Constitution of the International Organization for Migration › CHAPTER I — PURPOSES AND FUNCTIONS

Article 1

1 The purposes and functions of the Organization shall be:

(a) to make arrangements for the organized transfer of migrants, for whom existing facilities are inadequate or who would not otherwise be able to move without special assistance, to countries offering opportunities for orderly migration;

(b) to concern itself with the organized transfer of refugees, displaced persons and other individuals in need of international migration services for whom arrangements may be made between the Organization and the States concerned, including those States undertaking to receive them;

(c) to provide, at the request of and in agreement with the States concerned, migration services such as recruitment, selection, processing, language training, orientation activities, medical examination, placement, activities facilitating reception and integration, advisory services on migration questions, and other assistance as is in accord with the aims of the Organization;

(d) to provide similar services as requested by States, or in co-operation with other interested international organizations, for voluntary return migration, including voluntary repatriation;

(e) to provide a forum to States as well as international and other organizations for the exchange of views and experiences, and the promotion of co-operation and co-ordination of efforts on international migration issues, including studies on such issues in order to develop practical solutions.

2 In carrying out its functions, the Organization shall co-operate closely with international organizations, governmental and non-governmental, concerned with migration, refugees, and human resources in order, inter alia, to facilitate the co-ordination of international activities in these fields. Such co-operation shall be carried out in the mutual respect of the competences of the organizations concerned.

3 The Organization shall recognize the fact that control of standards of admission and the number of immigrants to be admitted are matters within the domestic jurisdiction of States, and, in carrying out its functions, shall conform to the laws, regulations and policies of the States concerned.

Article 2

The Members of the Organization shall be:

(a) the States being Members of the Organization which have accepted this Constitution according to Article 34 per 21 november 2013: artikel 29, or to which the terms of Article 35 per 21 november 2013: artikel 30 apply;

(b) other States with a demonstrated interest in the principle of free movement of persons which undertake to make a financial contribution at least to the administrative requirements of the Organization, the rate of which will be agreed to by the Council and by the State concerned, subject to a two-thirds majority vote of the Council and upon acceptance by the State of this Constitution in accordance with its constitutional processes.

Article 3

Any Member State may give notice of withdrawal from the Organization effective at the end of a financial year. Such notice must be in writing and must reach the Director General of the Organization at least four months before the end of the financial year. The financial obligations to the Organization of a Member State which has given notice of withdrawal shall include the entire financial year in which notice is given.

Article 4

1 A Member State which is in arrears in the payment of its financial contributions to the Organization shall have no right to vote if the amount of its arrears equals or exceeds the amount of the contributions due from it for the preceding two years. However, the loss of voting rights shall become effective one year after the Council has been informed that the member concerned is in arrears to an extent entailing the loss of voting rights, if at that time the Member State is still in arrears to the said extent. The Council may nevertheless, by a simple majority vote, maintain or restore the right to vote of such a Member State if it is satisfied that the failure to pay is due to conditions beyond the control of the Member State.

2 Any Member State may be suspended from membership by a two-thirds majority vote of the Council if it persistently violates the principles of this Constitution. The Council shall have the authority to restore such membership by a simple majority vote.

Article 5

There are established as the organs of the Organization:

(a) the Council;

(b) the Administration.

Article 6

The functions of the Council, in addition to those mentioned in other provisions of this Constitution, shall be:

(a) to determine, examine and review the policies, programmes and activities of the Organization;

(b) to review the reports and to approve and direct the activities of any subsidiary body;

(c) to review the reports and to approve and direct the activities of the Director General;

(d) to review and approve the programme, the Budget, the expenditure and the accounts of the Organization;

(e) to take any other appropriate action to further the purposes of the Organization.

Article 7

1 The Council shall be composed of representatives of the Member States.

2 Each Member State shall have one representative and such alternates and advisers as it may deem necessary.

3 Each Member State shall have one vote in the Council.

Article 8

The Council may admit, upon their application, non-member States and international organizations, governmental or non-governmental, concerned with migration, refugees or human resources as observers at its meetings under conditions which may be prescribed in its rules of procedure. No such observers shall have the right to vote.

Article 9

1 The Council shall meet in regular session once a year.

2 The Council shall meet in special session at the request of:

(a) one third of its members;

(b) the Director General or the Chairman of the Council in urgent circumstances.

3 The Council shall elect, at the beginning of each regular session, a Chairman and other officers for a one-year term.

Article 10

The Council may set up such subsidiary bodies as may be required for the proper discharge of its functions.

Article 11

The Council shall adopt its own rules of procedure.

Article 12

The Administration shall comprise a Director General, a Deputy Director General and such staff as the Council may determine.

