Artikel 1

Voor de toepassing van dit Protocol wordt onder de onderstaande termen het volgende verstaan:

– Diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij: de bij de verzoekende Partij geaccrediteerde diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij;

– Begeleider(s): de door de verzoekende Partij aangewezen perso(o)n(en) ter begeleiding van de over te nemen of door te geleiden persoon.

Artikel 2

1 De Partijen wisselen binnen dertig (30) dagen na de sluiting van dit Protocol een lijst van de voor de uitvoering van de Overeenkomst bevoegde autoriteiten en van hun bij de andere Partijen geaccrediteerde diplomatieke of consulaire vertegenwoordigingen uit.

2 De Partijen stellen elkaar onverwijld in kennis van iedere verandering in de in het eerste lid bedoelde lijst.

Artikel 3

1 De voor de uitvoering van de Overeenkomst te gebruiken grensovergangen staan vermeld in bijlage 1 bij dit Protocol.

2 De Partijen stellen elkaar onverwijld in kennis van iedere verandering in de in het eerste lid bedoelde lijst.

3 De bevoegde autoriteiten kunnen per geval instemmen met het gebruik van andere grensovergangen dan die vermeld in bijlage 1 bij dit Protocol.

Artikel 4

1 Een terug- of overnameverzoek wordt via e-mail, per telefax, of andere telecommunicatiemiddelen ingediend bij de bevoegde autoriteit van de aangezochte Partij.

2 Voor de indiening van een terug- of overnameverzoek wordt gebruikgemaakt van het formulier dat als bijlage 5 aan de Overeenkomst is gehecht.

3 De verzoekende Partij wendt zich voor het verkrijgen van nadere inlichtingen met betrekking tot het ingediende terug- of overnameverzoek tot de bevoegde autoriteit van de aangezochte Partij.

Artikel 5

1 Het antwoord op een terug- of overnameverzoek wordt overeenkomstig artikel 10, tweede lid, van de Overeenkomst via e-mail, per telefax, of andere telecommunicatiemiddelen aan de bevoegde autoriteit van de verzoekende Partij verzonden. Aan de diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij wordt gelijktijdig een kopie van dit antwoord gestuurd.

2 Voor de beantwoording van het terug- of overnameverzoek wordt gebruikgemaakt van het formulier dat als bijlage 2 aan dit Protocol is gehecht.

3 Overeenkomstig artikel 10, derde lid, van de Overeenkomst dient de afwijzing van een verzoek om overname met redenen te worden omkleed.

4 Indien nadat de aangezochte Partij een positief antwoord op het terug- of overnameverzoek heeft gegeven en alvorens de feitelijke overdracht heeft plaatsgevonden, op basis van nieuw bewijsmateriaal wordt vastgesteld dat niet werd voldaan aan de voorwaarden voor terug- of overname, behoudt de aangezochte Partij zich het recht voor de verzoekende Partij te vragen de instemming met het terug- of overnameverzoek in te trekken.

Artikel 6

1 Na een positief antwoord op een terug- of overnameverzoek verstrekt de diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij de bevoegde autoriteit van de verzoekende Partij onverwijld en uiterlijk binnen drie (3) werkdagen het voor de terug- of overname benodigde reisdocument overeenkomstig artikel 2, vierde lid, artikel 3, derde lid, artikel 4, vierde lid, of artikel 5, vierde lid, van de Overeenkomst.

2 Indien de diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij het gevraagde reisdocument niet binnen drie (3) werkdagen na de datum van ontvangst van het positieve antwoord verstrekt, wordt de aangezochte Partij geacht te hebben ingestemd met het gebruik van een door de verzoekende Partij verstrekt reisdocument.

3 Het document dat de Benelux-Staten voor dit doel kunnen gebruiken is als bijlage 3 aan dit Protocol gehecht. Georgië stelt de andere Partijen zo spoedig mogelijk langs diplomatieke weg in kennis van het document dat voor dit doel dient te worden gebruikt.

4 Indien de betrokkene om juridische of feitelijke redenen niet binnen de geldigheidstermijn van het oorspronkelijk afgegeven reisdocument kan worden overgedragen, verstrekt de diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij overeenkomstig artikel 2, vierde lid, of artikel 4, vijfde lid, van de Overeenkomst binnen drie (3) werkdagen een nieuw reisdocument met dezelfde geldigheidstermijn of verlengt zij de geldigheidstermijn van het oorspronkelijke document.

