Convention on the protection and promotion of the diversity of cultural expressions › I — OBJECTIVES AND GUIDING PRINCIPLES

Article 1

The objectives of this Convention are:

a) to protect and promote the diversity of cultural expressions;

b) to create the conditions for cultures to flourish and to freely interact in a mutually beneficial manner;

c) to encourage dialogue among cultures with a view to ensuring wider and balanced cultural exchanges in the world in favour of intercultural respect and a culture of peace;

d) to foster interculturality in order to develop cultural interaction in the spirit of building bridges among peoples;

e) to promote respect for the diversity of cultural expressions and raise awareness of its value at the local, national and international levels;

f) to reaffirm the importance of the link between culture and development for all countries, particularly for developing countries, and to support actions undertaken nationally and internationally to secure recognition of the true value of this link;

g) to give recognition to the distinctive nature of cultural activities, goods and services as vehicles of identity, values and meaning;

h) to reaffirm the sovereign rights of States to maintain, adopt and implement policies and measures that they deem appropriate for the protection and promotion of the diversity of cultural expressions on their territory;

i) to strengthen international cooperation and solidarity in a spirit of partnership with a view, in particular, to enhancing the capacities of developing countries in order to protect and promote the diversity of cultural expressions.

Convention on the protection and promotion of the diversity of cultural expressions › II — SCOPE OF APPLICATION

Article 3

This Convention shall apply to the policies and measures adopted by the Parties related to the protection and promotion of the diversity of cultural expressions.

Convention on the protection and promotion of the diversity of cultural expressions › III — DEFINITIONS

Article 4

For the purposes of this Convention, it is understood that:

1. Cultural diversity

‘‘Cultural diversity’’ refers to the manifold ways in which the cultures of groups and societies find expression. These expressions are passed on within and among groups and societies.

Cultural diversity is made manifest not only through the varied ways in which the cultural heritage of humanity is expressed, augmented and transmitted through the variety of cultural expressions, but also through diverse modes of artistic creation, production, dissemination, distribution and enjoyment, whatever the means and technologies used.

2. Cultural content

‘‘Cultural content’’ refers to the symbolic meaning, artistic dimension and cultural values that originate from or express cultural identities.

3. Cultural expressions

‘‘Cultural expressions’’ are those expressions that result from the creativity of individuals, groups and societies, and that have cultural content.

4. Cultural activities, goods and services

‘‘Cultural activities, goods and services’’ refers to those activities, goods and services, which at the time they are considered as a specific attribute, use or purpose, embody or convey cultural expressions, irrespective of the commercial value they may have. Cultural activities may be an end in themselves, or they may contribute to the production of cultural goods and services.

5. Cultural industries

‘‘Cultural industries’’ refers to industries producing and distributing cultural goods or services as defined in paragraph 4 above.

6. Cultural policies and measures

‘‘Cultural policies and measures’’ refers to those policies and measures relating to culture, whether at the local, national, regional or international level that are either focused on culture as such or are designed to have a direct effect on cultural expressions of individuals, groups or societies, including on the creation, production, dissemination, distribution of and access to cultural activities, goods and services.

7. Protection

‘‘Protection’’ means the adoption of measures aimed at the preservation, safeguarding and enhancement of the diversity of cultural expressions.

‘‘Protect’’ means to adopt such measures.

8. Interculturality

‘‘Interculturality’’ refers to the existence and equitable interaction of diverse cultures and the possibility of generating shared cultural expressions through dialogue and mutual respect.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 5

1 The Parties, in conformity with the Charter of the United Nations, the principles of international law and universally recognized human rights instruments, reaffirm their sovereign right to formulate and implement their cultural policies and to adopt measures to protect and promote the diversity of cultural expressions and to strengthen international cooperation to achieve the purposes of this Convention.

2 When a Party implements policies and takes measures to protect and promote the diversity of cultural expressions within its territory, its policies and measures shall be consistent with the provisions of this Convention.

Article 6

1 Within the framework of its cultural policies and measures as defined in Article 4.6 and taking into account its own particular circumstances and needs, each Party may adopt measures aimed at protecting and promoting the diversity of cultural expressions within its territory.

2 Such measures may include the following:

(i) regulatory measures aimed at protecting and promoting diversity of cultural expressions;

(ii) measures that, in an appropriate manner, provide opportunities for domestic cultural activities, goods and services among all those available within the national territory for the creation, production, dissemination, distribution and enjoyment of such domestic cultural activities, goods and services, including provisions relating to the language used for such activities, goods and services;

(iii) measures aimed at providing domestic independent cultural industries and activities in the informal sector effective access to the means of production, dissemination and distribution of cultural activities, goods and services;

(iv) measures aimed at providing public financial assistance;

(v) measures aimed at encouraging non-profit organizations, as well as public and private institutions and artists and other cultural professionals, to develop and promote the free exchange and circulation of ideas, cultural expressions and cultural activities, goods and services, and to stimulate both the creative and entrepreneurial spirit in their activities;

(vi) measures aimed at establishing and supporting public institutions, as appropriate;

(vii) measures aimed at nurturing and supporting artists and others involved in the creation of cultural expressions;

(viii) measures aimed at enhancing diversity of the media, including through public service broadcasting.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 7

1 Parties shall endeavour to create in their territory an environment which encourages individuals and social groups:

a) to create, produce, disseminate, distribute and have access to their own cultural expressions, paying due attention to the special circumstances and needs of women as well as various social groups, including persons belonging to minorities and indigenous peoples;

b) to have access to diverse cultural expressions from within their territory as well as from other countries of the world.

2 Parties shall also endeavour to recognize the important contribution of artists, others involved in the creative process, cultural communities, and organizations that support their work, and their central role in nurturing the diversity of cultural expressions.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 8

1 Without prejudice to the provisions of Articles 5 and 6, a Party may determine the existence of special situations where cultural expressions on its territory are at risk of extinction, under serious threat, or otherwise in need of urgent safeguarding.

2 Parties may take all appropriate measures to protect and preserve cultural expressions in situations referred to in paragraph 1 in a manner consistent with the provisions of this Convention.

3 Parties shall report to the Intergovernmental Committee referred to in Article 23 all measures taken to meet the exigencies of the situation, and the Committee may make appropriate recommendations.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 9

Parties shall:

a) provide appropriate information in their reports to Unesco every four years on measures taken to protect and promote the diversity of cultural expressions within their territory and at the international level;

b) designate a point of contact responsible for information sharing in relation to this Convention;

c) share and exchange information relating to the protection and promotion of the diversity of cultural expressions.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 10

Parties shall:

a) encourage and promote understanding of the importance of the protection and promotion of the diversity of cultural expressions, inter alia, through educational and greater public awareness programmes;

b) cooperate with other Parties and international and regional organizations in achieving the purpose of this article;

c) endeavour to encourage creativity and strengthen production capacities by setting up educational, training and exchange programmes in the field of cultural industries. These measures should be implemented in a manner which does not have a negative impact on traditional forms of production.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 11

Parties acknowledge the fundamental role of civil society in protecting and promoting the diversity of cultural expressions. Parties shall encourage the active participation of civil society in their efforts to achieve the objectives of this Convention.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 12

Parties shall endeavour to strengthen their bilateral, regional and international cooperation for the creation of conditions conducive to the promotion of the diversity of cultural expressions, taking particular account of the situations referred to in Articles 8 and 17, notably in order to:

a) facilitate dialogue among Parties on cultural policy;

b) enhance public sector strategic and management capacities in cultural public sector institutions, through professional and international cultural exchanges and sharing of best practices;

c) reinforce partnerships with and among civil society, non-governmental organizations and the private sector in fostering and promoting the diversity of cultural expressions;

d) promote the use of new technologies, encourage partnerships to enhance information sharing and cultural understanding, and foster the diversity of cultural expressions;

e) encourage the conclusion of co-production and co-distribution agreements.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 13