Article 13

1 The Director General and the Deputy Director General shall be elected by a two-thirds majority vote of the Council and may be re-elected for one additional term. Their term of office shall normally be five years but may, in exceptional cases, be less if a two-thirds majority of the Council so decides. They shall serve under contracts approved by the Council, which shall be signed on behalf of the Organization by the Chairman of the Council.

2 The Director General shall be responsible to the Council. The Director General shall discharge the administrative and executive functions of the Organization in accordance with this Constitution and the policies and decisions of the Council and the rules and regulations established by them. The Director General shall formulate proposals for appropriate action by the Council.

Article 14

The Director General shall appoint the staff of the Administration in accordance with the staff regulations adopted by the Council.

Article 15

1 In the performance of their duties, the Director General, the Deputy Director General and the staff shall neither seek nor receive instructions from any State or from any authority external to the Organization. They shall refrain from any action which might reflect adversely on their position as international officials.

2 Each Member State undertakes to respect the exclusively international character of the responsibilities of the Director General, the Deputy Director General and the staff and not to seek to influence them in the discharge of their responsibilities.

3 Efficiency, competence and integrity shall be the necessary considerations in the recruitment and employment of the staff which, except in special circumstances, shall be recruited among the nationals of the Member States of the Organization, taking into account the principle of equitable geographical distribution.

Article 16

The Director General shall be present, or be represented by the Deputy Director General or another designated official, at all sessions of the Council, and any subsidiary bodies. The Director General or the designated representative may participate in the discussions but shall have no vote.

Article 17

At the regular session of the Council following the end of each financial year, the Director General shall make to the Council a report on the work of the Organization, giving a full account of its activities during that year.

Article 18

1 The Organization shall have its Headquarters in Geneva. The Council may, by a two-thirds majority vote, change its location.

2 The meetings of the Council shall be held in Geneva, unless two-thirds of the members of the Council have agreed to meet elsewhere.

Article 19

The Director General shall submit to the Council an annual budget covering the administrative and operational requirements and the anticipated resources of the Organization, such supplementary estimates as may be required and the annual or special accounting statements of the Organization.

Article 20

1 The requirements of the Organization shall be financed:

(a) as to the Administrative part of the Budget, by cash contributions from Member States, which shall be due at the beginning of the financial year to which they relate and shall be paid promptly;

(b) as to the Operational part of the Budget, by contributions in cash, in kind or in services from Member States, other States, international organizations, governmental or non-governmental, other legal entities or individuals, which shall be paid as early as possible and in full prior to the expiration of the financial year to which they relate.

2 Member States shall contribute to the Administrative part of the Budget of the Organization at a rate agreed to by the Council and by the Member State concerned.

3 Contributions to the operational expenditure of the Organization shall be voluntary and any contributor to the Operational part of the Budget may stipulate with the Organization terms and conditions, consistent with the purposes and functions of the Organization, under which its contributions may be used.

(a) All Headquarters administrative expenditure and all other administrative expenditure except that incurred in pursuance of the functions outlined in paragraph 1 (c) and (d) of Article 1 shall be attributed to the Administrative part of the Budget;

(b) all operational expenditure and such administrative expenditure as is incurred in pursuance of the functions outlined in paragraph 1 (c) and (d) of Article 1 shall be attributed to the Operational part of the Budget.

5 The Council shall ensure that the management is conducted in an efficient and economical manner.

Article 21

The financial regulations shall be established by the Council.

Article 22

The Organization shall possess full juridical personality. It shall enjoy such legal capacity, as may be necessary for the exercise of its functions and the fulfilment of its purposes, and in particular the capacity, in accordance with the laws of the State: (a) to contract; (b) to acquire and dispose of immovable and movable property; (c) to receive and disburse private and public funds; (d) to institute legal proceedings.

Article 23

1 The Organization shall enjoy such privileges and immunities as are necessary for the exercise of its functions and the fulfilment of its purposes.

2 Representatives of Member States, the Director General, the Deputy Director General and the staff of the Administration shall likewise enjoy such privileges and immunities as are necessary for the independent exercise of their functions in connection with the Organization.

3 These privileges and immunities shall be defined in agreements between the Organization and the States concerned or through other measures taken by these States.

Article 24

1 Except as otherwise expressly provided in this Constitution or rules made by the Council, all decisions of the Council and all subsidiary bodies shall be taken by a simple majority vote.

2 Majorities provided for in this Constitution or rules made by the Council shall refer to members present and voting.

3 No vote shall be valid unless a majority of the members of the Council or the subsidiary bodies concerned are present.

Article 25

1 Texts of proposed amendments to this Constitution shall be communicated by the Director General to Governments of Member States at least three months in advance of their consideration by the Council.

