PART I
The Contracting Parties accept as the aim of their policy, to be pursued by all appropriate means, both national and international in character, the attainment of conditions in which the following rights and principles may be effectively realised:

The nationals of anyone of the Contracting Parties have the right to engage in any gainful occupation in the territory of anyone of the others on a footing of equality with the nationals of the latter, subject to restrictions based on cogent economic or social reasons.

Migrant workers who are nationals of a Contracting Party and their families have the right to protection and assistance in the territory of any other Contracting Party.

PART II
The Contracting Parties undertake, as provided for in Part III, to consider themselves bound by the obligations laid down in the following Articles and paragraphs.

Article 1
With a view to ensuring the effective exercise of the right to work, the Contracting Parties undertake:
1. to accept as one of their primary aims and responsibilities the achievement and maintenance of as high and stable a level of employment as possible, with a view to the attainment of full employment;
2. to protect effectively the right of the worker to earn his living in an occupation freely entered upon;
3. to establish or maintain free employment services for all workers;
4. to provide or promote appropriate vocational guidance, training and rehabilitation.

Article 2
With a view to ensuring the effective exercise of the right to just conditions of work, the Contracting Parties undertake:
1. to provide for reasonable daily and weekly working hours, the working week to be progressively reduced to the extent that the increase of productivity and other relevant factors permit;
2. to provide for public holidays with pay;
3. to provide for a minimum of two weeks annual holiday with pay;
4. to provide for additional paid holidays or reduced working hours for workers engaged in dangerous or unhealthy occupations as prescribed;
5. to ensure a weekly rest period which shall, as far as possible, coincide with the day recognised by tradition or custom in the country or region concerned as a day of rest.

Article 3
With a view to ensuring the effective exercise of the right to safe and healthy working conditions, the Contracting Parties undertake:
1. to issue safety and health regulations;
2. to provide for the enforcement of such regulations by measures of supervision;
3. to consult, as appropriate, employers' and workers' organisations on measures intended to improve industrial safety and health.

Article 4
With a view to ensuring the effective exercise of the right to a fair remuneration, the Contracting Parties undertake:
1. to recognise the right of workers to a remuneration such as will give them and their families a decent standard of living;
2. to recognise the right of workers to an increased rate of remuneration for overtime work, subject to exceptions in particular cases;
3. to recognise the right of men and women workers to equal pay for work of equal value;
4. to recognise the right of all workers to a reasonable period of notice for termination of employment;
5. to permit deductions from wages only under conditions and to the extent prescribed by national laws or regulations or fixed by collective agreements or arbitration awards.
The exercise of these rights shall be achieved by freely concluded, collective agreements, by statutory wage-fixing machinery, or by other means appropriate to national conditions.

Article 5
With a view to ensuring or promoting the freedom of workers and employers to form local, national or international organisations for the protection of their economic and social interests and to join those organisations, the Contracting Parties undertake that national law shall not be such as to impair nor shall it be so applied as to impair this freedom. The extent to which the guarantees provided for in this article shall apply to the police shall be determined by national laws or regulations. The principle governing the application to the members of the armed forces of these guarantees and the extent to which they shall apply to persons in this category shall equally be determined by national laws or regulations.

Article 6
With a view to ensuring the effective exercise of the right to bargain collectively, the Contracting Parties undertake:
1. to promote joint consultation between workers and employers;
2. to promote, where necessary and appropriate, machinery for voluntary negotiations between employers or employers' organisations and workers' organisations, with a view to the regulation of terms and conditions of employment by means of collective agreements;
3. to promote the establishment and use of appropriate machinery for conciliation and voluntary arbitration for the settlement of labour disputes;
and recognise:
4. the right of workers and employers to collective action in cases of conflicts of interest, including the right to strike, subject to obligations that might arise out of collective agreements previously entered into.

