European Agreement on continued payment of scholarships to students studying abroad
Article 1
For the purpose of this Agreement:
(a) The term “institutions of higher education” shall denote:
(i) universities;
(ii) other institutions of higher education recognised for the purpose of this Agreement by the competent authorities of the Contracting Party in whose territory they are situated;
(b) The term “scholarship” shall denote all forms of direct financial support granted to students, undergraduate and post-graduate, provided by the State or other authority, including grants towards the payment of fees, maintenance awards and study loans.

Article 2
For the purpose of this Agreement, a distinction shall be drawn between Contracting Parties according to whether the authority competent in their territory to deal with the award of scholarships is:
(a) the State;
(b) other authorities;
(c) the State and/or other authorities, as the case may be.

Article 3
A scholarship that has been awarded by a Contracting Party falling within the category mentioned in sub-paragraph (a) of Article 2, for the purpose of enabling a person being a national of such Contracting Party to undertake a course of study or research at an institution of higher education in the territory of such Contracting Party, shall continue to be paid if that person is admitted, at his request and with the approval of the authorities supervising his studies or research, to pursue the said course of study or research in an institution of higher education in the territory of another Contracting Party.

Article 4
Nothing in this Agreement shall be deemed to affect the prevailing rules and regulations concerning the admission of students to institutions of higher education, or the requirements of authorities awarding scholarships with regard to the satisfactory pursuance or the duration of the course of study or research for which the award is made or for which it is renewed.

Article 5
1 Contracting Parties falling within the category mentioned in sub-paragraph (b) of Article 2 shall transmit the text of this Agreement to the authorities competent in their territory to deal with matters pertaining to the award of scholarships and shall encourage the favourable consideration and application by them of the principle set out in Article 3.
2 Contracting Parties falling within the category mentioned in sub-paragraph (c) of Article 2 shall apply the provisions of Article 3 where the State is the authority competent to deal with the award of scholarships, and the provisions of paragraph 1 of this Article where the State is not the competent authority in this matter.

Article 6
Any Contracting Party may, by notification addressed to the Secretary General of the Council of Europe, declare that it will extend the application of this Agreement to persons other than those specified under Article 3.

Article 7
1 This Agreement shall be open to signature by the member States of the Council of Europe, who may become Parties to it either by:
(a) signature without reservation in respect of ratification or acceptance; or
(b) signature with reservation in respect of ratification or acceptance, followed by ratification or acceptance.
2 Instruments of ratification or acceptance shall be deposited with the Secretary General of the Council of Europe.

Article 8
1 This Agreement shall enter into force one month after the date on which five member States of the Council of Europe shall have become Parties to the Agreement, in accordance with the provisions of Article 7.
2 As regards any member State who shall subsequently sign the Agreement without reservation in respect of ratification or acceptance or who shall ratify or accept it, the Agreement shall enter into force one month after the date of such signature or after the date of deposit of the instrument of ratification or acceptance.

Article 9
1 After the entry into force of this Agreement:
(a) any non-member State of the Council of Europe which is a Contracting Party to the European Cultural Convention, signed at Paris on 19 December 1954, may accede to this Agreement;
(b) the Committee of Ministers of the Council of Europe may invite any other non-member State to accede to this Agreement.
2 Such accession shall be effected by depositing with the Secretary General of the Council of Europe an instrument of accession which shall take effect one month after the date of its deposit.

Article 10
1 Any signatory State, at the time of signature or when depositing its instrument of ratification or acceptance, or any acceding State, when depositing its instrument of accession, may specify the territory or territories to which this Agreement shall apply.
2 Any signatory State, when depositing its instrument of ratification or acceptance or at any later date, or any acceding State, when depositing its instrument of accession or at any later date, by declaration addressed to the Secretary General of the Council of Europe, may extend this Agreement to any other territory or territories specified in the declaration and for whose international relations it is responsible or on whose behalf it is authorised to give undertakings.
3 Any declaration made in pursuance of the preceding paragraph may, in respect of any territory mentioned in such declaration, be withdrawn according to the procedure laid down in Article 11 of this Agreement.

Article 11
1 This Agreement shall remain in force indefinitely.
2 Any Contracting Party may, in so far as it is concerned, denounce this Agreement by means of a notification addressed to the Secretary General of the Council of Europe.
3 Such denunciation shall take effect six months after the date of receipt by the Secretary General of such notification.

Article 12
The Secretary General of the Council of Europe shall notify the member States of the Council and any State which has acceded to this Agreement, of:
(a) any signature without reservation in respect of ratification or acceptance;
(b) any signature with reservation in respect of ratification or acceptance;
(c) the deposit of any instrument of ratification, acceptance or accession;
(d) any date of entry into force of this Agreement in accordance with Article 8 thereof;
(e) any declaration received in pursuance of the provisions of Article 6 and of paragraphs 2 and 3 of Article 10;
(f) any notification received in pursuance of the provisions of Article 11 and the date on which denunciation takes effect.

