Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article I

For the purpose of the present Convention, unless the context otherwise requires:

(a) “Species” means any species, subspecies, or geographically separate population thereof;

(b) “Specimen” means:

(i) any animal or plant, whether alive or dead;

(ii) in the case of an animal: for species included in Appendices I and II, any readily recognizable part or derivative thereof; and for species included in Appendix III, any readily recognizable part or derivative thereof specified in Appendix III in relation to the species; and

(iii) in the case of a plant: for species included in Appendix I, any readily recognizable part or derivative thereof; and for species included in Appendices II and III, any readily recognizable part or derivative thereof specified in Appendices II and III in relation to the species;

(c) “Trade” means export, re-export, import and introduction from the sea;

(d) “Re-export” means export of any specimen that has previously been imported;

(e) “Introduction from the sea” means transportation into a State of specimens of any species which were taken in the marine environment not under the jurisdiction of any State;

(f) “Scientific Authority” means a national scientific authority designated in accordance with Article IX;

(g) “Management Authority” means a national management authority designated in accordance with Article IX;

(h) “Party” means a State for which the present Convention has entered into force.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article II

1 Appendix I shall include all species threatened with extinction which are or may be affected by trade. Trade in specimens of these species must be subject to particularly strict regulation in order not to endanger further their survival and must only be authorized in exceptional circumstances.

2 Appendix II shall include:

(a) all species which although not necessarily now threatened with extinction may become so unless trade in specimens of such species is subject to strict regulation in order to avoid utilization incompatible with their survival; and

(b) other species which must be subject to regulation in order that trade in specimens of certain species referred to in sub-paragraph (a) of this paragraph may be brought under effective control.

3 Appendix III shall include all species which any Party identifies as being subject to regulation within its jurisdiction for the purpose of preventing or restricting exploitation, and as needing the cooperation of other parties in the control of trade.

4 The Parties shall not allow trade in specimens of species included in Appendices I, II and III except in accordance with the provisions of the present Convention.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article III

1 All trade in specimens of species included in Appendix I shall be in accordance with the provisions of this Article.

2 The export of any specimen of a species included in Appendix I shall require the prior grant and presentation of an export permit. An export permit shall only be granted when the following conditions have been met:

(a) a Scientific Authority of the State of export has advised that such export will not be detrimental to the survival of that species;

(b) a Management Authority of the State of export is satisfied that the specimen was not obtained in contravention of the laws of that State for the protection of fauna and flora;

(c) a Management Authority of the State of export is satisfied that any living specimen will be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment; and

(d) a Management Authority of the State of export is satisfied that an import permit has been granted for the specimen.

3 The import of any specimen of a species included in Appendix I shall require the prior grant and presentation of an import permit and either an export permit or a re-export certificate. An import permit shall only be granted when the following conditions have been met:

(a) a Scientific Authority of the State of import has advised that the import will be for purposes which are not detrimental to the survival of the species involved;

(b) a Scientific Authority of the State of import is satisfied that the proposed recipient of a living specimen is suitably equipped to house and care for it; and

(c) a Management Authority of the State of import is satisfied that the specimen is not to be used for primarily commercial purposes.

4 The re-export of any specimen of a species included in Appendix I shall require the prior grant and presentation of a re-export certificate. A re-export certificate shall only be granted when the following conditions have been met:

(a) a Management Authority of the State of re-export is satisfied that the specimen was imported into that State in accordance with the provisions of the present Convention;

(b) a Management Authority of the State of re-export is satisfied that any living specimen will be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment; and

(c) a Management Authority of the State of re-export is satisfied that an import permit has been granted for any living specimen.

5 The introduction from the sea of any specimen of a species included in Appendix I shall require the prior grant of a certificate from a Management Authority of the State of introduction. A certificate shall only be granted when the following conditions have been met:

(a) a Scientific Authority of the State of introduction advises that the introduction will not be detrimental to the survival of the species involved;

(b) a Management Authority of the State of introduction is satisfied that the proposed recipient of a living specimen is suitably equipped to house and care for it; and

(c) a Management Authority of the State of introduction is satisfied that the specimen is not to be used for primarily commercial purposes.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article IV

1 All trade in specimens of species included in Appendix II shall be in accordance with the provisions of this Article.

2 The export of any specimen of a species included in Appendix II shall require the prior grant and presentation of an export permit. An export permit shall only be granted when the following conditions have been met:

(a) a Scientific Authority of the State of export has advised that such export will not be detrimental to the survival of that species;

(b) a Management Authority of the State of export is satisfied that the specimen was not obtained in contravention of the laws of that State for the protection of fauna and flora; and

(c) a Management Authority of the State of export is satisfied that any living specimen will be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment.

3 A Scientific Authority in each Party shall monitor both the export permits granted by that State for specimens of species included in Appendix II and the actual exports of such specimens. Whenever a Scientific Authority determines that the export of specimens of any such species should be limited in order to maintain that species throughout its range at a level consistent with its role in the ecosystems in which it occurs and well above the level at which that species might become eligible for inclusion in Appendix I, the Scientific Authority shall advise the appropriate Management Authority of suitable measures to be taken to limit the grant of export permits for specimens of that species.

4 The import of any specimen of a species included in Appendix II shall require the prior presentation of either an export permit or a re-export certificate.

5 The re-export of any specimen of a species included in Appendix II shall require the prior grant and presentation of a re-export certificate. A re-export certificate shall only be granted when the following conditions have been met:

(a) a Management Authority of the State of re-export is satisfied that the specimen was imported into that State in accordance with the provisions of the present Convention; and

(b) a Management Authority of the State of re-export is satisfied that any living specimen will be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment.

6 The introduction from the sea of any specimen of a species included in Appendix II shall require the prior grant of a certificate from a Management Authority of the State of introduction. A certificate shall only be granted when the following conditions have been met:

(a) a Scientific Authority of the State of introduction advises that the introduction will not be detrimental to the survival of the species involved; and

(b) a Management Authority of the State of introduction is satisfied that any living specimen will be so handled as to minimize the risk of injury, damage to health or cruel treatment.

7 Certificates referred to in paragraph 6 of this Article may be granted on the advice of a Scientific Authority, in consultation with other national scientific authorities or, when appropriate, international scientific authorities, in respect of periods not exceeding one year for total numbers of specimens to be introduced in such periods.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article V

1 All trade in specimens of species included in Appendix III shall be in accordance with the provisions of this Article.

2 The export of any specimen of a species included in Appendix III from any State which has included that species in Appendix III shall require the prior grant and presentation of an export permit. An export permit shall only be granted when the following conditions have been met:

(a) a Management Authority of the State of export is satisfied that the specimen was not obtained in contravention of the laws of that State for the protection of fauna and flora; and

(b) a Management Authority of the State of export is satisfied that any living specimen will be so prepared and shipped as to minimize the risk of injury, damage to health or cruel treatment.

3 The import of any specimen of a species included in Appendix III shall require, except in circumstances to which paragraph 4 of this Article applies, the prior presentation of a certificate of origin and, where the import is from a State which has included that species in Appendix III, an export permit.

4 In the case of re-export, a certificate granted by the Management Authority of the State of re-export that the specimen was processed in that State or is being re-exported shall be accepted by the State of import as evidence that the provisions of the present Convention have been complied with in respect of the specimen concerned.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article VI

1 Permits and certificates granted under the provisions of Articles III, IV, and V shall be in accordance with the provisions of this Article.

2 An export permit shall contain the information specified in the model set forth in Appendix IV, and may only be used for export within a period of six months from the date on which it was granted.

3 Each permit or certificate shall contain the title of the present Convention, the name and any identifying stamp of the Management Authority granting it and a control number assigned by the Management Authority.

4 Any copies of a permit or certificate issued by a Management Authority shall be clearly marked as copies only and no such copy may be used in place of the original, except to the extent endorsed thereon.

5 A separate permit or certificate shall be required for each consignment of specimens.

6 A Management Authority of the State of import of any specimen shall cancel and retain the export permit or re-export certificate and any corresponding import permit presented in respect of the import of that specimen.

7 Where appropriate and feasible a Management Authority may affix a mark upon any specimen to assist in identifying the specimen. For these purposes “mark” means any indelible imprint, lead seal or other suitable means of identifying a specimen, designed in such a way as to render its imitation by unauthorized persons as difficult as possible.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article VII

1 The provisions of Articles III, IV and V shall not apply to the transit or trans-shipment of specimens through or in the territory of a Party while the specimens remain in Customs control.

2 Where a Management Authority of the State of export or reexport is satisfied that a specimen was acquired before the provisions of the present Convention applied to that specimen, the provisions of Articles III, IV and V shall not apply to that specimen where the Management Authority issues a certificate to that effect.

3 The provisions of Articles III, IV and V shall not apply to specimens that are personal or household effects. This exemption shall not apply where:

(a) in the case of specimens of a species included in Appendix I, they were acquired by the owner outside his State of usual residence, and are being imported into that State; or

(b) in the case of specimens of species included in Appendix II:

(i) they were acquired by the owner outside his State of usual residence and in a State where removal from the wild occurred;

(ii) they are being imported into the owner's State of usual residence; and

(iii) the State where removal from the wild occurred requires the prior grant of export permits before any export of such specimens;

unless a Management Authority is satisfied that the specimens were acquired before the provisions of the present Convention applied to such specimens.

4 Specimens of an animal species included in Appendix I bred in captivity for commercial purposes, or of a plant species included in Appendix I artificially propagated for commercial purposes, shall be deemed to be specimens of species included in Appendix II.

5 Where a Management Authority of the State of export is satisfied that any specimen of an animal species was bred in captivity or any specimen of a plant species was artificially propagated, or is a part of such an animal or plant or was derived therefrom, a certificate by that Management Authority to that effect shall be accepted in lieu of any of the permits or certificates required under the provisions of Articles III, IV or V.

6 The provisions of Articles III, IV and V shall not apply to the non-commercial loan, donation or exchange between scientists or scientific institutions registered by a Management Authority of their State, of herbarium specimens, other preserved, dried or embedded museum specimens, and live plant material which carry a label issued or approved by a Management Authority.

7 A Management Authority of any State may waive the requirements of Articles III, IV and V and allow the movement without permits or certificates of specimens which form part of a travelling zoo, circus, menagerie, plant exhibition or other travelling exhibition provided that:

(a) the exporter or importer registers full details of such specimens with that Management Authority;

(b) the specimens are in either of the categories specified in paragraphs 2 or 5 of this Article; and

(c) the Management Authority is satisfied that any living specimen will be so transported and cared for as to minimize the risk of injury, damage to health or cruel treatment.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article VIII

1 The Parties shall take appropriate measures to enforce the provisions of the present Convention and to prohibit trade in specimens in violation thereof. These shall include measures:

(a) to penalize trade in, or possession of, such specimens, or both; and

(b) to provide for the confiscation or return to the State of export of such specimens.

2 In addition to the measures taken under paragraph 1 of this Article, a Party may, when it deems it necessary, provide for any method of internal reimbursement for expenses incurred as a result of the confiscation of a specimen traded in violation of the measures taken in the application of the provisions of the present Convention.

3 As far as possible, the Parties shall ensure that specimens shall pass through any formalities required for trade with a minimum of delay. To facilitate such passage, a Party may designate ports of exit and ports of entry at which specimens must be presented for clearance. The Parties shall ensure further that all living specimens, during any period of transit, holding or shipment, are properly cared for so as to minimize the risk of injury, damage to health or cruel treatment.

4 Where a living specimen is confiscated as a result of measures referred to in paragraph 1 of this Article:

(a) the specimen shall be entrusted to a Management Authority of the State of confiscation;

(b) the Management Authority shall, after consultation with the State of export, return the specimen to that State at the expense of that State, or to a rescue centre or such other place as the Management Authority deems appropriate and consistent with the purposes of the present Convention; and

(c) the Management Authority may obtain the advice of a Scientific Authority or may, whenever it considers it desirable, consult the Secretariat in order to facilitate the decision under subparagraph (b) of this paragraph, including the choice of a rescue centre or other place.

