Convention concerning the Promotion of Collective Bargaining › PART I — SCOPE AND DEFINITIONS

Article 1

1 This Convention applies to all branches of economic activity.

2 The extent to which the guarantees provided for in this Convention apply to the armed forces and the police may be determined by national laws or regulations or national practice.

3 As regards the public service, special modalities of application of this Convention may be fixed by national laws or regulations or national practice.

Convention concerning the Promotion of Collective Bargaining › PART I — SCOPE AND DEFINITIONS

Article 2

For the purpose of this Convention the term "collective bargaining" extends to all negotiations which take place between an employer, a group of employers or one or more employers' organisations, on the one hand, and one or more workers' organisations, on the other, for

(a) determining working conditions and terms of employment; and/or

(b) regulating relations between employers and workers; and/or

(c) regulating relations between employers or their organisation and a workers organisation or workers' organisations.

Convention concerning the Promotion of Collective Bargaining › PART I — SCOPE AND DEFINITIONS

Article 3

1 Where national law or practice recognises the existence of workers' representatives as defined in Article 3, subparagraph (b), of the Workers' Representatives Convention, 1971, national law or practice may determine the extent to which the term “collective bargaining” shall also extend, for the purpose of this Convention, to negotiations with these representatives.

2 Where, in pursuance of paragraph 1 of this Article, the term “collective bargaining” also includes negotiations with the workers' representatives referred to in that paragraph, appropriate measures shall be taken, wherever necessary, to ensure that the existence of these representatives is not used to undermine the position of the workers' organisations concerned.

Convention concerning the Promotion of Collective Bargaining › PART II — METHODS OF APPLICATION

Article 4

The provisions of this Convention shall, in so far as they are not otherwise made effective by means of collective agreements, arbitration awards or in such other manner as may be consistent with national practice, be given effect by national laws or regulations.

Convention concerning the Promotion of Collective Bargaining › PART III — PROMOTION OF COLLECTIVE BARGAINING

Article 5

1 Measures adapted to national conditions shall be taken to promote collective bargaining.

2 The aims of the measures referred to in paragraph 1 of this Article shall be the following:

(a) collective bargaining should be made possible for all employers and all groups of workers in the branches of activity covered by this Convention;

(b) collective bargaining should be progressively extended to all matters covered by subparagraphs (a), (b) and (c) of Article 2 of this Convention;

(c) the establishment of rules of procedure agreed between employers' and workers' organisations should be encouraged;

(d) collective bargaining should not be hampered by the absence of rules governing the procedure to be used or by the inadequacy or inappropriateness of such rules;

(e) bodies and procedures for the settlement of labour disputes should be so conceived as to contribute to the promotion of collective bargaining.

Article 6

The Provisions of this Convention do not preclude the operation of industrial relations systems in which collective bargaining takes place within the framework of conciliation and/or arbitration machinery or institutions, in which machinery or institutions the parties to the collective bargaining process voluntarily participate.

Article 7

Measures taken by public authorities to encourage and promote the development of collective bargaining shall be the subject of prior consultation and, whenever possible, agreement between public authorities and employers' and workers' organisations.

Article 8

The measures taken with a view to promoting collective bargaining shall not be so conceived or applied as to hamper the freedom of collective bargaining.

Article 9

This Convention does not revise any existing Convention or Recommendation.

Article 10

The formal ratifications of this Convention shall be communicated to the Director-General of the International Labour Office for registration.

Article 11

1 This Convention shall be binding only upon those Members of the International Labour Organisation whose ratifications have been registered with the Director-General.

2 It shall come into force twelve months after the date on which the ratifications of two Members have been registered with the Director-General.

3 Thereafter, this Convention shall come into force for any Member twelve months after the date on which its ratification has been registered.

Article 12

1 A Member which has ratified this Convention may denounce it after the expiration of ten years from the date on which the Convention first comes into force, by an act communicated to the Director-General of the International Labour Office for registration. Such denunciation shall not take effect until one year after the date on which it is registered.

