Protocol of 1978 relating to the International Convention for the Prevention of Pollution from Ships, 1973

Article I

1 The Parties to the present Protocol undertake to give effect to the provisions of:

(a) the present Protocol and the Annex hereto which shall constitute an integral part of the present Protocol; and

(b) the International Convention for the Prevention of Pollution from Ships, 1973 (hereinafter referred to as “the Convention”), subject to the modifications and additions set out in the present Protocol.

2 The provisions of the Convention and the present Protocol shall be read and interpreted together as one single instrument.

3 Every reference to the present Protocol constitutes at the same time a reference to the Annex hereto.

Article II

1 Notwithstanding the provisions of Article 14(1) of the Convention, the Parties to the present Protocol agree that they shall not be bound by the provisions of Annex II of the Convention for a period of three years from the date of entry into force of the present Protocol or for such longer period as may be decided by a two-thirds majority of the Parties to the present Protocol in the Marine Environment Protection Committee (hereinafter referred to as “the Committee”) of the Inter-Governmental Maritime Consultative Organization (hereinafter referred to as “the Organization”).

2 During the period specified in paragraph 1 of this Article, the Parties to the present Protocol shall not be under any obligations nor entitled to claim any privileges under the Convention in respect of matters relating to Annex II of the Convention and all reference to Parties in the Convention shall not include the Parties to the present Protocol in so far as matters relating to that Annex are concerned.

Article IV

1 The present Protocol shall be open for signature at the Headquarters of the Organization from 1 June 1978 to 31 May 1979 and shall thereafter remain open for accession. States may become Parties to the present Protocol by:

(a) signature without reservation as to ratification, acceptance or approval; or

(b) signature, subject to ratification, acceptance or approval, followed by ratification, acceptance or approval; or

(c) accession.

2 Ratification, acceptance, approval or accession shall be effected by the deposit of an instrument to that effect with the Secretary-General of the Organization.

Article V

1 The present Protocol shall enter into force twelve months after the date on which not less than fifteen States, the combined merchant fleets of which constitute not less than fifty per cent of the gross tonnage of the world's merchant shipping, have become Parties to it in accordance with Article IV of the present Protocol.

2 Any instrument of ratification, acceptance, approval or accession deposited after the date on which the present Protocol enters into force shall take effect three months after the date of deposit.

3 After the date on which an amendment to the present Protocol is deemed to have been accepted in accordance with Article 16 of the Convention, any instrument of ratification, acceptance, approval or accession deposited shall apply to the present Protocol as amended.

Article VI

The procedures set out in Article 16 of the Convention in respect of amendments to the Articles, an Annex and an Appendix to an Annex of the Convention shall apply respectively to amendments to the Articles, the Annex and an Appendix to the Annex of the present Protocol.

Article VII

1 The present Protocol may be denounced by any Party to the present Protocol at any time after the expiry of five years from the date on which the Protocol enters into force for that Party.

2 Denunciation shall be effected by the deposit of an instrument of denunciation with the Secretary-General of the Organization.

3 A denunciation shall take effect twelve months after receipt of the notification by the Secretary-General of the Organization or after the expiry of any other longer period which may be indicated in the notification.

Article VIII

1 The present Protocol shall be deposited with the Secretary-General of the Organization (hereinafter referred to as “the Depositary”).

2 The Depositary shall:

(a) inform all States which have signed the present Protocol or acceded thereto of:

(i) each new signature or deposit of an instrument of ratification, acceptance, approval or accession, together with the date thereof;

(ii) the date of entry into force of the present Protocol;

(iii) the deposit of any instrument of denunciation of the present Protocol together with the date on which it was received and the date on which the denunciation takes effect;

(iv) any decision made in accordance with Article 11(1) of the present Protocol;

(b) transmit certified true copies of the present Protocol to all States which have signed the present Protocol or acceded thereto.

3 As soon as the present Protocol enters into force, a certified true copy thereof shall be transmitted by the Depositary to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.

Article IX

The present Protocol is established in a single original in the English, French, Russian and Spanish languages, each text being equally authentic. Official translations in the Arabic, German, Italian and Japanese languages shall be prepared and deposited with the signed original.

Annex — MODIFICATIONS AND ADDITIONS TO THE INTERNATIONAL CONVENTION FOR THE PREVENTION OF POLLUTION FROM SHIPS, 1973

Wijzigt het Internationaal Verdrag ter voorkoming van verontreiniging door schepen, 1973, zoals gewijzigd door het Protocol daarbij van 1978; Londen, 2 november 1973.

Artikel I

1 De Partijen bij dit Protocol verbinden zich uitvoering te geven aan de bepalingen van:

(a) dit Protocol en de Bijlage daarbij, die een integrerend deel van dit Protocol vormt; en

(b) het Internationaal Verdrag ter voorkoming van verontreiniging door schepen, 1973 (hierna te noemen „het Verdrag”), behoudens de wijzigingen en aanvullingen vermeld in dit Protocol.