5 Indien de diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij het in het derde lid bedoelde reisdocument niet binnen drie (3) werkdagen verstrekt, wordt de aangezochte Partij geacht te hebben ingestemd met het gebruik van een door de verzoekende Partij verstrekt reisdocument.

Artikel 7

1 Indien de verzoekende Partij geen enkel document, als bedoeld in artikel 8 van de Overeenkomst, kan overleggen en de aangezochte Partij de nationaliteit van die persoon niet op een andere wijze kan vaststellen, ondervraagt de diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij, op verzoek van de verzoekende Partij, de terug te nemen persoon binnen vier dagen na de indiening van het verzoek om terugname. Het verzoek om terugname wordt schriftelijk beantwoord binnen de in artikel 10, tweede lid, van de Overeenkomst bepaalde termijnen.

2 De verzoekende Partij vervoert de te ondervragen persoon naar de diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij. De ondervraging kan in onderlinge overeenstemming tussen de Partijen buiten de diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij plaatsvinden. De kosten van vervoer worden gedragen door de verzoekende Partij.

3 Indien de ondervraging met de terug te nemen persoon om praktische redenen niet binnen de in het eerste lid bepaalde termijn werd georganiseerd, neemt de aangezochte Partij op schriftelijk verzoek van de verzoekende Partij een besluit over het verzoek om terugname nadat de ondervraging heeft plaatsgevonden.

Artikel 8

1 De bevoegde autoriteit van de verzoekende Partij stelt de bevoegde autoriteit van de aangezochte Partij via e-mail, per telefax, of andere telecommunicatiemiddelen minimaal drie (3) werkdagen voordat de betrokkene wordt overgedragen in kennis van haar voornemen daartoe.

Daartoe wordt gebruikgemaakt van het formulier dat als bijlage 4 aan dit Protocol is gehecht. Een kopie van dit formulier wordt verstrekt aan de diplomatieke of consulaire vertegenwoordiging van de aangezochte Partij.

2 Indien de verzoekende Partij de terug- of over te nemen persoon niet kan overdragen binnen de in artikel 10, lid 4, van de Overeenkomst genoemde termijn van drie (3) maanden dan wel op de datum die overeenkomstig het eerste lid ter kennis is gebracht van de aangezochte Partij, stelt zij de bevoegde autoriteit van de aangezochte Partij daarvan onverwijld in kennis.

3 Zodra de feitelijke overdracht kan plaatsvinden, stelt de bevoegde autoriteit van de verzoekende Partij de aangezochte Partij daarvan in kennis overeenkomstig het eerste lid van dit artikel.

4 Indien de verzoekende Partij van mening is dat het vervoer over land of over zee dient plaats te vinden, maken de bevoegde autoriteiten van de verzoekende Partij daarvan afzonderlijk melding op het in het eerste lid van dit artikel genoemde formulier.

Artikel 9

1 Een doorgeleidingsverzoek wordt minimaal acht (8) werkdagen voor de geplande doorgeleiding via e-mail, per telefax, of andere telecommunicatiemiddelen ingediend bij de bevoegde autoriteit van de aangezochte Partij. Daartoe wordt gebruikgemaakt van het formulier dat als bijlage 6 aan de Overeenkomst is gehecht.

2 De bevoegde autoriteit van de aangezochte Partij bericht onverwijld doch uiterlijk binnen vijf (5) werkdagen na de ontvangst van het doorgeleidingsverzoek, via e-mail, per telefax, of andere telecommunicatiemiddelen of zij instemt met de doorgeleiding, het tijdstip van overdracht, de beoogde plaats van binnenkomst, het type doorgeleiding en het eventuele gebruik van begeleiders. Daartoe wordt gebruik gemaakt van het formulier dat als bijlage 5 aan dit Protocol is gehecht.

3 Doorgeleiding geschiedt in beginsel door de lucht.

Artikel 10

1 Indien de verzoekende Partij ondersteuning van een specifieke doorgeleiding door de autoriteiten van de aangezochte Partij noodzakelijk acht, dient zij de aard en inhoud van de gewenste ondersteuning te vermelden bij het verzoek om doorgeleiding, gebruikmakend van het formulier dat als bijlage 6 aan de Overeenkomst is gehecht.

2 In het antwoord op het verzoek om doorgeleiding bericht de aangezochte Partij of zij kan voorzien in de gevraagde ondersteuning.