Parties shall endeavour to integrate culture in their development policies at all levels for the creation of conditions conducive to sustainable development and, within this framework, foster aspects relating to the protection and promotion of the diversity of cultural expressions.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 14

Parties shall endeavour to support cooperation for sustainable development and poverty reduction, especially in relation to the specific needs of developing countries, in order to foster the emergence of a dynamic cultural sector by, inter alia, the following means:

a) the strengthening of the cultural industries in developing countries through:

(i) creating and strengthening cultural production and distribution capacities in developing countries;

(ii) facilitating wider access to the global market and international distribution networks for their cultural activities, goods and services;

(iii) enabling the emergence of viable local and regional markets;

(iv) adopting, where possible, appropriate measures in developed countries with a view to facilitating access to their territory for the cultural activities, goods and services of developing countries;

(v) providing support for creative work and facilitating the mobility, to the extent possible, of artists from the developing world;

(vi) encouraging appropriate collaboration between developed and developing countries in the areas, inter alia, of music and film;

b) capacity-building through the exchange of information, experience and expertise, as well as the training of human resources in developing countries, in the public and private sector relating to, inter alia, strategic and management capacities, policy development and implementation, promotion and distribution of cultural expressions, small-, medium- and micro-enterprise development, the use of technology, and skills development and transfer;

c) technology transfer through the introduction of appropriate incentive measures for the transfer of technology and know-how, especially in the areas of cultural industries and enterprises;

d) financial support through:

(i) the establishment of an International Fund for Cultural Diversity as provided in Article 18;

(ii) the provision of official development assistance, as appropriate, including technical assistance, to stimulate and support creativity;

(iii) other forms of financial assistance such as low interest loans, grants and other funding mechanisms.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 15

Parties shall encourage the development of partnerships, between and within the public and private sectors and non-profit organizations, in order to cooperate with developing countries in the enhancement of their capacities in the protection and promotion of the diversity of cultural expressions. These innovative partnerships shall, according to the practical needs of developing countries, emphasize the further development of infrastructure, human resources and policies, as well as the exchange of cultural activities, goods and services.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 16

Developed countries shall facilitate cultural exchanges with developing countries by granting, through the appropriate institutional and legal frameworks, preferential treatment to artists and other cultural professionals and practitioners, as well as cultural goods and services from developing countries.

Article 17

Parties shall cooperate in providing assistance to each other, and, in particular to developing countries, in situations referred to under Article 8.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 18

1 An International Fund for Cultural Diversity, hereinafter referred to as ‘‘the Fund‘‘, is hereby established.

2 The Fund shall consist of funds-in-trust established in accordance with the Financial Regulations of Unesco.

3 The resources of the Fund shall consist of:

a) voluntary contributions made by Parties;

b) funds appropriated for this purpose by the General Conference of Unesco;

c) contributions, gifts or bequests by other States; organizations and programmes of the United Nations system, other regional or international organizations; and public or private bodies or individuals;

d) any interest due on resources of the Fund;

e) funds raised through collections and receipts from events organized for the benefit of the Fund;

f) any other resources authorized by the Fund’s regulations.

4 The use of resources of the Fund shall be decided by the Intergovernmental Committee on the basis of guidelines determined by the Conference of Parties referred to in Article 22.

5 The Intergovernmental Committee may accept contributions and other forms of assistance for general and specific purposes relating to specific projects, provided that those projects have been approved by it.

6 No political, economic or other conditions that are incompatible with the objectives of this Convention may be attached to contributions made to the Fund.

7 Parties shall endeavour to provide voluntary contributions on a regular basis towards the implementation of this Convention.

Convention on the protection and promotion of the diversity of cultural expressions › IV — RIGHTS AND OBLIGATIONS OF PARTIES

Article 19

1 Parties agree to exchange information and share expertise concerning data collection and statistics on the diversity of cultural expressions as well as on best practices for its protection and promotion.

2 Unesco shall facilitate, through the use of existing mechanisms within the Secretariat, the collection, analysis and dissemination of all relevant information, statistics and best practices.

3 Unesco shall also establish and update a data bank on different sectors and governmental, private and non-profit organizations involved in the area of cultural expressions.

4 To facilitate the collection of data, Unesco shall pay particular attention to capacity-building and the strengthening of expertise for Parties that submit a request for such assistance.

5 The collection of information identified in this Article shall complement the information collected under the provisions of Article 9.

Convention on the protection and promotion of the diversity of cultural expressions › V — RELATIONSHIP TO OTHER INSTRUMENTS

Article 20

1 Parties recognize that they shall perform in good faith their obligations under this Convention and all other treaties to which they are parties. Accordingly, without subordinating this Convention to any other treaty,

a) they shall foster mutual supportiveness between this Convention and the other treaties to which they are parties; and

b) when interpreting and applying the other treaties to which they are parties or when entering into other international obligations, Parties shall take into account the relevant provisions of this Convention.

2 Nothing in this Convention shall be interpreted as modifying rights and obligations of the Parties under any other treaties to which they are parties.

Convention on the protection and promotion of the diversity of cultural expressions › V — RELATIONSHIP TO OTHER INSTRUMENTS

Article 21

Parties undertake to promote the objectives and principles of this Convention in other international forums. For this purpose, Parties shall consult each other, as appropriate, bearing in mind these objectives and principles.

Convention on the protection and promotion of the diversity of cultural expressions › VI — ORGANS OF THE CONVENTION

Article 22

1 A Conference of Parties shall be established. The Conference of Parties shall be the plenary and supreme body of this Convention.

2 The Conference of Parties shall meet in ordinary session every two years, as far as possible, in conjunction with the General Conference of Unesco. It may meet in extraordinary session if it so decides or if the Intergovernmental Committee receives a request to that effect from at least one-third of the Parties.

3 The Conference of Parties shall adopt its own rules of procedure.

4 The functions of the Conference of Parties shall be, inter alia:

a) to elect the Members of the Intergovernmental Committee;

b) to receive and examine reports of the Parties to this Convention transmitted by the Intergovernmental Committee;

c) to approve the operational guidelines prepared upon its request by the Intergovernmental Committee;

d) to take whatever other measures it may consider necessary to further the objectives of this Convention.

Convention on the protection and promotion of the diversity of cultural expressions › VI — ORGANS OF THE CONVENTION

Article 23

1 An Intergovernmental Committee for the Protection and Promotion of the Diversity of Cultural Expressions, hereinafter referred to as ‘‘the Intergovernmental Committee‘‘, shall be established within Unesco. It shall be composed of representatives of 18 States Parties to the Convention, elected for a term of four years by the Conference of Parties upon entry into force of this Convention pursuant to Article 29.

2 The Intergovernmental Committee shall meet annually.

3 The Intergovernmental Committee shall function under the authority and guidance of and be accountable to the Conference of Parties.

4 The Members of the Intergovernmental Committee shall be increased to 24 once the number of Parties to the Convention reaches 50.

5 The election of Members of the Intergovernmental Committee shall be based on the principles of equitable geographical representation as well as rotation.

6 Without prejudice to the other responsibilities conferred upon it by this Convention, the functions of the Intergovernmental Committee shall be:

a) to promote the objectives of this Convention and to encourage and monitor the implementation thereof;

b) to prepare and submit for approval by the Conference of Parties, upon its request, the operational guidelines for the implementation and application of the provisions of the Convention;

c) to transmit to the Conference of Parties reports from Parties to the Convention, together with its comments and a summary of their contents;

d) to make appropriate recommendations to be taken in situations brought to its attention by Parties to the Convention in accordance with relevant provisions of the Convention, in particular Article 8;

e) to establish procedures and other mechanisms for consultation aimed at promoting the objectives and principles of this Convention in other international forums;

f) to perform any other tasks as may be requested by the Conference of Parties.