5 A rescue centre as referred to in paragraph 4 of this Article means an institution designated by a Management Authority to look after the welfare of living specimens, particularly those that have been confiscated.

6 Each Party shall maintain records of trade in specimens of species included in Appendices I, II and III which shall cover:

(a) the names and addresses of exporters and importers; and

(b) the number and type of permits and certificates granted; the States with which such trade occurred; the numbers or quantities and types of specimens, names of species as included in Appendices I, II and III and, where applicable, the size and sex of the specimens in question.

7 Each Party shall prepare periodic reports on its implementation of the present Convention and shall transmit to the Secretariat:

(a) an annual report containing a summary of the information specified in sub-paragraph (b) of paragraph 6 of this Article; and

(b) a biennial report on legislative, regulatory and administrative measures taken to enforce the provisions of the present Convention.

8 The information referred to in paragraph 7 of this Article shall be available to the public where this is not inconsistent with the law of the Party concerned.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article IX

1 Each Party shall designate for the purposes of the present Convention:

(a) one or more Management Authorities competent to grant permits or certificates on behalf of that Party; and

(b) one or more Scientific Authorities.

2 A State depositing an instrument of ratification, acceptance, approval or accession shall at that time inform the Depositary Government of the name and address of the Management Authority authorized to communicate with other Parties and with the Secretariat.

3 Any changes in the designations or authorizations under the provisions of this Article shall be communicated by the Party concerned to the Secretariat for transmission to all other Parties.

4 Any Management Authority referred to in paragraph 2 of this Article shall if so requested by the Secretariat or the Management Authority of another Party, communicate to it impression of stamps, seals or other devices used to authenticate permits or certificates.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article X

Where export or re-export is to, or import is from, a State not a party to the present Convention, comparable documentation issued by the competent authorities in that State which substantially conforms with the requirements of the present Convention for permits and certificates may be accepted in lieu thereof by any Party.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XI

1 The Secretariat shall call a meeting of the Conference of the Parties not later than two years after the entry into force of the present Convention.

2 Thereafter the Secretariat shall convene regular meetings at least once every two years, unless the Conference decides otherwise, and extraordinary meetings at any time on the written request of at least one-third of the Parties.

3 At meetings, whether regular or extraordinary, the Parties shall review the implementation of the present Convention and may:

(a) make such provision as may be necessary to enable the Secretariat to carry out its duties and adopt financial provisions;

(b) consider and adopt amendments to Appendices I and II in accordance with Article XV;

(c) review the progress made towards the restoration and conservation of the species included in Appendices I, II and III;

(d) receive and consider any reports presented by the Secretariat or by any Party; and

(e) where appropriate, make recommendations for improving the effectiveness of the present Convention.

4 At each regular meeting, the Parties may determine the time and venue of the next regular meeting to be held in accordance with the provisions of paragraph 2 of this Article.

5 At any meeting, the Parties may determine and adopt rules of procedure for the meeting.

6 The United Nations, its Specialized Agencies and the International Atomic Energy Agency, as well as any State not a Party to the present Convention, may be represented at meetings of the Conference by observers, who shall have the right to participate but not to vote.

7 Any body or agency technically qualified in protection, conservation or management of wild fauna and flora, in the following categories, which has informed the Secretariat of its desire to be represented at meetings of the Conference by observers, shall be admitted unless at least one-third of the Parties present object:

(a) international agencies or bodies, either governmental or non-governmental, and national governmental agencies and bodies; and

(b) national non-governmental agencies or bodies which have been approved for this purpose by the State in which they are located.

Once admitted, these observers shall have the right to participate but not to vote.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XII

1 Upon entry into force of the present Convention, a Secretariat shall be provided by the Executive Director of the United Nations Environment Programme. To the extent and in the manner he considers appropriate, he may be assisted by suitable inter-governmental or non-governmental international or national agencies and bodies technically qualified in protection, conservation and management of wild fauna and flora.

2 The functions of the Secretariat shall be:

(a) to arrange for and service meetings of the Parties;

(b) to perform the functions entrusted to it under the provisions of Articles XV and XVI of the present Convention;

(c) to undertake scientific and technical studies in accordance with programmes authorized by the Conference of the Parties as will contribute to the implementation of the present Convention, including studies concerning standards for appropriate preparation and shipment of living specimens and the means of identifying specimens;

(d) to study the reports of Parties and to request from Parties such further information with respect thereto as it deems necessary to ensure implementation of the present Convention;

(e) to invite the attention of the Parties to any matter pertaining to the aims of the present Convention;

(f) to publish periodically and distribute to the Parties current editions of Appendices I, II and III together with any information which will facilitate identification of specimens of species included in those Appendices;

(g) to prepare annual reports to the Parties on its work and on the implementation of the present Convention and such other reports as meetings of the Parties may request;

(h) to make recommendations for the implementation of the aims and provisions of the present Convention, including the exchange of information of a scientific or technical nature;

(i) to perform any other function as may be entrusted to it by the Parties.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XIII

1 When the Secretariat in the light of information received is satisfied that any species included in Appendices I or II is being affected adversely by trade in specimens of that species or that the provisions of the present Convention are not being effectively implemented, it shall communicate such information to the authorized Management Authority of the Party or Parties concerned.

2 When any Party receives a communication as indicated in paragraph 1 of this Article, it shall, as soon as possible, inform the Secretariat of any relevant facts insofar as its laws permit and, where appropriate, propose remedial action. Where the Party considers that an inquiry is desirable, such inquiry may be carried out by one or more persons expressly authorized by the Party.

3 The information provided by the Party or resulting from any inquiry as specified in paragraph 2 of this Article shall be reviewed by the next Conference of the Parties which may make whatever recommendations it deems appropriate.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XIV

1 The provisions of the present Convention shall in no way affect the right of Parties to adopt:

(a) stricter domestic measures regarding the conditions for trade, taking, possession or transport of specimens of species included in Appendices I, II and III, or the complete prohibition thereof; or

(b) domestic measures restricting or prohibiting trade, taking, possession, or transport of species not included in Appendices I, II or III.

2 The provisions of the present Convention shall in no way affect the provisions of any domestic measures or the obligations of Parties deriving from any treaty, convention, or international agreement relating to other aspects of trade, taking, possession, or transport of specimens which is in force or subsequently may enter into force for any Party including any measure pertaining to the Customs, public health, veterinary or plant quarantine fields.

3 The provisions of the present Convention shall in no way affect the provisions of, or the obligations deriving from, any treaty, convention or international agreement concluded or which may be concluded between States creating a union or regional trade agreement establishing or maintaining a common external customs control and removing customs control between the parties thereto insofar as they relate to trade among the States members of that union or agreement.

4 A State party to the present Convention, which is also a party to any other treaty, convention or international agreement which is in force at the time of the coming into force of the present Convention and under the provisions of which protection is afforded to marine species included in Appendix II, shall be relieved of the obligations imposed on it under the provisions of the present Convention with respect to trade in specimens of species included in Appendix II that are taken by ships registered in that State and in accordance with the provisions of such other treaty, convention or international agreement.

5 Notwithstanding the provisions of Articles III, IV and V, any export of a specimen taken in accordance with paragraph 4 of this Article shall only require a certificate from a Management Authority of the State of introduction to the effect that the specimen was taken in accordance with the provisions of the other treaty, convention or international agreement in question.

6 Nothing in the present Convention shall prejudice the codification and development of the law of the sea by the United Nations Conference on the Law of the Sea convened pursuant to Resolution 2750 C (XXV) of the General Assembly of the United Nations nor the present or future claims and legal views of any State concerning the law of the sea and the nature and extent of coastal and flag State jurisdiction.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XV

1 The following provisions shall apply in relation to amendments to Appendices I and II at meetings of the Conference of the Parties:

(a) Any Party may propose an amendment to Appendix I or II for consideration at the next meeting. The text of the proposed amendment shall be communicated to the Secretariat at least 150 days before the meeting. The Secretariat shall consult the other Parties and interested bodies on the amendment in accordance with the provisions of sub-paragraphs (b) and (c) of paragraph 2 of this Article and shall communicate the response to all Parties not later than 30 days before the meeting.

(b) Amendments shall be adopted by a two-thirds majority of Parties present and voting. For these purposes “Parties present and voting” means Parties present and casting an affirmative or negative vote. Parties abstaining from voting shall not be counted among the two-thirds required for adopting an amendment.

(c) Amendments adopted at a meeting shall enter into force 90 days after that meeting for all Parties except those which make a reservation in accordance with paragraph 3 of this Article.

2 The following provisions shall apply in relation to amendments to Appendices I and II between meetings of the Conference of the Parties:

(a) Any Party may propose an amendment to Appendix I or II for consideration between meetings by the postal procedures set forth in this paragraph.

(b) For marine species, the Secretariat shall, upon receiving the text of the proposed amendment, immediately communicate it to the Parties. It shall also consult inter-governmental bodies having a function in relation to those species especially with a view to obtaining scientific data these bodies may be able to provide and to ensuring coordination with any conservation measures enforced by such bodies. The Secretariat shall communicate the views expressed and data provided by these bodies and its own findings and recommendations to the Parties as soon as possible.

(c) For species other than marine species, the Secretariat shall, upon receiving the text of the proposed amendment, immediately communicate it to the Parties, and, as soon as possible thereafter, its own recommendations.

(d) Any Party may, within 60 days of the date on which the Secretariat communicated its recommendations to the Parties under sub-paragraphs (b) or (c) of this paragraph, transmit to the Secretariat any comments on the proposed amendment together with any relevant scientific data and information.

(e) The Secretariat shall communicate the replies received together with its own recommendations to the Parties as soon as possible.

(f) If no objection to the proposed amendment is received by the Secretariat within 30 days of the date the replies and recommendations were communicated under the provisions of sub-paragraph (e) of this paragraph, the amendment shall enter into force 90 days later for all Parties except those which make a reservation in accordance with paragraph 3 of this Article.

(g) If an objection by any Party is received by the Secretariat, the proposed amendment shall be submitted to a postal vote in accordance with the provisions of sub-paragraphs (h), (i) and (j) of this paragraph.

(h) The Secretariat shall notify the Parties that notification of objection has been received.

(i) Unless the Secretariat receives the votes for, against or in abstention from at least one-half of the Parties within 60 days of the date of notification under sub-paragraph (h) of this paragraph, the proposed amendment shall be referred to the next meeting of the Conference for further consideration.

(j) Provided that votes are received from one-half of the Parties, the amendment shall be adopted by a two-thirds majority of Parties casting an affirmative or negative vote.

(k) The Secretariat shall notify all Parties of the result of the vote.

(l) If the proposed amendment is adopted it shall enter into force 90 days after the date of the notification by the Secretariat of its acceptance for all Parties except those which make a reservation in accordance with paragraph 3 of this Article.

3 During the period of 90 days provided for by sub-paragraph (c) of paragraph 1 or sub-paragraph (1) of paragraph 2 of this Article any Party may by notification in writing to the Depositary Government make a reservation with respect to the amendment. Until such reservation is withdrawn the Party shall be treated as a State not a party to the present Convention with respect to trade in the species concerned.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XVI

1 Any party may at any time submit to the Secretariat a list of species which it identifies as being subject to regulation within its jurisdiction for the purpose mentioned in paragraph 3 of Article II. Appendix III shall include the names of the Parties submitting the species for inclusion therein, the scientific names of the species so submitted, and any parts or derivatives of the animals or plants concerned that are specified in relation to the species for the purposes of sub-paragraph (b) of Article I.

