Article 6

The Convention shall be supplemented by the following provisions:

“Channels and means of communication

1. For the purpose of the Convention, communications may be forwarded by using electronic or any other means affording evidence in writing, under conditions which allow the Parties to ascertain their authenticity. In any case, the Party concerned shall, upon request and at any time, submit the originals or authenticated copies of documents.

2. The use of the International Criminal Police Organization (Interpol) or of diplomatic channels is not excluded.

3. Any State may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, declare that, for the purpose of Article 12 and Article 14, paragraph 1.a, of the Convention, it reserves the right to require the original or authenticated copy of the request and supporting documents.”

Fourth Additional Protocol to the European Convention on Extradition

Article 7

1 The words and expressions used in this Protocol shall be interpreted within the meaning of the Convention. As regards the Parties to this Protocol, the provisions of the Convention shall apply, mutatis mutandis, to the extent that they are compatible with the provisions of this Protocol.

2 The provisions of this Protocol are without prejudice to the application of Article 28, paragraphs 2 and 3, of the Convention concerning the relations between the Convention and bilateral or multilateral agreements.

Article 8

The Convention shall be supplemented by the following provisions:

“Friendly settlement

The European Committee on Crime Problems of the Council of Europe shall be kept informed regarding the application of the Convention and the Additional Protocols thereto and shall do whatever is necessary to facilitate a friendly settlement of any difficulty which may arise out of their interpretation and application.”

Fourth Additional Protocol to the European Convention on Extradition

Article 9

1 This Protocol shall be open for signature by the member States of the Council of Europe which are Parties to or have signed the Convention. It shall be subject to ratification, acceptance or approval. A signatory may not ratify, accept or approve this Protocol unless it has previously ratified, accepted or approved the Convention, or does so simultaneously. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

2 This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the deposit of the third instrument of ratification, acceptance or approval.

3 In respect of any signatory State which subsequently deposits its instrument of ratification, acceptance or approval, this Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date of deposit.

Article 10

1 Any non-member State which has acceded to the Convention may accede to this Protocol after it has entered into force.

2 Such accession shall be effected by depositing an instrument of accession with the Secretary General of the Council of Europe.

3 In respect of any acceding State, the Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date of the deposit of the instrument of accession.

Article 11

This Protocol shall apply to requests received after the entry into force of the Protocol between the Parties concerned.

Article 12

1 Any State may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, specify the territory or territories to which this Protocol shall apply.

2 Any State may, at any later time, by declaration addressed to the Secretary General of the Council of Europe, extend the application of this Protocol to any other territory specified in the declaration. In respect of such territory the Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date of receipt of such declaration by the Secretary General.

3 Any declaration made under the two preceding paragraphs may, in respect of any territory specified in such declaration, be withdrawn by a notification addressed to the Secretary General of the Council of Europe. The withdrawal shall become effective on the first day of the month following the expiration of a period of six months after the date of receipt of such notification by the Secretary General.

Fourth Additional Protocol to the European Convention on Extradition

Article 13

1 Reservations made by a State to the provisions of the Convention and the Additional Protocols thereto which are not amended by this Protocol shall also be applicable to this Protocol, unless that State otherwise declares at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession. The same shall apply to any declaration made in respect or by virtue of any provision of the Convention and the Additional Protocols thereto.

2 Reservations and declarations made by a State to any provision of the Convention which is amended by this Protocol shall not be applicable as between the Parties to this Protocol.

3 No reservation may be made in respect of the provisions of this Protocol, with the exception of the reservations provided for in Article 10, paragraph 3, and Article 21, paragraph 5, of the Convention as amended by this Protocol, and in Article 6, paragraph 3, of this Protocol. Reciprocity may be applied to any reservation made.

4 Any State may wholly or partially withdraw a reservation or declaration it has made in accordance with this Protocol, by means of a notification addressed to the Secretary General of the Council of Europe, which shall become effective as from the date of its receipt.

Article 14

1 Any Party may, in so far as it is concerned, denounce this Protocol by means of a notification addressed to the Secretary General of the Council of Europe.

2 Such denunciation shall become effective on the first day of the month following the expiration of a period of six months after the date of receipt of the notification by the Secretary General of the Council of Europe.