7 The Intergovernmental Committee, in accordance with its Rules of Procedure, may invite at any time public or private organizations or individuals to participate in its meetings for consultation on specific issues.

8 The Intergovernmental Committee shall prepare and submit to the Conference of Parties, for approval, its own Rules of Procedure.

Convention on the protection and promotion of the diversity of cultural expressions › VI — ORGANS OF THE CONVENTION

Article 24

1 The organs of the Convention shall be assisted by the Unesco Secretariat.

2 The Secretariat shall prepare the documentation of the Conference of Parties and the Intergovernmental Committee as well as the agenda of their meetings and shall assist in and report on the implementation of their decisions.

Convention on the protection and promotion of the diversity of cultural expressions › VII — FINAL CLAUSES

Article 25

1 In the event of a dispute between Parties to this Convention concerning the interpretation or the application of the Convention, the Parties shall seek a solution by negotiation.

2 If the Parties concerned cannot reach agreement by negotiation, they may jointly seek the good offices of, or request mediation by, a third party.

3 If good offices or mediation are not undertaken or if there is no settlement by negotiation, good offices or mediation, a Party may have recourse to conciliation in accordance with the procedure laid down in the Annex of this Convention. The Parties shall consider in good faith the proposal made by the Conciliation Commission for the resolution of the dispute.

4 Each Party may, at the time of ratification, acceptance, approval or accession, declare that it does not recognize the conciliation procedure provided for above. Any Party having made such a declaration may, at any time, withdraw this declaration by notification to the Director-General of Unesco.

Convention on the protection and promotion of the diversity of cultural expressions › VII — FINAL CLAUSES

Article 26

1 This Convention shall be subject to ratification, acceptance, approval or accession by Member States of Unesco in accordance with their respective constitutional procedures.

2 The instruments of ratification, acceptance, approval or accession shall be deposited with the Director-General of Unesco.

Convention on the protection and promotion of the diversity of cultural expressions › VII — FINAL CLAUSES

Article 27

1 This Convention shall be open to accession by all States not Members of Unesco but members of the United Nations, or of any of its specialized agencies, that are invited by the General Conference of Unesco to accede to it.

2 This Convention shall also be open to accession by territories which enjoy full internal self-government recognized as such by the United Nations, but which have not attained full independence in accordance with General Assembly resolution 1514 (XV), and which have competence over the matters governed by this Convention, including the competence to enter into treaties in respect of such matters.

3 The following provisions apply to regional economic integration organizations:

a) This Convention shall also be open to accession by any regional economic integration organization, which shall, except as provided below, be fully bound by the provisions of the Convention in the same manner as States Parties;

b) In the event that one or more Member States of such an organization is also Party to this Convention, the organization and such Member State or States shall decide on their responsibility for the performance of their obligations under this Convention. Such distribution of responsibility shall take effect following completion of the notification procedure described in subparagraph (c). The organization and the Member States shall not be entitled to exercise rights under this Convention concurrently. In addition, regional economic integration organizations, in matters within their competence, shall exercise their rights to vote with a number of votes equal to the number of their Member States that are Parties to this Convention. Such an organization shall not exercise its right to vote if any of its Member States exercises its right, and vice-versa;

c) A regional economic integration organization and its Member State or States which have agreed on a distribution of responsibilities as provided in subparagraph (b) shall inform the Parties of any such proposed distribution of responsibilities in the following manner:

(i) in their instrument of accession, such organization shall declare with specificity, the distribution of their responsibilities with respect to matters governed by the Convention;

(ii) in the event of any later modification of their respective responsibilities, the regional economic integration organization shall inform the depositary of any such proposed modification of their respective responsibilities; the depositary shall in turn inform the Parties of such modification;

d) Member States of a regional economic integration organization which become Parties to this Convention shall be presumed to retain competence over all matters in respect of which transfers of competence to the organization have not been specifically declared or informed to the depositary;

e) “Regional economic integration organization” means an organization constituted by sovereign States, members of the United Nations or of any of its specialized agencies, to which those States have transferred competence in respect of matters governed by this Convention and which has been duly authorized, in accordance with its internal procedures, to become a Party to it.

4 The instrument of accession shall be deposited with the Director-General of Unesco.

Article 28

Upon becoming Parties to this Convention, each Party shall designate a point of contact as referred to in Article 9.

Article 29

1 This Convention shall enter into force three months after the date of deposit of the thirtieth instrument of ratification, acceptance, approval or accession, but only with respect to those States or regional economic integration organizations that have deposited their respective instruments of ratification, acceptance, approval, or accession on or before that date. It shall enter into force with respect to any other Party three months after the deposit of its instrument of ratification, acceptance, approval or accession.

2 For the purposes of this Article, any instrument deposited by a regional economic integration organization shall not be counted as additional to those deposited by Member States of the organization.

Article 30

Recognizing that international agreements are equally binding on Parties regardless of their constitutional systems, the following provisions shall apply to Parties which have a federal or non-unitary constitutional system:

a) with regard to the provisions of this Convention, the implementation of which comes under the legal jurisdiction of the federal or central legislative power, the obligations of the federal or central government shall be the same as for those Parties which are not federal States;

b) with regard to the provisions of the Convention, the implementation of which comes under the jurisdiction of individual constituent units such as States, counties, provinces, or cantons which are not obliged by the constitutional system of the federation to take legislative measures, the federal government shall inform, as necessary, the competent authorities of constituent units such as States, counties, provinces or cantons of the said provisions, with its recommendation for their adoption.

Article 31

1 Any Party to this Convention may denounce this Convention.

2 The denunciation shall be notified by an instrument in writing deposited with the Director-General of Unesco.

3 The denunciation shall take effect 12 months after the receipt of the instrument of denunciation. It shall in no way affect the financial obligations of the Party denouncing the Convention until the date on which the withdrawal takes effect.

Article 32

The Director-General of Unesco, as the depositary of this Convention, shall inform the Member States of the Organization, the States not members of the Organization and regional economic integration organizations referred to in Article 27, as well as the United Nations, of the deposit of all the instruments of ratification, acceptance, approval or accession provided for in Articles 26 and 27, and of the denunciations provided for in Article 31.

Article 33

1 A Party to this Convention may, by written communication addressed to the Director-General, propose amendments to this Convention. The Director-General shall circulate such communication to all Parties. If, within six months from the date of dispatch of the communication, no less than one half of the Parties reply favourably to the request, the Director-General shall present such proposal to the next session of the Conference of Parties for discussion and possible adoption.

2 Amendments shall be adopted by a two-thirds majority of Parties present and voting.

3 Once adopted, amendments to this Convention shall be submitted to the Parties for ratification, acceptance, approval or accession.

4 For Parties which have ratified, accepted, approved or acceded to them, amendments to this Convention shall enter into force three months after the deposit of the instruments referred to in paragraph 3 of this Article by two-thirds of the Parties. Thereafter, for each Party that ratifies, accepts, approves or accedes to an amendment, the said amendment shall enter into force three months after the date of deposit by that Party of its instrument of ratification, acceptance, approval or accession.

5 The procedure set out in paragraphs 3 and 4 shall not apply to amendments to Article 23 concerning the number of Members of the Intergovernmental Committee. These amendments shall enter into force at the time they are adopted.