2 Amendments involving fundamental changes in the Constitution of the Organization or new obligations for the Member States shall come into force when adopted by two-thirds of the members of the Council and accepted by two-thirds of the Member States in accordance with their respective constitutional processes. Whether an amendment involves a fundamental change in the Constitution shall be decided by the Council by a two-thirds majority vote. Other amendments shall come into force when adopted by a two-thirds majority vote of the Council.

Article 26

Any dispute concerning the interpretation or application of this Constitution which is not settled by negotiation or by a two-thirds majority vote of the Council shall be referred to the International Court of Justice in conformity with the Statute of the Court, unless the Member States concerned agree on another mode of settlement within a reasonable period of time.

Article 27

Subject to approval by two-thirds of the members of the Council, the Organization may take over from any other international organization or agency the purposes and activities of which lie within the purposes of the Organization such activities, resources and obligations as may be determined by international agreement or by mutually acceptable arrangements entered into between the competent authorities of the respective organizations.

Article 28

The Council may, by a three-quarters majority vote of its members, decide to dissolve the Organization.

This Constitution shall come into force, for those Governments Members of the Intergovernmental Committee for European Migration which have accepted it in accordance with their respective constitutional processes, on the day of the first meeting of that Committee after:

(a) at least two-thirds of the Members of the Committee, and

(b) a number of Members whose contributions represent at least 75 per cent of the Administrative part of the Budget,

shall have communicated to the Director their acceptance of this Constitution.

Article 30

Those Governments Members of the Intergovernmental Committee for European Migration which have not by the date of coming into force of this Constitution communicated to the Director their acceptance of this Constitution may remain Members of the Committee for a period of one year from that date if they contribute to the administrative requirements of the Committee in accordance with paragraph 2 of Article 25per 21 november 2013: artikel 20, tweede lid, and they shall retain during that period the right to accept the Constitution.

Article 31

The English, French and Spanish texts of this Constitution shall be regarded as equally authentic.

ANNEX — Resolution 1) d.d. 5 December 1951. to establish a Provisional Intergovernmental Committee for the Movement of Migrants from Europe

(1) to constitute a „Provisional Intergovernmental Committee for the Movement of Migrants from Europe”;

(2) that the purpose of the Committee will be to make arrangements for the transport of migrants, for whom existing facilities are inadequate and who could not otherwise be moved, from certain European countries having surplus population to countries overseas which offer opportunities for orderly immigration, consistent with the policies of the countries concerned;

(3) that the terms of reference of the Committee will be:

(a) to provide and arrange for land, sea and air transportation, as required;

(b) to assume responsibility for the charter of such ships operated under the auspices of the I.R.O. as may be required;

(c) to co-ordinate a shipping programme utilizing commercial shipping facilities to the maximum extent possible and the chartered ships transferred from the I.R.O. to secure those movements for which commercial facilities are inadequate;

(d) to take such actions as may be directly related to these ends, taking account of such national and international services as are available;

(e) to take such other actions as will be necessary and appropriate to discharge the foregoing functions;

(4) that among the migrants with whom the Committee will be concerned are included refugees and new refugees for whose migration arrangements may be made between the Committee and the governments of the countries affording asylum;

(5) that membership in the Committee will be open to governments with a demonstrated interest in the principle of the free movement of persons and which undertake, subject to approval by the proper governmental authorities, to make a financial contribution to the Committee, the amount of which will be agreed to by the Committee and by the government concerned;

(6) that the Committee will elect its own officers, establish its Rules of Procedure, establish such sub-committees as it may decide (including an intergovernmental sub-committee on the co-ordination of transport), and exercise the powers required to carry out its purpose;

(7) that the Committee will agree to a plan of operations, a budget, a plan of expenditure and the terms and conditions under which available funds shall be spent, in accordance with the following principles:

(a) each country of reception will retain control of standards of admission and the number of immigrants to be admitted;

(b) only those services will be undertaken by the Committee which are essential to the movement of migrants who could not otherwise be moved;

(c) the Committee will ensure that its administration is conducted in an efficient and economical manner;

(d) any Member Government making a contribution to the operating fund will be able to stipulate the terms and conditions under which that contribution can be used;

(8) that the Committee will appoint a Director responsible to the Committee;

(9) that the Committee shall vest the Director with the powers necessary to carry out the responsibilities entrusted to him by the Committee;

(10) that the Committee will give early consideration to the question of the relations to be established with international, non-governmental and voluntary organizations conducting activities in the field of migration and refugees; and

(11) that the Committee will examine the need for its continuing existence beyond a twelve-month period.