2 Each list submitted under the provisions of paragraph 1 of this Article shall be communicated to the Parties by the Secretariat as soon as possible after receiving it. The list shall take effect as part of Appendix III 90 days after the date of such communication. At any time after the communication of such list, any Party may by notification in writing to the Depositary Government enter a reservation with respect to any species or any parts or derivatives, and until such reservation is withdrawn, the State shall be treated as a State not a Party to the present Convention with respect to trade in the species or part or derivative concerned.

3 A Party which has submitted a species for inclusion in Appendix III may withdraw it at any time by notification to the Secretariat which shall communicate the withdrawal to all Parties. The withdrawal shall take effect 30 days after the date of such communication.

4 Any Party submitting a list under the provisions of paragraph 1 of this Article shall submit to the Secretariat a copy of all domestic laws and regulations applicable to the protection of such species, together with any interpretations which the Party may deem appropriate or the Secretariat may request. The Party shall, for as long as the species in question is included in Appendix III, submit any amendments of such laws and regulations or any new interpretations as they are adopted.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XVII

1 An extraordinary meeting of the Conference of the Parties shall be convened by the Secretariat on the written request of at least one-third of the Parties to consider and adopt amendments to the present Convention. Such amendments shall be adopted by a two-thirds majority of Parties present and voting. For these purposes “Parties present and voting” means Parties present and casting an affirmative or negative vote. Parties abstaining from voting shall not be counted among the two-thirds required for adopting an amendment.

2 The text of any proposed amendment shall be communicated by the Secretariat to all Parties at least 90 days before the meeting.

3 An amendment shall enter into force for the Parties which have accepted it 60 days after two-thirds of the Parties have deposited an instrument of acceptance of the amendment with the Depositary Government. Thereafter, the amendment shall enter into force for any other Party 60 days after that Party deposits its instrument of acceptance of the amendment.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XVIII

1 Any dispute which may arise between two or more Parties with respect to the interpretation or application of the provisions of the present Convention shall be subject to negotiation between the Parties involved in the dispute.

2 If the dispute cannot be resolved in accordance with paragraph 1 of this Article, the Parties may, by mutual consent, submit the dispute to arbitration, in particular that of the Permanent Court of Arbitration at The Hague, and the Parties submitting the dispute shall be bound by the arbitral decision.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XIX

The present Convention shall be open for signature at Washington until 30th April 1973 and thereafter at Berne until 31st December 1974.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XX

The present Convention shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Government of the Swiss Confederation which shall be the Depositary Government.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XXI

The present Convention shall be open indefinitely for accession. Instruments of accession shall be deposited with the Depositary Government.

1. This Convention shall be open for accession by regional economic integration organizations constituted by sovereign States which have competence in respect of the negotiation, conclusion and implementation of international agreements in matters transferred to them by their Member States and covered by this Convention.

2. In their instruments of accession, such organizations shall declare the extent of their competence with respect to the matters governed by the Convention. These organizations shall also inform the Depositary Government of any substantial modification in the extent of their competence. Notifications by regional economic integration organizations concerning their competence with respect to matters governed by this Convention and modifications thereto shall be distributed to the Parties by the Depositary Government.

3. In matters within their competence, such regional economic integration organizations shall exercise the rights and fulfill the obligations which this Convention attributes to their Member States, which are Parties to the Convention. In such cases the Member States of the organizations shall not be entitled to exercise such rights individually.

4. In the fields of their competence, regional economic integration organizations shall exercise their right to vote with a number of votes equal to the number of their Member States which are Parties to the Convention. Such organizations shall not exercise their right to vote if their Member States exercise theirs, and vice versa.

5. Any reference to “Party” in the sense used in Article I(h) of this Convention to “State'V'States” or to “State Party'V'States Parties” to the Convention shall be construed as including a reference to any regional economic integration organization having competence in respect of the negotiation, conclusion and application of international agreements in matters covered by this Convention.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XXII

1 The present Convention shall enter into force 90 days after the date of deposit of the tenth instrument of ratification, acceptance, approval or accession, with the Depositary Government.

2 For each State which ratifies, accepts or approves the present Convention or accedes thereto after the deposit of the tenth instrument of ratification, acceptance, approval or accession, the present Convention shall enter into force 90 days after the deposit by such State of its instrument of ratification, acceptance, approval or accession.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XXIII

1 The provisions of the present Convention shall not be subject to general reservations. Specific reservations may be entered in accordance with the provisions of this Article and Articles XV and XVI.

2 Any State may, on depositing its instrument of ratification, acceptance, approval or accession, enter a specific reservation with regard to:

(a) any species included in Appendix I, II or III; or

(b) any parts or derivatives specified in relation to a species included in Appendix III.

3 Until a Party withdraws its reservation entered under the provisions of this Article, it shall be treated as a State not a party to the present Convention with respect to trade in the particular species or parts or derivatives specified in such reservation.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XXIV

Any Party may denounce the present Convention by written notification to the Depositary Government at any time. The denunciation shall take effect twelve months after the Depositary Government has received the notification.

Convention on International Trade in Endangered Species of Wild Fauna and Flora

Article XXV

1 The original of the present Convention, in the Chinese, English, French, Russian and Spanish languages, each version being equally authentic, shall be deposited with the Depositary Government, which shall transmit certified copies thereof to all States that have signed it or deposited instruments of accession to it.

2 The Depositary Government shall inform all signatory and acceding States and the Secretariat of signatures, deposit of instruments of ratification, acceptance, approval or accession, entry into force of the present Convention, amendments thereto, entry and withdrawal of reservations and notifications of denunciation.

3 As soon as the present Convention enters into force, a certified copy thereof shall be transmitted by the Depositary Government to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.

Appendices I, II and III

Appendices I, II and III (deel 1)

Interpretation

1. Species included in these Appendices are referred to:

a) by the name of the species; or

b) as being all of the species included in a higher taxon or designated part thereof.

2. The abbreviation “spp.” is used to denote all species of a higher taxon.

3. Other references to taxa higher than species are for the purposes of information or classification only. The common names included after the scientific names of families are for reference only. They are intended to indicate the species within the family concerned that are included in the Appendices. In most cases this is not all of the species within the family.

4. The following abbreviations are used for plant taxa below the level of species:

a) “ssp.” is used to denote subspecies; and

b) “var(s).” is used to denote variety (varieties).

5. As none of the species or higher taxa of FLORA included in Appendix I is annotated to the effect that its hybrids shall be treated in accordance with the provisions of Article III of the Convention, this means that artificially propagated hybrids produced from one or more of these species or taxa may be traded with a certificate of artificial propagation, and that seeds and pollen (including pollinia), cut flowers, seedling or tissue cultures obtained in vitro transported in sterile containers of these hybrids are not subject to the provisions of the Convention.

6. The names of the countries in parentheses placed against the names of species in Appendix III are those of the Parties submitting these species for inclusion in this Appendix.

7. When a species is included in Appendix I, II or III, the whole, live or dead, animal or plant is always included. In addition, all parts and derivatives thereof are also included in the same Appendix unless, for animal species listed in Appendix III and plant species listed in Appendix II or III, the species is annotated with the symbol # followed by a number to indicate that only specific parts and derivatives are included. The symbol # followed by a number placed against the name of a species or higher taxon included in Appendix II or III refers to a footnote that indicates the parts or derivatives of animals or plants that are designated as 'specimens' subject to the provisions of the Convention in accordance with Article I, paragraph (b), subparagraph (ii) or (iii).

8. The terms and expressions below, used in annotations in these Appendices, are defined as follows:

Extract

Any substance obtained directly from plant material by physical or chemical means regardless of the manufacturing process. An extract may be solid (e.g. crystals, resin, fine or coarse particles), semi-solid (e.g. gums, waxes) or liquid (e.g. solutions, tinctures, oil and essential oils).

Finished musical instruments

A musical instrument (as referenced by the Harmonized System of the World Customs Organization, Chapter 92; musical instruments, parts and accessories of such articles) that is ready to play or needs only the installation of parts to make it playable. This term includes antique instruments (as defined by the Harmonized System codes 97.05 and 97.06; Works of art, collectors' pieces and antiques).

Finished musical instrument accessories

A musical instrument accessory (as referenced by the Harmonized System of the World Customs Organization, Chapter 92; musical instruments, parts and accessories of such articles) that is separate from the musical instrument, and is specifically designed or shaped to be used explicitly in association with an instrument, and that requires no further modification to be used.

Finished musical instrument parts

A part (as referenced by the Harmonized System of the World Customs Organization, Chapter 92; musical instruments, parts and accessories of such articles) of a musical instrument that is ready to install and is specifically designed and shaped to be used explicitly in association with the instrument to make it playable.

Finished products packaged and ready for retail trade

Products, shipped singly or in bulk, requiring no further processing, packaged, labelled for final use or the retail trade in a state fit for being sold to or used by the general public.

Powder

A dry, solid substance in the form of fine or coarse particles.

Shipment

Cargo transported under the terms of a single bill of lading or air waybill, irrespective of the quantity or number of containers or packages; or pieces worn, carried or included in personal baggage.

Ten (10) kg per shipment

For the term “10 kg per shipment”, the 10 kg limit should be interpreted as referring to the weight of wood of each individual annotated species of genus Dalbergia or Guibourtia present in the items in the shipment. The 10 kg limit is to be assessed only against the individual weights of the portions of wood of each individual annotated species contained in each item of the shipment, and not against the total weight of the shipment. The total weights present of each individual annotated species are considered individually to determine whether a CITES permit or certificate is required for each individual annotated species, and weights of different individual annotated species are not added together for this purpose.

Transformed wood

Defined by Harmonized System code 44.09: Wood (including strips, friezes for parquet flooring, not assembled), continuously shaped (tongued, grooved, rebated, chamfered, V-jointed, beaded, moulded, rounded or the like) along any of its edges, ends or faces, whether or not planed, sanded or end-jointed.

Woodchips

Wood that has been reduced to small pieces.

A1 Specimens of the domesticated form are not subject to the provisions of the Convention.

A3 A zero export quota for wild specimens traded for commercial purposes, except for specimens from the population of Saiga tatarica of Kazakhstan under the following conditions:

a) Trade in only government owned whole horns, originating in Kazakhstan, stockpiled and marked in accordance with marking and traceability requirements developed by Kazakhstan;

b) Prior verification by the Secretariat and Kazakhstan, in consultation with the Standing Committee through its Chair, that sufficient control mechanisms and traceability systems are already in place in Kazakhstan and trade partners;

c) Kazakhstan supervises the first shipment to each new trading partner to ensure the marking and traceability systems are in place and working adequately; and

d) Limited to a total amount of 30 tons until CoP21 to be reviewed in order to determine a potential for further trade based on a revised proposal.

On a proposal from the Secretariat, the Standing Committee can decide to cause this trade to cease partially or completely in the event of non-compliance by exporting or importing countries, or in the case of proven detrimental impacts of the trade on the saiga population.

A4 For the exclusive purpose of allowing international trade in fibre from vicuñas (Vicugna vicugna) and their derivative products, only if the fibre comes from the shearing of live vicuñas. Trade in products derived from the fibre may only take place in accordance with the following provisions:

a) Any person or entity processing vicuña fibre to manufacture cloth and garments must request authorization from the relevant authorities of the country of origin (Countries of origin: The countries where the species occurs, that is, Argentina, Bolivia, Chile, Ecuador and Peru) to use the “vicuña country of origin” wording, mark or logo adopted by the range States of the species that are signatories to the Convention for the Conservation and Management of the Vicuña.

b) Marketed cloth or garments must be marked or identified in accordance with the following provisions:

i) For international trade in cloth made from live-sheared vicuña fibre, whether the cloth was produced within or outside of the range States of the species, the wording, mark or logo must be used so that the country of origin can be identified. The VICUÑA [COUNTRY OF ORIGIN] wording, mark or logo has the format as detailed below:

This wording, mark or logo must appear on the reverse side of the cloth. In addition, the selvages of the cloth must bear the words VICUÑA [COUNTRY OF ORIGIN].

ii) For international trade in garments made from live-sheared vicuña fibre, whether the garments were produced within or outside of the range States of the species, the wording, mark or logo indicated in paragraph b) i) must be used. This wording, mark or logo must appear on a label on the garment itself. If the garments are produced outside of the country of origin, the name of the country where the garment was produced should also be indicated, in addition to the wording, mark or logo referred to in paragraph b) i).

c) For international trade in handicraft products made from live-sheared vicuña fibre produced within the range States of the species, the VICUÑA [COUNTRY OF ORIGIN] - ARTESANÍA wording, mark or logo must be used as detailed below:

d) If live-sheared vicuña fibre from various countries of origin is used for the production of cloth and garments, the wording, mark or logo of each of the countries of origin of the fibre must be indicated, as detailed in paragraphs b) i) and ii).

e) All other specimens shall be deemed to be specimens of species listed in Appendix I and the trade in them shall be regulated accordingly.

