Resolution by the ESRO Council concerning acceptance of a special TD project Overeenkomst tussen zekere Lid-Staten van de Europese Organisatie voor Ruimteonderzoek en de Europese Organisatie voor Ruimteonderzoek inzake de uitvoering van een bijzonder TD-project

The Council
Having noted the Declaration made on 9 October 1968 by the Representatives to the Council of the Organisation of the Federal Republic of Germany, the Kingdom of Belgium, the Kingdom of Denmark, Spain, the French Republic, the Kingdom of the Netherlands, the United Kingdom of Great Britain and Northern Ireland, the Kingdom of Sweden, and the Swiss Confederation,
Having considered the draft Arrangement between certain Member States of the Organisation and the Organisation, concerning the execution of a Special Project for the design, development, construction and placing in orbit of a TD satellite incorporating the essential features of the mission of the TD4 satellite formerly included in the programme of the Organisation, under which Arrangement the Organisation would make available, in accordance with Article VIII of the Convention for its establishment, its assistance and the use of its facilities for this project and which sets out the detailed terms and conditions under which the Organisation would make available its assistance and the use of its facilities for this project;
1. Authorises the Director General to sign, on behalf of the Organisation, the draft Arrangement mentioned above;
2. Authorises the Director General, pending the coming into force of the Arrangement:
(a) to make available, as required, the assistance of the Organisation and the use of its facilities for the Special Project;
(b) to enter into further commitments, including a suitable interim contractual arrangement with the MESH Group, up to a maximum of MF 25 until 31 December 1968, on the basis that these commitments shall be financed by the participating Governments;
(c) to open a special account for the financing of the Special Project;
3. Authorises the Director General, after the entry into force of the Arrangement:
(a) to conclude the final contract with the MESH Group and such other contracts as are necessary for the execution of the Special Project;
(b) to make all other provisions necessary for the execution of the Special Project, in conformity with the Arrangement;
(c) to provide for the operation of the TD satellite after its placing in orbit;
4. Agrees that the value of the contracts and sub-contracts, interim and final, awarded for the implementation of the Special Project and the participating Governments' contributions thereto shall be taken into account when applying the rule concerning geographical distribution contained in Resolution ESRO/C/XXI Res. 4 adopted by the Council on 21st December, 1967.