6 A State or a regional economic integration organization referred to in Article 27 which becomes a Party to this Convention after the entry into force of amendments in conformity with paragraph 4 of this Article shall, failing an expression of different intention, be considered to be:

a) Party to this Convention as so amended; and

b) a Party to the unamended Convention in relation to any Party not bound by the amendments.

This Convention has been drawn up in Arabic, Chinese, English, French, Russian and Spanish, all six texts being equally authoritative.

Article 35

In conformity with Article 102 of the Charter of the United Nations, this Convention shall be registered with the Secretariat of the United Nations at the request of the Director-General of Unesco.

Annex — CONCILIATION PROCEDURE

Article 1

A Conciliation Commission shall be created upon the request of one of the Parties to the dispute. The Commission shall, unless the Parties otherwise agree, be composed of five members, two appointed by each Party concerned and a President chosen jointly by those members.

In disputes between more than two Parties, Parties in the same interest shall appoint their members of the Commission jointly by agreement. Where two or more Parties have separate interests or there is a disagreement as to whether they are of the same interest, they shall appoint their members separately.

If any appointments by the Parties are not made within two months of the date of the request to create a Conciliation Commission, the Director-General of Unesco shall, if asked to do so by the Party that made the request, make those appointments within a further two-month period.

The Conciliation Commission shall take its decisions by majority vote of its members. It shall, unless the Parties to the dispute otherwise agree, determine its own procedure. It shall render a proposal for resolution of the dispute, which the Parties shall consider in good faith.

Artikel 1

Dit verdrag heeft tot doel:

a. de diversiteit van cultuuruitingen te beschermen en te bevorderen;

b. de voorwaarden te scheppen waarin culturen zich kunnen ontplooien en vrij met elkaar in wisselwerking kunnen staan, en elkaar aldus wederzijds kunnen verrijken;

c. de dialoog tussen culturen aan te moedigen om in de wereld intensere en evenwichtiger culturele uitwisselingen te verzekeren, die het intercultureel respect en een vredescultuur ten goede komen;

d. de interculturaliteit te stimuleren om de culturele wisselwerking te ontwikkelen en zodoende bruggen tussen volkeren te slaan;

e. het respect voor de diversiteit van cultuuruitingen te bevorderen, alsook de bewustwording op lokaal, nationaal en internationaal vlak van de waarde van die diversiteit;

f. nogmaals het belang te bevestigen van het verband tussen cultuur en ontwikkeling voor alle landen, in het bijzonder voor de ontwikkelingslanden, en nationale en internationale maatregelen met het oog op de erkenning van de werkelijke waarde van dat verband aan te moedigen;

g. de specifieke aard te erkennen van culturele activiteiten, goederen en diensten als dragers van identiteiten, waarden en betekenissen;

h. nogmaals het soevereine recht van de staten te bevestigen om een beleid en maatregelen te handhaven, goed te keuren en uit te voeren die zij passend achten voor de bescherming en de bevordering van de diversiteit van cultuuruitingen op hun grondgebied;

i. de internationale samenwerking en solidariteit in een geest van partnerschap te versterken teneinde met name de capaciteiten van de ontwikkelingslanden om de diversiteit van cultuuruitingen te beschermen en te bevorderen, te verhogen.

Artikel 3

Dit verdrag is van toepassing op de maatregelen en het beleid van de partijen met betrekking tot de bescherming en de bevordering van de diversiteit van cultuuruitingen.

Artikel 4

In dit verdrag worden de volgende definities gehanteerd:

1 Culturele diversiteit

Onder „culturele diversiteit’’ wordt verstaan: de veelheid aan vormen waardoor de culturen van groepen en samenlevingen tot uiting komen. Deze uitingen worden binnen en tussen de groepen en samenlevingen overgebracht.

Culturele diversiteit komt niet alleen tot uiting in de uiteenlopende vormen waarin het cultureel erfgoed van de mensheid dankzij de diversiteit van cultuuruitingen wordt geopenbaard, verrijkt en overgebracht, maar, ongeacht de gebruikte middelen en technologieën, ook via de verschillende wijzen om cultuuruitingen te scheppen, te produceren, te verspreiden, te distribueren en te genieten.

2 Culturele inhoud

Onder „culturele inhoud’’ wordt verstaan: de symbolische betekenis, de artistieke dimensie en de culturele waarden waaraan culturele identiteiten ten grondslag liggen of die deze tot uiting brengen.

3 Cultuuruitingen

„Cultuuruitingen’’ zijn uitingen die het resultaat zijn van de creativiteit van individuen, groepen en samenlevingen, en die een culturele inhoud hebben.

4 Culturele activiteiten, goederen en diensten

Onder „culturele activiteiten, goederen en diensten’’ wordt verstaan: activiteiten, goederen en diensten die gezien hun specifieke aard, aanwending of doel, vorm geven aan cultuuruitingen of deze overbrengen, ongeacht hun eventuele commerciële waarde. Culturele activiteiten kunnen een doel op zich zijn, maar kunnen ook bijdragen tot de productie van culturele goederen en diensten.

5 Cultuurindustrie

Onder „cultuurindustrie’’ wordt verstaan: de industrie die culturele goederen of diensten zoals omschreven in punt 4 produceert of distribueert.

6 Cultuurbeleid en culturele maatregelen

Onder „cultuurbeleid en culturele maatregelen’’ wordt verstaan: het beleid en de maatregelen op cultuurgebied op lokaal, nationaal, regionaal of internationaal niveau, ongeacht of deze op de eigenlijke cultuur zijn toegespitst, dan wel bedoeld zijn om een rechtstreekse uitwerking te hebben op cultuuruitingen van individuen, groepen of samenlevingen, inclusief op het scheppen, produceren, verspreiden en distribueren van culturele activiteiten, goederen en diensten, alsook op de toegang daartoe.

7 Bescherming

Onder „bescherming’’ wordt verstaan: het nemen van maatregelen met het oog op het behoud, de vrijwaring en de versterking van de diversiteit van cultuuruitingen.

Onder „beschermen’’ wordt verstaan: dergelijke maatregelen nemen.

8 Interculturaliteit

Onder „interculturaliteit’’ wordt verstaan: het bestaan van en de billijke wisselwerking tussen verschillende culturen, alsook de mogelijkheid om via dialoog en wederzijds respect tot gezamenlijke cultuuruitingen te komen.

Artikel 5

1 Overeenkomstig het Handvest van de Verenigde Naties, de internationale rechtsbeginselen en de universeel erkende instrumenten op het gebied van de mensenrechten, bevestigen de partijen hun soevereine recht om hun cultuurbeleid te bepalen en uit te voeren, en om maatregelen te nemen ter bescherming en bevordering van de diversiteit van cultuuruitingen en ter versterking van de internationale samenwerking teneinde de doelstellingen van dit verdrag te verwezenlijken.

2 Wanneer een partij een beleid uitvoert en maatregelen neemt om de diversiteit van cultuuruitingen op haar grondgebied te beschermen en te bevorderen, moeten haar beleid en maatregelen met dit verdrag in overeenstemming zijn.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › IV — RECHTEN EN VERPLICHTINGEN VAN DE PARTIJEN

Artikel 6

1 Elke partij kan in het kader van haar in artikel 4, punt 6, beschreven cultuurbeleid en culturele maatregelen, en rekening houdend met de eigen omstandigheden en behoeften, maatregelen nemen ter bescherming en bevordering van de diversiteit van cultuuruitingen op haar grondgebied.