A5 For Panthera leo (African populations): a zero annual export quota is established for specimens of bones, bone pieces, bone products, claws, skeletons, skulls and teeth removed from the wild and traded for commercial purposes. Annual export quotas for trade in bones, bone pieces, bone products, claws, skeletons, skulls and teeth for commercial purposes, derived from captive breeding operations in South Africa, will be established and communicated annually to the CITES Secretariat.

Appendices I, II and III

Appendices I, II and III (deel 9)

A6 Annual export quotas for live specimens and hunting trophies are granted as follows: Botswana: 5; Namibia: 150; Zimbabwe: 50. The trade in such specimens is subject to the provisions of Article III of the Convention.

A7 For Tursiops truncatus (Black Sea population): a zero annual export quota has been established for live specimens removed from the wild and traded for primarily commercial purposes.

A8 A zero annual export quota has been established. All specimens shall be deemed to be specimens of species included in Appendix I and the trade in them shall be regulated accordingly.

A9 The populations of Eswatini and South Africa of Ceratotherium simum simum are included in Appendix II for the exclusive purpose of allowing international trade in live animals to appropriate and acceptable destinations and hunting trophies. All other specimens shall be deemed to be specimens of species included in Appendix I and the trade in them shall be regulated accordingly.

A10 The population of Namibia of Ceratotherium simum simum is included in Appendix II for the exclusive purpose of allowing international trade in live animals for in-situ conservation only, and only within the natural and historical range of Ceratotherium simum in Africa. All other specimens shall be deemed to be specimens of species included in Appendix I and the trade in them shall be regulated accordingly.

A11 Populations of Botswana, Namibia, South Africa and Zimbabwe (listed in Appendix II):

For the exclusive purpose of allowing:

a) trade in hunting trophies for non-commercial purposes;

b) trade in live animals to appropriate and acceptable destinations;

c) trade in hides;

d) trade in hair;

e) trade in leather goods; and

f) trade in individually marked and certified ekipas incorporated in finished jewellery for non-commercial purposes for Namibia and ivory carvings for non-commercial purposes for Zimbabwe.

The Standing Committee can decide to cause this trade to cease partially or completely in the event of non-compliance by exporting or importing countries, or in the case of proven detrimental impacts of the trade on other elephant populations.

All other specimens shall be deemed to be specimens of species included in Appendix I and the trade in them shall be regulated accordingly.

A12 The population of Brazil of Caiman latirostris is included in Appendix II subject to a zero annual export quota for wild specimens traded for commercial purposes.

A13 The population of Ecuador of Melanosuchus niger is included in Appendix II subject to a zero annual export quota until an annual export quota has been approved by the CITES Secretariat and the IUCN/SSC Crocodile Specialist Group.

A14 The population of Mexico of Crocodylus acutus is included in Appendix II subject to a zero export quota for wild specimens for commercial purposes.

A15 The population of Belize of Crocodylus moreletii is included in Appendix II with a zero quota for wild specimens traded for commercial purposes.

A16 The population of Egypt of Crocodylus niloticus is included in Appendix II subject to a zero quota for wild specimens traded for commercial purposes.

A17 The population of the United Republic of Tanzania of Crocodylus niloticus is included in Appendix II subject to an annual export quota of no more than 1,600 wild specimens including hunting trophies, in addition to ranched specimens.

A18 The population of Malaysia of Crocodylus porosus is included in Appendix II with wild harvest restricted to the State of Sarawak and a zero quota for wild specimens for the other States of Malaysia (Sabah and Peninsular Malaysia), with no change in the zero quota unless approved by the Parties.

A19 The population of the Palawan islands, Philippines, of Crocodylus porosus is included in Appendix II subject to a zero annual export quota for wild specimens traded for commercial purposes.

A20 Zero export quota for wild specimens for commercial purposes.

A21 Abronia aurita, A. gaiophantasma, A. montecristoi, A. salvadorensis and A. vasconcelosii are subject to a zero export quota for wild specimens.

A22 Zero export quota for specimens from the wild.

A23 Zero quota for wild specimens for commercial purposes.

A23 For Cuora aurocapitata, C. flavomarginata, C. mccordi, C. mouhotii, C. pani, C. trifasciata, C. yunnanensis and C. zhoui: a zero quota for wild specimens for commercial purposes.

A24 For Centrochelys sulcata: a zero annual export quota has been established for specimens removed from the wild and traded for primarily commercial purposes.

A26 Fossils are not subject to the provisions of the Convention.

#4 All parts and derivatives, except:

a) seeds (including seedpods of Orchidaceae), spores and pollen (including pollinia). The exemption does not apply to seeds from Cactaceae spp. exported from Mexico, and to seeds from Beccariophoenix madagascariensis and Dypsis decaryi exported from Madagascar;

b) seedling or tissue cultures obtained in vitro transported in sterile containers;

c) cut flowers of artificially propagated plants;

d) fruits, and parts and derivatives thereof, of naturalized or artificially propagated plants of the genus Vanilla (Orchidaceae) and of the family Cactaceae;

e) stems, flowers, and parts and derivatives thereof, of naturalized or artificially propagated plants of the genera Opuntia subgenus Opuntia and Selenicereus (Cactaceae);

f) finished products packaged and ready for retail trade of Aloe ferox and Euphorbia antisyphilitica; and

g) finished products derived from artificial propagation, packaged and ready for retail trade of cosmetics containing parts and derivatives of Bletilla striata, Cycnoches cooperi, Gastrodia elata, Phalaenopsis amabilis or Phalaenopsis lobbii.

#5 Logs, sawn wood and veneer sheets.

#10 All parts and derivatives, except finished musical instruments, finished musical instrument accessories and finished musical instrument parts for non-commercial trade only for the purpose of paid and unpaid performance, personal use, display, loan, competition, teaching, appraisal, or repair, provided that this does not change the ownership and that such transport is not for sale, transfer or disposal of the specimen outside of the owner’s usual State of residence. Zero quota for wild-harvested specimens (source code W) traded for commercial purposes.

#11 Logs, sawn wood, veneer sheets, plywood, powder and extracts. Finished products containing such extracts as ingredients, including fragrances, are not considered to be covered by this annotation.

#13 The kernel (also known as 'endosperm', 'pulp' or 'copra') and any derivatives thereof, except finished products packaged and ready for retail trade.

#14 All parts and derivatives except:

a) seeds and pollen;

b) seedling or tissue cultures obtained in vitro transported in sterile containers;

c) fruits;

d) leaves;

e) exhausted agarwood powder, including compressed powder in all shapes; and

f) finished products packaged and ready for retail trade, this exemption does not apply to wood chips, beads, prayer beads and carvings.

b) finished products to a maximum weight of wood of the listed species of up to 10 kg per shipment;

c) finished musical instruments, finished musical instrument parts and finished musical instrument accessories;

d) parts and derivatives of Dalbergia cochinchinensis, which are covered by Annotation#4; and

e) parts and derivatives of Dalbergia spp. originating and exported from Mexico, which are covered by Annotation#6.

P1 Artificially propagated specimens of the following hybrids and/or cultivars are not subject to the provisions of the Convention:

– Hatiora x graeseri

– Schlumbergera x buckleyi

– Schlumbergera russelliana x Schlumbergera truncata

– Schlumbergera orssichiana x Schlumbergera truncata

– Schlumbergera opuntioides x Schlumbergera truncata

– Schlumbergera truncata (cultivars)

– Cactaceae spp. colour mutants grafted on the following grafting stocks: Harrisia 'Jusbertii', Hylocereus trigonus or Hylocereus undatus

– Opuntia microdasys (cultivars).

P2 Artificially propagated specimens of cultivars of Euphorbia trigona, artificially propagated specimens of crested, fan-shaped or colour mutants of Euphorbia lactea, when grafted on artificially propagated root stock of Euphorbia neriifolia, and artificially propagated specimens of cultivars of Euphorbia ‘Milii’ when they are traded in shipments of 100 or more plants and readily recognizable as artificially propagated specimens, are not subject to the provisions of the Convention.

P3 Artificially propagated hybrids of the following genera are not subject to the provisions of the Convention, if conditions, as indicated under a) and b), are met: Cymbidium, Dendrobium, Phalaenopsis and Vanda:

a) Specimens are readily recognizable as artificially propagated and do not show any signs of having been collected in the wild such as mechanical damage or strong dehydration resulting from collection, irregular growth and heterogeneous size and shape within a taxon and shipment, algae or other epiphyllous organisms adhering to leaves, or damage by insects or other pests; and

b)

i) when shipped in non-flowering state, the specimens must be traded in shipments consisting of individual containers (such as cartons, boxes, crates or individual shelves of CC-containers) each containing 20 or more plants of the same hybrid; the plants within each container must exhibit a high degree of uniformity and healthiness; and the shipment must be accompanied by documentation, such as an invoice, which clearly states the number of plants of each hybrid; or

ii) when shipped in flowering state, with at least one fully open flower per specimen, no minimum number of specimens per shipment is required but specimens must be professionally processed for commercial retail sale, e.g. labelled with printed labels or packaged with printed packages indicating the name of the hybrid and the country of final processing. This should be clearly visible and allow easy verification.

Plants not clearly qualifying for the exemption must be accompanied by appropriate CITES documents.

P4 Seedling or tissue cultures obtained in vitro and transported in sterile containers are not subject to the provisions of the Convention only if the specimens meet the definition of ‘artificially propagated’ agreed by the Conference of the Parties.

P5 Artificially propagated specimens of cultivars of Cyclamen persicum are not subject to the provisions of the Convention. However, the exemption does not apply to such specimens traded as dormant tubers.

P6 Artificially propagated hybrids and cultivars of Taxus cuspidata, live, in pots or other small containers, each consignment being accompanied by a label or document stating the name of the taxon or taxa and the text 'artificially propagated', are not subject to the provisions of the Convention.

P7 Zero export quota for wild-taken specimens for commercial purposes.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel I

Voor de toepassing van deze Overeenkomst betekent, tenzij uit het zinsverband duidelijk anders blijkt:

a) „soort”: elke soort, ondersoort of een van hun geografisch geïsoleerde populaties;

b) „specimen”:

i) elke dier of elke plant, levend of dood;

ii) in geval van een dier: ten aanzien van de in Bijlagen I en II opgenomen soorten, elk gemakkelijk herkenbaar deel van een dier of elk daaruit verkregen produkt, en ten aanzien van de in Bijlage III opgenomen soorten, elk gemakkelijk herkenbaar deel van een dier of elk daaruit verkregen produkt dat in deze Bijlage is genoemd;

iii) in geval van een plant: ten aanzien van de in Bijlage I opgenomen soorten, elk gemakkelijk herkenbaar deel van de plant of elk daaruit verkregen produkt en ten aanzien van de in Bijlagen II en III opgenomen soorten, elk gemakkelijk herkenbaar deel van de plant of elk daaruit verkregen produkt dat in deze Bijlage is genoemd;

c) „handel”: de uitvoer, de wederuitvoer, de invoer en het inbrengen van uit de zee voortkomende dieren en planten;

d) „wederuitvoer”: de uitvoer van elk tevoren ingevoerd specimen;

e) „aanvoer van uit de zee voortkomende planten en dieren”: het tot binnen de grenzen van een Staat vervoeren van specimens van soorten die zijn gehaald uit zeegebied dat niet tot het rechtsgebied van een Staat behoort;

f) „wetenschappelijke autoriteit”: een overeenkomstig artikel IX aangewezen nationale wetenschappelijke autoriteit;

g) „administratieve instantie”: een overeenkomstig artikel IX aangewezen nationale administratieve instantie;

h) „partij”: een Staat ten aanzien van wie dit Verdrag in werking is getreden.

