Protocol concerning co-operation in combating oil spills in the wider Caribbean region
Article 1
For the purposes of this Protocol:
1. "Wider Caribbean region" means the Convention area as defined in article 2 of the Convention and adjacent coastal areas.
2. "Convention" means the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean Region.
3. "Related interests" means the interests of a Contracting Party directly affected or threatened and concerning, among others:
(a) maritime, coastal, port or estuarine activities;
(b) the historical and tourist appeal of the area in question, including water sports and recreation;
(c) the health of the coastal population; and
(d) fishing activities and the conservation of natural resources.
4. "Oil spill incident" means a discharge, or a significant threat of a discharge, of oil, however caused, of a magnitude that requires emergency action or other immediate response for the purpose of minimizing its effects or eliminating the threat.
5. "Organization" means the institution referred to in paragraph 3 of article 2 of the Convention.
6. "Regional Co-ordinating Unit" means the unit referred to in the Action Plan for the Caribbean Environment Programme.
Protocol concerning co-operation in combating oil spills in the wider Caribbean region
Article 2
This Protocol applies to oil spill incidents which have resulted in, or which pose a significant threat of, pollution to the marine and coastal environment of the wider Caribbean region or which adversely affect the related interests of one or more of the Contracting Parties.
Protocol concerning co-operation in combating oil spills in the wider Caribbean region
Article 3
1 The Contracting Parties shall, within their capabilities, co-operate in taking all necessary measures, both preventive and remedial, for the protection of the marine and coastal environment of the wider Caribbean region, particularly the coastal areas of the islands of the region, from oil spill incidents.
2 The Contracting Parties shall, within their capabilities, establish and maintain, or ensure the establishment and maintenance of, the means of responding to oil spill incidents and shall endeavour to reduce the risk thereof. Such means shall include the enactment, as necessary, of relevant legislation, the preparation of contingency plans, the identification and development of the capability to respond to an oil spill incident and the designation of an authority responsible for the implementation of this Protocol.
Protocol concerning co-operation in combating oil spills in the wider Caribbean region
Article 4
Each Contracting Party shall periodically exchange with the other Contracting Parties up-to-date information relating to its implementation of this Protocol, including the identity of the authorities responsible for such implementation, and information on their laws, regulations, institutions and operational procedures relating to the prevention of oil spill incidents and to the means of reducing and combating the harmful effects of oil spills.

Article 5
1 Each Contracting Party shall establish appropriate procedures to ensure that information regarding oil spill incidents is reported as rapidly as possible, and shall, inter alia:
(a) require its appropriate officials, masters of ships flying its flag and persons in charge of offshore facilities operating under its jurisdiction to report to it any oil spill incident involving their ships or facilities;
(b) request masters of all ships and pilots of all aircraft operating in the vicinity of its coasts to report to it any oil spill incident of which they are aware.
2 In the event of receiving a report regarding an oil spill incident, a Contracting Party shall immediately notify all other Contracting Parties whose interests are likely to be affected by such incident, as well as the flag State of any ship involved in it. The Contracting Party shall also inform the competent international organizations. Furthermore, as soon as feasible, it shall inform such Contracting Parties and competent international organizations of measures it has taken to minimize or reduce pollution or the threat thereof.
Protocol concerning co-operation in combating oil spills in the wider Caribbean region
Article 6
1 Each Contracting Party shall render assistance, within its capabilities, to other Contracting Parties which request assistance in responding to an oil spill incident within the framework of joint response action agreed between or among the requesting and assisting Contracting Parties.
2 Each Contracting Party shall, subject to its laws and regulations, facilitate the movement into, through and out of its territory of technical personnel, equipment and material necessary for responding to an oil spill incident.

Article 7
Each Contracting Party shall, within its capabilities, take steps including those outlined below in responding to an oil spill incident:
(a) make a preliminary assessment of the incident, including the type and extent of existing or likely pollution effects;
(b) promptly communicate information concerning the incident pursuant to article 5;
(c) promptly determine its ability to take effective measures to respond to the incident and the assistance that might be required;
(d) consult as appropriate with other Contracting Parties concerned in the process of determining the necessary response to the incident;
(e) take the measures necessary to prevent, reduce or eliminate the effects of the incident, including monitoring of the situation.
Protocol concerning co-operation in combating oil spills in the wider Caribbean region
Article 8
1 With a view to facilitating the implementation of the provisions of this Protocol, and in particular articles 6 and 7, the Contracting Parties should conclude appropriate bilateral or multilateral subregional arrangements.
2 Contracting Parties to this Protocol which enter into such subregional arrangements shall notify the other Contracting Parties, as well as the Organization, of the conclusion and the content of such arrangements.