Article 7
With a view to ensuring the effective exercise of the right of children and young persons to protection, the Contracting Parties undertake:
1. to provide that the minimum age of admission to employment shall be 15 years, subject to exceptions for children employed in prescribed light work without harm to their health, morals or education;
2. to provide that a higher minimum age of admission to employment shall be fixed with respect to prescribed occupations regarded as dangerous or unhealthy;
3. to provide that persons who are still subject to compulsory education shall not be employed in such work as would deprive them of the full benefit of their education;
4. to provide that the working hours of persons under 16 years of age shall be limited in accordance with the needs of their development, and particularly with their need for vocational training;
5. to recognise the right of young workers and apprentices to a fair wage or other appropriate allowances;
6. to provide that the time spent by young persons in vocational training during the normal working hours, with the consent of the employer, shall be treated as forming part of the working day;
7. to provide that employed persons of under 18 years of age shall be entitled to not less than three weeks' annual holiday with pay;
8. to provide that persons under 18 years of age shall not be employed in night work with the exception of certain occupations provided for by national laws or regulations;
9. to provide that persons under 18 years of age employed in occupations prescribed by national laws or regulations shall be subject to regular medical control;
10. to ensure special protection against physical and moral dangers to which children and young persons are exposed, and particularly against those resulting directly or indirectly from their work.

Article 8
With a view to ensuring the effective exercise of the right of employed women to protection, the Contracting Parties undertake:
1. to provide either by paid leave, by adequate social security benefits or by benefits from public funds for women to take leave before and after childbirth up to a total of at least 12 weeks;
2. to consider it as unlawful for an employer to give a woman notice of dismissal during her absence on maternity leave or to give her notice of dismissal at such a time that the notice would expire during such absence;
3. to provide that mothers who are nursing their infants shall be entitled to sufficient time off for this purpose;
4.
(a) to regulate the employment of women workers on night work in industrial employment;
(b) to prohibit the employment of women workers in underground mining, and, as appropriate, on all other work which is unsuitable for them by reason of its dangerous, unhealthy, or arduous nature.

Article 9
With a view to ensuring the effective exercise of the right to vocational guidance, the Contracting Parties undertake to provide or promote, as necessary, a service which will assist all persons, including the handicapped, to solve problems related to occupational choice and progress with due regard to the individual's characteristics and their relation to occupational opportunity: this assistance should be available free of charge, both to young persons, including school children, and to adults.

Article 10
With a view to ensuring the effective exercise of the right to vocational training, the Contracting Parties undertake:
1. to provide or promote, as necessary, the technical and vocational training of all persons, including the handicapped, in consultation with employers' and workers' organisations, and to grant facilities for access to higher technical and university education, based solely on individual aptitude;
2. to provide or promote a system of apprenticeship and other systematic arrangements for training young boys and girls in their various employments;
3. to provide or promote, as necessary:
(a) adequate and readily available training facilities for adult workers;
(b) special facilities for the re-training of adult workers needed as a result of technological development or new trends in employment;
4. to encouraige the full utilisation of the facilities provided by appropriate measures such as:
(a) reducing or abolishing any fees or charges;
(b) granting financial assistance in appropriate cases;
(c) including in the normal working hours time spent on supplementary training taken by the worker, at the request of his employer, during employment;
(d) ensuring, through adequate supervision, in consultation with the employers' and workers' organisations, the efficiency of apprenticeship and other training arrangements for young workers, and equate protection of young workers generally.

Article 11
With a view to ensuring the effective exercise of the right to protection of health, the Contracting Parties undertake, either directly or in co-operation with public or private organisations, to take appropriate measures designed inter alia:
1. to remove as far as possible the causes of ill-health;
2. to provide advisory and educational facilities for the promotion of health and the encouragement of individual responsibility in matters of health;
3. to prevent as far as possible epidemic, endemic and other diseases.