2 De bepalingen van het Verdrag en dit Protocol worden te zamen beschouwd en uitgelegd als een en dezelfde akte.

3 Iedere verwijzing naar dit Protocol vormt tevens een verwijzing naar de Bijlage daarbij.

Artikel II

1 Niettegenstaande het bepaalde in artikel 14, eerste lid, van het Verdrag komen de Partijen bij dit Protocol overeen dat zij door de bepalingen van Bijlage II bij het Verdrag niet zijn gebonden gedurende een tijdvak van drie jaar te rekenen van de datum van inwerkingtreding van dit Protocol of gedurende een langer tijdvak waartoe mocht worden besloten door een twee derde meerderheid van de Partijen bij dit Protocol in de Commissie voor de bescherming van het mariene milieu (hierna te noemen „de Commissie”) van de Intergouvernementele Maritieme Consultatieve Organisatie (hierna te noemen „de Organisatie”).

2 Gedurende het tijdvak bepaald in het eerste lid van dit artikel zijn de Partijen bij dit Protocol noch gebonden door verplichtingen, noch gerechtigd aanspraak te maken op voorrechten krachtens het Verdrag ten aanzien van kwesties verband houdend met Bijlage II bij het Verdrag en heeft iedere in het Verdrag voorkomende verwijzing naar de Partijen niet betrekking op de Partijen bij dit Protocol voor zover het kwesties betreft die verband houden met bedoelde Bijlage.

Artikel III

Wijzigt het Internationaal Verdrag ter voorkoming van verontreiniging door schepen, 1973, zoals gewijzigd door het Protocol daarbij van 1978; Londen, 2 november 1973.

Artikel IV

1 Dit Protocol staat van 1 juni 1978 tot 31 mei 1979 op de zetel van de Organisatie open voor ondertekening en blijft daarna openstaan voor toetreding. Staten kunnen Partij bij dit Protocol worden door:

(a) ondertekening zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring; of

(b) ondertekening onder voorbehoud van bekrachtiging, aanvaarding of goedkeuring, gevolgd door bekrachtiging, aanvaarding of goedkeuring; of

(c) toetreding.

2 Bekrachtiging, aanvaarding, goedkeuring of toetreding geschiedt door nederlegging van een daartoe strekkende akte bij de Secretaris-Generaal van de Organisatie.

Artikel V

1 Dit Protocol treedt in werking twaalf maanden na de datum waarop niet minder dan vijftien Staten waarvan de koopvaardijvloten te zamen ten minste vijftig procent vormen van de bruto tonnage van de wereldkoopvaardijvloot, Partij bij dit Protocol zijn geworden overeenkomstig artikel IV van dit Protocol.

2 Iedere akte van bekrachtiging, aanvaarding, goedkeuring of toetreding nedergelegd na de datum waarop dit Protocol in werking treedt, wordt van kracht drie maanden na de datum van nederlegging.

3 Na de datum waarop een wijziging op dit Protocol wordt geacht te zijn aanvaard overeenkomstig artikel 16 van het Verdrag, heeft iedere nedergelegde akte van bekrachtiging, aanvaarding, goedkeuring of toetreding betrekking op dit Protocol zoals gewijzigd.

Artikel VI

De procedures bepaald in artikel 16 van het Verdrag ten aanzien van wijzigingen van de artikelen van het Verdrag, van een Bijlage en van een Aanhangsel van een Bijlage bij het Verdrag gelden respectievelijk voor de wijzigingen van de artikelen van dit Protocol, van de Bijlage en van een Aanhangsel van de Bijlage bij dit Protocol.

Artikel VII

1 Dit Protocol kan door iedere Partij bij dit Protocol te allen tijde worden opgezegd na verloop van vijf jaar te rekenen van de datum waarop het Protocol voor die Partij in werking is getreden.

2 Opzegging geschiedt door nederlegging van een akte van opzegging bij de Secretaris-Generaal van de Organisatie.

3 Een opzegging wordt van kracht twaalf maanden na ontvangst van de kennisgeving door de Secretaris-Generaal van de Organisatie, dan wel na het verstrijken van een langer tijdvak indien zulks in de kennisgeving is aangeduid.

Artikel VIII

1 Dit Protocol wordt neder gelegd bij de Secretaris-Generaal van de Organisatie (hierna te noemen „de depositaris”).

2 De depositaris:

(a) doet alle Staten die dit Protocol hebben ondertekend of daartoe zijn toegetreden, mededeling van:

(i) iedere nieuwe ondertekening of nederlegging van een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, met vermelding van de datum daarvan;

(ii) de datum van inwerkingtreding van dit Protocol;

(iii) de nederlegging van iedere akte van opzegging van dit Protocol, met vermelding van de datum waarop deze is ontvangen alsmede van de datum waarop de opzegging van kracht wordt;

(iv) ieder besluit genomen overeenkomstig artikel II, eerste lid, van dit Protocol;

(b) zendt voor eensluidend gewaarmerkte afschriften van dit Protocol aan alle Staten die het Protocol hebben ondertekend of daartoe zijn toegetreden.

3 Zodra dit Protocol in werking treedt, wordt een voor eensluidend gewaarmerkt afschrift door de depositaris toegezonden aan het Secretariaat van de Verenigde Naties ter registratie en publikatie, overeenkomstig artikel 102 van het Handvest der Verenigde Naties.

Artikel IX

Dit Protocol is opgesteld in een enkel exemplaar, in de Engelse, de Franse, de Russische en de Spaanse taal, zijnde alle teksten gelijkelijk authentiek. Er worden officiële vertalingen vervaardigd in de Arabische, de Duitse, de Italiaanse en de Japanse taal en deze worden nedergelegd bij het ondertekende oorspronkelijke exemplaar.