Protocol concerning co-operation in combating oil spills in the wider Caribbean region
Article 9
The Contracting Parties designate the Organization to carry out, through the Regional Co-ordinating Unit when established and in close co-operation with the International Maritime Organization, the following functions:
(a) assisting Contracting Parties, upon request, in the following areas:
(i) the preparation, periodic review and updating of the contingency plans referred to in paragraph 2 of article 3, with a view, inter alia, to promoting the compatibility of the plans of the Contracting Parties, and
(ii) publicizing training courses and programmes;
(b) assisting the Contracting Parties upon request, on a regional basis, in the following areas:
(i) the co-ordination of regional emergency response activities, and
(ii) the provision of a forum for discussion of such activities and related topics;
(c) establishing and maintaining liaison with:
(i) competent regional and international organizations, and
(ii) appropriate private entities conducting activities in the wider Caribbean region, including major oil producers, refiners, oil spill clean-up contractors and co-operatives, and oil transporters;
(d) maintaining a current inventory of emergency response equipment, materials and expertise available in the wider Caribbean region;
(e) disseminating information on the prevention and combating of oil spills;
(f) identifying or maintaining means for emergency response communications;
(g) encouraging research by the Contracting Parties, competent international organizations and appropriate private entities on oil spill-related matters, including the environmental impacts of oil spills and of oil spill control materials and techniques;
(h) assisting the Contracting Parties in the exchange of information pursuant to article 4; and
(i) preparing reports and carrying out other duties assigned to it by the Contracting Parties.
Protocol concerning co-operation in combating oil spills in the wider Caribbean region
Article 10
1 Ordinary meetings of the Contracting Parties to this Protocol shall be held in conjunction with ordinary meetings of the Contracting Parties to the Convention held pursuant to article 16 of the Convention. The Contracting Parties to this Protocol may also hold extraordinary meetings as provided for in article 16 of the Convention.
2 It shall be the function of the meetings of the Contracting Parties:
(a) to review the operation of this Protocol and to consider special technical arrangements and other measures to improve its effectiveness;
(b) to consider means whereby regional co-operation could be extended to incidents involving hazardous substances other than oil; and
(c) to consider measures to improve co-operation under this Protocol including, in accordance with paragraph 2 (d) of article 16 of the Convention, possible amendments to this Protocol.
Protocol concerning co-operation in combating oil spills in the wider Caribbean region
Article 11
1 The provisions of the Convention relating to its protocols shall apply to this Protocol.
2 The rules of procedure and the financial rules adopted pursuant to article 20 of the Convention shall apply to this Protocol, unless the Contracting Parties to this Protocol agree otherwise.
Annex — to the Protocol
Annex — to the Protocol
On the basis of paragraph 2 (b) of Article 10 of this Protocol, the Contracting Parties at their first meeting are committed to preparing, through an annex, the changes necessary to extend this Protocol to regional co-operation to combat spills of hazardous substances other than oil. Pending the preparation and entry into force of such annex, the Protocol shall be provisionally applied upon its entry into force to hazardous substances other than oil.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 1
Voor de toepassing van dit Protocol:
1. betekent «Caraïbisch gebied» het Verdragsgebied zoals omschreven in artikel 2 van het Verdrag, en de aangrenzende kustgebieden.
2. betekent «Verdrag» het Verdrag inzake de bescherming en ontwikkeling van het mariene milieu van het Caraïbisch gebied.
3. betekent «daarmede samenhangende belangen» de belangen van een rechtstreeks getroffen of bedreigde Verdragsluitende Partij, die onder meer betrekking hebben op:
(a) werkzaamheden op zee, aan de kust, in de havens of aan de riviermondingen;
(b) de aantrekkingskracht van het desbetreffende gebied vanuit een oogpunt van de historie en het toerisme, met inbegrip van watersportbeoefening en recreatie;
(c) de gezondheid van de kustbevolking; en
(d) de visserij en het behoud van natuurlijke rijkdommen.
4. betekent «olielozing» uitstroming, of een aanzienlijke dreiging van uitstroming van olie, ongeacht de oorzaak, van een omvang die het treffen van noodmaatregelen of ander onmiddellijk optreden vereist ten einde de gevolgen ervan tot een minimum te beperken of de dreiging weg te nemen.
5. betekent «Organisatie» de instelling bedoeld in artikel 2, derde lid, van het Verdrag.