2 Het kan daarbij gaan om:

a. regelgeving ter bescherming en bevordering van de diversiteit van cultuuruitingen;

b. maatregelen die de nationale culturele activiteiten, goederen en diensten passende kansen bieden om hun plaats te vinden tussen alle activiteiten, goederen en diensten die op haar grondgebied beschikbaar zijn voor hun schepping, productie, verspreiding, distributie en genot, met inbegrip van maatregelen met betrekking tot de taal die voor deze activiteiten, goederen en diensten wordt gebruikt;

c. maatregelen die ertoe strekken de onafhankelijke nationale cultuurindustrie en de activiteiten van de informele sector effectieve toegang te verstrekken tot de middelen om culturele activiteiten, goederen en diensten te produceren, te verspreiden en te distribueren;

d. maatregelen om financiële overheidssteun toe te kennen;

e. maatregelen om non-profitorganisaties, overheids- en privé-instellingen, kunstenaars en andere professionals uit de cultuursector ertoe aan te moedigen de vrije uitwisseling en het vrije verkeer van ideeën en cultuuruitingen, alsook van culturele activiteiten, goederen en diensten te ontwikkelen en te bevorderen, en de creativiteit en de ondernemingsgeest bij hun activiteiten te stimuleren;

f. maatregelen om op passende wijze openbare instellingen op te richten en te ondersteunen;

g. maatregelen om kunstenaars en al wie bij het scheppen van cultuuruitingen is betrokken, aan te moedigen en te steunen;

h. maatregelen ter bevordering van de diversiteit van de media, onder meer via de openbare omroep.

Artikel 7

1 De partijen streven ernaar om op hun grondgebied de omstandigheden te creëren die personen en maatschappelijke groepen ertoe aanzetten:

a. hun eigen cultuuruitingen te scheppen, te verspreiden, te distribueren en er toegang toe te hebben, terdege rekening houdend met de specifieke omstandigheden en behoeften van vrouwen en van diverse groepen in de samenleving, met inbegrip van personen die tot een minderheid behoren en autochtone volkeren;

b. toegang te hebben tot diverse cultuuruitingen uit hun grondgebied en uit andere landen in de wereld.

2 De partijen streven er eveneens naar de belangrijke bijdrage te erkennen van kunstenaars en van al wie bij het scheppingsproces betrokken is, van culturele gemeenschappen en van organisaties die hen in hun werk steunen, alsook hun centrale rol die erin bestaat de diversiteit van cultuuruitingen te bevorderen.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › IV — RECHTEN EN VERPLICHTINGEN VAN DE PARTIJEN

Artikel 8

1 Onverminderd de artikelen 5 en 6 kan een partij vaststellen dat zich speciale situaties voordoen waarin cultuuruitingen op haar grondgebied gevaar lopen te verdwijnen, ernstig bedreigd worden of op de ene of andere manier dringend moeten worden gevrijwaard.

2 De partijen kunnen in de in lid 1 genoemde situaties alle nodige maatregelen nemen om cultuuruitingen in overeenstemming met dit verdrag te beschermen en te behouden.

3 De partijen brengen bij het in artikel 23 bedoelde Intergouvernementeel Comité verslag uit over alle maatregelen die zijn genomen om de situatie te verhelpen, en het Comité kan passende aanbevelingen doen.

Artikel 9

De partijen:

a. verstrekken om de vier jaar in hun verslagen aan de UNESCO passende informatie over de maatregelen ter bescherming en bevordering van de diversiteit van cultuuruitingen die zij op hun grondgebied en op internationaal niveau hebben genomen;

b. wijzen een contactpunt aan dat bevoegd is voor de uitwisseling van informatie met betrekking tot dit verdrag;

c. delen informatie mee en wisselen informatie uit over de bescherming en de bevordering van de diversiteit van cultuuruitingen.

Artikel 10

De partijen:

a. bevorderen en ontwikkelen, onder meer door voorlichtings- en bewustmakingsprogramma’s voor het publiek, het inzicht dat de bescherming en de bevordering van de diversiteit van cultuuruitingen van belang zijn;

b. werken samen met andere partijen en internationale en regionale organisaties om het doel van dit artikel te verwezenlijken;

c. zetten zich ervoor in om creativiteit aan te moedigen en productiecapaciteiten te versterken door op het gebied van de cultuurindustrie voorlichtings-, opleidings- en uitwisselingsprogramma’s in te stellen. Deze maatregelen moeten op zodanige wijze worden toegepast dat zij geen negatieve gevolgen hebben voor traditionele productievormen.

Artikel 11

De partijen erkennen de essentiële rol van het maatschappelijk middenveld in de bescherming en de bevordering van de diversiteit van cultuuruitingen. Zij moedigen het maatschappelijk middenveld ertoe aan actief te participeren in hun inspanningen om de doelstellingen van dit verdrag te verwezenlijken.

Artikel 12

De partijen streven ernaar hun bilaterale, regionale en internationale samenwerking te versterken om gunstige voorwaarden te scheppen voor de bevordering van de diversiteit van cultuuruitingen, in het bijzonder rekening houdend met de in artikelen 8 en 17 vermelde situaties, met name teneinde:

a. de dialoog tussen de partijen over cultuurbeleid te bevorderen;

b. de strategische en beheerscapaciteiten van de overheidssector in de openbare cultuurinstellingen te versterken dankzij professionele en internationale culturele uitwisselingen en het doorgeven van beste praktijken;

c. de partnerschappen met en tussen het maatschappelijk middenveld, niet-gouvernementele organisaties en de privé-sector te versterken om de diversiteit van cultuuruitingen te bevorderen;

d. de aanwending van nieuwe technologieën te bevorderen, partnerschappen aan te moedigen om de informatie-uitwisseling en het begrip van culturen te versterken, en de diversiteit van cultuuruitingen te bevorderen;

e. het sluiten van coproductie- en codistributieovereenkomsten aan te moedigen.

Artikel 13

De partijen streven ernaar cultuur op alle niveaus in hun ontwikkelingsbeleid te integreren om gunstige voorwaarden voor duurzame ontwikkeling te scheppen, en in dat kader aspecten die verband houden met de bescherming en de bevordering van cultuuruitingen te stimuleren.

Artikel 14

De partijen beijveren zich ervoor de samenwerking met het oog op duurzame ontwikkeling en armoedebestrijding te steunen, in het bijzonder wat de specifieke behoeften van de ontwikkelingslanden betreft, teneinde onder meer met de volgende middelen het ontluiken van een dynamische culturele sector te bevorderen:

a. versterking van de cultuurindustrie van de ontwikkelingslanden:

i. door in ontwikkelingslanden culturele productie- en distributiecapaciteit te scheppen en te versterken;

ii. door een betere toegang van hun culturele activiteiten, goederen en diensten tot de wereldmarkt en de internationale distributienetwerken te bevorderen;

iii. door het ontstaan van levensvatbare lokale en regionale markten mogelijk te maken;

iv. door in de ontwikkelde landen, waar mogelijk, passende maatregelen te nemen om de toegang tot hun grondgebied van culturele activiteiten, goederen en diensten uit ontwikkelingslanden te bevorderen;

v. door creatief werk te steunen en, voorzover mogelijk, de mobiliteit van kunstenaars uit ontwikkelingslanden te bevorderen;

vi. door een passende samenwerking tussen ontwikkelde en ontwikkelingslanden aan te moedigen, met name op het gebied van muziek en film;

b. versterking van de capaciteiten door uitwisseling van informatie, ervaring en deskundigheid, alsook door opleiding van het menselijk potentieel in ontwikkelingslanden in de overheids- en de privé-sector, met name inzake strategische en beheerscapaciteiten, het uitwerken en uitvoeren van een beleid, de bevordering en de distributie van cultuuruitingen, de ontwikkeling van middelgrote, kleine en micro-ondernemingen, de aanwending van technologie en de ontwikkeling en overdracht van vaardigheden;

c. overdracht van technologie door de invoering van passende stimuleringsmaatregelen voor de overdracht van technologie en knowhow, in het bijzonder op het gebied van de cultuurindustrie en culturele ondernemingen;

d. financiële steun door:

i. de oprichting van een Internationaal Fonds voor culturele diversiteit, zoals bepaald in artikel 18;

ii. de toekenning van passende officiële ontwikkelingshulp, onder meer van technische bijstand, om creativiteit te stimuleren en te steunen;

iii. andere vormen van financiële hulp zoals laagrentende leningen, subsidies en andere financieringsmechanismen.

