geschieden de bewaking en het eventueel aan boord brengen onder het gezag en, voor zover mogelijk, met ondersteuning van deze Partij.

Artikel 12
1 Begeleiders zijn door de Verzoekende Partij aangewezen en zijn verantwoordelijk voor de begeleiding van de terug of over te nemen of door te geleiden persoon.
2 Op het grondgebied van de Aangezochte Partij moeten de begeleiders in alle omstandigheden het recht van de Aangezochte Partij naleven.
3 Bij de uitvoering van de terugname en doorgeleiding, voor zover deze op het grondgebied van de Aangezochte Partij plaatsvinden, zijn de bevoegdheden van de begeleiders beperkt tot zelfverdediging. Daarnaast kunnen de begeleiders, bij afwezigheid van ter zake bevoegde ambtenaren van de aangezochte Partij of ter ondersteuning van deze ambtenaren, in reactie op een onmiddellijke en ernstige dreiging op redelijke en evenredige wijze optreden om te voorkomen dat de betrokkene vlucht, zichzelf of derden letsel toebrengt dan wel schade aan goederen veroorzaakt.
4 De begeleiders voeren hun taak ongewapend en in burgerkledij uit. Zij dienen in het bezit te zijn van een begeleidingsvergunning, de toestemming voor terugname en een identiteitsbewijs.
5 De autoriteiten van de Aangezochte Partij verlenen de begeleiders bij de uitoefening van hun taken in het kader van de Overeenkomst dezelfde bescherming en bijstand als aan de eigen ter zake bevoegde ambtenaren.

Artikel 13
1 Door de Aangezochte Partij gemaakte kosten in verband met terugname en doorgeleiding welke op grond van artikel 12 van de Overeenkomst ten laste van de Verzoekende Partij komen, worden door de Verzoekende Partij na overlegging van een factuur vergoed. Deze factuur vermeldt tevens de bankgegevens van de Aangezochte Partij.
2 De Verzoekende Partij betaalt alle kosten aan de Aangezochte Partij binnen dertig (30) dagen na ontvangst van de factuur.

Artikel 15
1 De bijlagen 1 tot en met 6 vormen een integrerend onderdeel van dit Protocol.
2 Elke wijziging van de Bijlagen bij dit Protocol wordt schriftelijk overeengekomen tussen de Partijen en wordt van kracht op een door de Partijen te bepalen datum.