Considering

that, under the terms of its Resolution No. 31, a draft Constitution has been examined at its Fifth and Sixth Sessions and that, after a study of the observations and proposals submitted by the Member Governments, certain other governments and the international, governmental and non-governmental organizations concerned with migration and refugees, the Constitution attached to the present Resolution has been prepared,

to recommend to Member Governments to accept this Constitution and to notify the Director of their acceptance at the earliest possible date,

Requests the Director

to transmit the present resolution to Member Governments and to governments which might adhere to the Committee.

In view of Article 33 of the Constitution, under the terms of which the said Constitution shall come into force for those Member Governments of the Intergovernmental Committee for European Migration which have accepted it, in accordance with their respective constitutional processes, at the first Committee Meeting after:

(a) at least two-thirds of the Members of the Committee, and

(b) a number of Members, representing at least 75 % of the contributions to the administrative part of the budget, shall have communicated to the Director their acceptance of this Constitution,

that Governments with a demonstrated interest in the principle of the free movement of persons which undertake to make a financial contribution at least to the administrative requirements of the Committee, the amount of which will be agreed to by the Committee and by the Governments concerned, may become Members of the Committee subject to a two-thirds majority vote of the members of the Committee.

Artikel 1

1 De doeleinden en functies van de Organisatie zijn:

(a) het treffen van regelingen voor de georganiseerde overbrenging van migranten voor wie de bestaande voorzieningen onvoldoende zijn of die anders niet in staat zouden zijn zonder bijzondere hulp naar landen te vertrekken die gelegenheid bieden voor systematische migratie;

(b) zich bezig te houden met de georganiseerde overbrenging van vluchtelingen, ontheemden en andere personen die behoefte hebben aan internationale migratiediensten, voor wie regelingen kunnen worden getroffen tussen de Organisatie en de betrokken Staten, met inbegrip van de Staten die op zich nemen hen te ontvangen;

(c) het verlenen, op verzoek van en in overeenstemming met de betrokken Staten, van migratiediensten zoals werving, selectie, voorbereiding, taalonderwijs, voorlichting inzake beroepskeuze, medisch onderzoek, het vinden van een werkkring, activiteiten ter vergemakkelijking van de ontvangst en integratie, adviesdiensten inzake migratievraagstukken, en andere hulp die in overeenstemming is met de doeleinden van de Organisatie;

(d) het verlenen van soortgelijke diensten, op verzoek van Staten of in samenwerking met andere belanghebbende internationale organisaties, voor vrijwillige remigratie, met inbegrip van vrijwillige repatriëring;

(e) het verschaffen van een forum voor zowel Staten als internationale en andere organisaties voor de uitwisseling van denkbeelden en ervaringen en de bevordering van de samenwerking bij en de coördinatie van maatregelen inzake internationale migratievraagstukken, met inbegrip van de bestudering van zodanige vraagstukken met het doel tot praktische oplossingen te komen.

2 Bij de uitoefening van haar functies werkt de Organisatie nauw samen met gouvernementele en niet-gouvernementele internationale organisaties die zich bezig houden met migratie, vluchtelingen en de ontwikkeling van het menselijk potentieel, ten einde onder meer de coördinatie van internationale activiteiten op deze terreinen te vergemakkelijken. Deze samenwerking geschiedt met wederzijdse eerbiediging van de bevoegdheden van de betrokken organisaties.

3 De Organisatie erkent dat de normen van toelating en het aantal toe te laten immigranten kwesties zijn die vallen onder de uitsluitende bevoegdheid van de Staten. Bij de uitoefening van haar functies houdt de Organisatie zich aan de wetten en voorschriften en het beleid van de betrokken Staten.

Artikel 2

Leden van de Organisatie zijn:

(a) de Staten die lid zijn van de Organisatie en die dit Statuut overeenkomstig artikel 34 per 21 november 2013: artikel 29 hebben aanvaard, of op welke de bepalingen van artikel 35 per 21 november 2013: artikel 30 van toepassing zijn

(b) andere Staten die aangetoond hebben dat zij belang hebben bij het beginsel van het vrije verkeer van personen, en die zich verbinden althans in de administratieve kosten van de Organisatie financieel bij te dragen; de omvang van de bijdrage zal worden overeengekomen tussen de Raad en de betrokken Staat onder voorwaarde dat de Raad een beslissing neemt met een tweederde meerderheid van stemmen en dat deze Staat dit Statuut aanvaardt in overeenstemming met zijn constitutionele voorschriften.

Artikel 3

Een Lidstaat kan mededeling doen dat hij zich uit de Organisatie terugtrekt met ingang van het einde van het boekjaar. Een dergelijke mededeling dient schriftelijk te geschieden en dient de Directeur-Generaal van de Organisatie minstens vier maanden vóór het einde van het boekjaar te hebben bereikt. De financiële verplichtingen ten aanzien van de Organisatie omvatten voor een Lidstaat die mededeling van opzegging heeft gedaan, het gehele boekjaar waarin deze mededeling werd gedaan.