Article 12
With a view to ensuring the effective exercise of the right to social security, the Contracting Parties undertake:
1. to establish or maintain a system of social security;
2. to maintain the social security system at a satisfactory level at least equal to that required for ratification of International Labour Convention (No. 102) Concerning Minimum Standards of Social Security;
3. to endeavour to raise progressively the system of social security to a higher level;
4. to take steps, by the conclusion of appropriate bilateral and multilateral agreements, or by other means, and subject to the conditions laid down in such agreements, in order to ensure:
(a) equal treatment with their own nationals of the nationals of other Contracting Parties in respect of social security rights, including the retention of benefits arising out of social security legislation, whatever movements the persons protected may undertake between the territories of the Contracting Parties;
(b) the granting, maintenance and resumption of social security rights by such means as the accumulation of insurance or employment periods completed under the legislation of each of the Contracting Parties.

Article 13
With a view to ensuring the effective exercise of the right to social and medical assistance, the Contracting Parties undertake:
1. to ensure that any person who is without adequate resources and who is unable to secure such resources either by his own efforts or from other sources, in particular by benefits under a social security scheme, be granted adequate assistance, and, in case of sickness, the care necessitated by his condition;
2. to ensure that persons receiving such assistance shall not, for that reason, suffer from a diminution of their political or social rights;
3. to provide that everyone may receive by appropriate public or private services such advice and personal help as may be required to prevent, to remove, or to alleviate personal or family want;
4. to apply the provisions referred to in paragraphs 1, 2 and 3 of this Article on an equal footing with their nationals to nationals of other Contracting Parties lawfully within their territories, in accordance with their obligations under the European Convention on Social and Medical Assistance, signed at Paris on 11th December 1953.

Article 14
With a view to ensuring the effective exercise of the right to benefit from social welfare services, the Contracting Parties undertake:
1. to promote or provide services which, by using methods of social work, would contribute to the welfare and development of both individuals and groups in the community, and to their adjustment to the social environment;
2. to encourage the participation of individuals and voluntary or other organisations in the establishment and maintenance of such services.

Article 15
With a view to ensuring the effective exercise of the right of the physically or mentally disabled to vocational training, rehabilitation and resettlement, the Contracting Parties undertake:
1. to take adequate measures for the provision of training facilities, including, where necessary, specialised institutions, public or private;
2. to take adequate measures for the placing of disabled persons in employment, such as specialised placing services, facilities for sheltered employment and measures to encourage employers to admit disabled persons to employment.

Article 16
With a view to ensuring the necessary conditions for the full development of the family which is a fundamental unit of society, the Contracting Parties undertake to promote the economic, legal and social protection of family life by such means as social and family benefits, fiscal arrangements, provision of family housing, benefits for the newly married, and other appropriate means.

Article 17
With a view to ensuring the effective exercise of the right of mothers and children to social and economic protection, the Contracting Parties will take all appropriate and necessary measures to that end, including the establishment or maintenance of appropriate institutions or services.