2 Each Member which has ratified this Convention and which does not, within the year following the expiration of the period of ten years mentioned in the preceding paragraph, exercise the right of denunciation provided for in this Article, will be bound for another period of ten years and, thereafter, may denounce this Convention at the expiration of each period of ten years under the terms provided for in this Article.

Article 13

1 The Director-General of the International Labour Office shall notify all Members of the International Labour Organisation of the registration of all ratifications and denunciations communicated to him by the Members of the Organisation.

2 When notifying the Members of the Organisation of the registration of the second ratification communicated to him, the Director-General shall draw the attention of the Members of the Organisation to the date upon which the Convention will come into force.

Article 14

The Director-General of the International Labour Office shall communicate to the Secretary-General of the United Nations for registration in accordance with Article 102 of the Charter of the United Nations full particulars of all ratifications and acts of denunciation registered by him in accordance with the provisions of the preceding Articles.

Article 15

At such times as it may consider necessary the Governing Body of the International Labour Office shall present to the General Conference a report on the working of this Convention and shall examine the desirability of placing on the agenda of the Conference the question of its revision in whole or in part.

Article 16

1 Should the Conference adopt a new Convention revising this Convention in whole or in part, then, unless the new Convention otherwise provides

(a) indentification by a Member of the new revising Convention shall ipso jure involve the immediate denunciation of this Convention, notwithstanding the provisions of Article 12 above, if and when the new revising Convention shall have come into force;

(b) as from the date when the new revising Convention comes into force this Convention shall cease to be open to ratification by the Members.

2 This Convention shall in any case remain in force in its actual form and content for those Members which have ratified it but have not ratified the revising Convention.

Article 17

The English and French versions of the text of this Convention are equally authoritative.

The foregoing is the authentic text of the Convention duly adopted by the General Conference of the International Labour Organisation during its Sixty-seventh Session which was held at Geneva and declared closed the twenty-fourth day of June 1981.

Verdrag betreffende de bevordering van het collectief onderhandelen › DEEL I — TOEPASSINGSGEBIED EN BEGRIPSOMSCHRIJVINGEN

Artikel 1

1 Dit Verdrag is van toepassing op alle takken van economische bedrijvigheid.

2 In hoeverre de waarborgen, neergelegd in dit Verdrag, van toepassing zijn op de krijgsmacht en de politie, kan worden bepaald door nationale wetgeving of door de nationale praktijk.

3 Wat de openbare dienst betreft, kunnen door de nationale wetgeving of door de nationale praktijk bijzondere modaliteiten voor de toepassing van dit Verdrag worden vastgesteld.

Verdrag betreffende de bevordering van het collectief onderhandelen › DEEL I — TOEPASSINGSGEBIED EN BEGRIPSOMSCHRIJVINGEN

Artikel 2

Voor de toepassing van dit Verdrag wordt onder de term „collectief onderhandelen" verstaan alle onderhandelingen die plaatsvinden tussen een werkgever, een groep werkgevers of een of meer werkgeversorganisaties enerzijds en een of meer werknemersorganisaties anderzijds, om:

a) arbeids- en tewerkstellingsvoorwaarden vast te stellen; en/of

b) betrekkingen tussen werkgevers en werknemers te regelen; en/of

c) betrekkingen te regelen tussen werkgevers of hun organisaties en een of meer werknemersorganisaties.

Verdrag betreffende de bevordering van het collectief onderhandelen › DEEL I — TOEPASSINGSGEBIED EN BEGRIPSOMSCHRIJVINGEN

Artikel 3

1 Voor zover de nationale wetgeving of de nationale praktijk het bestaan erkent van werknemersvertegenwoordigers zoals omschreven in artikel 3, letter b), van het Verdrag betreffende de vertegenwoordigers van de werknemers, 1971, kan door de nationale wetgeving of de nationale praktijk worden bepaald in hoeverre de term „collectief onderhandelen” voor de toepassing van dit Verdrag tevens onderhandelingen met deze vertegenwoordigers omvat.

