Nr. I Notawisseling tussen de Regering van het Koninkrijk der Nederlanden en de Regering van het Koninkrijk Noorwegen houdende een overeenkomst inzake het verlenen van vergunningen aan zendamateurs

The Embassy of the Kingdom of the Netherlands presents its compliments to the Ministry of Foreign Affairs of the Kingdom of Norway and with reference to the conversations between representatives of the Government of the Kingdom of the Netherlands and representatives of the Government of the Kingdom of Norway concerning the possibility of an agreement between the two Governments on the reciprocal granting of permissions to licensed amateur radio operators of either country to operate stations in the other country, in accordance with the provisions of Article 41 of the Radio Regulation under the International Telecommunications Convention of Malaga-Torremolinos, 1973, has the honour to inform the Ministry that the Government of the Kingdom of the Netherlands is prepared to conclude such an agreement with the Government of the Kingdom of Norway in the following terms.

1. A national of the Kingdom of the Netherlands who is licensed by his Government as an amateur radio operator and who operates an amateur radio station licensed by the said Government shall, when visiting Norway, be permitted by the appropriate Norwegian authority to operate an amateur radio service station subject to the conditions in this Agreement.

2. A national of the Kingdom of Norway who is licensed by his Government as an amateur radio operator and who operates an amateur radio station licensed by the said Government shall, when visiting the Kingdom of the Netherlands, be permitted by the appropriate Netherlands authority to operate an amateur radio station subject to the conditions in this Agreement.

3. The national who is licensed by his Government as an amateur radio operator, shall, before being permitted to operate a station as provided for in paragraphes 1 and 2, obtain from the appropriate administrative authority of the other Government, an authorization for that purpose.

4. The appropriate administrative authority of each Government may issue or cancel an authorization as referred to in paragraph 3, under the same conditions and terms as authorizations for its own nationals.

5. If an authorization referred to in paragraph 3 is cancelled by the appropriate administrative authority of either Government, the authority concerned shall inform the appropriate administrative authority of the other Government of such cancellation.

6. The amateur radio stations of the Kingdom of the Netherlands and of the Kingdom of Norway, while being operated under the terms of this Agreement shall comply with the pertinent rules and regulations of the country in which they are operated, as well as the pertinent international rules and regulations.

7. Amateur radio operating privileges provided for in this Agreement shall be granted on the basis of reciprocity.

8. As regards the Kingdom of the Netherlands, the present provisions shall apply to the Kingdom in Europe only.

If the foregoing proposal is acceptable to the Government of the Kingdom of Norway, the Embassy has furthermore the honour to propose that the present Note and the Ministry's reply concurring therein shall constitute an Agreement between the two Governments, which shall enter into effect on the date that both Governments have communicated each other in writing that the constitutional requirements in their respective countries have been complied with.

The Agreement shall remain in force for an indefinite period and be subject to termination by either Government serving six months' notice on the other.

The Agreement may be extended to the Netherlands Antilles. Such extension shall take effect from such date and subject to the necessary modifications, as may be agreed upon in notes to be exchanged through diplomatic channels. After such extension has been effected, termination by the Government of the Kingdom of the Netherlands may be limited to one of the constituent parts of the Kingdom.

The Royal Netherlands Embassy avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Kingdom of Norway the assurances of its highest consideration.