Artikel II

1 Bijlage I omvat alle met uitsterven bedreigde soorten die door de handel worden of zouden kunnen worden getroffen. De handel in specimens van deze soorten moet aan bijzonder strenge voorschriften worden onderworpen ten einde hun voortbestaan niet verder in gevaar te brengen en zij moet slechts in buitengewone gevallen worden toegestaan.

2 Bijlage II omvat

a) alle soorten die weliswaar niet noodzakelijkerwijze thans worden bedreigd met uitsterven, maar die hieraan zouden kunnen worden blootgesteld indien de handel in specimens van deze soorten niet zou worden onderworpen aan strenge voorschriften die ten doel hebben de hun voortbestaan bedreigende exploitatie te vermijden;

b) andere soorten die aan voorschriften moeten worden onderworpen ten einde de in alinea a) bedoelde controle op de handel in specimens van de in Bijlage II opgenomen soorten doeltreffend te maken.

3 Bijlage III omvat alle soorten waarvan een Partij verklaart dat deze, binnen de grenzen van haar rechtsbevoegdheid, zijn onderworpen aan een verordening die ten doel heeft hun exploitatie te verhinderen of te beperken en waarvoor de samenwerking met de andere Partijen bij de controle op de handel noodzakelijk is.

4 De Partijen staan de handel in specimens van de in Bijlagen I, II en III opgenomen soorten slechts toe indien deze in overeenstemming is met de bepalingen van deze Overeenkomst.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel III

1 Alle handel in specimens van in Bijlage I opgenomen soorten moet in overeenstemming zijn met de bepalingen van dit artikel.

2 Voor het uitvoeren van een specimen van een in Bijlage I opgenomen soort is de voorafgaande verlening en overlegging van een uitvoervergunning vereist. Een uitvoervergunning kan slechts worden verleend indien aan de volgende voorwaarden is voldaan:

a) een wetenschappelijke autoriteit van de Staat van uitvoer heeft verklaard dat deze uitvoer het voortbestaan van de betrokken soort niet schaadt;

b) ten genoege van een administratieve instantie van de Staat van uitvoer is aangetoond dat de verkrijging van het specimen niet in strijd is geweest met de in die Staat van kracht zijnde wetten inzake het behoud van dier- en plantesoorten;

c) ten genoege van een administratieve instantie van de Staat van uitvoer is aangetoond dat elk levend specimen op zodanige wijze wordt gereedgemaakt voor verzending en vervoerd dat risico's van verwondingen, schade aan de gezondheid of ruwe behandeling tot een minimum worden beperkt;

d) ten genoege van een administratieve instantie van de Staat van uitvoer is aangetoond dat een invoervergunning voor genoemd specimen is uitgereikt.

3 Voor het invoeren van een specimen van een in Bijlage I opgenomen soort is de voorafgaande verlening en overlegging van een invoervergunning en van hetzij een uitvoervergunning, hetzij een certificaat van wederuitvoer nodig. Een invoervergunning kan slechts worden verleend indien aan de volgende voorwaarden is voldaan:

a) een wetenschappelijke autoriteit van de Staat van invoer heeft verklaard dat de invoer doeleinden dient welke het voortbestaan van genoemde soort niet schaden;

b) ten genoege van een wetenschappelijke autoriteit van de Staat van invoer is aangetoond, dat degene voor wie een levend specimen is bestemd, voldoende is uitgerust om het te huisvesten en te verzorgen;

c) ten genoege van een administratieve instantie van de Staat van invoer is aangetoond dat het specimen niet zal worden gebruikt voor overwegend commerciële doeleinden.

4 Voor de wederuitvoer van een specimen van een in Bijlage I opgenomen soort is de voorafgaande verlening en overlegging van een certificaat van wederuitvoer vereist. Een certificaat van wederuitvoer kan slechts worden verleend indien aan de volgende voorwaarden is voldaan:

a) ten genoege van een administratieve instantie van de Staat van wederuitvoer is aangetoond dat het specimen overeenkomstig de bepalingen van dit Verdrag in die Staat is ingevoerd;

b) ten genoege van een administratieve instantie van de Staat van wederuitvoer is aangetoond dat elk levend specimen op zodanige wijze wordt gereedgemaakt voor verzending en vervoerd dat risico's van verwondingen, schade aan de gezondheid of ruwe behandeling tot een minimum worden beperkt;

c) ten genoege van een administratieve instantie van de Staat van wederuitvoer is aangetoond dat een invoervergunning voor elk levend specimen is verleend.

5 Voor aanvoer vanuit zee van een specimen van een in Bijlage I opgenomen soort is een certificaat vereist dat tevoren is uitgereikt door de administratieve instantie van de Staat waar het specimen is aangevoerd. Genoemd certificaat kan slechts worden verleend indien aan de volgende voorwaarden is voldaan:

a) een wetenschappelijke autoriteit van de Staat waar het specimen is aangevoerd heeft verklaard dat deze aanvoer het voortbestaan van de betrokken soort niet schaadt;

b) ten genoege van een administratieve instantie van de Staat waar het specimen is aangevoerd, is aangetoond dat degene voor wie een levend specimen is bestemd, voldoende is uitgerust om het te huisvesten en te verzorgen;

c) ten genoege van een administratieve instantie van de Staat waar het specimen is aangevoerd, is aangetoond dat het specimen niet zal worden gebruikt voor overwegend commerciële doeleinden.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel IV

1 Alle handel in specimens van in Bijlage II opgenomen soorten moet in overeenstemming zijn met de bepalingen van dit artikel.

2 Voor de uitvoer van een specimen van een in Bijlage II opgenomen soort is de voorafgaande verlening en overlegging van een uitvoervergunning vereist. Een uitvoervergunning kan slechts worden verleend indien aan de volgende voorwaarden is voldaan:

a) een wetenschappelijke autoriteit van de Staat van uitvoer heeft verklaard dat deze uitvoer het voortbestaan van de betrokken soort niet schaadt;

b) ten genoege van een administratieve instantie van de Staat van uitvoer is aangetoond dat de verkrijging van het specimen niet in strijd is geweest met de in die Staat van kracht zijnde wetten inzake het behoud van dier- en plantesoorten;

c) ten genoege van een administratieve instantie van de Staat van uitvoer is aangetoond dat elk levend specimen op zodanige wijze wordt gereedgemaakt voor verzending en vervoerd dat risico's van verwondingen, schade aan de gezondheid of ruwe behandeling tot een minimum worden beperkt.

3 Een wetenschappelijke autoriteit van elke Partij dient voortdurend toezicht te houden zowel op de verlening door genoemde Partij van uitvoervergunningen voor de specimens van in Bijlage II opgenomen soorten als op de feitelijke uitvoer van die specimens. Wanneer een wetenschappelijke autoriteit vaststelt dat de uitvoer van specimens van een van deze soorten zou moeten worden beperkt, ten einde deze soort in zijn gehele verspreidingsgebied te behouden op een niveau, dat overeenkomt met zijn rol in de ecosystemen waarin hij voorkomt, en dat tevens duidelijk hoger ligt dan het peil dat aanleiding zou geven tot opname van die soort in Bijlage I, dan stelt zij de bevoegde administratieve instantie in kennis van de geëigende maatregelen die moeten worden genomen om de verlening van uitvoervergunningen voor specimens van genoemde soort te beperken.

4 Voor het invoeren van een specimen van een in Bijlage II opgenomen soort is de voorafgaande overlegging vereist van hetzij een uitvoervergunning hetzij een certificaat van wederuitvoer.

5 Voor de wederuitvoer van een specimen van een in Bijlage II opgenomen soort is de voorafgaande uitreiking en overlegging van een certificaat van wederuitvoer vereist. Een certificaat van wederuitvoer kan slechts worden verleend indien aan de volgende voorwaarden is voldaan:

a) ten genoege van een administratieve instantie van de Staat van wederuitvoer is aangetoond dat het specimen overeenkomstig de bepalingen van dit Verdrag in deze Staat is ingevoerd;

b) ten genoege van een administratieve instantie van de Staat van wederuitvoer is aangetoond dat elk levend specimen op zodanige wijze wordt gereedgemaakt voor verzending en vervoerd dat risico's van verwondingen, schade aan de gezondheid of ruwe behandeling tot een minimum worden beperkt.

6 Voor aanvoer vanuit zee van een specimen van een in Bijlage II opgenomen soort is een certificaat vereist dat tevoren is uitgereikt door een administratieve instantie van de Staat waar dit specimen is aangevoerd. Dit certificaat kan slechts worden verleend indien aan de volgende voorwaarden is voldaan:

a) een wetenschappelijke autoriteit van de Staat waar het specimen is aangevoerd heeft verklaard dat de aanvoer het voortbestaan van genoemde soort niet schaadt;

b) ten genoege van een administratieve instantie van de Staat waar het specimen is aangevoerd, is aangetoond dat elk levend specimen op zodanige wijze zal worden behandeld dat risico's van verwondingen, schade aan de gezondheid of ruwe behandeling tot een minimum worden beperkt.

7 De in het zesde lid van dit artikel bedoelde certificaten kunnen worden uitgereikt op advies van een wetenschappelijke autoriteit, nadat deze overleg heeft gepleegd met andere nationale of eventueel internationale wetenschappelijke autoriteiten over de totale aantallen specimens die mogen worden aangevoerd gedurende perioden van niet langer dan een jaar.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel V

1 Alle handel in specimens van in Bijlage III opgenomen soorten moet in overeenstemming zijn met de bepalingen van dit artikel.

2 Voor het uitvoeren van een specimen van een in Bijlage III opgenomen soort vanuit elke Staat die genoemde soort in Bijlage III heeft laten opnemen is de voorafgaande uitreiking en overlegging vereist van een uitvoervergunning. Een uitvoervergunning kan slechts worden verleend indien aan de volgende voorwaarden is voldaan:

a) ten genoege van een administratieve instantie van de Staat van uitvoer is aangetoond dat het verkrijgen van het betreffende specimen niet in strijd is geweest met de in die Staat van kracht zijnde wetten inzake het behoud van dier- en plantesoorten;

b) ten genoege van een administratieve instantie van de Staat van uitvoer is aangetoond dat elk levend specimen op zodanige wijze wordt gereedgemaakt voor verzending en vervoerd dat risico's van verwondingen, schade aan de gezondheid of ruwe behandeling tot een minimum worden beperkt.

3 Met uitzondering van de in het vierde lid van dit artikel bedoelde gevallen, is voor de invoer van elk specimen van een in Bijlage III opgenomen soort vereist dat tevoren een certificaat van herkomst wordt overgelegd en in geval van invoer vanuit een Staat die genoemde soort in Bijlage III heeft laten opnemen, een uitvoervergunning.

4 In geval van wederuitvoer dient een door de administratieve instantie van de Staat van wederuitvoer uitgereikt certificaat waarin wordt verklaard dat het specimen in die Staat is verwerkt of opnieuw wordt uitgevoerd, door de Staat van invoer als bewijs te worden aanvaard dat de bepalingen van deze Overeenkomst ten aanzien van de betreffende specimens zijn nagekomen.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel VI

1 De krachtens de bepalingen van de artikelen III, IV en V uitgereikte vergunningen en certificaten moeten in overeenstemming zijn met de bepalingen van dit artikel.