3 Voor zover de betrokkene op het grondgebied van de aangezochte Partij wordt begeleid, geschieden de bewaking en het eventueel aan boord brengen onder het gezag en, voor zover mogelijk, met ondersteuning van deze Partij.

Artikel 11

1 Op het grondgebied van de aangezochte Partij dienen de begeleiders in alle omstandigheden het recht van de aangezochte Partij na te leven.

2 Bij de uitvoering van de terug- of overnames en doorgeleidingen, voor zover deze plaatsvinden op het grondgebied van de aangezochte Partij, zijn de bevoegdheden van de begeleiders beperkt tot zelfverdediging.

Daarnaast kunnen de begeleiders, bij afwezigheid van bevoegde ambtenaren van de aangezochte Partij of ter ondersteuning van deze ambtenaren, in reactie op een onmiddellijke en ernstige dreiging op redelijke en proportionele wijze optreden om te voorkomen dat de betrokkene vlucht, zichzelf of derden letsel toebrengt dan wel schade aan goederen veroorzaakt.

3 De begeleiders voeren hun taak ongewapend en in burgerkledij uit. Zij dienen in het bezit te zijn van een machtiging tot begeleiding, de toestemming voor terug- of overname of doorgeleiding en een identiteitsbewijs.

4 De autoriteiten van de aangezochte Partij verlenen de begeleiders bij de uitoefening van hun taken in het kader van de Overeenkomst dezelfde bescherming en bijstand als aan de eigen bevoegde ambtenaren.

Artikel 12

1 Door de aangezochte Partij gemaakte kosten in verband met terug- of overname en doorgeleiding welke op grond van artikel 15 van de Overeenkomst ten laste van de verzoekende Partij komen, worden door de verzoekende Partij na overlegging van een factuur vergoed. Deze factuur vermeldt tevens de bankgegevens van de aangezochte Partij.

2 De verzoekende Partij vergoedt alle kosten binnen dertig (30) dagen na ontvangst van de factuur aan de aangezochte Partij.

Artikel 13

1 De Partijen dienen samen te werken om problemen rond de uitvoering van de Overeenkomst op te lossen.

2 Op verzoek van één van de Partijen wordt er een vergadering van deskundigen, bestaande uit vertegenwoordigers van de bevoegde autoriteiten van de Partijen, bijeengeroepen.

Artikel 14

De Partijen communiceren met elkaar in de Engelse taal.

Artikel 15

1 De bijlagen l tot en met 5 vormen een integrerend onderdeel van dit Protocol.

2 Dit Protocol en rijn bijlagen kunnen in onderlinge overeenstemming tussen de Partijen worden gewijzigd en aangevuld. Wijzigingen en aanvullingen van het Protocol worden opgesteld in de vorm van afzonderlijke protocollen, die een integrerend onderdeel van dit Protocol vormen en in werking treden volgens de in artikel 17, tweede lid, van dit Protocol bedoelde procedure.

3 Elke wijziging van de bijlagen bij dit Protocol wordt schriftelijk overeengekomen tussen de Partijen en wordt van kracht op een door de Partijen te bepalen datum.

Artikel 16

Dit Protocol is van toepassing op het grondgebied van Georgië, alsook op het grondgebied van het Koninkrijk België, het grondgebied van het Groothertogdom Luxemburg en het grondgebied van het Koninkrijk der Nederlanden waar het Verdrag betreffende de werking van de Europese Unie van toepassing is.

Artikel 17

1 De Partijen stellen elkaar in kennis van de voltooiing van hun nationale wettelijke procedures voor de inwerkingtreding van dit Protocol.

2 Overeenkomstig artikel 23, tweede lid, van de Overeenkomst treedt dit Protocol in werking op de eerste dag van de tweede maand nadat de depositaris het Gemengd Comité overname in kennis heeft gesteld van de voltooiing van de respectievelijke benodigde interne procedures door de Partijen. Een afschrift van deze kennisgeving wordt door de depositaris aan alle Partijen verstrekt.

3 Het Protocol wordt voor onbepaalde tijd gesloten en houdt tegelijk met de beëindiging van de Overeenkomst op van toepassing te zijn.

Artikel 18

Het Secretariaat-Generaal van de Benelux is de depositaris van dit Protocol. De depositaris doet elke Partij een eensluidend afschrift van het origineel toekomen.

