Convention for the partial revision of the Conventions adopted by the General Conference of the International Labour Organisation at its first twenty-eight sessions for the prupose of making provision for the future discharge of certain chancery functions entrusted by the said Conventions to the Secretary-General of the League of Nations and introducing therein certain further amendments consequential upon the dissolution of the League of Nations and the amendment of the Constitution of the International Labour Organisation.

Article 1

1 Wijzigt alle door de Internationale Arbeidsconferentie in de loop van haar eerste vijfentwintig zittingen aangenomen verdragen.

2 The registration by the Director-General of the International Labour Office of the ratifications of Convention and amendments, acts of denunciation, and declarations provided for in the Conventions adopted by the Conference in the course of its first twenty-five sessions shall have the same force and effect for all purposes as the registration of such ratifications, acts of denunciation and declarations by the Secretary-General of the League of Nations in accordance with the terms of the original texts of the said Conventions.

3 The Director-General of the International Labour Office shall communicate to the Secretary-General of the United Nations for registration in accordance with Article 102 of the Charter of the United Nations full particulars of all ratifications, acts of denunciation and declarations registered by him in accordance with the provisions of the Conventions adopted by the Conference at its first twenty-five sessions as amended by the foregoing provisions of this Article.

Article 3

Any Member of the Organisation which, after the date of the coming into force of this Convention, communicates to the Director-General of the International Labour Office its formal ratification of any Convention adopted by the Conference in the course of its first twenty-eight sessions shall be deemed to have ratified that Convention as modified by this Convention.

Article 4

Two copies of this Convention shall be authenticated by the signature of the President of the Conference and of the Director-General of the International Labour Office. Of these copies one shall be deposited in the archives of the International Labour Office and the other shall be communicated to the Secretary-General of the United Nations for registration in accordance with Article 102 of the Charter of the United Nations. The Director-General shall communicate a certified copy of this Convention to each of the Members of the International Labour Organisation.

Article 5

1 The formal ratifications of this Convention shall be communicated to the Director-General of the International Labour Office.

2 The Convention shall come into force at the date on which the ratifications of two Members of the International Labour Organisation have been received by the Director-General.

3 On the coming into force of this Convention and on the subsequent receipt of further ratifications of the Convention, the Director-General of the International Labour Office shall so notify all the Members of the International Labour Organisation and the Secretary-General of the United Nations.

4 Each Member of the Organisation which ratifies this Convention thereby recognises the validity of any action taken thereunder during the interval between the first coming into force of the Convention and the date of its own ratification.

Article 6

On the first coming into force of this Convention the Director-General of the International Labour Office shall cause official texts of the Conventions adopted by the Conference in the course of its first twenty-eight sessions as modified by the provisions of this Convention to be prepared in two original copies, duly authenticated by his signature, one of which shall be deposited in the archives of the International Labour Office and one of which shall be communicated to the Secretary-General of the United Nations for registration in accordance with Article 102 of the Charter of the United Nations; the Director-General shall communicate certified copies of these texts to each of the Members of the Organisation.

Article 7

Notwithstanding anything contained in any of the Conventions adopted by the Conference in the course of its first twenty-eight sessions, the ratification of this Convention by a Member shall not, ipso jure, involve the denunciation of any such Convention, nor shall the entry into force of this Convention close any such Convention to further ratification.

Article 8

1 Should the Conference adopt a new Convention revising this Convention in whole or in part, then, unless the new Convention otherwise provides —

a. the ratification by a Member of the new revising Convention shall, ipso jure, involve the denunciation of this Convention if and when the new revising Convention shall have come into force;

b. as from the date when the new revising Convention comes into force this Convention shall cease to be open to ratification by the Members.

2 This Convention shall in any case remain in force in its present form and content for those Members which have ratified it but have not ratified the revising Convention.

Artikel 1

1 Wijzigt alle door de Internationale Arbeidsconferentie in de loop van haar eerste vijfentwintig zittingen aangenomen verdragen.

2 De registratie door de Directeur-Generaal van het Internationaal Arbeidsbureau van de bekrachtigingen van verdragen en wijzigingen, van akten van opzegging en van verklaringen, waarin door de verdragen, welke door de Conferentie in de loop van haar eerste vijf en twintig zittingen zijn aangenomen, voorzien is, heeft voor alle doeleinden dezelfde kracht en hetzelfde gevolg als de registratie van dergelijke bekrachtigingen, akten van opzegging en veklaringen, welke door de Secretaris-Generaal van de Volkenbond is gedaan overeenkomstig de bewoordingen van de oorspronkelijke teksten van bedoelde verdragen.

3 De Directeur-Generaal van het Internationaal Arbeidsbureau doet de Secretaris-Generaal van de Verenigde Naties, — ter registratie overeenkomstig het bepaalde in artikel 102 van het Handvest der Verenigde Naties — mededeling van de volledige bijzonderheden van alle bekrachtigingen, akten van opzegging en verklaringen, welke door hem zijn ingeschreven overeenkomstig de bepalingen van de door de Conferentie in haar eerste vijf en twintig zittingen aangenomen verdragen, zoals die gewijzigd zijn bij de voorgaande bepalingen van dit artikel.

