Optional Protocol of Signature concerning the compulsory settlement of disputes
Article I
Disputes arising out of the interpretation or application of any Convention on the Law of the Sea shall lie within the compulsory jurisdiction of the International Court of Justice, and may accordingly be brought before the Court by an application made by any party to the dispute being a Party to this Protocol.

Article II
This undertaking relates to all the provisions of any Convention on the Law of the Sea except, in the Convention on Fishing and Conservation of the Living Resources of the High Seas, articles 4, 5, 6, 7 and 8, to which articles 9, 10, 11 and 12 of that Convention remain applicable.

Article III
The Parties may agree, within a period of two months after one party has notified its opinion to the other that a dispute exists, to resort not to the International Court of Justice but to an arbitral tribunal. After the expiry of said period, either Party to this Protocol may bring the dispute before the Court by an application.

Article IV
1 Within the same period of two months, the Parties to this Protocol may agree to adopt a conciliation procedure before resorting to the International Court of Justice.
2 The conciliation commission shall make its recommendations within five months after its appointment. If its recommendations are not accepted by the parties to the dispute within two months after they have been delivered, either party may bring the dispute before the Court by an application.

Article V
This Protocol shall remain open for signature by all States who become Parties to any Convention on the Law of the Sea adopted by the United Nations Conference on the Law of the Sea and is subject to ratification, where necessary, according to the constitutional requirements of the signatory States.

Article VI
The Secretary-General of the United Nations shall inform all States who become Parties to any Convention on the Law of the Sea of signatures to this Protocol and of the deposit of instruments of ratification in accordance with article V.

Article VII
The original of this Protocol, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations, who shall send certified copies thereof to all States referred to in article V.

Artikel I
Geschillen welke ontstaan tengevolge van de uitlegging of toepassing van een der zeerechtverdragen, vallen binnen de verplichte rechtsmacht van het Internationale Gerechtshof en kunnen derhalve door iedere partij bij het geschil die Partij is bij dit Protocol door middel van een rekwest aan het Hof worden voorgelegd.

Artikel II
Deze verplichting heeft betrekking op alle bepalingen van elk der zeerechtverdragen, behalve de artikelen 4, 5, 6, 7 en 8 van het Verdrag inzake de visserij en de instandhouding van de levende rijkdommen van de volle zee, waarop de artikelen 9, 10, 11 en 12 van dat Verdrag van toepassing blijven.

Artikel III
De Partijen kunnen binnen een tijdvak van twee maanden nadat de ene Partij aan de andere als haar mening te kennen heeft gegeven, dat er een geschil bestaat, overeenkomen geen beroep te doen op het Internationale Gerechtshof, doch op een scheidsrechterlijk tribunaal. Na het verstrijken van genoemd tijdvak kan iedere Partij bij dit Protocol het geschil door middel van een rekwest aan het Hof voorleggen.

Artikel IV
1 Binnen hetzelfde tijdvak van twee maanden kunnen de Partijen bij dit Protocol overeenkomen een verzoeningsprocedure te aanvaarden, alvorens een beroep te doen op het Internationale Gerechtshof.
2 De verzoeningscommissie dient haar aanbevelingen te doen binnen vijf maanden na haar benoeming. Indien haar aanbevelingen niet binnen twee maanden nadat zij zijn gedaan, door de partijen bij het geschil zijn aanvaard, kan elk van beide partijen door middel van een rekwest het geschil aan het Hof voorleggen.

Artikel V
Dit Protocol blijft opengesteld voor ondertekening door alle staten die Partij worden bij een van de zeerechtverdragen aanvaard door de Conferentie van de Verenigde Naties over zeerecht, en dient te worden bekrachtigd in de gevallen waarin zulks uit hoofde van de grondwettelijke vereisten van de ondertekenende staten nodig is.

Artikel VI
De Secretaris-Generaal van de Verenigde Naties doet aan alle staten die Partij worden bij een der zeerechtverdragen mededeling van de ondertekeningen van dit Protocol en van de nederlegging van akten van bekrachtiging overeenkomstig artikel V.

Artikel VII
Het origineel van dit Protocol, waarvan de Chinese, Engelse, Franse, Russische en Spaanse teksten gelijkelijk authentiek zijn, zal worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties, die gewaarmerkte afschriften ervan zal doen toekomen aan alle in artikel V bedoelde staten.
