Article 3 Verdrag inzake de overbrenging van gevonniste personen tussen het Koninkrijk der Nederlanden en de Republiek Peru

The sentenced person may be transferred under this Treaty only on the following conditions:

a. if he is a national of the receiving State;

b. if the judgement is final and executable;

c. if, at the time of receipt of the request for transfer, there remains still at least six months of the sentence to be served, except for exceptional circumstances;

d. if the acts or omissions on account of which the sentence has been imposed constitute a criminal offence according to the law of the receiving State or would constitute a criminal offence if committed on its territory;

e. if he has not been sentenced exclusively for military offenses;

f. if he consents to the transfer;

g. if he has payed the fine and the compensation to the victim as imposed in the judgement. Except in cases where the sentenced person gives proof of absolute insolvency; and

h. if the transferring and the receiving States agree to the transfer.