Article 18
With a view to ensuring the effective exercise of the right to engage in a gainful occupation in the territory of any other Contracting Party, the Contracting Parties undertake:
1. to apply existing regulations in a spirit of liberality;
2. to simplify existing formalities and to reduce or abolish chancery dues and other charges payable by foreign workers or their employers;
3. to liberalise, individually or collectively, regulations governing the employment of foreign workers;
and recognise:
4. the right of their nationals to leave the country to engage in a gainful occupation in the territories of the other Contracting Parties.
European Social Charter › PART II
Article 19
With a view to ensuring the effective exercise of the right of migrant workers and their families to protection and assistance in the territory of any other Contracting Party, the Contracting Parties undertake:
1. to maintain or to satisfy themselves that there are maintained adequate and free services to assist such workers, particularly in obtaining accurate information, and to take all appropriate steps, so far as national laws and regulations permit, against misleading propaganda relating to emigration and immigration;
2. to adopt appropriate measures within their own jurisdiction to facilitate the departure, journey and reception of such workers and their families, and to provide, within their own jurisdiction, appropriate services for health, medical attention and good hygienic conditions during the journey;
3. to promote co-operation, as appropriate, between social services, public and private, in emigration and immigration countries;
4. to secure for such workers lawfully within their territories, insofar as such matters are regulated by law or regulations or are subject to the control of administrative authorities, treatment not less favourable than that of their own nationals in respect of the following matters:
(a) remuneration and other employment and working conditions;
(b) membership of trade unions and enjoyment of the benefits of collective bargaining;
(c) acommodation;
5. to secure for such workers lawfully within their territories treatment not less favourable than that of their own nationals with regard to employment taxes, dues or contributions payable in respect of employed persons;
6. to facilitate as far as possible the reunion of the family of a foreign worker permitted to establish himself in the territory;
7. to secure for such workers lawfully within their territories treatment not less favourable than that of their own nationals with regard to legal proceedings relating to matters referred to in this Article;
8. to secure that such workers lawfully residing within their territories are not expelled unless they endanger national security or offend against public interest or morality;
9. to permit, within legal limits, the transfer of such parts of the earnings and savings of such workers as they may desire;
10. to extend the protection and assistance provided for in this Article to self-employed migrants insofar as such measures apply.
European Social Charter › PART III
Article 20
1 Each of the Contracting Parties undertakes:
(a) to consider Part I of this Charter as a declaration of the aims which it will pursue by all appropriate means, as stated in the introductory paragraph of that Part;
(b) to consider itself bound by at least five of the following Articles of Part II of this Charter:
Articles 1, 5, 6, 12, 13, 16 and 19;
(c) in addition to the Articles selected by it in accordance with the preceding sub-paragraph, to consider itself bound by such a number of Articles or numbered paragraphs of Part II of the Charter as it may select, provided that the total number of Articles or numbered paragraphs by which it is bound is not less than 10 Articles or 45 numbered paragraphs;
2 The Articles or paragraphs selected in accordance with subparagraphs (b) and (c) of paragraph 1 of this Article shall be notified to the Secretary-General of the Council of Europe at the time when the instrument of ratification or approval of the Contracting Party concerned is deposited.
3 Any Contracting Party may, at a later date, declare by notification to the Secretary-General that it considers itself bound by any Articles or any numbered paragraphs of Part II of the Charter which it has not already accepted under the terms of paragraph 1 of this Article. Such undertakings subsequently given shall be deemed to be an integral part of the ratification or approval, and shall have the same effect as from the thirtieth day after the date of the notification.
4 The Secretary-General shall communicate to all the signatory Governments and to the Director-General of the International Labour Office any notification which he shall have received pursuant to this Part of the Charter.
5 Each Contracting Party shall maintain a system of labour inspection appropriate to national conditions.

Article 21
The Contracting Parties shall send to the Secretary-General of the Council of Europe a report at two-yearly intervals, in a form to be determined by the Committee of Ministers, concerning the application of such provisions of Part II of the Charter as they have accepted.

Article 22
The Contracting Parties shall send to the Secretary-General, at appropriate intervals as requested by the Committee of Ministers, reports relating to the provisions of Part II of the Charter which they did not accept at the time of their ratification or approval or in a subsequent notification. The Committee of Ministers shall determine from time to time in respect of which provisions such reports shall be requested and the form of the reports to be provided.

Article 23
1 Each Contracting Party shall communicate copies of its reports referred to in Articles 21 and 22 to such of its national organisations as are members of the international organisations of employers and trade unions to be invited under Article 27, paragraph 2, to be represented at meetings of the Sub-committee of the Governmental Social Committee.
2 The Contracting Parties shall forward to the Secretary-General any comments on the said reports received from these national organisations, if so requested by them.

Article 24
The reports sent to the Secretary-General in accordance with Articles 21 and 22 shall be examined by a Committee of Experts, who shall have also before them any comments forwarded to the Secretary-General in accordance with paragraph 2 of Article 23.