2 Een uitvoervergunning moet de inlichtingen bevatten zoals aangeduid in het model dat in Bijlage IV is weergegeven en is slechts gedurende een periode van zes maanden te rekenen van de datum van afgifte geldig voor de uitvoer.

3 Elke vergunning of elk certificaat verwijst naar de titel van deze Overeenkomst en bevat de naam en het stempel van de administratieve instantie die de uitreiking heeft verricht en een door haar toegekend controlenummer.

4 Elk door een administratieve instantie uitgereikt afschrift van een vergunning of van een certificaat moet duidelijk als zodanig worden gemerkt en kan niet worden gebruikt in plaats van het origineel, tenzij op het afschrift anders is aangegeven.

5 Een afzonderlijke vergunning of afzonderlijk certificaat is vereist voor elke zending specimens.

6 Een administratieve instantie van de Staat van invoer van enig specimen dient de uitvoervergunning of het certificaat van wederuitvoer en elke bij de invoer van genoemd specimen overgelegde overeenkomstige invoervergunning ongeldig te verklaren en in te nemen.

7 Indien zinvol en uitvoerbaar kan een administratieve instantie een specimen ter identificatie van een kenteken voorzien. Voor dit doel betekent „kenteken” elk onuitwisbaar merkteken, loden zegel of ander geschikt middel waarmee een specimen geïdentificeerd kan worden en dat zo is ontworpen dat namaak ervan zoveel mogelijk is bemoeilijkt.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel VII

1 De bepalingen van de artikelen III, IV en V zijn niet van toepassing op de doorvoer of overlading van specimens op het gebied van een Partij wanneer deze specimens onder douanecontrole blijven.

2 Wanneer ten genoege van een administratieve instantie van de Staat van uitvoer of van wederuitvoer is aangetoond dat een specimen is verkregen voordat de bepalingen van dit Verdrag van toepassing waren op genoemd specimen, zijn de bepalingen van de artikelen III, IV en V niet van toepassing op dit specimen, op voorwaarde dat genoemde administratieve instantie hiertoe een certificaat uitreikt.

3 De bepalingen van de artikelen III, IV en V zijn niet van toepassing op specimens die vallen onder persoonlijke bezittingen of huisraad. Deze uitzondering is evenwel niet van toepassing:

a) indien het gaat om specimens van een in Bijlage I opgenomen soort, wanneer deze door hun eigenaar zijn verkregen buiten de Staat waar hij permanent verblijf heeft en in die Staat worden ingevoerd; of

b) indien het gaat om specimens van een in Bijlage II opgenomen soort,

i) wanneer deze door hun eigenaar zijn verkregen tijdens een verblijf buiten de Staat waar hij zijn gewoonlijk verblijf heeft en in een Staat waar genoemde specimens uit het wild zijn gehaald;

ii) wanneer deze worden ingevoerd in de Staat waar de eigenaar zijn gewoonlijk verblijf heeft; en

iii) wanneer de Staat waar genoemde specimens uit het wild zijn gehaald de voorafgaande uitreiking van een uitvoervergunning eist;

tenzij ten genoege van een administratieve instantie is aangetoond, dat deze specimens zijn verkregen voordat de bepalingen van deze Overeenkomst van toepassing zijn geworden op de betreffende specimens.

4 De specimens van een in Bijlage I opgenomen diersoort die in gevangenschap voor commerciële doeleinden zijn gefokt, of van een in Bijlage I opgenomen plantesoort die kunstmatig voor commerciële doeleinden is gekweekt, worden beschouwd als specimens van in Bijlage II opgenomen soorten.

5 Wanneer ten genoege van een administratieve instantie van de Staat van uitvoer is aangetoond dat een specimen van een diersoort in gevangenschap is gefokt of dat een specimen van een plantesoort kunstmatig is gekweekt of wanneer het een deel van een zodanig dier of een zodanige plant of een van de produkten daarvan betreft dan wordt een door die administratieve instantie hiertoe uitgereikt certificaat aanvaard in plaats van overeenkomstig de bepalingen van de artikelen III, IV of V benodigde vergunningen en certificaten.

6 De bepalingen van de artikelen III, IV en V zijn niet van toepassing op uitlening, schenking of uitwisseling voor niet-commerciële doeleinden tussen wetenschapsmensen en wetenschappelijke instituten die door een administratieve instantie van hun Staat zijn geregistreerd, van specimens uit herbaria, van andere geconserveerde, gedroogde of ingesloten specimens uit musea en van levende planten die een door een administratieve instantie uitgereikt of goedgekeurd merkteken dragen.

7 Een administratieve instantie van elke Staat kan uitzonderingen op de verplichtingen van de artikelen III, IV en V toestaan en machtiging verlenen om specimens die deel uitmaken van een reizende diergaarde, een circus, een menagerie, een plantententoonstelling of andere reizende tentoonstelling, zonder vergunning of certificaten te verplaatsen, op voorwaarde dat:

a) de exporteur of de importeur de volledige kenmerken van die specimens bij de administratieve instantie registreert;

b) die specimens vallen onder een van de in het tweede of vijfde lid van dit artikel aangeduide categorieën; en

c) ten genoege van de administratieve instantie is aangetoond dat elk levend specimen op zodanige wijze wordt vervoerd en behandeld dat risico's van verwondingen, schade aan de gezondheid of ruwe behandeling tot een minimum worden beperkt.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel VIII

1 De Partijen nemen gepaste maatregelen om de bepalingen van deze Overeenkomst uit te voeren en de handel in specimens waarbij deze worden overtreden, te verbieden.

Deze maatregelen omvatten:

a) het strafbaar stellen van de handel in of het bezit van dergelijke specimens, of beide; en

b) het treffen van voorzieningen ter verbeurdverklaring of terugzending aan de Staat van uitvoer van dergelijke specimens.

2 Behalve de op grond van het eerste lid van dit artikel genomen maatregelen, kan een Partij, wanneer zij dit nodig acht, voorzieningen treffen voor een methode van vergoeding over en weer van de gemaakte kosten die voortvloeiden uit de verbeurdverklaring van een specimen dat werd verhandeld met schending van de krachtens de bepalingen van dit Verdrag genomen maatregelen.

3 De Partijen dragen er zoveel mogelijk zorg voor dat de voor de handel in specimens vereiste formaliteiten zo snel mogelijk worden uitgevoerd. Ten einde deze formaliteiten te vergemakkelijken, kan elke Partij havens voor vertrek en havens voor aankomst aanwijzen waar de specimens bij de douane moeten worden aangegeven. De Partijen dragen er eveneens zorg voor dat alle levende specimens gedurende de tijd van doorvoer, verblijf of vervoer op gepaste wijze worden behandeld zodat risico's van verwondingen, schade aan de gezondheid en ruwe behandeling tot een minimum worden beperkt.

4 Bij verbeurdverklaring van een levend specimen als gevolg van de bepalingen van het eerste lid van dit artikel, gelden de volgende afspraken:

a) het specimen wordt toevertrouwd aan een administratieve instantie van de Staat die tot verbeurdverklaring is overgegaan;

b) na overleg met de Staat van uitvoer zendt de administratieve instantie deze het specimen op kosten van die Staat terug of zendt het naar een bewaarplaats of enige andere plaats die deze instantie geschikt en in overeenstemming met de doeleinden van deze Overeenkomst acht; en

c) de administratieve instantie kan het advies inwinnen van een wetenschappelijke autoriteit of het Secretariaat raadplegen wanneer zij dit wenselijk acht, teneinde de onder letter b) van dit lid bedoelde beslissing met inbegrip van de keus van een bewaarplaats, te vergemakkelijken.

5 Een bewaarplaats, zoals bedoeld in het vierde lid van dit artikel, is een door een administratieve instantie aangewezen instelling die zorg draagt voor het welzijn van levende specimens, in het bijzonder die welke verbeurd zijn verklaard.

6 Elke Partij houdt een register bij van de handel in specimens van in Bijlagen I, II en III opgenomen soorten, waarin worden opgetekend:

a) de namen en adressen van exporteurs en importeurs; en

b) het aantal en de soort van uitgereikte vergunningen en certificaten; de Staten waarmee deze handel heeft plaats gevonden; de aantallen of hoeveelheden en typen specimens, namen van soorten zoals in Bijlagen I, II en III opgenomen en, indien toepasselijk, de afmetingen en het geslacht van genoemde specimens.

7 Elke Partij stelt periodieke rapporten op over de uitvoering van deze Overeenkomst door deze Partij en doet het Secretariaat toekomen:

a) een jaarrapport dat een samenvatting van de in het zesde lid, letter b) van dit artikel genoemde inlichtingen bevat; en

b) een tweejaarlijks rapport over de voor de toepassing van deze Overeenkomst genomen wettelijke, reglementaire en administratieve maatregelen.

8 De in het zevende lid van dit artikel bedoelde inlichtingen staan ter beschikking van het publiek voor zover dit niet in strijd is met de wettelijke en reglementaire bepalingen van de betrokken Partij.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel IX

1 Voor de toepassing van deze Overeenkomst benoemt elke Partij:

a) een of meer administratieve instanties die bevoegd zijn vergunningen of certificaten namens deze Partij uit te reiken, en

b) een of meer wetenschappelijke autoriteiten.

2 Bij de nederlegging van de akten van bekrachtiging, toetreding, goedkeuring of aanvaarding, stelt elke Staat de depot-Regering tegelijkertijd in kennis van de naam en het adres van de administratieve instantie die gemachtigd is in verbinding te treden met andere Partijen en met het Secretariaat.

3 Elke wijziging in de aanwijzingen of machtigingen die ingevolge de bepalingen van dit artikel zijn gedaan, moet door de betrokken Partij ter kennis worden gebracht van het Secretariaat dat alle andere Partijen op de hoogte stelt.

4 De in het tweede lid van dit artikel bedoelde administratieve instantie moet, indien daarom wordt verzocht door het Secretariaat of de administratieve instantie van een andere Partij, hun de afdruk doen toekomen van de stempels, zegels of andere middelen die worden gebruikt om vergunningen of certificaten te legaliseren.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel X

In geval van uitvoer of wederuitvoer naar of van invoer uit een Staat die geen partij is bij deze Overeenkomst, kunnen de Partijen, in plaats van de door dit Verdrag vereiste vergunningen en certificaten, gelijksoortige, door de bevoegde autoriteiten van genoemde Staat uitgereikte documenten aanvaarden; deze documenten moeten in essentie overeenstemmen met de in dit Verdrag voor vergunningen en certificaten vereiste voorwaarden.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XI

1 Het Secretariaat roept niet later dan twee jaar na de inwerkingtreding van dit Verdrag een vergadering van de Conferentie der Partijen bijeen.

2 Vervolgens roept het Secretariaat, tenzij de Conferentie anders besluit, tenminste eenmaal per twee jaar gewone vergaderingen bijeen, en buitengewone zittingen te allen tijde op schriftelijk verzoek van tenminste een derde deel der Partijen.

3 Tijdens gewone of buitengewone vergaderingen van deze Conferentie geven de Partijen een overzicht van de uitvoering van deze Overeenkomst en kunnen:

a) de nodige maatregelen nemen om het Secretariaat in staat te stellen zijn taken uit te voeren en financiële voorzieningen te treffen;

b) overeenkomstig artikel XV voorstellen tot wijziging van Bijlagen I en II overwegen en aanvaarden;

c) de voortgang bespreken ten aanzien van het herstel en behoud van de in Bijlage I, II en III opgenomen soorten;

d) elk door het Secretariaat of door enige Partij voorgelegd rapport in ontvangst nemen en behandelen; en

e) zo nodig aanbevelingen doen ter verbetering van de doeltreffendheid van deze Overeenkomst.