The European Ministers of Education,
Having discussed various aspects of the problems of student admission to universities - conditions of eligibility and financial questions;
Take note of the increase, for social as well as educational reasons, in the number of students emerging from secondary education with qualifications for higher education;
Stress the importance of maintaining the standards both of academic achievement required for university entry and of the universities themselves during the process of expansion;
Hope that for university entrance more attention will be paid to the general level of education than to pre-university specialisation;
Take note that, although universities (with their particular tasks and perspectives) are the most important constituent part of high education, there is, at the same time, need for further development of other forms of higher education;
Consider that all young persons qualified by ability and attainment to enter higher education should have the opportunity to do so;
Urge that, in so far as admission restrictions exist as a result of an insufficient capacity of institutions of higher education, these restrictions should be reduced and gradually abolished by expanding the systems of higher education;
Believe that it should be the obligation of the State that at least all students of ability who cannot finance a course of study themselves or from their parents' funds should be provided with the means for studying from public funds;
Recognising the need to encourage exchanges of undergraduate and particularly post-graduate students between European countries, hope that, over and above the provision already made in this respect by international organisations, steps will be taken to ensure that national programmes of financial support for students become equally applicable to periods of study in other European countries,
Are of the opinion that increased opportunities and financial support for students should have their corollary in adequate methods of selection, a suitably wide range of courses, possibly a greater variety of diplomas at differing levels, and a degree of academic supervision consistent with the maintenance of the traditional freedom and integrity of the universities themselves;
Stress the desirability of fostering opportunities for those who did not follow the regular path of entry to higher education from the secondary schools to be admitted to higher education, both at home and abroad;
Welcome the work of the Council for Cultural Co-operation of the Council of Europe in the field of higher education, and express the wish that the Council should devote particular attention in its programme to the problems mentioned in the present resolution.

Artikel 1
Voor de toepassing van deze Overeenkomst:
(a) wordt onder „instellingen voor wetenschappelijk onderwijs” verstaan:
(i) universiteiten;
(ii) andere instellingen voor wetenschappelijk onderwijs die voor de toepassing van deze Overeenkomst zijn erkend door de bevoegde autoriteiten van de Overeenkomstsluitende Partij op wier grondgebied zij zijn gevestigd;
(b) wordt onder „studietoelage” verstaan alle rechtstreekse financiële steun toegekend aan studenten in de verschillende fasen van het wetenschappelijk onderwijs, verstrekt door de Staat of een andere autoriteit, met inbegrip van toelagen voor de betaling van collegegelden, vergoedingen voor levensonderhoud en leningen voor studiedoeleinden.

Artikel 2
Voor de toepassing van deze Overeenkomst wordt onderscheid gemaakt tussen de Overeenkomstsluitende Partijen al naar de autoriteit in hun grondgebied die bevoegd is studietoelagen toe te kennen is:
(a) de Staat;
(b) andere autoriteiten;
(c) de Staat en/of andere autoriteiten, al naar gelang het geval.

Artikel 3
De studietoelage toegekend door een Overeenkomstsluitende Partij behorend tot de categorie bedoeld onder (a) van artikel 2, ten einde een van haar onderdanen in staat te stellen een bepaalde studie te ondernemen of wetenschappelijk onderzoek te verrichten aan een instelling voor wetenschappelijk onderwijs op haar grondgebied wordt aan deze onderdaan doorbetaald indien hem op zijn verzoek en met de goedkeuring van de autoriteiten die toezicht uitoefenen op zijn studie of onderzoek, wordt toegestaan deze studie of dit onderzoek voort te zetten aan een instelling voor wetenschappelijk onderwijs op het grondgebied van een andere Overeenkomstsluitende Partij.

Artikel 4
Geen enkele bepaling in deze Overeenkomst mag zo worden uitgelegd dat zij van invloed zou zijn op de geldende regels en voorschriften betreffende de toelating van studenten tot instellingen voor wetenschappelijk onderwijs, of op de eisen die door de studietoelagen verlenende autoriteiten ten aanzien van bevredigende studieresultaten of de duur van de studie of van het onderzoek voor toekenning of verlenging van de studietoelage worden gesteld.
Europese Overeenkomst inzake de doorbetaling van studietoelagen aan in het buitenland studerende studenten
Artikel 5
1 De Overeenkomstsluitende Partijen behorende tot de categorie bedoeld onder (b) van artikel 2 zenden de tekst van deze Overeenkomst toe aan de autoriteiten die op hun grondgebied bevoegd zijn in aangelegenheden betreffende de toekenning van studietoelagen en bevorderen zoveel mogelijk dat die autoriteiten het in artikel 3 neergelegde beginsel in welwillende overweging nemen en toepassen.
2 De Overeenkomstsluitende Partijen behorende tot de categorie bedoeld onder (c) van artikel 2 passen de bepalingen van artikel 3 toe in gevallen waarin toekenning van studietoelagen onder de bevoegdheid van de Staat valt en het bepaalde in het eerste lid van dit artikel in gevallen waarin de Staat niet de terzake bevoegde autoriteit is.