Article 1

For the application of this Protocol, the following terms are understood to have the following meaning:

− Diplomatic or consular mission of the Requested Party:

the diplomatic or consular representation of the Requested Party accredited to the Requesting Party;

− Escort(s):

the person (or persons) designated by the Requesting Party to accompany the person to be readmitted or who is in transit.

Article 2

1 The Parties shall exchange lists of the authorities competent to implement the Agreement and of their diplomatic or consular mission accredited to the other Parties, within thirty (30) days after the conclusion of this Protocol.

2 The Parties shall notify each other immediately of any change in the lists referred to in paragraph 1.

Article 3

1 The border crossing points to be used for the purposes of implementing the Agreement are listed in Annex 1 to this Protocol.

2 The Parties shall notify each other immediately of any change in the list referred to in paragraph 1.

3 The competent authorities may agree, on a case-by-case basis, to use other border crossing points than those listed in Annex 1 to this Protocol.

Article 4

1 A readmission application shall be submitted to the competent authority of the Requested Party by email, fax or other means of telecommunication.

2 To submit a readmission application the form attached as Annex 5 to the Agreement shall be used.

3 To obtain additional information regarding a submitted readmission application, the Requesting Party shall apply to the competent authority of the Requested Party.

Article 5

1 A reply to a readmission application shall be sent to the competent authority of the Requesting Party by email, fax or other means of telecommunication in accordance with article 10, paragraph 2, of the Agreement. A copy of the reply shall be sent to the diplomatic or consular mission of the Requested Party simultaneously.

2 To reply to a readmission application the form attached as Annex 2 to this Protocol shall be used.

3 In accordance with article 10, paragraph 3, of the Agreement, reasons shall be given for the refusal of a readmission application.

4 If it is established, on the basis of new evidence, that the requirements for readmission had not been complied with, after the Requested Party has given the positive response to readmission application and before the actual transfer, the Requested Party reserves the right to address the Requesting Party to revoke the consent to the readmission application.

Article 6

1 After a positive reply is given to a readmission application, the diplomatic or consular mission of the Requested Party shall issue to the competent authority of the Requesting Party the travel document required for readmission without delay, but no later than within three (3) working days in accordance with article 2, paragraph 4, article 3, paragraph 3, article 4, paragraph 4 or article 5, paragraph 4, of the Agreement.

2 If the diplomatic or consular mission of the Requested Party fails to issue the requested travel document within three (3) working days after the date of receipt of a positive reply, the Requested Party shall be deemed to have consented to the use of a travel document issued by the Requesting Party.

3 The document that the States of the Benelux may use for this purpose is attached as Annex 3 to this Protocol. Georgia shall notify the other Parties on the document to be used for this purpose via diplomatic channels at earliest convenience.

4 If, for legal or factual reasons, the person concerned cannot be transferred within the period of validity of the travel document that was originally issued, the diplomatic or consular mission of the Requested Party shall, in accordance with article 2, paragraph 4 or article 4, paragraph 5, of the Agreement, issue within three (3) working days a new travel document with the same period of validity or shall extend the period of validity of the original document.

5 If the diplomatic or consular mission of the Requested Party fails to issue a travel document as referred to in paragraph 3 within three (3) working days, the Requested Party shall be deemed to have agreed to the use of a travel document issued by the Requesting Party.

Article 7

1 If the Requesting Party is unable to provide any document as referred to in article 8 of the Agreement and the Requested Party is unable to establish the nationality of that person otherwise, the diplomatic or consular mission of the Requested Party, at the request of the Requesting Party, shall conduct an interview with the person to be readmitted within four days after the submission of the readmission application. The readmission application shall be replied to in writing within the time limits established in article 10, paragraph 2, of the Agreement.

2 The Requesting Party shall transport the person to be interviewed to the diplomatic or consular mission of the Requested Party. Upon agreement between the Parties, the interview can be held outside the diplomatic or consular mission of the Requested Party. Transportation costs shall be covered by the Requesting Party.

3 If, for practical reasons, the interview with the person to be readmitted was not organized within the time limit set in paragraph 1, at the written request of the Requesting Party, the Requested Party shall make a decision regarding the readmission application after the interview is held.

Article 8

1 The competent authority of the Requesting Party shall notify the competent authority of the Requested Party by email, fax or other means of telecommunication of its intention to transfer the person concerned at least three (3) working days before the date of transfer. The form attached as Annex 4 to this Protocol shall be used for this purpose. A copy of the form shall be issued to the diplomatic or consular mission of the Requested Party.

