The Royal Netherlands Embassy presents its compliments to the Department of Foreign Affairs of Fiji and has the honour to refer to the letter of 20 October 1971 of the Prime Minister and Minister of Foreign Affairs of Fiji to the Minister of Foreign Affairs of the Kingdom of the Netherlands No. 1173/15/1, which reads as follows.

The Embassy has the honour to inform the Department that the Government of the Kingdom of the Netherlands accepts the proposal of the Government of Fiji that the Treaty between the Netherlands and Great Britain concerning the mutual assistance in the conduct of proceedings in civil and commercial matters, signed at London on 31 May 1932, shall be binding between their countries, it being understood that with respect of Fiji the Convention shall be modified by substituting the words “Chief Registrar of the Supreme Court” for “Senior Master of the Supreme Court of Judicature”, wherever the latter appear in the text.

The Embassy has the honour further to inform the Department that the Government of the Kingdom of the Netherlands is prepared to conclude an agreement to that effect with the Government of Fiji.

The Netherlands Government however proposes that this Agreement, which shall be constituted by the Letter from the Prime Minister and Minister for Foreign Affairs of Fiji of 20 October 1971 No. 1173/15/1, this Note and the Ministry's Note in reply concurring therein, shall be applied in such a way that requests by the competent judicial authority in one country to the competent judicial authority in the other country for service of judicial and extrajudicial documents or for the taking of evidence may either be addressed and sent in accordance with the regime provided for in and under the Treaty of 1932 or be communicated directly between these judicial authorities.

The Netherlands Government further proposes that this agreement shall enter into force on the date on which the Government of the Kingdom of the Netherlands has notified the Government of Fiji in writing that the procedures constitutionally required in the Kingdom of the Netherlands in respect of this agreement have been complied with.

The Royal Netherlands Embassy avails itself of this opportunity to renew to the Department of Foreign Affairs of Fiji the assurances of its highest consideration.