6. betekent «Regionaal Coördinatiecentrum» het centrum, bedoeld in het Actieplan voor het Caraïbisch Milieuprogramma.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 2
Dit Protocol is van toepassing op olielozingen die hebben geleid tot of die een aanzienlijke dreiging inhouden van, verontreiniging van het mariene milieu en de kusten van het Caraïbisch gebied of die de daarmede samenhangende belangen van een of meer Verdragsluitende Partijen nadelig beïnvloeden.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 3
1 De Verdragsluitende Partijen werken naar vermogen samen bij het nemen van alle nodige, preventieve en corrigerende, maatregelen voor de bescherming van het mariene milieu en de kusten van het Caraïbisch gebied, vooral de kustgebieden van de eilanden van het gebied, tegen olielozingen.
2 Naar vermogen scheppen de Verdragsluitende Partijen de middelen en houden deze in stand, of verzekeren zulks, ten einde te kunnen optreden bij olielozingen en trachten zij het risico daarvan te beperken. Zodanige middelen omvatten de uitvaardiging, voor zover nodig, van ter zake dienende wetten, de opstelling van rampenplannen, de vaststelling en ontwikkeling van het vermogen tot optreden bij een olielozing, en de aanwijzing van een voor de tenuitvoerlegging van dit Protocol verantwoordelijke autoriteit.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 4
Elke Verdragsluitende Partij wisselt periodiek met de andere Verdragsluitende Partijen recente informatie uit aangaande haar toepassing van dit Protocol, met inbegrip van de aanduiding van de autoriteiten die voor deze toepassing verantwoordelijk zijn, alsmede informatie inzake haar wetten, voorschriften, instellingen en operationele procedures betreffende het voorkomen van olielozingen en de middelen voor het beperken en bestrijden van de schadelijke gevolgen van olielozingen.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 5
1 Elke Verdragsluitende Partij stelt passende procedures vast ten einde te verzekeren dat informatie aangaande olielozingen zo snel mogelijk wordt gemeld en dient, onder andere:
(a) van haar daartoe bevoegde functionarissen, kapiteins van schepen die haar vlag voeren en beheerders van onder haar rechtsmacht staande voorzieningen voor de kust, te verlangen dat dezen haar iedere olielozing melden, waarbij hun schepen of voorzieningen betrokken zijn;
(b) de kapiteins van alle schepen en de piloten van alle luchtvaartuigen die hun werkzaamheden verrichten in de nabijheid van haar kusten te verzoeken, haar iedere olielozing te melden waarvan zij kennis dragen.
2 Ingeval een Verdragsluitende Partij een melding aangaande een olielozing ontvangt, brengt zij deze onmiddellijk ter kennis van alle andere Verdragsluitende Partijen wier belangen naar alle waarschijnlijkheid door zulk een voorval worden getroffen, alsook van de vlaggestaat van een daarbij betrokken schip. De Verdragsluitende Partij stelt ook de bevoegde internationale organisaties op de hoogte. Bovendien stelt zij, zodra zulks mogelijk is, deze Verdragsluitende Partijen en bevoegde internationale organisaties in kennis van de door haar genomen maatregelen om de verontreiniging of de dreiging daarvan te verminderen of tot een minimum te beperken.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 6
1 Elke Verdragsluitende Partij verleent naar vermogen bijstand aan andere Verdragsluitende Partijen die om bijstand verzoeken, bij het optreden bij een olielozing, zulks in het kader van het tussen de verzoekende en bijstand verlenende Verdragsluitende Partijen overeengekomen gezamenlijk optreden.
2 Elke Verdragsluitende Partij vergemakkelijkt, onder voorbehoud van haar wetten en voorschriften het verkeer naar, via en uit haar grondgebied van technisch personeel, uitrusting en materialen nodig voor het optreden bij een olielozing.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 7
Elke Verdragsluitende Partij neemt met name en naar vermogen de onderstaande maatregelen ten einde op te treden bij een olielozing:
(a) het verrichten van een voorlopige evaluatie van de lozing, met inbegrip van de aard en de omvang van bestaande of vermoedelijke verontreinigende gevolgen;
(b) het onverwijld mededelen van informatie betreffende de lozing ingevolge artikel 5;
(c) het onverwijld vaststellen van haar vermogen tot het nemen van doeltreffende maatregelen voor het optreden bij de lozing en van de bijstand die nodig zou kunnen zijn;
(d) het waar passend plegen van overleg met andere betrokken Verdragsluitende Partijen bij het vaststellen van het noodzakelijke optreden bij de lozing;
(e) het nemen van de nodige maatregelen, ter voorkoming, vermindering of wegneming van de gevolgen van de lozing, met inbegrip van het bewaken van de situatie.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 8
1 Ten einde de toepassing van de bepalingen van dit Protocol, en inzonderheid van de artikelen 6 en 7 te vergemakkelijken, dienen de Verdragsluitende Partijen passende bilaterale of multilaterale subregionale regelingen aan te gaan.