Artikel 3

Elk Lid van de Organisatie, dat, na de datum, waarop dit Verdrag in werking treedt, de Directeur-Generaal van het Internationaal Arbeidsbureau mededeling doet van zijn officiële bekrachtiging van een door de Conferentie in de loop van haar eerste acht en twintig zittingen aangenomen verdrag, wordt geacht dat verdrag bekrachtigd te hebben, zoals het door het onderhavige Verdrag gewijzigd is.

Artikel 4

Twee authentieke exemplaren van dit Verdrag worden ondertekend door de Voorzitter van de Conferentie en de Directeur-Generaal van het Internationaal Arbeidsbureau. Een dezer exemplaren wordt nedergelegd in het archief van het Internationaal Arbeidsbureau, het andere aan de Secretaris-Generaal van de Verenigde Naties gezonden om, overeenkomstig het bepaalde in artikel 102 van het Handvest der Verenigde Naties, te worden geregistreerd. De Directeur-Generaal doet een gewaarmerkt afschrift van dit Verdrag aan alle Leden van de Internationale Arbeidsorganisatie toekomen.

Artikel 5

1 De officiële bekrachtigingen van dit Verdrag worden de Directeur-Generaal van het Internationaal Arbeidsbureau medegedeeld.

2 Het Verdrag treedt in werking op de datum, waarop de bekrachtigingen van twee Leden van de Internationale Arbeidsorganisatie door de Directeur-Generaal ontvangen zijn.

3 Zodra dit Verdrag in werking treedt en zodra verdere bekrachtigingen van dit Verdrag ontvangen zijn, geeft de Directeur-Generaal van het Internationaal Arbeidsbureau daarvan kennis aan alle Leden van de Internationale Arbeidsorganisatie en aan de Secretaris-Generaal van de Verenigde Naties.

4 Elk Lid van de Organisatie, dat dit Verdrag bekrachtigt, erkent daarbij de geldigheid van elke actie krachtens dit Verdrag ondernomen gedurende de tijd tussen de inwerkingtreding van het Verdag en de datum van eigen bekrachtiging.

Artikel 6

Bij het in werking treden van dit Verdrag draagt de Directeur-Generaal van het Internationaal Arbeidsbureau zorg, dat van de officiële teksten van de door de Conferentie in de loop van haar eerste acht en twintig zittingen aangenomen verdragen, zoals die door de bepalingen van dit Verdrag gewijzigd zijn, twee authentieke exemplaren gemaakt worden, die behoorlijk van zijn handtekening zijn voorzien; een van die exemplaren wordt in het archief van het Internationaal Arbeidsbureau nedergelegd en een aan de Secretaris-Generaal van de Verenigde Naties gezonden om overeenkomstig het bepaalde in artikel 102 van het Handvest der Verenigde Naties te worden geregistreerd; de Directeur-Generaal doet gewaarmerkte afschriften van deze teksten aan alle Leden van de Organisatie toekomen.

Artikel 7

Ondanks hetgeen in een door de Conferentie in de loop van haar eerste acht en twintig zittingen aangenomen verdrag bepaald moge zijn, brengt de bekrachtiging van dit Verdrag door een Lid niet van zelf de opzegging van een zodanig verdrag met zich mede, noch belet het in werking treden van dit Verdrag de verdere bekrachtigingen van een zodanig verdrag.

VERDRAG BETREFFENDE DE GEDEELTELIJKE HERZIENING VAN DE DOOR DE ALGEMENE CONFERENTIE VAN DE INTERNATIONALE ARBEIDSORGANISATIE IN HAAR EERSTE ACHT EN TWINTIG ZITTINGEN AANGENOMEN VERDRAGEN, WELK VERDRAG TEN DOEL HEEFT TE VOORZIEN IN DE TOEKOMSTIGE UITOEFENING VAN BEPAALDE ADMINISTRATIEVE FUNCTIES, DIE DE SECRETARIS-GENERAAL VAN DE VOLKENBOND BIJ DIE VERDRAGEN WAREN OPGEDRAGEN EN IN BEDOELDE VERDRAGEN BEPAALDE AANVULLENDE WIJZIGINGEN AAN TE BRENGEN, DIE DOOR DE OPHEFFING VAN DE VOLKENBOND EN DOOR DE WIJZIGING VAN HET STATUUT VAN DE INTERNATIONALE ARBEIDSORGANISATIE NOODZAKELIJK ZIJN GEWORDEN.

Artikel 8

1 Indien de Conferentie een nieuw verdrag aanneemt, hetwelk het onderhavige Verdrag geheel of gedeeltelijk wijzigt, zal, tenzij het nieuwe verdrag anders bepaalt:

a. de bekrachtiging door een Lid van het nieuwe verdrag vanzelf meebrengen, de opzegging van dit Verdrag, onder voorbehoud evenwel, dat het nieuwe verdrag, houdende herziening, in werking is getreden;

b. vanaf de datum, waarop het nieuwe verdrag, houdende herziening, in werking is getreden, het onderhavige Verdrag niet meer door de Leden bekrachtigd kunnen worden.

2 Het onderhavige Verdrag blijft in elk geval naar vorm en inhoud van kracht voor die Leden, die het bekrachtigd hebben en die het nieuwe verdrag, houdende herziening, niet bekrachtigd hebben.

Artikel 9

De Engelse en Franse tekst van dit Verdrag zijn gelijkelijk authentiek.