Artikel 15

De partijen stimuleren de ontwikkeling van partnerschappen tussen en in de overheidssector, de privé-sector en non-profitorganisaties, die tot doel hebben met ontwikkelingslanden samen te werken aan de versterking van hun capaciteit om de diversiteit van cultuuruitingen te beschermen en te bevorderen. Inspelend op de concrete behoeften van de ontwikkelingslanden zullen deze vernieuwende partnerschappen de nadruk leggen op de verdere ontwikkeling van infrastructuur, menselijk potentieel en beleidsmaatregelen, alsook op de uitwisseling van culturele activiteiten, goederen en diensten.

Artikel 16

De ontwikkelde landen bevorderen de culturele uitwisselingen met de ontwikkelingslanden door hun kunstenaars en andere professionals uit de cultuursector en cultuurbeoefenaars, alsook hun culturele goederen en diensten door middel van een passend institutioneel en juridisch kader een voorkeursbehandeling te geven.

Artikel 17

De partijen werken samen om elkaar, en in het bijzonder de ontwikkelingslanden, in de in artikel 8 bedoelde situaties bijstand te verlenen.

Artikel 18

1 Er wordt een Internationaal Fonds voor culturele diversiteit opgericht, hierna „het fonds” te noemen.

2 Het fonds bestaat uit deposito’s overeenkomstig het financieel reglement van de UNESCO.

3 De middelen van het fonds omvatten:

a. de vrijwillige bijdragen van de partijen;

b. de fondsen die met dit doel door de Algemene Conferentie van de UNESCO zijn toegewezen;

c. de stortingen, giften of legaten van andere staten, organisaties en programma’s van de Verenigde Naties, andere regionale of internationale organisaties, en overheids- of privé-instellingen of privé-personen;

d. verschuldigde rente op de middelen van het fonds;

e. de opbrengst van inzamelingen en ontvangsten van manifestaties die ten gunste van het fonds werden georganiseerd;

f. alle andere middelen die het reglement van het fonds toestaat.

4 Het Intergouvernementeel Comité beslist over de aanwending van de middelen van het fonds op grond van de richtsnoeren van de in artikel 22 bedoelde Conferentie van de partijen.

5 Het Intergouvernementeel Comité kan voor algemene of specifieke doelstellingen in verband met welomschreven projecten bijdragen en andere vormen van steun aanvaarden, op voorwaarde dat die projecten door het Intergouvernementeel Comité zijn goedgekeurd.

6 Aan de bijdragen tot het fonds mogen geen politieke, economische of andere voorwaarden zijn verbonden die onverenigbaar zijn met de doelstellingen van dit verdrag.

7 De partijen streven ernaar op gezette tijden vrijwillige bijdragen te storten voor de uitvoering van dit verdrag.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › IV — RECHTEN EN VERPLICHTINGEN VAN DE PARTIJEN

Artikel 19

1 De partijen komen overeen informatie en deskundigheid met betrekking tot gegevensverzameling en statistieken op het gebied van de diversiteit van cultuuruitingen uit te wisselen, alsook met betrekking tot beste praktijken om deze diversiteit te beschermen en te bevorderen.

2 Door gebruik te maken van de bestaande mechanismen van het secretariaat bevordert de UNESCO het verzamelen, de analyse en de verspreiding van alle informatie, statistieken en beste praktijken op dit gebied.

3 Voorts creëert en actualiseert de UNESCO een gegevensbank over verschillende sectoren en gouvernementele, particuliere en non-profitorganisaties die actief zijn op het gebied van cultuuruitingen.

4 Teneinde het verzamelen van de gegevens te bevorderen, besteedt de UNESCO bijzondere aandacht aan de versterking van de capaciteit en de deskundigheid van de partijen die op dat gebied om bijstand vragen.

5 De in dit artikel beschreven verzameling van informatie vult de in artikel 9 bedoelde informatie aan.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › V — VERHOUDING TOT ANDERE INSTRUMENTEN

Artikel 20

1 De partijen erkennen dat zij hun verplichtingen krachtens dit en alle andere verdragen waarbij zij partij zijn, te goeder trouw moeten nakomen. Zonder dit verdrag aan andere verdragen ondergeschikt te maken,

a. bevorderen zij de wederzijdse ondersteuning van dit en de andere verdragen waarbij zij partij zijn; en

b. houden zij bij de interpretatie en de toepassing van andere verdragen waarbij zij partij zijn of bij het aangaan van andere internationale verplichtingen rekening met de relevante bepalingen van dit verdrag.

2 Niets in dit verdrag mag worden geïnterpreteerd als een wijziging van de rechten en verplichtingen van de partijen krachtens andere verdragen waarbij zij partij zijn.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › V — VERHOUDING TOT ANDERE INSTRUMENTEN

Artikel 21

De partijen verbinden zich ertoe de verwezenlijking van de doelstellingen en beginselen van dit verdrag op andere internationale fora te bevorderen. Daartoe plegen de partijen, indien nodig, overleg, daarbij deze doelstellingen en beginselen in gedachten houdend.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › VI — ORGANEN VAN HET VERDRAG

Artikel 22

1 Er wordt een Conferentie van de partijen ingesteld. Deze Conferentie is het plenaire en hoogste orgaan van dit verdrag.

2 De Conferentie van de partijen komt, voorzover mogelijk, om de twee jaar in gewone zitting bijeenin het kader van de Algemene Conferentie van de UNESCO. Zij kan in buitengewone zitting bijeenkomen wanneer zij daartoe beslist, of wanneer het Intergouvernementeel Comité daartoe van minstens een derde van de partijen een verzoek ontvangt.

3 De Conferentie van de partijen stelt haar reglement van orde vast.

4 De Conferentie van de partijen heeft onder meer de taak:

a. de leden van het Intergouvernementeel Comité te verkiezen;

b. de door het Intergouvernementeel Comité doorgestuurde verslagen van de partijen bij het verdrag in ontvangst te nemen en te bespreken;

c. de operationele richtsnoeren, die het Intergouvernementeel Comité op haar verzoek heeft opgesteld, goed te keuren;

d. alle nodige maatregelen te nemen die zij nodig acht voor de verwezenlijking van de doelstellingen van dit verdrag.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › VI — ORGANEN VAN HET VERDRAG

Artikel 23

1 Bij de UNESCO wordt een Intergouvernementeel Comité voor de bescherming en de bevordering van de diversiteit van cultuuruitingen ingesteld, hierna „het Intergouvernementeel Comité” te noemen. Het comité bestaat uit vertegenwoordigers van 18 staten die partij zijn bij het verdrag. Zij worden, zodra dit verdrag overeenkomstig artikel 29 in werking treedt, voor vier jaar door de Conferentie van de partijen verkozen.

2 Het Intergouvernementeel Comité komt één keer per jaar bijeen.

3 Het Intergouvernementeel Comité staat onder toezicht en volgt de richtsnoeren van de Conferentie van de partijen, en is haar rekenschap verschuldigd.