Artikel 4

1 Een Lidstaat die achterstallig is met de betaling van zijn financiële bijdragen aan de Organisatie, heeft geen stemrecht indien het achterstallige bedrag gelijk is aan of hoger is dan het bedrag van de bijdragen die over de twee voorgaande jaren door hem verschuldigd zijn. Het verlies van stemrecht wordt evenwel van kracht een jaar nadat de Raad ervan in kennis is gesteld dat het betrokken lid in zodanige mate achterstallig is dat dit het verlies van stemrecht tot gevolg heeft, indien de Lidstaat op dat tijdstip nog in dezelfde mate achterstallig is. De Raad kan niettemin door een met gewone meerderheid van stemmen te nemen beslissing het stemrecht van een dergelijke Lidstaat handhaven of herstellen, indien hij ervan overtuigd is dat het uitblijven van de betaling te wijten is aan omstandigheden buiten de macht van de Lidstaat.

2 Een Lidstaat kan als lid worden geschorst door een met een tweederde meerderheid van stemmen te nemen beslissing van de Raad, indien hij bij voortduring inbreuk maakt op de beginselen van dit Statuut. De Raad is bevoegd het lidmaatschap te herstellen door een met eenvoudige meerderheid van stemmen te nemen beslissing.

Artikel 5

Als organen van de Organisatie worden ingesteld:

(a) de Raad;

(b) de Administratie.

Artikel 6

De functies van de Raad, naast die welke in andere bepalingen van dit Statuut worden genoemd, zijn:

(a) het bepalen, onderzoeken en beoordelen van het beleid, de programma's en de activiteiten van de Organisatie;

(b) het bestuderen van de rapporten en het goedkeuren en leiden van de werkzaamheden van hulporganen;

(c) het bestuderen van de rapporten en het goedkeuren en leiden van de werkzaamheden van de Directeur-Generaal;

(d) het bestuderen en goedkeuren van het programma, de begroting, de uitgaven en de rekeningen van de Organisatie;

(e) het nemen van alle andere maatregelen die zijn gericht op het bevorderen van de doeleinden van de Organisatie.

Artikel 7

1 De Raad bestaat uit vertegenwoordigers van de Lidstaten.

2 Elke Lidstaat heeft één vertegenwoordiger en zoveel plaatsvervangers en adviseurs als hij nodig oordeelt.

3 Elke Lidstaat heeft één stem in de Raad.

Artikel 8

De Raad kan, op hun verzoek, niet-Lidstaten en gouvernementele of niet-gouvernementele internationale organisaties die zich bezighouden met migratie, vluchtelingen of de ontwikkeling van het menselijk potentieel, als waarnemers toelaten tot zijn vergaderingen op de in zijn huishoudelijk reglement eventueel voor te schrijven voorwaarden. Deze waarnemers hebben geen stemrecht.

Artikel 9

1 De Raad komt eenmaal per jaar in gewone zitting bijeen.

2 De Raad komt in buitengewone zitting bijeen op verzoek van:

(a) een derde van zijn leden;

(b) de Directeur-Generaal of de Voorzitter van de Raad, in dringende gevallen.

3 De Raad kiest aan het begin van iedere gewone zitting een Voorzitter en andere functionarissen voor een ambtstermijn van één jaar.

Artikel 10

De Raad kan die hulporganen instellen die voor een juiste uitoefening van zijn functies noodzakelijk zijn.

Artikel 12

De Administratie bestaat uit een Directeur-Generaal, een Plaatsvervangend Directeur-Generaal en uit door de Raad vast te stellen personeel.

Artikel 13

1 De Directeur-Generaal en de Plaatsvervangend Directeur-Generaal worden gekozen door de Raad met een tweederde meerderheid van stemmen en kunnen worden herkozen voor één extra ambtstermijn. Hun ambtstermijn is gewoonlijk vijf jaar, maar kan in uitzonderlijke gevallen korter zijn, als de Raad zulks met een tweederde meerderheid van stemmen beslist. Zij verrichten hun werkzaamheden op grond van door de Raad goedgekeurde contracten, die namens de Organisatie worden ondertekend door de Voorzitter van de Raad.

2 De Directeur-Generaal is verantwoording verschuldigd aan de Raad. De Directeur-Generaal oefent de administratieve en bestuurlijke functies van de Organisatie uit in overeenstemming met dit Statuut en met het beleid en de beslissingen van de Raad en de door deze vastgestelde regels en voorschriften. De Directeur-Generaal formuleert voorstellen met het oog op door de Raad te nemen maatregelen.