4 Tijdens elke gewone vergadering kunnen de Partijen de datum en de plaats vaststellen van de volgende welke overeenkomstig de bepalingen van het tweede lid van dit artikel dient te worden gehouden.

5 Tijdens elke vergadering kunnen de Partijen het huishoudelijk reglement voor die vergadering opstellen en aanvaarden.

6 De Organisatie der Verenigde Naties, haar gespecialiseerde organisaties en de Internationale Organisatie voor Atoomenergie, benevens elke bij deze Overeenkomst niet Partij zijnde Staat kunnen op de vergaderingen van de Conferentie worden vertegenwoordigd door waarnemers die recht van deelname maar geen stemrecht hebben.

7 Alle op het gebied van bescherming, behoud of beheer van wilde dier- en plantesoorten technisch gekwalificeerde instanties of instellingen die het Secretariaat in kennis hebben gesteld van hun wens zich door waarnemers te laten vertegenwoordigen op de vergaderingen van de Conferentie, worden toegelaten - tenzij tenminste een derde van de aanwezige Partijen hiertegen bezwaar aantekentop voorwaarde dat zij tot een der volgende categorieën behoren:

a) internationale, wel of niet van overheidswege ingestelde, instanties of instellingen en nationale, van overheidswege ingestelde, instanties of instellingen; en

b) nationale, niet van overheidswege ingestelde instanties of instellingen, die door de Staat waar zij zijn gevestigd voor dit doel zijn goedgekeurd.

Wanneer deze waarnemers eenmaal zijn toegelaten, hebben zij wel recht op deelname maar geen stemrecht.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XII

1 Bij de inwerkingtreding van dit Verdrag voorziet de algemeen directeur van het Milieuprogramma van de Verenigde Naties in een Secretariaat. Voor zover hij dit nodig acht, kan hij terzijde worden gestaan door internationale of nationale, hiertoe geschikte wel of niet van overheidswege ingestelde bevoegde en op het gebied van bescherming, behoud en beheer van wilde dier- en plantesoorten technisch gekwalificeerde instanties.

2 Het Secretariaat heeft de volgende taken:

a) het organiseren van de conferenties der Partijen en het verlenen van de daarbij behorende diensten;

b) het uitvoeren van de taken die op grond van de bepalingen van de artikelen XV en XVI van deze Overeenkomst aan het Secretariaat zijn toevertrouwd;

c) het ondernemen van wetenschappelijke en technische studies overeenkomstig de door de Conferentie der Partijen vastgestelde programma's, welke een bijdrage leveren aan de toepassing van deze Overeenkomst met inbegrip van studies over de normen voor de gepaste wijze van gereedmaken voor verzending en vervoer van levende specimens en studies over de middelen ter identificatie van deze specimens;

d) het bestuderen van de rapporten der Partijen en het aan de Partijen verzoeken om nadere inlichtingen hierover welke het nodig acht om de toepassing van deze Overeenkomst te verzekeren;

e) het vestigen van de aandacht der Partijen op elk vraagstuk dat betrekking heeft op de doeleinden van deze Overeenkomst;

f) het geregeld laten verschijnen en aan de Partijen doen toekomen van bijgewerkte lijsten van Bijlagen I, II en III benevens alle inlichtingen die de identificatie van de specimens van de in deze Bijlagen opgenomen soorten kunnen vergemakkelijken;

g) het ten behoeve van de Partijen opstellen van jaarverslagen over zijn eigen werkzaamheden en over de toepassing van deze Overeenkomst, benevens elk ander door de Partijen tijdens de vergaderingen van de Conferentie gevraagd rapport;

h) het doen van aanbevelingen voor het nastreven van de doeleinden en de toepassing van de bepalingen van deze Overeenkomst, met inbegrip van de uitwisseling van wetenschappelijke of technische inlichtingen;

i) het vervullen van alle andere taken die de Partijen aan het Secretariaat kunnen toevertrouwen.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XIII

1 Wanneer het Secretariaat, op grond van ontvangen inlichtingen, van mening is dat een in Bijlage I of II opgenomen soort door de handel in specimens van deze soort nadeel ondervindt of dat de bepalingen van deze Overeenkomst niet doeltreffend worden toegepast, stelt het de bevoegde administratieve instantie van de betrokken Partij of Partijen hiervan in kennis.

2 Wanneer een Partij inlichtingen ontvangt als bedoeld in het eerste lid van dit artikel, stelt zij zo snel mogelijk en voor zover haar wetgeving dit toestaat, het Secretariaat op de hoogte van alle daarmede verband houdende feiten en stelt eventueel corrigerende maatregelen voor. Wanneer de Partij meent dat een onderzoek wenselijk is, kan dit worden uitgevoerd door een of meer door genoemde Partij speciaal hiertoe gemachtigde personen.

3 De inlichtingen die door de Partij worden verschaft of voortvloeien uit een onderzoek zoals bedoeld in het tweede lid van dit artikel, worden behandeld tijdens de eerstvolgende Conferentie der Partijen, welke elke aanbeveling kan doen die haar goeddunkt.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XIV

1 De bepalingen van deze Overeenkomst zijn op geen enkele wijze van invloed op het recht der Partijen de volgende maatregelen te nemen:

a) strengere binnenlandse maatregelen wat betreft de voorwaarden waaraan de handel, het in bezit nemen, het in bezit hebben of het vervoer van specimens van in Bijlagen I, II en III opgenomen soorten, moeten voldoen, welke maatregelen kunnen worden uitgebreid tot een volledig verbod; of

b) binnenlandse maatregelen die de handel, het in bezit nemen, het in bezit hebben of het vervoer van niet in Bijlage I, II of III opgenomen soorten beperken of verbieden.

2 De bepalingen van deze Overeenkomst zijn op geen enkele wijze van invloed op de binnenlandse maatregelen of de verplichtingen der Partijen die voortvloeien uit alle verdragen, of internationale overeenkomsten betreffende andere aspecten van de handel, het in bezit nemen, het in bezit hebben of het vervoer van specimens, welke ten aanzien van elke Partij van kracht zijn of kunnen worden, met inbegrip van elke maatregel op het gebied van de douane, de volksgezondheid, de diergeneeskunde of de quarantaine van planten.

3 De bepalingen van deze Overeenkomst zijn op geen enkele wijze van invloed op de bepalingen van of de verplichtingen die voortvloeien uit een tussen Staten reeds gesloten of nog te sluiten verdrag, een nationale of andere overeenkomst waarbij een unie of een regionale handelszone in het leven wordt geroepen die de instelling of de handhaving van gemeenschappelijke douanecontrole aan de buitengrenzen en de opheffing van douanecontrole tussen de partijen met zich brengt, voor zover deze bepalingen of verplichtingen betrekking hebben op de handel tussen de lid-Staten van een dergelijke unie of handelszone.

4 Een bij deze Overeenkomst Partij zijnde Staat die eveneens Partij is bij een ander verdrag, of een andere internationale overeenkomst welke van kracht is op het tijdstip van de inwerkingtreding van deze Overeenkomst en waarvan de bepalingen bescherming verlenen aan de in Bijlage II opgenomen mariene soorten, wordt ontheven van de verplichtingen die hem op grond van de bepalingen van deze Overeenkomst zijn opgelegd, wat betreft de handel in specimens van in Bijlage II opgenomen soorten die door in die Staat geregistreerde schepen en in overeenstemming met de bepalingen van dat andere verdrag of van die andere internationale overeenkomst, uit de zee zijn verkregen.

5 Niettegenstaande de bepalingen van de artikelen III, IV en V is voor de uitvoer van een overeenkomstig het vierde lid van dit artikel verkregen specimen slechts een certificaat vereist van een administratieve instantie van de Staat waar dit specimen is aangevoerd, waarin wordt verklaard dat het specimen overeenkomstig de bepalingen van het andere desbetreffende verdrag, of de andere internationale overeenkomst, is verkregen.

6 De bepalingen van deze Overeenkomst laten onverlet de codificatie en de ontwikkeling van het zeerecht door de Conferentie der Verenigde Naties over het Zeerecht, bijeengeroepen op grond van Resolutie No. 2750 C (XXV) van de Algemene Vergadering van de Verenigde Naties, benevens de huidige of toekomstige eisen en juridische standpunten van elke Staat inzake het zeerecht en de aard en omvang van zijn rechtsmacht ten aanzien van het zeegebied langs zijn kust en de onder zijn vlag varende schepen.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XV

1 De volgende bepalingen zijn van toepassing met betrekking tot de wijziging van Bijlagen I en II die worden voorgesteld tijdens de vergaderingen van de Conferentie der Partijen:

a) Elke Partij kan een wijziging van Bijlage I of II voorstellen ter behandeling tijdens de volgende vergadering. De tekst van het wijzigingsvoorstel wordt ten minste 150 dagen voor de vergadering aan het Secretariaat medegedeeld.

Het Secretariaat raadpleegt de andere Partijen en betrokken instanties over de wijziging, overeenkomstig de bepalingen van het tweede lid, letters b en c, van dit artikel, en doet ten minste dertig dagen voor de vergadering de antwoorden toekomen aan alle Partijen.

b) De wijzigingen worden aangenomen met een twee derde meerderheid der aanwezige en hun stem uitbrengende Partijen. In dit verband betekent „aanwezige en hun stem uitbrengende Partijen” de Partijen die aanwezig zijn en die een stem voor of tegen uitbrengen. Bij het berekenen van de voor het aannemen van de wijziging vereiste twee derde meerderheid, worden onthoudingen niet meegeteld.

c) De tijdens een vergadering aangenomen wijzigingen worden 90 dagen na deze vergadering van kracht voor alle Partijen, met uitzondering van die welke overeenkomstig de bepalingen van het derde lid van dit artikel een voorbehoud maken.

2 De volgende bepalingen zijn van toepassing met betrekking tot de wijzigingen van Bijlage I en II die worden voorgesteld in de periode tussen de vergaderingen van de Conferenties der Partijen:

a) Elke Partij kan een wijziging van Bijlage I of II voorstellen ter behandeling in de periode tussen de vergaderingen volgens de in dit lid vastgestelde wijze van stemming per brief.

b) Wat betreft de mariene soorten zendt het Secretariaat de tekst van de voorgestelde wijziging direct na ontvangst door aan de Partijen. Het pleegt eveneens overleg met de intergouvernementele instellingen die op het terrein van deze soorten werkzaam zijn, in het bijzonder met het oog op het verkrijgen van wetenschappelijke gegevens die deze instanties kunnen verschaffen en het verzekeren van de coördinatie van alle door deze instanties getroffen maatregelen tot behoud van deze soorten. Het Secretariaat stelt de Partijen zo snel mogelijk op de hoogte van de door deze instanties tot uitdrukking gebrachte meningen en verschafte gegevens benevens van zijn eigen conclusies en aanbevelingen.

c) Wat betreft de niet mariene soorten zendt het Secretariaat de tekst van de voorgestelde wijziging direct na ontvangst door aan de Partijen. Vervolgens doet het hun zo snel mogelijk zijn eigen aanbevelingen toekomen.

d) Elke Partij kan, binnen 60 dagen na de datum waarop het Secretariaat ingevolge het bepaalde in letter b) of c) van dit lid zijn aanbevelingen aan de Partijen heeft doen toekomen, aan dit Secretariaat opmerkingen aangaande de voorgestelde wijziging benevens relevante wetenschappelijke gegevens en inlichtingen toezenden.

e) Het Secretariaat deelt de Partijen zo snel mogelijk de antwoorden mede die het heeft ontvangen, vergezeld van zijn eigen aanbevelingen.

f) Indien het Secretariaat geen bezwaar tegen de voorgestelde wijziging heeft ontvangen binnen 30 dagen na de datum waarop het de op grond van het bepaalde in letter e) van dit lid ontvangen antwoorden en aanbevelingen heeft medegedeeld, wordt de wijziging 90 dagen later van kracht voor alle Partijen met uitzondering van die welke overeenkomstig het bepaalde in het derde lid van dit artikel een voorbehoud maken.

g) Indien het Secretariaat een bezwaar van een Partij ontvangt, moet over de voorgestelde wijziging overeenkomstig het bepaalde in de letters h), i) en j) van dit lid per brief worden gestemd.

h) Het Secretariaat stelt de Partijen in kennis van een ingediend bezwaar.

i) Tenzij het Secretariaat de stemmen voor of tegen of de ontvangen van ten minste de helft der Partijen heeft ontvangen binnen 60 dagen na de datum der kennisgeving overeenkomstig letter h) van dit lid, wordt de voorgestelde wijziging verwezen naar de volgende vergadering van de Conferentie om opnieuw te worden behandeld.

j) Mits door ten minste de helft der Partijen een stem is uitgebracht, wordt de voorgestelde wijziging aangenomen bij een meerderheid van twee derde der Partijen die hetzij één stem voor, hetzij één stem tegen hebben uitgebracht.

k) Het Secretariaat stelt alle Partijen in kennis van het resultaat der stemming.

l) Indien de voorgestelde wijziging is aangenomen, wordt zij 90 dagen na de datum van kennisgeving door het Secretariaat van de aanvaarding van kracht voor alle Partijen, met uitzondering van die welke overeenkomstig de bepalingen van het derde lid van dit artikel een voorbehoud maken.