2 Wanneer ingevolge het eerste lid van dit artikel, de term „collectief onderhandelen” tevens de in dat lid bedoelde onderhandelingen met werknemersvertegenwoordigers omvat, dienen indien nodig passende maatregelen te worden getroffen, ten einde te waarborgen dat van het feit dat zodanige vertegenwoordigers bestaan, niet gebruik gemaakt wordt om de positie van de betrokken werknemersorganisaties te verzwakken.

Verdrag betreffende de bevordering van het collectief onderhandelen › DEEL II — WIJZE VAN TOEPASSING

Artikel 4

Voor zover de bepalingen van dit Verdrag niet worden toegepast door middel van collectieve arbeidsovereenkomsten, arbitrale uitspraken of op andere wijze overeenkomstig de nationale praktijk, worden zij toegepast door middel van nationale wetgeving.

Verdrag betreffende de bevordering van het collectief onderhandelen › DEEL III — BEVORDERING VAN COLLECTIEF ONDERHANDELEN

Artikel 5

1 Ten einde collectief onderhandelen te bevorderen, dienen aan de nationale omstandigheden aangepaste maatregelen te worden getroffen.

2 De in het eerste lid van dit artikel bedoelde maatregelen dienen ten doel te hebben:

a) dat collectief onderhandelen mogelijk wordt gemaakt voor allewerkgevers en alle categorieën van werknemers in de onder dit Verdrag vallende takken van economische bedrijvigheid;

b) dat collectief onderhandelen geleidelijk wordt uitgebreid tot alle in artikel 2, letters a), b) en c) van dit Verdrag genoemde aangelegenheden;

c) dat het totstandkomen van tussen organisaties van werkgevers en van werknemers overeengekomen procedureregels wordt aangemoedigd;

d) dat collectief onderhandelen niet wordt belemmerd door het ontbreken, tekort schieten of niet passend zijn van regels inzake de te hanteren procedure;

e) dat de organen en procedures voor het regelen van arbeidsgeschillen zo worden opgezet dat zij bijdragen aan de bevordering van collectief onderhandelen.

Verdrag betreffende de bevordering van het collectief onderhandelen › DEEL III — BEVORDERING VAN COLLECTIEF ONDERHANDELEN

Artikel 6

Het in dit Verdrag bepaalde laat onverlet het functioneren van systemen tot regeling van de betrekkingen tussen werkgevers en werknemers, waarbij collectief wordt onderhandeld in het kader van regelingen of instellingen voor bemiddeling en/of arbitrage, en waaraan door de bij het collectief onderhandelen betrokken partijen vrijwillig wordt deelgenomen.

Artikel 7

De door de overheid getroffen maatregelen ter bevordering en aanmoediging van collectief onderhandelen dienen het onderwerp te zijn van voorafgaand overleg en waar mogelijk van overeenstemming tussen de overheid en organisaties van werkgevers en van werknemers.

Artikel 8

De ter bevordering van het collectief onderhandelen getroffen maatregelen mogen niet zo worden opgesteld of toegepast dat zij de vrijheid van collectief onderhandelen belemmeren.

Artikel 9

Dit Verdrag vormt geen herziening van een bestaand verdrag of een bestaande aanbeveling.

Artikel 10

De officiële bekrachtigingen van dit Verdrag worden medegedeeld aan de Directeur-Generaal van het Internationale Arbeidsbureau en door hem geregistreerd.

Verdrag betreffende de bevordering van het collectief onderhandelen › DEEL IV — SLOTBEPALINGEN

Artikel 11

1 Dit Verdrag is slechts verbindend voor die Leden van de Internationale Arbeidsorganisatie, die hun bekrachtigingen door de Directeur-Generaal hebben doen registreren.

