Monsieur le Chargé d'Affaires,

I have the honour to inform you that in order to arrange for the continuation of the present freedom of travel between the Kingdom of the Netherlands in Europe and the Federation of Malaya, the Government of the Federation of Malaya are prepared to conclude with the Government of the Kingdom of the Netherlands an agreement in the following terms:

(1) Netherlands subjects shall be free to travel from any place whatever to the Federation of Malaya without the necessity of obtaining a visa in advance provided that they are furnished with valid Netherlands passports.

(2) Holders of valid Federation of Malaya passports shall be free to travel from any place whatever to the Kingdom of the Netherlands in Europe without the necessity of obtaining a visa in advance.

(3) It is understood that the waiver of the visa requirement does not exempt Netherlands subjects and citizens of the Federation of Malaya from the necessity of complying with the laws and regulations concerning the entry, residence (temporary or permanent) and employment or occupation of foreigners in the two countries, and that travellers who are unable to satisfy the immigration authorities that they comply with these laws and regulations are liable to be refused leave to enter or land.

(4) The provisions of this agreement will be provisionally applied as from the date of receipt of the Netherlands Government's reply.

The agreement shall come into force on the day of receipt by the Government of the Federation of Malaya of a note in which the Netherlands Government inform the Government of the Federation of Malaya that the approval constitutionally required in the Netherlands has been obtained.

(5) Either Party may temporarily suspend the present agreement for reasons of public order; the suspension shall immediately be notified to the other Party through the diplomatic channel.

Either Party may denounce the present agreement at six months' notice.

If the Netherlands Government are prepared to accept the foregoing proposals I have the honour to suggest that the present Note and your confirmatory reply shall be regarded as placing on record the agreement reached between our two Governments on this matter.