2 Verdragsluitende Partijen bij dit Protocol die zulke subregionale regelingen aangaan, stellen de andere Verdragsluitende Partijen, alsook de Organisatie, in kennis van het aangaan en de inhoud van zulke regelingen.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 9
De Verdragsluitende Partijen wijzen de Organisatie aan voor het verrichten, via het Regionale Coördinatiecentrum, zodra dit is ingesteld, en in nauwe samenwerking met de Internationale Maritieme Organisatie, van de volgende taken:
(a) het bijstaan van de Verdragsluitende Partijen, op hun verzoek, op de volgende terreinen:
(i) de opstelling, periodieke herziening en bijwerking van de in kel 3, tweede lid, bedoelde rampenplannen, ten einde, onder meer de onderlinge afstemming van de plannen van de Verdragsluitende Parjen te bevorderen, en
(ii) het geven van bekendheid aan opleidingscursussen en -programma's;
(b) het bijstaan van de Verdragsluitende Partijen, op hun verzoek, op regionale basis, op de volgende terreinen:
(i) de coördinatie van regionale activiteiten tot optreden in noodgevallen, en
(ii) het bieden van een forum voor bespreking van zulke activiteiten en aanverwante onderwerpen;
(c) het leggen en onderhouden van contacten met:
(i) bevoegde regionale en internationale organisaties, en
(ii) in aanmerking komende particuliere lichamen die activiteiten in het Caraïbisch gebied verrichten, waaronder grote olieproducenten, beheerders van raffinaderijen, bedrijven en coöperaties die een gebied reinigen van uitgestroomde olie, en vervoerders van olie;
(d) het bijhouden van een actuele inventaris van de uitrusting, materialen en deskundigen die voor het optreden in noodgevallen in het Caraïbisch gebied beschikbaar zijn;
(e) het verspreiden van informatie inzake het voorkomen en bestrijden van olielozingen;
(f) het aanwijzen of in stand houden van communicatiemiddelen voor optreden in noodgevallen;
(g) het bevorderen van onderzoek door de Verdragsluitende Partijen, de internationale organisaties en in aanmerking komende particuliere lichamen, van met olielozingen samenhangende onderwerpen, met inbegrip van de milieu-effecten van olielozingen en van materialen en technieken voor de bestrijding van uitgestroomde olie;
(h) het bijstaan van de Verdragsluitende Partijen bij de uitwisseling van informatie ingevolge artikel 4; en
(i) het opstellen van verslagen en het verrichten van andere taken, haar opgedragen door de Verdragsluitende Partijen.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 10
1 De gewone vergaderingen van de Verdragsluitende Partijen bij dit Protocol worden gehouden te zamen met de gewone vergaderingen van de Partijen bij het Verdrag, die worden gehouden ingevolge artikel 16 van het Verdrag. De Verdragsluitende Partijen bij dit Protocol kunnen ook buitengewone vergaderingen houden, zoals bepaald in artikel 16 van het Verdrag.
2 Het is de taak van de vergaderingen van de Verdragsluitende Partijen:
(a) de werking van dit Protocol te toetsen en bijzondere technische regelingen en andere maatregelen ter verbetering van de doeltreffendheid van dit Protocol te onderzoeken;
(b) middelen te onderzoeken waardoor de regionale samenwerking zou kunnen worden uitgebreid tot voorvallen waarbij andere gevaarlijke stoffen dan olie zijn betrokken; en
(c) maatregelen te onderzoeken ter verbetering van de samenwerking krachtens dit Protocol, met inbegrip, overeenkomstig artikel 16, tweede lid, onder (d), van het Verdrag, van mogelijke wijzigingen op dit Protocol.
Protocol betreffende samenwerking bij de bestrijding van olielozingen in het Caraïbisch gebied
Artikel 11
1 De bepalingen van het Verdrag betreffende de protocollen daarbij zijn van toepassing op dit Protocol.
2 De procedureregels en de financiële voorschriften die ingevolge artikel 20 van het Verdrag zijn aangenomen, zijn van toepassing op dit Protocol, tenzij de Verdragsluitende Partijen bij dit Protocol anders overeenkomen.
Bijlage — bij het Protocol
Bijlage — bij het Protocol
Op grond van artikel 10, tweede lid, onder (b) van dit Protocol hebben de Verdragsluitende Partijen zich ertoe verbonden, tijdens hun eerste vergadering, in de vorm van een bijlage, de wijzigingen op te stellen die nodig zijn om dit Protocol uit te breiden tot regionale samenwerking ter bestrijding van het uitstromen van andere gevaarlijke stoffen dan olie. In afwachting van de opstelling en inwerkingtreding van zulk een bijlage wordt het Protocol bij zijn inwerkingtreding voorlopig toegepast op andere gevaarlijke stoffen dan olie.