Artikel 14

De Directeur-Generaal benoemt het personeel van de Administratie in overeenstemming met de personeelsvoorschriften die door de Raad zijn aangenomen.

Artikel 15

1 Bij de vervulling van hun taak vragen de Directeur-Generaal, de Plaatsvervangend Directeur-Generaal en het personeel geen instructies aan, noch ontvangen zij instructies van enige Staat of van enige autoriteit buiten de Organisatie. Zij onthouden zich van elke handeling die hun positie als internationale functionarissen nadelig zou kunnen beïnvloeden.

2 Elke Lidstaat verbindt zich, de uitsluitend internationale aard van de functies van de Directeur-Generaal, de Plaatsvervangend Directeur-Generaal en het personeel te eerbiedigen en niet te trachten hen bij de uitoefening van hun functies te beïnvloeden.

3 Geschiktheid, bekwaamheid en onkreukbaarheid zijn de noodzakelijke maatstaven bij het aannemen en het in dienst hebben van het personeel dat, behalve in bijzondere omstandigheden, wordt aangeworven uit onderdanen van Lidstaten van de Organisatie, met inachtneming van het beginsel van een billijke geografische verdeling.

Artikel 16

De Directeur-Generaal is aanwezig, of wordt vertegenwoordigd door de Plaatsvervangend Directeur-Generaal of door een andere aangewezen functionaris, bij alle zittingen van de Raad, van alle hulporganen. De Directeur-Generaal of de aangewezen vertegenwoordiger kan aan de besprekingen deelnemen, maar heeft geen stemrecht.

Artikel 17

Tijdens de gewone zitting van de Raad na het einde van elk boekjaar brengt de Directeur-Generaal verslag uit aan de Raad over het werk van de Organisatie, waarbij een volledig overzicht van haar activiteiten gedurende het afgelopen jaar wordt gegeven.

Artikel 18

1 De Organisatie is gevestigd te Genève. De Raad kan met een tweederde meerderheid van stemmen besluiten de zetel elders te vestigen.

2 De bijeenkomsten van de Raad worden gehouden in Genève, tenzij tweederde van de leden van de Raad ermede heeft ingestemd elders bijeen te komen.

Artikel 19

De Directeur-Generaal legt aan de Raad een jaarlijkse begroting voor, die de kosten van administratie en de werkzaamheden en de verwachte inkomsten van de Organisatie omvat, alsmede aanvullende voorzieningen indien deze nodig mochten zijn, en de jaarrekeningen of bijzondere rekeningen van de Organisatie.

Artikel 20

1 De behoeften van de Organisatie worden als volgt gefinancierd:

(a) wat het administratieve deel van de begroting betreft, door geldelijke bijdragen van de Lidstaten, die verschuldigd zijn aan het begin van het boekjaar waarop zij betrekking hebben, en die onverwijld dienen te worden voldaan;

(b) wat het deel van de begroting betreft dat betrekking heeft op de werkzaamheden door bijdragen in geld, in natura of in diensten van de Lidstaten, van andere Staten, gouvernementele of niet-gouvernementele internationale organisaties, andere rechtspersonen of personen, die zo spoedig mogelijk en volledig worden voldaan vóór het verstrijken van het boekjaar waarop zij betrekking hebben.

2 De Lidstaten dragen voor het administratieve deel van de begroting van de Organisatie bij in een omvang die wordt overeengekomen tussen de Raad en de betrokken Lidstaat.

3 De bijdragen in de kosten van de werkzaamheden van de Organisatie zijn vrijwillig en ieder die bijdraagt voor het deel van de begroting dat betrekking heeft op de werkzaamheden, kan met de Organisatie de voorwaarden overeenkomen, verenigbaar met de doeleinden en functies van de Organisatie, waaronder zijn of haar bijdragen kunnen worden gebruikt.

(a) Alle administratieve kosten ter plaatse van de zetel en alle andere administratieve kosten, behalve die welke worden gemaakt ter uitoefening van de functies, genoemd in artikel 1, eerste lid, letters (c) en (d), komen ten laste van het administratieve deel van de begroting;

(b) alle kosten van de werkzaamheden en die administratieve kosten welke worden gemaakt ter uitoefening van de functies, genoemd in artikel 1, eerste lid, letter (c) en (d), komen ten laste van het deel van de begroting dat betrekking heeft op de werkzaamheden.

5 De raad ziet er op toe dat het beheer op een doeltreffende en economisch verantwoorde wijze wordt gevoerd.

Artikel 21

Het financieel reglement wordt vastgesteld door de Raad.