Article 25
1 The Committee of Experts shall consist of not more than seven members appointed by the Committee of Ministers from a list of independent experts of the highest integrity and of recognised competence in international social questions, nominated by the Contracting Parties.
2 The members of the Committee shall be appointed for a period of six years. They may be reappointed. However, of the members first appointed, the terms of office of two members shall expire at the end of four years.
3 The members whose terms of office are to expire at the end of the initial period of four years shall be chosen by lot by the Committee of Ministers immediately after the first appointment has been made.
4 A member of the Committee of Experts appointed to replace a member whose term of office has not expired shall hold office for the remainder of his predecessor's term.

Article 26
The International Labour Organisation shall be invited to nominate a representative to participate in a consultative capacity in the deliberations of the Committee of Experts.

Article 27
1 The reports of the Contracting Parties and the conclusions of the Committee of Experts shall be submitted for examination to a Sub-committee of the Governmental Social Committee of the Council of Europe.
2 The Sub-committee shall be composed of one representative of each of the Contracting Parties. It shall invite no more than two international organisations of employers and no more than two international trade union organisations as it may designate to be represented as observers in a consultative capacity at its meetings. Moreover, it may consult no more than two representatives of international non-governmental organisations having consultative status with the Council of Europe, in respect of questions with which the organisations are particularly qualified to deal, such as social welfare, and the economic and social protection of the family.
3 The Sub-committee shall present to the Committee of Ministers a report containing its conclusions and append the report of the Committee of Experts.

Article 28
The Secretary-General of the Council of Europe shall transmit to the Consultative Assembly, the Conclusions of the Committee of Experts. The Consultative Assembly shall communicate its views on these Conclusions to the Committee of Ministers.

Article 29
By a majority of two-thirds of the members entitled to sit on the Committee, the Committee of Ministers may, on the basis of the report of the Sub-committee, and after consultation with the Consultative Assembly, make to each Contracting Party any necessary recommendations.

Article 30
1 In time of war or other public emergency threatening the life of the nation any Contracting Party may take measures derogating from its obligations under this Charter to the extent strictly required by the exigencies of the situation, provided that such measures are not inconsistent with its other obligations under international law.
2 Any Contracting Party which has availed itself of this right of derogation shall, within a reasonable lapse of time, keep the Secretary-General of the Council of Europe fully informed of the measures taken and of the reasons therefor. It shall likewise inform the Secretary-General when such measures have ceased to operate and the provisions of the Charter which it has accepted are again being fully executed.
3 The Secretary-General shall in turn inform other Contracting Parties and the Director-General of the International Labour Office of all communications received in accordance with paragraph 2 of this Article.

Article 31
1 The rights and principles set forth in Part I when effectively realised, and their effective exercise as provided for in Part II, shall not be subject to any restrictions or limitations not specified in those Parts, except such as are prescribed by law and are necessary in a democratic society for the protection of the rights and freedoms of others or for the protection of public interest, national security, public health, or morals.
2 The restrictions permitted under this Charter to the rights and obligations set forth herein shall not be applied for any purpose other than that for which they have been prescribed.

Article 32
The provisions of this Charter shall not prejudice the provisions of domestic law or of any bilateral or multilateral treaties, conventions or agreements which are already in force, or may come into force, under which more favourable treatment would be accorded to the persons protected.

