Resolution on the Spacelab Programme Overeenkomst tussen bepaalde Lid-Staten van de Europese Organisatie voor Ruimteonderzoek en de Europese Organisatie voor Ruimteonderzoek betreffende de uitvoering van het Ruimtelaboratorium-programma

The Council,

Recalling its decision to authorise the Director General to execute the first part of the Phase B studies on the Sortie Laboratory (“Spacelab”) programme up to 31 July 1973 (ESRO/C/MIN/50),

In application of the agreement reached at the Ministerial Meeting of the European Space Conference held in Brussels on 20 December 1972 regarding the Spacelab programme, and following the letter to the American authorities from the President of the ESC (see CSE/CS(73)1),

Recalling that Belgium, Germany, Italy and Spain are already engaged on the Phase B studies for this programme, and noting that they have expressed the desire to conclude an arrangement among themselves and with the Organisation regarding the execution of the Spacelab programme by ESRO, and that other countries have expressed in varying degrees their interest in this important programme,

Notes that the programme in question is in conformity with the general purposes of ESRO and, pending the establishment of a single European space organisation,

Authorises, by virtue of Article VIII of the ESRO Convention opened for signature in Paris on 14 June 1962, the Director General to:

(a) negotiate with the participating States and other interested States the terms of an Arrangement concerning the execution of the programme, the definitive establishment of the Programme Board which shall be responsible for the programme, and laying down the details of its implementation; this Arrangement shall include a provision according to which it will be open for Participating States to withdraw until 15 August 1973 if the results of the Phase B studies should indicate that the present estimates be significantly exceeded;

(b) pending the entry into force of the Arrangement under (a), make the Organisation's assistance available, and permit the use of its facilities for the said programme, within such limits as the Council may fix, provided that this does not adversely affect the satisfactory execution of the Organisation's other programmes;

(c) pending the entry into force of the Arrangement under (a), conclude the necessary contracts for the execution of the programme, within the limits of the financial commitments made by Participating States and in conformity with the rules and procedures in force in the Organisation;

(d) contact NASA for the purpose of negotiating with that body the appropriate legal framework for the cooperation between the two agencies, and submit to the Council as soon as possible a draft proposal on the subject, and to assist the participating and other interested Governments in the negotiations for an intergovernmental agreement which may be concluded with the United States;

(e) pending the entry into force of the Arrangement under (a), take any other measures that may be necessary for the satisfactory execution of the programme;

Requests its Chairman to inform the American authorities and the President of the ESC of the decisions it has taken,

Requests the Director General to produce a report by 31 March 1973 describing the measures he proposes taking to ensure that this programme does not adversely affect the satisfactory execution of the Organisation's other programmes.