Artikel 6
Iedere Overeenkomstsluitende Partij kan door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte kennisgeving verklaren dat zij de toepassing van deze Overeenkomst zal uitbreiden tot andere dan de in artikel 3 aangeduide personen.

Artikel 7
1 Deze Overeenkomst staat open voor ondertekening door de Lid-Staten van de Raad van Europa, die Partij bij deze Overeenkomst kunnen worden door hetzij:
(a) ondertekening zonder voorbehoud van bekrachtiging of aanvaarding; hetzij
(b) ondertekening onder voorbehoud van bekrachtiging of aanvaarding, gevolgd door bekrachtiging of aanvaarding.
2 De akten van bekrachtiging of aanvaarding zullen worden nedergelegd bij de Secretaris-Generaal van de Raad van Europa.

Artikel 8
1 Deze Overeenkomst treedt in werking een maand na de datum waarop, overeenkomstig het in artikel 7 bepaalde, vijf Lid-Staten van de Raad van Europa Partij bij de Overeenkomst zijn geworden.
2 Ten aanzien van Lid-Staten die de Overeenkomst daarna ondertekenen zonder voorbehoud van bekrachtiging of aanvaarding of die haar bekrachtigen of aanvaarden treedt de Overeenkomst in werking een maand na de datum van zodanige ondertekening of na de datum van nederlegging van de akte van bekrachtiging of aanvaarding.
Europese Overeenkomst inzake de doorbetaling van studietoelagen aan in het buitenland studerende studenten
Artikel 9
1 Na de inwerkingtreding van deze Overeenkomst:
(a) kan iedere niet-Lid-Staat van de Raad van Europa die een Verdragsluitende Partij is bij het Europees Cultureel Verdrag, ondertekend te Parijs op 19 december 1954, tot deze Overeenkomst toetreden;
(b) kan het Comité van Ministers van de Raad van Europa iedere Staat die geen lid is van de Raad, uitnodigen tot deze Overeenkomst toe te treden.
2 Toetreding geschiedt door nederlegging van een akte van toetreding bij de Secretaris-Generaal van de Raad van Europa en wordt van kracht een maand na de datum van nederlegging daarvan.
Europese Overeenkomst inzake de doorbetaling van studietoelagen aan in het buitenland studerende studenten
Artikel 10
1 Iedere ondertekenende Staat kan bij de ondertekening of bij nederlegging van zijn akte van bekrachtiging of aanvaarding, of iedere toetredende Staat kan bij nederlegging van zijn akte van toetreding, aangeven op welk gebied of welke gebieden deze Overeenkomst van toepassing is.
2 Iedere ondertekenende Staat kan op het ogenblik van de nederlegging van zijn akte van bekrachtiging of aanvaarding of op een later tijdstip, of iedere toetredende Staat kan bij nederlegging van zijn akte van toetreding of op een later tijdstip, door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte kennisgeving, de toepasselijkheid van deze Overeenkomst uitbreiden tot het gebied of de gebieden, genoemd in deze kennisgeving, voor de internationale betrekkingen waarvan hij verantwoordelijk is of waarvoor hij bevoegd is overeenkomsten aan te gaan.
3 Elke krachtens het bepaalde in het voorgaande lid afgelegde verklaring kan, ten aanzien van elk gebied, in die verklaring genoemd, overeenkomstig de in artikel 11 van deze Overeenkomst omschreven procedure worden ingetrokken.

Artikel 11
1 Deze Overeenkomst is voor onbepaalde tijd van kracht.
2 Elke Overeenkomstsluitende Partij kan deze Overeenkomst opzeggen door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte kennisgeving.
3 Deze opzegging wordt van kracht zes maanden na het tijdstip van ontvangst van deze kennisgeving door de Secretaris-Generaal.

Artikel 12
De Secretaris-Generaal van de Raad van Europa doet aan de Leden van de Raad en iedere Staat die tot deze Overeenkomst is toegetreden, mededeling van:
(a) elke ondertekening zonder voorbehoud van bekrachtiging of aanvaarding;
(b) elke ondertekening onder voorbehoud van bekrachtiging of aanvaarding;
(c) de nederlegging van elke akte van bekrachtiging, aanvaarding of toetreding;
(d) elke datum van inwerkingtreding van deze Overeenkomst overeenkomstig artikel 8;
(e) elke kennisgeving ontvangen krachtens het bepaalde in artikel 6 en artikel 10, leden 2 en 3;
(f) elke krachtens de bepalingen van artikel 11 ontvangen kennisgeving en de datum waarop de opzegging van kracht wordt.
