The Embassy of the Republic of Korea presents its compliments to the Embassy of the Kingdom of the Netherlands and has the honour to refer to the conversations that have recently taken place between the representatives of the Government of the Republic of Korea and the Government of the Kingdom of the Netherlands with respect to the conclusion of an agreement for the mutual granting and protection of the rights on patents and trade marks to the nationals of the other country. The understandings reached as a result of these conversations are as follows:

Nationals and corporations of either country within the territories of the other shall be granted the same rights as are given to the nationals and corporations of the other country with respect to the rights for registration and protection of patents and trade marks, whether or not they have a domicile or an establishment in the other country. However, the foregoing shall not prejudice the right of either country to provide that domicile be elected with an authorized agent, established in the country where protection is desired.

Nationals and corporations of either country shall be subject to laws and regulations relating to patents or trade marks, as the case may be, of the country where the protection is claimed, in order to secure the protection referred to in the above two paragraphs.

Upon receipt of a Note from the Embassy of the Kingdom of the Netherlands confirming that the foregoing provisions are acceptable to the Government of the Kingdom of the Netherlands, the Government of the Republic of Korea will consider that the present Note and the Embassy's Note in reply thereto constitute an agreement between the two Governments on this subject.

The agreement shall enter into force on a date to be laid down in an exchange of Notes stating that the approval constitutionally required in either country has been obtained. The agreement may be terminated by either party giving six months' notice in writing to the other party.

As far as the Kingdom of the Netherlands is concerned the present agreement shall only apply to the territory of the Kingdom in Europe. The agreement may be extended to any of the other parts of the Kingdom by means of a written notification from the Government of the Kingdom of the Netherlands to the Government of Korea.

The Embassy of the Republic of Korea avails itself of this opportunity to renew to the Embassy of the Kingdom of the Netherlands the assurances of its highest consideration.
