Article 5 Protocol tussen de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg, het Koninkrijk der Nederlanden) en Georgië ter uitvoering van de Overeenkomst tussen de Europese Unie en Georgië inzake de overname van personen die zonder vergunning op het grondgebied verblijven

1 A reply to a readmission application shall be sent to the competent authority of the Requesting Party by email, fax or other means of telecommunication in accordance with article 10, paragraph 2, of the Agreement. A copy of the reply shall be sent to the diplomatic or consular mission of the Requested Party simultaneously.

2 To reply to a readmission application the form attached as Annex 2 to this Protocol shall be used.

3 In accordance with article 10, paragraph 3, of the Agreement, reasons shall be given for the refusal of a readmission application.

4 If it is established, on the basis of new evidence, that the requirements for readmission had not been complied with, after the Requested Party has given the positive response to readmission application and before the actual transfer, the Requested Party reserves the right to address the Requesting Party to revoke the consent to the readmission application.