2 Het treedt in werking twaalf maanden na de datum waarop de bekrachtigingen van twee Leden door de Directeur-Generaal zijn geregistreerd.

3 Vervolgens treedt dit Verdrag voor ieder Lid in werking twaalf maanden na de datum waarop zijn bekrachtiging is geregistreerd.

Artikel 12

1 Ieder Lid dat dit Verdrag heeft bekrachtigd, kan het opzeggen na afloop van een termijn van tien jaar na de datum waarop het Verdrag in werking is getreden, door middel van een aan de Directeur-Generaal van het Internationale Arbeidsbureau gerichte en door deze geregistreerde verklaring. De opzegging wordt eerst van kracht een jaar na de datum waarop zij is geregistreerd.

2 Ieder Lid dat dit Verdrag heeft bekrachtigd en niet binnen een jaar na afloop van de termijn van tien jaar als bedoeld in het vorige lid, gebruik maakt van de bevoegdheid tot opzegging bedoeld in dit artikel, is voor een nieuwe termijn van tien jaar gebonden en kan daarna dit Verdrag opzeggen na afloop van elke termijn van tien jaar op de voorwaarden voorzien in dit artikel.

Artikel 13

1 De Directeur-Generaal van het Internationale Arbeidsbureau stelt alle Leden van de Internationale Arbeidsorganisatie in kennis van de registratie van alle bekrachtigingen en opzeggingen, die hem door de Leden van de Organisatie zijn medegedeeld.

2 Bij de kennisgeving aan de Leden van de Organisatie van de registratie van de tweede hem meegedeelde bekrachtiging, vestigt de Directeur-Generaal de aandacht van de Leden van de Organisatie op de datum waarop dit Verdrag in werking treedt.

Artikel 14

De Directeur-Generaal van het Internationale Arbeidsbureau doet aan de Secretaris-Generaal van de Verenigde Naties mededeling, ter registratie in overeenstemming met het bepaalde in artikel 102 van het Handvest der Verenigde Naties, van de volledige bijzonderheden omtrent alle bekrachtigingen en opzeggingen, die hij overeenkomstig de bepalingen van de voorgaande artikelen heeft geregistreerd.

Artikel 15

De Raad van Beheer van het Internationale Arbeidsbureau brengt, telkens wanneer deze dit noodzakelijk acht aan de Algemene Conferentie verslag uit over de toepassing van dit Verdrag en onderzoekt of het wenselijk is de gehele of gedeeltelijke herziening ervan op de agenda van de Conferentie te plaatsen.

Artikel 16

1 Indien de Conferentie een nieuw verdrag aanneemt, houdende gehele of gedeeltelijke herziening van dit Verdrag, zal, tenzij het nieuwe Verdrag anders bepaalt:

a) bekrachtiging door een Lid van het nieuwe Verdrag, houdende herziening, ipso jure onmiddellijke opzegging van dit Verdrag ten gevolge hebben, niettegenstaande het bepaalde in artikel 12 hierboven, onder voorbehoud evenwel dat het nieuwe Verdrag, houdende herziening, in werking is getreden;

b) met ingang van de datum waarop het nieuwe Verdrag, houdende herziening, in werking is getreden, kan dit Verdrag niet langer door de Leden worden bekrachtigd.

2 Dit Verdrag blijft echter naar vorm en inhoud van kracht voor de Leden die het hebben bekrachtigd en die het nieuwe Verdrag, houdende herziening, niet hebben bekrachtigd.

Artikel 17

De Engelse en de Franse tekst van dit Verdrag zijn gelijkelijk gezaghebbend.

De voorgaande tekst is de authentieke tekst van het Verdrag, naar behoren aangenomen door de Algemene Conferentie van de Internationale Arbeidsorganisatie tijdens haar zevenenzestigste zitting, welke werd gehouden te Genève en voor gesloten werd verklaard op de vierentwintigste juni 1981.