4 Het aantal leden van het Intergouvernementeel Comité wordt op 24 gebracht zodra er 50 partijen zijn bij het verdrag.

5 De verkiezing van de leden van het Intergouvernementeel Comité is gebaseerd op de beginselen van een billijke geografische spreiding en roulering.

6 Onverminderd de andere bevoegdheden die dit verdrag het Intergouvernementeel Comité verleent, heeft dat Comité de volgende taken:

a. de verwezenlijking van de doelstellingen van dit verdrag bevorderen, en de uitvoering ervan stimuleren en hierop toezicht houden;

b. op verzoek van de Conferentie van de partijen de operationele richtsnoeren voor de uitvoering en de toepassing van de bepalingen van het verdrag opstellen, en haar die ter goedkeuring voorleggen;

c. de verslagen van de partijen bij het verdrag, samen met zijn opmerkingen en een samenvatting van de inhoud ervan, doen toekomen aan de Conferentie van de partijen;

d. passende aanbevelingen doen in situaties die de partijen hem overeenkomstig de relevante bepalingen van het verdrag, en in het bijzonder artikel 8, ter kennis brengen;

e. raadplegingsprocedures en -mechanismen instellen om de verwezenlijking van de doelstellingen en de naleving van de beginselen van dit verdrag in andere internationale fora te bevorderen;

f. alle taken uit te voeren waarom de Conferentie van de partijen verzoekt.

7 Overeenkomstig zijn reglement van orde kan het Intergouvernementeel Comité op elk ogenblik overheidsorganen, privé-organen of natuurlijke personen op zijn vergaderingen uitnodigen om hen over specifieke aangelegenheden te raadplegen.

8 Het Intergouvernementeel Comité stelt zijn reglement van orde vast en legt het ter goedkeuring voor aan de Conferentie van de partijen.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › VI — ORGANEN VAN HET VERDRAG

Artikel 24

1 De organen van het verdrag worden bijgestaan door het secretariaat van de UNESCO.

2 Het secretariaat stelt de documentatie van de Conferentie van de partijen en van het Intergouvernementeel Comité samen, stelt de ontwerp-agenda van hun vergaderingen op, helpt hun beslissingen uit te voeren en brengt er verslag over uit.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › VII — SLOTBEPALINGEN

Artikel 25

1 Wanneer de partijen het oneens zijn over de interpretatie of de toepassing van dit verdrag, proberen zij door overleg een oplossing te vinden.

2 Wanneer de betrokken partijen niet door overleg tot overeenstemming kunnen komen, kunnen zij in onderlinge overeenstemming een beroep doen op de bijstand of bemiddeling van een derde.

3 Wanneer er geen bijstand is verleend of er geen bemiddeling heeft plaatsgevonden, of wanneer het geschil niet kon worden geregeld door overleg, bijstand of bemiddeling, kan één van de partijen een beroep doen op de verzoeningsprocedure in de bijlage bij dit verdrag. De partijen overwegen te goeder trouw het voorstel van de verzoeningscommissie voor de regeling van het geschil.

4 Elke partij kan bij de bekrachtiging, de aanvaarding, de goedkeuring of de toetreding verklaren dat zij de hierboven vermelde verzoeningsprocedure niet erkent. Elke partij die een dergelijke verklaring heeft afgelegd, kan die verklaring te allen tijde intrekken door middel van kennisgeving aan de directeur-generaal van de UNESCO.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › VII — SLOTBEPALINGEN

Artikel 26

1 Dit verdrag is onderworpen aan bekrachtiging, aanvaarding, goedkeuring of toetreding door de lidstaten van de UNESCO, overeenkomstig hun respectieve grondwettelijke procedures.

2 De akten van bekrachtiging, aanvaarding, goedkeuring of toetreding worden bij de directeur-generaal van de UNESCO nedergelegd.

Artikel 27

1 Tot dit verdrag kunnen staten toetreden die geen lid zijn van de UNESCO, maar wel van de Verenigde Naties of van één van haar gespecialiseerde instellingen, en die door de Algemene Conferentie van de UNESCO tot toetreding worden uitgenodigd.

2 Tot dit verdrag kunnen eveneens gebieden toetreden die een door de Verenigde Naties als dusdanig erkende volledige interne autonomie genieten, maar niet volledig onafhankelijk zijn overeenkomstig Resolutie 1514 (XV) van de Algemene Vergadering, en die bevoegd zijn voor de aangelegenheden die in dit verdrag worden geregeld, alsook om over deze aangelegenheden verdragen te sluiten.

3 De volgende bepalingen zijn van toepassing op de organisaties voor regionale economische integratie:

a. tot dit verdrag kan eveneens elke organisatie voor regionale economische integratie toetreden die, onder voorbehoud van het onderstaande, net als de staten die er partij bij zijn volledig gebonden is door dit verdrag;

b. wanneer één of meer lidstaten van een dergelijke organisatie ook partij zijn bij het verdrag, stellen die organisatie of die lidstaat/lidstaten hun verantwoordelijkheid bij het nakomen van hun verplichtingen krachtens dit verdrag vast. Deze verdeling van de verantwoordelijkheid wordt van kracht wanneer de onder c) beschreven kennisgevingsprocedure is voltooid. De organisatie en de lidstaten zijn niet gemachtigd om de uit dit verdrag voortvloeiende rechten tegelijkertijd uit te oefenen. Voorts beschikken de organisaties voor regionale economische integratie op hun bevoegdheidsgebieden voor de uitoefening van hun stemrecht over evenveel stemmen als er lidstaten van hun organisatie partij zijn bij dit verdrag. Deze organisaties maken geen gebruik van hun stemrecht wanneer hun lidstaten dat wel doen, en omgekeerd;

c. een organisatie voor regionale economische integratie en haar lidstaat of lidstaten die overeenkomstig punt b) een verdeling van de verantwoordelijkheid zijn overeengekomen, lichten de partijen op de volgende wijze over deze verdeling van de verantwoordelijkheid in:

i. in haar akte van toetreding vermeldt deze organisatie precies hoe de verantwoordelijkheden met betrekking tot de aangelegenheden die in het verdrag worden geregeld, zijn verdeeld;

ii. wanneer de respectieve verantwoordelijkheden nadien worden gewijzigd, licht de organisatie voor regionale economische integratie de depositaris in over elk voorstel om deze verantwoordelijkheden te wijzigen; de depositaris licht op zijn beurt de partijen over deze wijziging in;

d. de lidstaten van een organisatie voor regionale economische integratie die partij worden bij het verdrag, worden geacht bevoegd te blijven voor alle gebieden waarvoor er geen uitdrukkelijk aan de depositaris gemelde of gesignaleerde bevoegdheidsoverdracht aan de organisatie heeft plaatsgevonden;

e. onder „organisatie voor regionale economische integratie’’ wordt een organisatie verstaan die bestaat uit soevereine staten die lid zijn van de Verenigde Naties of van één van haar gespecialiseerde instellingen, waaraan deze staten hun bevoegdheid op gebieden die onder dit verdrag vallen hebben overgedragen, en waaraan volgens haar interne procedures toestemming is verleend om partij te worden bij dit verdrag.

4 De akte van toetreding wordt bij de directeur-generaal van de UNESCO nedergelegd.

Artikel 28

Elke partij die lid wordt bij dit verdrag wijst een contactpunt aan als bedoeld in artikel 9.

Artikel 29

1 Dit verdrag treedt in werking drie maanden na de datum waarop de dertigste akte van bekrachtiging, aanvaarding, goedkeuring of toetreding is nedergelegd, maar uitsluitend ten aanzien van de staten en organisaties voor regionale economische integratie die hun respectieve akte van bekrachtiging, aanvaarding, goedkeuring of toetreding op die datum of eerder hebben nedergelegd. Voor alle andere partijen treedt het verdrag in werking drie maanden na de nederlegging van hun akte van bekrachtiging, aanvaarding, goedkeuring of toetreding.