Artikel 22

De Organisatie bezit volledige rechtspersoonlijkheid. Zij bezit de wettelijke bevoegdheden die nodig zijn voor de uitoefening van haar functies en de verwezenlijking van haar doeleinden, en in het bijzonder de bevoegdheid om, in overeenstemming met de wetten van de Staat: (a) overeenkomsten te sluiten; (b) roerende en onroerende goederen te verwerven en er over te beschikken; (c) particuliere en openbare gelden te ontvangen en uit te geven; (d) in rechte op te treden.

Artikel 23

1 De Organisatie geniet de voorrechten en immuniteiten die nodig zijn voor de uitoefening van haar functies en de verwezenlijking van haar doeleinden.

2 De vertegenwoordigers van Lidstaten, de Directeur-Generaal, de Plaatsvervangend Directeur-Generaal en het personeel van de Administratie genieten eveneens de voorrechten en immuniteiten die nodig zijn voor de onafhankelijke uitoefening van hun functies in verband met de Organisatie.

3 Deze voorrechten en immuniteiten worden omschreven in overeenkomsten tussen de Organisatie en de betrokken Staten of vastgesteld door middel van andere door deze Staten genomen maatregelen.

Artikel 24

1 Tenzij uitdrukkelijk anders is bepaald in dit Statuut of in door de Raad uitgevaardigde regels, worden alle besluiten van de Raad en van alle hulporganen met gewone meerderheid van stemmen genomen.

2 Alle meerderheden, voorgeschreven in dit Statuut of in de door de Raad uitgevaardigde regels, hebben betrekking op het aantal aanwezige leden die hun stem uitbrengen.

3 Een stemming is alleen geldig indien de meerderheid van de leden van de Raad of van de betrokken hulporganen aanwezig is.

Artikel 25

1 De teksten van voorgestelde wijzigingen van dit Statuut dienen door de Directeur-Generaal minstens drie maanden voordat zij door de Raad zullen worden besproken, aan de Regeringen van de Lidstaten te worden toegezonden.

2 Wijzigingen die fundamentele veranderingen in het Statuut van de Organisatie of nieuwe verplichtingen voor de lidstaten inhouden worden van kracht wanneer zij door tweederde van de leden van de Raad zijn aangenomen en door tweederde van de lidstaten zijn aanvaard in overeenstemming met hun onderscheiden constitutionele procedures. Of een wijziging een fundamentele verandering in het Statuut inhoudt, wordt met een tweederde meerderheid van stemmen beslist door de Raad. Andere wijzigingen worden van kracht wanneer zij met een tweederde meerderheid van stemmen te nemen beslissing van de Raad worden aangenomen;

Artikel 26

Ieder geschil betreffende de uitlegging of toepassing van dit Statuut, dat niet door middel van onderhandelingen of door een met een tweederde meerderheid van stemmen genomen besluit van de Raad wordt geregeld, wordt overeenkomstig het Statuut van het Internationale Gerechtshof voorgelegd aan dit Hof, tenzij de betrokken Lidstaten binnen een redelijke termijn overeenstemming bereiken over een andere wijze van regeling van dit geschil.

Artikel 27

Onder voorbehoud van goedkeuring door tweederde van de leden van de Raad kan de Organisatie van iedere andere internationale organisatie of ieder ander internationaal lichaam waarvan de doeleinden en werkzaamheden binnen de doeleinden van de Organisatie liggen, de werkzaamheden, middelen en verplichtingen overnemen die in een internationale overeenkomst of in wederzijds aanvaardbare regelingen tussen de bevoegde autoriteiten van de onderscheiden organisaties worden vastgelegd.

Artikel 28

De Raad kan, met een meerderheid van stemmen van drievierde van zijn leden, besluiten de Organisatie te ontbinden.

Artikel 29

Ten aanzien van de Regeringen die lid zijn van de Intergouvernementele Commissie voor Europese Migratie en dit Statuut hebben aanvaard in overeenstemming met hun onderscheiden constitutionele voorschriften, treedt dit Statuut in werking op de dag waarop deze Commissie voor het eerst bijeenkomt, nadat:

(a) ten minste tweederde van de leden van de Commissie, en

(b) een aantal leden waarvan de bijdragen ten minste 75 procent van het administratieve deel van de begroting uitmaken,

de Directeur hebben medegedeeld dat zij dit Statuut aanvaarden.

Artikel 30

De Regeringen die lid zijn van de Intergouvernementele Commissie voor Europese Migratie en op de datum van inwerkingtreding van dit Statuut de Directeur nog niet in kennis hebben gesteld van hun aanvaarding van dit Statuut, kunnen gedurende een tijdvak van één jaar, te rekenen van deze datum, lid blijven van de Commissie, indien zij bijdragen in de administratieve kosten van de Commissie overeenkomstig artikel 25, tweede lidper 21 november 2013: artikel 20, tweede lid, en behouden gedurende dit tijdvak het recht het Statuut te aanvaarden.

