Agreement between the Kingdom of the Netherlands and the Special Court for Sierra Leone in connection with the transportation and storage of the archives of the Special Court
The Special Court for Sierra Leone (hereinafter referred to as “Special Court”) presents its compliments to the Ministry of Foreign Affairs of the Kingdom of the Netherlands and has the honour to refer to the consultations between the Ministry and the National Archives of the Netherlands (the Nationaal Archief, an Agency of the Ministry of Education, Culture and Science) on the one hand, and the Special Court, on the other hand, on the transportation of the archives of the Special Court to, and the storage of these archives at, the premises of the National Archives of the Netherlands (hereinafter “Transportation and Storage”).
As a result of these consultations held in connection with the Transportation and Storage of the Special Court’s archives, the Special Court has the honour to propose the following:
1 The Transportation and Storage of the Special Court’s archives shall be at the expense of the Special Court.
2 The Kingdom of the Netherlands shall only bear liability for damages and losses occurred to the archives of the SCSL in case these damages and losses are the result of gross negligence and intentional acts of its officers in connection with the Transportation of the archives by the Royal Netherlands Air Force.
During the Transportation and Storage of the Special Court’s archives, the Special Court (and upon its succession, the Residual Special Court) shall at all times retain exclusive ownership of the archives and remain exclusively responsible for the “Chain of Custody” of the archives.
In accordance with Article 2 of the Headquarters Agreement between the Kingdom of the Netherlands and the Special Court for Sierra Leone, of 19 June 2006, the provisions of the Agreement between the Kingdom of the Netherlands and the United Nations concerning the Headquarters of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991, concluded at New York on 29 July 1994, as amended (hereinafter referred to as “the Agreement”), shall apply, mutatis mutandis, in connection with the Transportation and Storage, in particular:
a) The archives of the Special Court, and in general all documents and materials made available, belonging to or used by the Special Court, shall be inviolable, as mentioned in Article IX of the Agreement;
b) The assets, income and other property of the Special Court, shall be exempt from all direct taxes, as mentioned in Article X of the Agreement;
c) All persons referred to in Article XIV, XV, XVII, XVIII and XIX of the Agreement shall have the right of unimpeded entry into, exit from and movement within the Kingdom of the Netherlands, and they shall be granted facilities for speedy travel as mentioned in Article XXIII of the Agreement.
1 Operational arrangements shall be made in connection with the Transportation and Storage.
2 The conditions of storage and access to the Special Court’s archives shall be regulated by a Memorandum of Understanding between the Special Court and the Kingdom of the Netherlands.
The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the Special Court for Sierra Leone and has the honour to refer to the special Courts’ Note of 26 November 2010, which reads as follows:

The Ministry has the honour to inform the Special Court that the proposals set forth in the Special Court’s Note are acceptable to the Ministry and to confirm that the Special Court’s Note and this Note shall constitute an Agreement between the Kingdom of the Netherlands and the Special Court for Sierra Leone in connection with the Transportation and Storage of the archives of the Special Court. This Agreement shall apply to the territory of the Kingdom of the Netherlands in Europe, and shall enter into force on the date of this affirmative Note in reply, with retroactive effect as per 10 December 2010.
The Ministry of Foreign Affairs of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Special Court for Sierra Leone the assurances of its highest consideration.

Welke gegevens wij wel kort gebruiken
Om de site te kunnen tonen, ontvangt de server uw IP-adres. Dat is een persoonsgegeven. Wij gebruiken het voor twee dingen:
De verbinding zelf. Zonder IP-adres kan de server het antwoord niet terugsturen. Dit duurt zolang het verzoek duurt.
Bescherming tegen misbruik. Eén aansluiting mag een beperkt aantal zoekopdrachten per minuut doen. Daarvoor houdt de server in het werkgeheugen een teller bij. Die teller hangt niet aan uw IP-adres, maar aan een code die daaruit wordt berekend met een geheime sleutel (HMAC-SHA-256). De sleutel wordt bij elke herstart opnieuw gemaakt en nergens bewaard. Zonder die sleutel is de code niet terug te rekenen naar uw IP-adres.
Gaat er op de server iets technisch mis, dan wordt de foutmelding bewaard, zonder IP-adres, adresregel of andere gegevens van uw verzoek.
Rechtsonder staat hoeveel zoekopdrachten er in totaal op deze site zijn gedaan. Iedere zoekopdracht telt mee. Wij bewaren alleen dat ene getal: niet wat er is gezocht, niet wanneer en niet door wie.
Grondslag
Wij gebruiken uw IP-adres op grond van ons gerechtvaardigd belang (artikel 6, lid 1, onder f AVG): de site bereikbaar, veilig en beschikbaar houden voor iedereen. Wij gebruiken het voor niets anders.
Hoe lang
IP-adres voor de verbinding: alleen tijdens het verzoek.
Teller tegen misbruik: in het werkgeheugen, weg na maximaal 15 minuten zonder verkeer. Bij een herstart is alles direct weg. Niets hiervan komt op schijf.
Wie de gegevens nog meer kan zien
De server staat bij een hostingpartij in Nederland. Die levert de machine en het netwerk en verwerkt daarbij technisch het netwerkverkeer. Wij delen geen gegevens met anderen en verkopen niets. Er gaan geen gegevens naar landen buiten de Europese Economische Ruimte.
Geautomatiseerde besluiten
Doet u te veel zoekopdrachten in korte tijd, dan krijgt u even de melding "Te veel verzoeken". Na ongeveer een minuut kunt u verder. Er worden geen andere besluiten over u genomen en er worden geen profielen gemaakt.
Uw rechten
U hebt recht op inzage, correctie, verwijdering, beperking en bezwaar. Omdat wij niets over u opslaan, kunnen wij u meestal niet terugvinden en is er dus ook niets in te zien of te verwijderen (artikel 11 AVG). U kunt ons altijd een vraag stellen via rechtspraak.zoeker.tipper155@passmail.net.
Bent u het niet eens met hoe wij met gegevens omgaan, dan kunt u een klacht indienen bij de Autoriteit Persoonsgegevens.
Wat u zelf ziet en bewaart
Uw zoekvraag staat in de adresbalk (bijvoorbeeld /?q=diefstal). Die komt in de geschiedenis van uw eigen browser, niet bij ons.
Klikt u naar een andere site, zoals wetten.overheid.nl, dan geeft uw browser niet door vanaf welke pagina u kwam.
De site werkt alleen via een versleutelde verbinding (HTTPS). Uw internetprovider kan zien dat u deze site bezoekt, maar niet wat u zoekt of leest.
Waar de wetteksten vandaan komen
De server haalt de teksten zelf één keer per dag op bij de overheid. Opent u een oudere versie van een regeling die nog niet op de server staat, dan haalt de server die versie op dat moment op. Dat verzoek komt van de server, niet van u, en er gaat niets over u mee. Wij bewaren niet wie om welke versie vroeg.

De teksten komen uit het Basiswettenbestand (BWB) van de overheid. Dat is dezelfde bron als die van wetten.overheid.nl. Op wetten, besluiten en verordeningen rust geen auteursrecht (artikel 11 Auteurswet). Van elk opgehaald bronbestand wordt een SHA-256-hash bewaard, zichtbaar op de pagina van de regeling.
Geen officiële bron, geen advies
De teksten worden automatisch overgenomen en kunnen fouten bevatten of achterlopen. Alleen de tekst op wetten.overheid.nl is de geldende tekst. Deze site geeft geen juridisch advies. Wij zijn niet aansprakelijk voor schade door het gebruik van deze site.