2 Voor de toepassing van dit artikel wordt een akte die door een organisatie voor regionale economische integratie wordt nedergelegd niet beschouwd als een bijkomende akte naast de akten die haar lidstaten reeds hebben nedergelegd.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › VII — SLOTBEPALINGEN

Artikel 30

Erkennende dat de internationale overeenkomsten de partijen, ongeacht hun grondwettelijke stelsels, verbinden, gelden de onderstaande bepalingen voor de partijen met een federaal of niet-unitair grondwettelijk stelsel:

a. wat de bepalingen van dit verdrag betreft, waarvan de toepassing tot de bevoegdheid van de federale of centrale wetgevende macht behoort, heeft de federale of centrale regering dezelfde verplichtingen als de partijen die geen federale staat zijn;

b. wat de bepalingen van dit verdrag betreft, waarvan de toepassing tot de bevoegdheid behoort van elk van de samenstellende delen zoals staten, districten, provincies of kantons, die krachtens het grondwettelijk stelsel van de federatie niet gehouden zijn wetgevingsmaatregelen te nemen, brengt de federale overheid deze bepalingen, indien nodig, ter kennis van de bevoegde autoriteiten van de samenstellende delen zoals staten, districten, provincies of kantons, samen met haar aanbeveling voor goedkeuring.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › VII — SLOTBEPALINGEN

Artikel 31

1 Elk van de partijen kan dit verdrag opzeggen.

2 Kennisgeving van de opzegging gebeurt door nederlegging van een schriftelijk instrument bij de directeur-generaal van de UNESCO.

3 De opzegging wordt van kracht twaalf maanden na ontvangst van de akte van opzegging. Zij wijzigt geenszins de financiële verplichtingen, die de opzeggende partij dient na te komen tot de datum waarop de opzegging van kracht wordt.

Artikel 32

In zijn hoedanigheid van depositaris van dit verdrag licht de directeur-generaal van de UNESCO de lidstaten van de organisatie, de in artikel 27 bedoelde niet-lidstaten en organisaties voor regionale economische integratie, alsook de Verenigde Naties, in over de nederlegging van alle in artikelen 26 en 27 bedoelde akten van bekrachtiging, aanvaarding, goedkeuring of toetreding, en over de in artikel 31 bedoelde opzeggingen.

Verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen › VII — SLOTBEPALINGEN

Artikel 33

1 Elke partij kan bij schriftelijke mededeling aan de directeur-generaal amendementen op dit verdrag voorstellen. De directeur-generaal doet deze mededeling aan alle partijen toekomen. Indien, binnen zes maanden na de datum waarop de mededeling is toegestuurd, minstens de helft van de partijen een gunstig antwoord heeft gegeven, presenteert de directeur-generaal dit voorstel ter bespreking en eventuele aanneming op de volgende zitting van de Conferentie van de partijen.

2 De amendementen worden aangenomen met een tweederde meerderheid van de aanwezige stemgerechtigde partijen.

3 Wanneer de amendementen op dit verdrag zijn aangenomen, worden zij ter aanvaarding, instemming, goedkeuring of toetreding aan de partijen voorgelegd.

4 Voor de partijen die de amendementen op dit verdrag hebben bekrachtigd, ze hebben aanvaard, ze hebben goedgekeurd of ertoe zijn toegetreden, treden deze amendementen in werking drie maanden na de nederlegging van de in lid 3 van dit artikel bedoelde akten door twee derden van de partijen. Vervolgens treedt dat amendement voor elke partij die het bekrachtigt, aanvaardt, goedkeurt of ertoe toetreedt in werking drie maanden na de nederlegging door de partij van haar akte van bekrachtiging, aanvaarding, goedkeuring of toetreding.

5 De in de leden 3 en 4 vastgestelde procedure is niet van toepassing op de amendementen op artikel 23 betreffende het aantal leden van het Intergouvernementeel Comité.

Deze amendementen treden in werking op het ogenblik van hun aanneming.

6 Een in artikel 27 bedoelde staat of organisatie voor regionale economische integratie die partij wordt bij dit verdrag na de inwerkingtreding van amendementen conform lid 4 van dit artikel, wordt, indien geen blijk werd gegeven van een andere intentie, geacht:

a. partij te zijn bij het aldus geamendeerde verdrag; en

b. partij te zijn bij het niet geamendeerde verdrag ten aanzien van alle partijen die niet door deze amendementen gebonden zijn.

Artikel 34

Dit verdrag is opgesteld in het Arabisch, het Chinees, het Engels, het Frans, het Russisch en het Spaans. De zes teksten zijn gelijkelijk authentiek.

Artikel 35

Overeenkomstig artikel 102 van het Handvest van de Verenigde Naties wordt dit verdrag op verzoek van de directeur-generaal van de UNESCO geregistreerd bij het secretariaat van de Verenigde Naties.

Bijlage — Verzoeningsprocedure

Artikel 1

Op verzoek van één van de partijen bij het geschil wordt een verzoeningscommissie opgericht. Tenzij de partijen er anders over beslissen, is de commissie samengesteld uit vijf leden: elke betrokken partij wijst twee leden aan, en de voorzitter wordt door de aldus aangewezen leden in onderlinge overeenstemming gekozen.

Bijlage — Verzoeningsprocedure

Artikel 2

Bij een geschil tussen meer dan twee partijen wijzen de partijen met dezelfde belangen hun leden van de commissie in onderlinge overeenstemming aan. Wanneer minstens twee partijen onafhankelijke belangen hebben of het er niet over eens zijn of zij dezelfde belangen hebben, wijzen zij hun leden afzonderlijk aan.

Bijlage — Verzoeningsprocedure

Artikel 3

Wanneer de partijen twee maanden na het verzoek tot oprichting van een verzoeningscommissie niet alle leden hebben aangewezen, wijst de directeur-generaal van de UNESCO op vraag van de partij die het verzoek heeft ingediend binnen een nieuwe termijn van twee maanden alle leden van de commissie aan die niet door de partijen zijn aangewezen.

Bijlage — Verzoeningsprocedure

Artikel 4

Wanneer de leden van de commissie binnen een termijn van twee maanden na de aanwijzing van het laatste lid van de commissie geen voorzitter hebben gekozen, wijst de directeur-generaal van de UNESCO op verzoek van een partij binnen een nieuwe termijn van twee maanden de voorzitter aan.

Bijlage — Verzoeningsprocedure

Artikel 5

De verzoeningscommissie neemt haar beslissingen met de meerderheid van de stemmen van haar leden. Tenzij de partijen bij het geschil daar anders over beschikken, stelt zij haar eigen procedure vast. Zij doet een voorstel voor een oplossing van het geschil, dat de partijen te goeder trouw overwegen.

Bijlage — Verzoeningsprocedure

Artikel 6

Bij onenigheid over de bevoegdheid van de verzoeningscommissie, beslist deze laatste of zij al dan niet bevoegd is.

„Wat de communautaire bevoegdheden betreft die zijn beschreven in de verklaring overeenkomstig artikel 27, lid 3, onder c), van het verdrag, is de Gemeenschap door het verdrag gebonden en zal zij zorgen voor de correcte toepassing ervan. De lidstaten van de Gemeenschap die partij zijn bij dit verdrag passen in hun wederzijdse betrekkingen de regels van het verdrag bijgevolg toe overeenkomstig de interne regels van de Gemeenschap, onverminderd passende wijzigingen die daarin worden aangebracht.”