Artikel 31

De Engelse, de Franse en de Spaanse tekst van dit Statuut worden beschouwd als gelijkelijk authentiek.

BIJLAGE — Resolutie 1) d.d. 5 December 1951. tot instelling van een Voorlopige Intergouvernementele Commissie voor de Migratie uit Europa

(1) Ingesteld wordt een „Voorlopige Intergouvernementele Commissie voor de Migratie uit Europa”;

(2) Het doel van de Commissie zal zijn het treffen van regelingen voor het vervoer van migranten, voor wie de bestaande vervoersgelegenheden onvoldoende zijn en die anders niet vervoerd zouden kunnen worden, van bepaalde Europese landen welke een bevolkingsoverschot hebben naar overzeese landen, welke gelegenheid bieden tot systematische immigratie, in overeenstemming met het beleid van de betrokken landen;

(3) De opdracht van de Commissie zal zijn:

(a) het verschaffen en regelen van vervoersgelegenheid over land, over zee of door de lucht, al naar nodig is;

(b) het aanvaarden voor zover nodig van de verantwoordelijkheid voor de bevrachting van schepen, welke onder toezicht van de Internationale Vluchtelingenorganisatie gebruikt, worden;

(c) het vaststellen van een gecoördineerd programma voor vervoer over zee, waarbij op de grootst mogelijke schaal van de bestaande scheepvaartlijnen gebruik wordt gemaakt en tevens van de gecharterde schepen, overgenomen van de Internationale Vluchtelingenorganisatie, teneinde die vervoersgelegenheid te verzekeren, waarvoor de gewone lijnen onvoldoende zijn;

(d) het nemen van die maatregelen welke rechtstreeks met deze doelstellingen in verband staan waarbij rekening wordt gehouden met beschikbare nationale en internationale diensten;

(e) het nemen van die andere maatregelen, welke noodzakelijk en geschikt zijn om bovengenoemde taken te vervullen;

(4) Tot de migranten met wie de Commissie zich zal bezighouden behoren vluchtelingen en nieuwe vluchtelingen voor wier migratie regelingen getroffen kunnen worden tussen de Commissie en de regeringen van de landen, welke asyl verlenen;

(5) Het lidmaatschap van de Commissie staat open voor die regeringen, welke aangetoond hebben dat zij belang hebben bij het beginsel van het vrije verkeer van personen en welke zich verbinden een financiële bijdrage te betalen aan de Commissie onder voorbehoud van goedkeuring door de betrokken Regeringsautoriteiten; het bedrag van deze bijdrage wordt overeengekomen tussen de Commissie en de betrokken Regering;

(6) De Commissie kiest haar eigen functionarissen, stelt haar eigen huishoudelijk reglement vast, stelt die sub-commissies in, welke zij nodig oordeelt (met inbegrip van een intergouvernementele subcommissie voor coördinatie van het vervoer), en oefent die bevoegdheden uit welke nodig zijn voor het uitvoeren van haar taak;

(7) De Commissie stelt een werk-plan, een begroting, een plan van uitgaven, alsmede de voorwaarden waaronder de beschikbare gelden zullen worden uitgegeven vast, in overeenstemming met de volgende beginselen:

(a) ieder immigratie-land behoudt de vrijheid de normen van toelating vast te stellen alsmede het aantal toe te laten immigranten;

(b) de Commissie verleent slechts die diensten, welke onmisbaar zijn voor het vervoer van migranten die anders niet vervoerd zouden kunnen worden;

(c) de Commissie zal erop toezien dal haar administratie op een doeltreffende en economisch verantwoorde wijze wordt gevoerd;

(d) iedere regering welke lid is van de Commissie en welke bijdraagt in het werk-fonds kan de voorwaarden vaststellen, waaronder haar bijdrage gebruikt kan worden;

(8) De Commissie benoemt een Directeur, die verantwoording verschuldigd is aan de Commissie;

(9) De Commissie geeft de Directeur die bevoegdheden, welke hij nodig heeft om zich te kwijten van de hem door de Commissie toevertrouwde taken;

(10) De Commissie zal zich onverwijld bezinnen op de betrekkingen, welke aangeknoopt dienen te worden met internationale, non-gouvernementele en particuliere instellingen, welke werkzaam zijn op het gebied van migratie en vluchtelingen; en

(11) De Commissie zal de vraag onderzoeken of het noodzakelijk is, dat zij langer dan twaalf maanden blijft bestaan.