Article 33
1 In member States where the provisions of paragraphs 1, 2, 3, 4 and 5 of Article 2, paragraphs 4, 6 and 7 of Article 7 and paragraphs 1, 2, 3 and 4 of Article 10 of Part II of this Charter are matters normally left to agreements between employers or employers' organisations and workers' organisations, or are normally carried out otherwise than by law, the undertakings of those paragraphs may be given and compliance with them shall be treated as effective if their provisions are applied through such agreements or other means to the great majority of the workers concerned.
2 In member States where these provisions are normally the subject of legislation, the undertakings concerned may likewise be given and compliance with them shall be regarded as effective if the provisions are applied by law to the great majority of the workers concerned.
European Social Charter › PART V
Article 34
1 This Charter shall apply to the metropolitan territory of each Contracting Party. Each signatory Government may, at the time of signature or of the deposit of its instrument of ratification or approval specify, by declaration addressed to the Secretary-General of the Council of Europe, the territory which shall be considered to be its metropolitan territory for this purpose.
2 Any Contracting Party may, at the time of ratification or approval of this Charter or at any time thereafter, declare by notification addressed to the Secretary-General of the Council of Europe, that the Charter shall extend in whole or in part to a non-metropolitan territory or territories specified in the said declaration for whose international relations it is responsible or for which it assumes international responsibility. It shall specify in the declaration the Articles or paragraphs of Part II of the Charter which it accepts as binding in respect of the territories named in the declaration.
3 The Charter shall extend to the territory or territories named in the aforesaid declaration as from the thirtieth day after the date on which the Secretary-General shall have received notification of such declaration.
4 Any Contracting Party may declare at a later date by notification addressed to the Secretary-General of the Council of Europe, that in respect of one or more of the territories to which the Charter has been extended in accordance with paragraph 2 of this Article, it accepts as binding any Articles or any numbered paragraphs which it has not already accepted in respect of that territory or territories. Such undertakings subsequently given shall be deemed to be an integral part of the original declaration in respect of the territory concerned, and shall have the same effect as from the thirtieth day after the date of the notification.
5 The Secretary-General shall communicate to the other signatory Governments and to the Director-General of the International Labour Office any notification transmitted to him in accordance with this Article.

Article 35
1 This Charter shall be open for signature by the Members of the Council of Europe. It shall be ratified or approved. Instruments of ratification or approval shall be deposited with the Secretary-General of the Council of Europe.
2 This Charter shall come into force as from the thirtieth day after the date of deposit of the fifth instrument of ratification or approval.
3 In respect of any signatory Government ratifying subsequently, the Charter shall come into force as from the thirtieth day after the date of deposit of its instrument of ratification or approval.
4 The Secretary-General shall notify all the Members of the Council of Europe and the Director-General of the International Labour Office, of the entry into force of the Charter, the names of the Contracting Parties which have ratified or approved it and the subsequent deposit of any instruments of ratification or approval.

Artikel 36
Any Member of the Council of Europe may propose amendments to this Charter in a communication addressed to the Secretary-General of the Council of Europe. The Secretary-General shall transmit to the other Members of the Council of Europe any amendments so proposed, which shall then be considered by the Committee of Ministers and submitted to the Consultative Assembly for opinion. Any amendments approved by the Committee of Ministers shall enter into force as from the thirtieth day after all the Contracting Parties have informed the Secretary-General of their acceptance. The Secretary-General shall notify all the Members of the Council of Europe and the Director-General of the International Labour Office of the entry into force of such amendments.

Article 37
1 Any Contracting Party may denounce this Charter only at the end of a period of five years from the date on which the Charter entered into force for it or at the end of any successive period of two years, and, in each case, after giving six months notice to the Secretary-General of the Council of Europe, who shall inform the other Parties and the Director-General of the International Labour Office accordingly. Such denunciation shall not affect the validity of the Charter in respect of the other Contracting Parties provided that at all times there are not less than five such Contracting Parties.
2 Any Contracting Party may, in accordance with the provisions set out in the preceding paragraph, denounce any Article or paragraph of Part II of the Charter accepted by it provided that the number of Articles or paragraphs by which this Contracting Party is bound shall never be less than 10 in the former case and 45 in the latter and that this number of Articles or paragraphs shall continue to include the Articles selected by the Contracting Party among those to which special reference is made in Article 20, paragraph 1, subparagraph (b).
3 Any Contracting Party may denounce the present Charter or any of the Articles or paragraphs of Part II of the Charter, under the conditions specified in paragraph 1 of this Article in respect of any territory to which the said Charter is applicable by virtue of a declaration made in accordance with paragraph 2 of Article 34.