3 Denunciation of the Convention automatically entails denunciation of this Protocol.

Article 15

The Secretary General of the Council of Europe shall notify the member States of the Council of Europe and any State which has acceded to this Protocol of:

a) any signature;

b) the deposit of any instrument of ratification, acceptance, approval or accession;

c) any date of entry into force of this Protocol in accordance with Articles 9 and 10;

d) any reservation made in accordance with Article 10, paragraph 3, and Article 21, paragraph 5, of the Convention as amended by this Protocol, as well as Article 6, paragraph 3, of this Protocol, and any withdrawal of such a reservation;

e) any declaration made in accordance with Article 12, paragraph 1, and Article 14, paragraph 3, of the Convention as amended by this Protocol, as well as Article 12 of this Protocol, and any withdrawal of such a declaration;

f) any notification received in pursuance of the provisions of Article 14 and the date on which denunciation takes effect;

g) any other act, declaration, notification or communication relating to this Protocol.

Artikel 6

Het Verdrag wordt aangevuld met de volgende bepalingen:

„Communicatiekanalen en -middelen

1. Voor de toepassing van het Verdrag kunnen mededelingen langs elektronische weg of met andere middelen worden verzonden op zodanige wijze dat schriftelijke vastlegging mogelijk is onder voorwaarden die de partijen in de gelegenheid stellen de authenticiteit ervan vast te stellen. In alle gevallen legt de betrokken partij op verzoek te allen tijde de originele stukken of gewaarmerkte afschriften daarvan over.

2. Het gebruik van de Internationale Criminele Politie Organisatie (Interpol) of van diplomatieke kanalen is niet uitgesloten.

3. Elke staat kan bij de ondertekening of bij de nederlegging van zijn akte van bekrachtiging, aanvaarding, goedkeuring of toetreding verklaren dat hij zich voor de toepassing van artikel 12 en artikel 14, eerste lid, onder (a), van het Verdrag het recht voorbehoudt het origineel of een gewaarmerkte kopie van het verzoek en de bewijsstukken te verlangen.”

Vierde aanvullend Protocol bij het Europees Verdrag betreffende uitlevering

Artikel 7

1 De in dit Protocol gebruikte woorden en uitdrukkingen worden uitgelegd in de geest van het Verdrag. Voor de partijen bij dit Protocol zijn de bepalingen van het Verdrag van overeenkomstige toepassing voor zover zij verenigbaar zijn met de bepalingen van dit Protocol.

2 De bepalingen van dit Protocol laten de toepassing van artikel 28, tweede en derde lid, van het Verdrag ter zake van de verhouding tussen het Verdrag en bilaterale of multilaterale verdragen onverlet.

Artikel 8

Het Verdrag wordt aangevuld met de volgende bepalingen:

„Minnelijke regeling

Het Europese Comité voor Strafrechtelijke Vraagstukken van de Raad van Europa wordt op de hoogte gehouden van de toepassing van dit Verdrag en de Aanvullende Protocollen daarbij en stelt alles in het werk om een minnelijke regeling te bewerkstelligen voor elk probleem dat zou kunnen voortvloeien uit de uitlegging en toepassing ervan.”

Vierde aanvullend Protocol bij het Europees Verdrag betreffende uitlevering

Artikel 9

1 Dit Protocol is opengesteld voor ondertekening door de lidstaten van de Raad van Europa die partij zijn bij of het Verdrag hebben ondertekend. Het dient te worden bekrachtigd, aanvaard of goedgekeurd. Een ondertekenaar van dit Protocol kan het uitsluitend bekrachtigen, aanvaarden of goedkeuren na of tegelijkertijd met de bekrachtiging, aanvaarding of goedkeuring van het Verdrag. De akten van bekrachtiging, aanvaarding of goedkeuring worden nedergelegd bij de Secretaris-Generaal van de Raad van Europa.

2 Dit Protocol treedt in werking op de eerste dag van de maand die volgt op het verstrijken van een tijdvak van drie maanden na de nederlegging van de derde akte van bekrachtiging, aanvaarding of goedkeuring.

3 Met betrekking tot elke ondertekenende staat die vervolgens zijn akte van bekrachtiging, aanvaarding of goedkeuring van het Protocol nederlegt, treedt dit Protocol in werking op de eerste dag van de maand na het verstrijken van een tijdvak van drie maanden na de datum van de nederlegging.

Vierde aanvullend Protocol bij het Europees Verdrag betreffende uitlevering

Artikel 10

1 Een staat die geen lid is en die is toegetreden tot het Verdrag kan tot dit Protocol toetreden na de inwerkingtreding ervan.

2 De toetreding geschiedt door de nederlegging van een akte van toetreding bij de Secretaris-Generaal van de Raad van Europa.

3 Ten aanzien van elke toetredende staat treedt het Verdrag in werking op de eerste dag van de maand die volgt op het verstrijken van een tijdvak van drie maanden na de datum van de nederlegging van de akte van toetreding.