2 If the Requesting Party is unable to transfer the person to be readmitted within the time limit of three (3) months referred to in article 10, paragraph 4, of the Agreement or at the date notified to the Requested Party in accordance with paragraph 1, it shall immediately notify the competent authority of the Requested Party accordingly.

3 As soon as the actual transfer can take place, the competent authority of the Requesting Party shall notify the Requested Party thereof, in accordance with paragraph 1 of this article.

4 If the Requesting Party is of the opinion that transport by land or sea is necessary, the competent authorities of the Requesting Party shall indicate this separately on the form referred to in paragraph 1 of this article.

Article 9

1 A transit application shall be submitted to the competent authority of the Requested Party by email, fax or other means of telecommunication at least eight (8) working days before transit takes place, using the form attached as Annex 6 to the Agreement.

2 The competent authority of the Requested Party shall reply by email, fax or other means of telecommunication without delay, but within five (5) working days after the receipt of the transit application as to whether it consents to the transit, time of transfer, envisaged point of entry, type of transit and possible use of escorts. The form to be used for this purpose is attached as Annex 5 to this Protocol.

3 In principle, transit shall take place by air.

Article 10

1 If the Requesting Party deems it necessary to have the support of the authorities of the Requested Party for a particular transit, the former shall state the nature and substance of the assistance required in the transit application submitted using the form attached as Annex 6 to the Agreement.

2 In the reply to the transit application, the Requested Party shall state whether it is able to provide the requested support.

3 In so far as the person concerned is escorted in the territory of the Requested Party, he or she shall be guarded and possibly escorted on board under the authority and, as far as possible, with the assistance of this Party.

Article 11

1 Escorts shall comply with the law of the Requested Party in all circumstances while in its territory.

2 When carrying out readmission and transit operations, as far as they take place in the territory of the Requested Party, the authority of escorts is limited to self-defense. In addition, in the absence of authorised officers of the Requested Party or in order to assist such officers, escorts are permitted to react reasonably and proportionately to an immediate and serious threat in order to prevent the person concerned from fleeing, injuring himself or others or causing damage to property.

3 Escorts shall perform their duties unarmed and in civilian clothes. They shall be in possession of an escort authorisation, the consent for readmission or transit, and an identity document.

4 The authorities of the Requested Party shall grant the same protection and assistance to escorts performing their duties in the context of the Agreement as they do their own authorised officers.

Article 12

1 The Requesting Party shall pay all invoiced costs incurred by the Requested Party in connection with readmission and transit operations which article 15 of the Agreement stipulates shall be borne by the Requesting Party. The invoice shall contain the bank details of the Requested Party.

2 The Requesting Party shall pay all costs to the Requested Party within thirty (30) days after the receipt of the invoice.

Article 13

1 The Parties shall co-operate to solve any problems that arise in the context of the implementation of the Agreement.

2 If one of the Parties so requests, a meeting of experts, consisting of representatives of the competent authorities of the Parties, shall be convened.

Article 14

The Parties shall communicate with one another in the English language.

Article 15

1 Annexes 1 to 5 shall constitute and integral part of this Protocol.

2 This Protocol and its Annexes may be amended and supplemented by mutual consent of the Parties. Amendments and supplements to the Protocol shall be drawn up in the form of separate protocols, which shall form an integral part of this Protocol, and enter into force in accordance with the procedure laid down in article 19, paragraph 2, of this Protocol.

3 Any amendments to the Annexes to this Protocol shall be agreed by the Parties in writing and shall enter into force on a date determined by the Parties.

Article 16

This Protocol applies within the territory of Georgia, and within the territory of the Kingdom of Belgium, the territory of the Grand Duchy of Luxembourg and the territory of the Kingdom of the Netherlands where the Treaty on the Functioning of the European Union is applicable.

Article 17

1 The Parties shall notify each other on the completion of their national legal procedures for the entry into force of this Protocol.

2 In accordance with article 23, paragraph 2, of the Agreement, this Protocol shall enter into force on the first day of the second month after the Joint Readmission Committee has been notified by the depositary that all Parties have completed their respective internal procedures necessary therefore. A copy of this notification shall be distributed by the depositary among all Parties.

3 The Protocol is concluded for an unlimited period and shall cease to apply simultaneously with the termination of the Agreement.

Article 18

The Secretariat General of the Benelux is the depositary of this Protocol. The depositary shall issue each Party with a true copy of the original.
