Agreement between the Kingdom of the Netherlands and the Association of Caribbean States defining the modalities of participation of the Netherlands Antilles as an Associate Member

Article 1

For the purpose of this Agreement:

1. The term “Agreement" means the Agreement between the Association of Caribbean States and the Kingdom of the Netherlands defining the modalities of participation of the Netherlands Antilles as an Associate Member.

2. The definitions used in this Agreement shall be the same as those set forth in Article I of the Convention.

Article 2

The Netherlands Antilles shall, in accordance with Articles IV and IX of the Convention, under the same conditions and the same modalities as Member States, have the right to intervene as an Associate Member in discussions and vote at meetings of the Ministerial Council, on those matters which belong to its constitutional competence and which affect it directly.

Article 3

The Netherlands Antilles shall, in accordance with article IV, paragraph 2 of the Convention, this Agreement and other agreements as approved by the Ministerial Council, under the same conditions and the same modalities as Member States, have the right to participate as an Associate Member in meetings of the Special Committees in which programmes, plans and projects are being studied and decided upon, which require its participation and fall within its autonomous authority and which affect it directly. The Netherlands Antilles may present projects and initiatives promoting regional co-operation.

Article 4

The Netherlands Antilles shall contribute to the Annual Budget of the Association, which in accordance with Article XII paragraph 2 of the Convention shall be approved by the Ministerial Council by consensus of the delegates. The amount of the contribution shall be in conformity with the applied criteria for the countries in Group I Category C of the quota distribution in the budget of the Association.

Article 5

The rights and obligations resulting from the present Agreement shall be exclusively binding upon the Netherlands Antilles.

Article 6

This Agreement shall come into force on the date on which the Kingdom of the Netherlands, on behalf of the Government of the Netherlands Antilles, shall have notified the Association of the completion of the relevant constitutional procedures. This notification cannot be made until the Kingdom of the Netherlands has deposited its instrument of adhesion of the Convention with the Government of the Republic of Colombia.

Artikel 1

Voor de toepassing van dit Verdrag wordt verstaan onder:

1. „Verdrag": het Verdrag tussen het Koninkrijk der Nederlanden en de Associatie van Caraïbische Staten tot vaststelling van de voorwaarden van deelname van de Nederlandse Antillen als geassocieerd lid.

2. De betekenis van de in dit Verdrag gebruikte begrippen is dezelfde als die uiteengezet in artikel I van het Verdrag (van 1994).

Artikel 2

Overeenkomstig de artikelen IV en IX van het Verdrag (van 1994) en onder dezelfde voorwaarden als aan de Lidstaten gesteld, zijn de Nederlandse Antillen gerechtigd als geassocieerd lid deel te nemen aan de besprekingen en te stemmen bij de vergaderingen van de Raad van ministers over alle zaken die de Nederlandse Antillen rechtstreeks aangaan en die vallen binnen het kader van hun grondwettelijke bevoegdheid.

Artikel 3

De Nederlandse Antillen zijn in overeenstemming met artikel IV, tweede lid, van het Verdrag (van 1994), dit Verdrag inzake de betrekkingen en van andere door de Raad van ministers goedgekeurde verdragen, en onder dezelfde voorwaarden als gesteld aan de Lidstaten, gerechtigd als geassocieerd lid deel te nemen aan de vergaderingen van de Bijzondere commissies, waarin programma's, plannen en projecten worden bestudeerd en daarover wordt beslist, en waarin hun deelname vereist is, en die binnen het kader van hun zelfbestuur vallen, en hun rechtstreeks aangaan. De Nederlandse Antillen zijn bevoegd projecten en initiatieven ter bevordering van de regionale samenwerking in te dienen.

Artikel 4

De Nederlandse Antillen dragen aan de jaarlijkse begroting van de Associatie datgene bij wat volgens artikel XII, tweede lid, van het Verdrag (van 1994) door de Raad van ministers wordt goedgekeurd bij consensus van de afgevaardigden. De hoogte van de bijdrage wordt bepaald conform de criteria die van toepassing zijn op de Landen ingedeeld in Groep 1, Categorie C, ter zake van de quotaverdeling van de Associatie.

Artikel 5

De rechten en plichten die uit dit Verdrag voortvloeien zijn alleen bindend voor de Nederlandse Antillen.

Artikel 6

Dit Verdrag treedt in werking op de datum waarop het Koninkrijk der Nederlanden, namens de Regering van de Nederlandse Antillen, de Associatie in kennis stelt van de voltooiing van de noodzakelijke grondwettelijke procedures. Deze kennisgeving kan niet worden gedaan dan nadat het Koninkrijk der Nederlanden zijn akte van toetreding tot het Verdrag (van 1994) heeft nedergelegd bij de Regering van de Republiek Colombia.