Artikel 11

Dit Protocol is van toepassing op verzoeken die na de inwerkingtreding van het Protocol tussen de betrokken partijen worden ontvangen.

Vierde aanvullend Protocol bij het Europees Verdrag betreffende uitlevering

Artikel 12

1 Elke staat kan, bij de ondertekening of bij de nederlegging van zijn akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, het gebied of de gebieden waarop dit Protocol van toepassing is nader aanduiden.

2 Elke staat kan op elk later tijdstip, door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte verklaring, de toepassing van dit Protocol uitbreiden tot ieder ander in de verklaring aangewezen grondgebied. Ten aanzien van een dergelijk grondgebied treedt het Protocol in werking op de eerste dag van de maand die volgt op het verstrijken van een tijdvak van drie maanden na de datum van ontvangst van die verklaring door de Secretaris-Generaal.

3 Elke krachtens de twee voorgaande leden gedane verklaring kan, met betrekking tot elk in die verklaring genoemd grondgebied, worden ingetrokken door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte kennisgeving. De intrekking wordt van kracht op de eerste dag van de maand die volgt op het verstrijken van een tijdvak van zes maanden na de datum van ontvangst van de kennisgeving door de Secretaris-Generaal.

Artikel 13

1 Door een staat gemaakte voorbehouden ten aanzien van de bepalingen van het Verdrag of de Aanvullende Protocollen daarbij die niet bij dit Protocol worden gewijzigd zijn eveneens op dit Protocol van toepassing, tenzij die staat anderszins verklaart op het tijdstip van ondertekening of bij de nederlegging van zijn akte van bekrachtiging, aanvaarding, goedkeuring of toetreding. Hetzelfde is van toepassing op verklaringen ter zake van of uit hoofde van een bepaling van het Verdrag of de Aanvullende Protocollen daarbij.

2 Voorbehouden en verklaringen van een staat ten aanzien van bepalingen van het Verdrag die bij dit Protocol worden gewijzigd, zijn tussen de partijen bij dit Protocol niet van toepassing.

3 Ten aanzien van de bepalingen van dit Protocol, met uitzondering van de voorbehouden bedoeld in artikel 10, derde lid, en artikel 21, vijfde lid, van het Verdrag zoals gewijzigd bij dit Protocol, en in artikel 6, derde lid, van dit Protocol, kan geen enkel voorbehoud worden gemaakt. Elk voorbehoud kan op basis van wederkerigheid worden gemaakt.

4 Elke staat kan een voorbehoud of een verklaring gemaakt of afgelegd in overeenstemming met dit Protocol geheel of gedeeltelijk intrekken door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte kennisgeving, die van kracht wordt op de datum van ontvangst ervan.

Vierde aanvullend Protocol bij het Europees Verdrag betreffende uitlevering

Artikel 14

1 Elke partij kan, voor zover zij erbij betrokken is, dit Protocol opzeggen door middel van een kennisgeving gericht aan de Secretaris-Generaal van de Raad van Europa.

2 Deze opzegging wordt van kracht op de eerste dag van de maand die volgt op het verstrijken van een tijdvak van zes maanden na de datum van ontvangst van de kennisgeving door de Secretaris-Generaal van de Raad van Europa.

3 Opzegging van het Verdrag heeft automatisch opzegging van dit Protocol ten gevolge.

Vierde aanvullend Protocol bij het Europees Verdrag betreffende uitlevering

Artikel 15

De Secretaris-Generaal van de Raad van Europa geeft de lidstaten van de Raad van Europa en iedere staat die tot dit Protocol is toegetreden, kennis van:

a. elke ondertekening;

b. de nederlegging van elke akte van bekrachtiging, aanvaarding, goedkeuring of toetreding;

c. elke datum van inwerkingtreding van dit Protocol in overeenstemming met de artikelen 9 en 10;

d. elk voorbehoud gemaakt overeenkomstig artikel 10, derde lid, en artikel 21, vijfde lid, van het Verdrag zoals gewijzigd bij dit Protocol, alsmede artikel 6, derde lid, van dit Protocol, en elke intrekking van een dergelijk voorbehoud;

e. elke verklaring afgelegd overeenkomstig artikel 12, eerste lid, en artikel 14, derde lid, van het Verdrag zoals gewijzigd bij dit Protocol, alsmede artikel 12, van dit Protocol, en elke intrekking van een dergelijke verklaring;

f. elke uit hoofde van de bepalingen van artikel 14 ontvangen kennisgeving en de datum waarop de opzegging van kracht wordt;

g. elke andere handeling, verklaring, kennisgeving of mededeling met betrekking tot dit Protocol.