3 Tijdens de periode van 90 dagen zoals bedoeld in letter c) van het eerste lid of in letter 1) van het tweede lid van dit artikel, kan elke Partij, door middel van een schriftelijke kennisgeving aan de depot-Regering, een voorbehoud maken ten aanzien van de wijziging. Zolang dit voorbehoud niet is ingetrokken, wordt deze Partij beschouwd als een Staat die geen Partij is bij deze Overeenkomst wat betreft de handel in bedoelde soorten.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XVI

1 Elke Partij kan te allen tijde aan het Secretariaat een lijst voorleggen van soorten, waarvan hij verklaart dat hij hen, binnen de grenzen van zijn bevoegdheid, tot het onderwerp heeft gemaakt van een regeling ter verwezenlijking van de in het derde lid van artikel II voorziene doeleinden. Bijlage III bevat de namen van de Partijen die de soort daarop hebben doen opnemen, de wetenschappelijke namen van die soorten en de delen der betreffende dieren en planten en de hieruit verkregen produkten welke uitdrukkelijk worden vermeld met betrekking tot de soort overeenkomstig het bepaalde in letter b) van artikel I.

2 Elke ingevolge het bepaalde in het eerste lid van dit artikel voorgelegde lijst, wordt door het Secretariaat zo spoedig mogelijk na ontvangst aan de Partijen medegedeeld. De lijst wordt als een integrerend deel van Bijlage III van kracht 90 dagen na de datum van een dergelijke mededeling. Elke Partij kan, te allen tijde na ontvangst van deze lijst, door middel van een schriftelijke kennisgeving aan de depot-Regering, een voorbehoud ten aanzien van elke soort, elk deel van of elk produkt verkregen uit de betreffende dieren of planten, indienen en zolang dit voorbehoud niet is ingetrokken, wordt die Staat beschouwd als een Staat die geen Partij bij deze Overeenkomst is wat betreft de handel in de soort of het deel van of het verkregen produkt uit de betreffende dieren of planten.

3 Een Partij die een soort in Bijlage III heeft laten opnemen, kan dit te allen tijde weer ongedaan maken door middel van een schriftelijke kennisgeving aan het Secretariaat dat alle Partijen hiervan in kennis stelt. De ongedaanmaking wordt 30 dagen na de datum van deze kennisgeving van kracht.

4 Elke Partij die op grond van het bepaalde in het eerste lid van dit artikel een lijst voorlegt, doet aan het Secretariaat een afschrift toekomen van alle binnenlandse wetten en bepalingen die van toepassing zijn op de bescherming van deze soorten, vergezeld van alle toelichtingen die de Partij nodig acht of welke het Secretariaat haar kan vragen. Zolang deze soorten in Bijlage III opgenomen blijven, doet de Partij mededeling van elke wijziging in deze wetten en bepalingen of elke nieuwe toelichting, zodra deze zijn aangenomen.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XVII

1 Indien ten minste een derde der Partijen hiertoe een schriftelijk verzoek indient wordt door het Secretariaat een buitengewone vergadering van de Conferentie der Partijen uitgeschreven, ten einde wijzigingen in deze Overeenkomst te behandelen en aan te nemen. Deze wijzigingen worden aangenomen met een meerderheid van twee derde der aanwezige en hun stem uitbrengende Partijen. In dit verband betekent „aanwezige en hun stem uitbrengende Partijen” de Partijen die aanwezig zijn en die een stem voor of tegen uitbrengen. Bij het berekenen van de voor het aannemen van een wijziging vereiste twee derde meerderheid, worden onthoudingen niet meegeteld.

2 Het Secretariaat doet de tekst van elk wijzigingsvoorstel ten minste 90 dagen voor de zitting van de Conferentie aan alle Partijen toekomen.

3 Een wijziging wordt van kracht voor de Partijen die deze hebben goedgekeurd op de zestigste dag nadat twee derde der Partijen een akte van goedkeuring van de wijziging bij de depot-Regering hebben nedergelegd. Vervolgens wordt de wijziging voor elke andere Partij van kracht 60 dagen na de nederlegging door genoemde Partij van haar akte van goedkeuring van de wijziging.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XVIII

1 Over elk tussen twee of meer Partijen bij deze Overeenkomst gerezen geschil ten aanzien van de interpretatie of de toepassing van de bepalingen van deze Overeenkomst, wordt tussen bij het geschil betrokken Partijen onderhandeld.

2 Indien het geschil niet overeenkomstig de in het eerste lid van dit artikel kan worden geregeld, kunnen de Partijen met wederzijds goedvinden het geschil aan arbitrage onderwerpen, met name aan die van het Permanente Hof van Arbitrage te 's-Gravenhage; de Partijen die het geschil aan arbitrage hebben onderworpen, zijn door de arbitrale uitspraak gebonden.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XIX

Deze Overeenkomst staat open voor ondertekening te Washington tot 30 april 1973 en na deze datum te Bern tot 31 december 1974.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XX

Deze Overeenkomst moet worden bekrachtigd, aanvaard of goedgekeurd. De akten van bekrachtiging, aanvaarding of goedkeuring worden nedergelegd bij de Regering van de Zwitserse Bondsstaat die optreedt als depot-Regering.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XXI

Deze Overeenkomst staat voor onbepaalde tijd open voor toetreding. De akten van toetreding worden nedergelegd bij de depot-Regering.

1. Deze Overeenkomst staat open voor toetreding door organisaties voor regionale economische integratie, opgericht door soevereine Staten, die bevoegd zijn met betrekking tot het onderhandelen over en het sluiten en het ten uitvoer leggen van internationale overeenkomsten betreffende aangelegenheden aan hen overgedragen door hun Lid-Staten en vallend onder deze Overeenkomst.

2. In hun akten van toetreding geven deze organisaties de reikwijdte aan van hun bevoegdheid met betrekking tot de door de Overeenkomst geregelde aangelegenheden. Deze organisaties stellen ook de depot-Regering in kennis van alle belangrijke wijzigingen in de reikwijdte van hun bevoegdheid. Kennisgevingen van organisaties voor regionale economische integratie betreffende hun bevoegdheid met betrekking tot aangelegenheden, geregeld door deze Overeenkomst, en wijzigingen in deze bevoegdheid, worden door de depot-Regering toegezonden aan de Partijen.

3. In binnen hun bevoegdheid vallende aangelegenheden oefenen deze organisaties voor regionale economische integratie de rechten uit en vervullen zij de verplichtingen die deze Overeenkomst toekent respectievelijk oplegt aan hun Lid-Staten die Partij bij de Overeenkomst zijn. In zulke gevallen zijn de Lid-Staten van de organisaties niet gerechtigd zulke rechten afzonderlijk uit te oefenen.

4. Op de terreinen waarop zij bevoegd zijn, oefenen de organisaties voor regionale economische integratie hun stemrecht uit met een aantal stemmen gelijk aan het aantal van hun Lid-Staten dat Partij bij de Overeenkomst is. Deze organisaties oefenen hun stemrecht niet uit indien hun Lid-Staten hun stemrecht uitoefenen, en omgekeerd.

5. Alle verwijzingen naar „Partij” in de zin gebruikt in artikel I, letter (h) van deze Overeenkomst, naar „Staat”/,,Staten” of naar bij de Overeenkomst „Partij zijnde Staat”/„Staten” worden zo uitgelegd, dat daarmede tevens wordt verwezen naar organisaties voor regionale economische integratie die bevoegd zijn met betrekking tot het onderhandelen over en het sluiten en het toepassen van internationale overeenkomsten betreffende onder deze Overeenkomst vallende aangelegenheden.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XXII

1 Deze Overeenkomst treedt in werking 90 dagen na de nederlegging van de tiende akte van bekrachtiging, aanvaarding, goedkeuring of toetreding bij de depot-Regering.

2 Voor elke Staat die deze Overeenkomst bekrachtigt, aanvaardt, goedkeurt of daartoe toetreedt na de nederlegging van de tiende akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, treedt deze Overeenkomst in werking 90 dagen na de nederlegging door die Staat van zijn akte van bekrachtiging, aanvaarding, goedkeuring of toetreding.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XXIII

1 Ten aanzien van deze Overeenkomst kunnen geen algemene voorbehouden worden gemaakt. Overeenkomstig het bepaalde in dit artikel en in de artikelen XV en XVI kunnen slechts bijzondere voorbehouden worden gemaakt.

2 Elke Staat kan bij de nederlegging van zijn akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, een bijzonder voorbehoud maken betreffende:

a) elke in Bijlage I, II of III opgenomen soort; of

b) alle delen van of alle produkten verkregen uit een dier of een plant van een in Bijlage III opgenomen soort.

3 Zolang een Partij haar op grond van de bepalingen van dit artikel gemaakt voorbehoud niet intrekt, wordt deze beschouwd als een Staat die geen Partij bij deze Overeenkomst is wat betreft de handel in soorten, delen van of produkten verkregen uit een dier of een plant, zoals nader aangeduid in genoemd voorbehoud.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XXIV

Elke Partij kan deze Overeenkomst opzeggen door middel van een aan de depot-Regering gerichte schriftelijke kennisgeving. De opzegging treedt in werking twaalf maanden nadat de depot-Regering deze kennisgeving heeft ontvangen.

Overeenkomst inzake de internationale handel in bedreigde in het wild levende dier- en plantesoorten

Artikel XXV

1 Het oorspronkelijke exemplaar van deze Overeenkomst, waarvan de Chinese, de Engelse, de Franse, de Russische en de Spaanse tekst gelijkelijk authentiek zijn, wordt nedergelegd bij de depot-Regering die daarvan voor eensluidend gewaarmerkte afschriften doet toekomen aan alle Staten die haar hebben ondertekend of die akten van toetreding tot deze Overeenkomst hebben nedergelegd.

2 De depot-Regering stelt de ondertekenende en tot deze Overeenkomst toetredende Staten en het Secretariaat in kennis van de ondertekeningen, de nederlegging van akten van bekrachtiging, aanvaarding, goedkeuring of toetreding, de inwerkingtreding van deze Overeenkomst, wijzigingen daarvan, de indiening en intrekking van voorbehouden en kennisgevingen van opzegging.

3 Zodra deze Overeenkomst in werking is getreden, doet de depot-Regering een voor eensluidend gewaarmerkt afschrift van deze Overeenkomst toekomen aan het Secretariaat der Verenigde Naties ter registratie en publikatie overeenkomstig artikel 102 van het Handvest der Verenigde Naties.