Without prejudice to Article 12, paragraph 4 and Article 13, paragraph 4, the persons covered by Articles 1 to 17 include foreigners only insofar as they are nationals of other Contracting Parties lawfully resident or working regularly within the territory of the Contracting Party concerned, subject to the understanding that these Articles are to be interpreted in the light of the provisions of Articles 18 and 19.
This interpretation would not prejudice the extension of similar facilities to other persons by any of the Contracting Parties.
Appendix to the Social Charter

Each Contracting Party will grant to refugees as defined in the Convention relating to the Status of Refugees, signed at Geneva on 28th July 1951, and lawfully staying in its territory, treatment as favourable as possible, and in any case not less favourable than under the obligations accepted by the Contracting Party under the said Convention and under any other existing international instruments applicable to those refugees.

DEEL I
De Overeenkomstsluitende Partijen stellen zich ten doel met alle passende middelen, zowel op nationaal als internationaal terrein, zodanige voorwaarden te scheppen dat de hiernavolgende rechten en beginselen daadwerkelijk kunnen worden verwezenlijkt:
1. Een ieder dient in staat te worden gesteld in zijn onderhoud te voorzien door werkzaamheden die hij vrijelijk heeft gekozen.
2. Alle werknemers hebben recht op billijke arbeidsvoorwaarden.
3. Alle werknemers hebben recht op veilige en hygiënische arbeidsomstandigheden.
4. Alle werknemers hebben recht op een billijke beloning welke hun en hun gezin een behoorlijk levenspeil waarborgt.
5. Alle werknemers en werkgevers hebben recht op vrijheid van vereniging in nationale of internationale organisaties voor de bescherming van hun economische en sociale belangen.
6. Alle werknemers en werkgevers hebben het recht collectief te onderhandelen.
7. Kinderen en jeugdige personen hebben recht op een bijzondere bescherming tegen de gevaren voor lichaam en geest waaraan zij blootstaan.
8. Zwangere vrouwen en andere vrouwen in de daarvoor in aanmerking komende omstandigheden hebben bij hun arbeid in dienstbetrekking recht op bijzondere bescherming.
9. Een ieder heeft recht op een doelmatige beroepskeuzevoorlichting, die erop gericht is hem bij te staan bij de keuze van een beroep dat strookt met zijn persoonlijke aanleg en belangstelling.
10. Een ieder heeft recht op een doelmatige vakopleiding.
11. Een ieder heeft het recht om gebruik te maken van alle voorzieningen welke hem in staat stellen in een zo goed mogelijke gezondheid te verkeren.
12. Alle werknemers en personen te hunnen laste hebben recht op sociale zekerheid.
13. Een ieder die geen voldoende middelen van bestaan heeft, heeft recht op sociale en geneeskundige bijstand.
14. Een ieder heeft recht op bijstand door diensten voor sociaal welzijn.
15. Iedere minder-valide heeft recht op vakopleiding en revalidatie in beroep en samenleving, ongeacht de oorzaak en aard van zijn invaliditeit.
16. Het gezin als fundamentele maatschappelijke eenheid heeft recht op een voor zijn volledige ontplooiing doelmatige sociale, wettelijke en economische bescherming.
17. Moeders en kinderen hebben, ongeacht de echtelijke staat en de gezinsverhoudingen, recht op een passende sociale en economische bescherming.
18. De onderdanen van de ene Overeenkomstsluitende Partij hebben het recht op het grondgebied van elke andere Partij een op winst gerichte bezigheid uit te oefenen op voet van gelijkheid met de onderdanen van laatstgenoemde Partij, behoudens beperkingen op grond van economische of sociale redenen van dringende aard.
19. Migrerende werknemers die onderdaan van een der Overeenkomstsluitende Partijen zijn, alsmede hun gezinnen, hebben recht op bescherming en bijstand op het grondgebied van elke andere Overeenkomstsluitende Partij.

DEEL II
De Overeenkomstsluitende Partijen verbinden zich, overeenkomstig het bepaalde in Deel III, zich gebonden te achten door de verplichtingen, vervat in de hiernavolgende artikelen en leden.

Artikel 1
Ten einde de onbelemmerde uitoefening van het recht op arbeid te waarborgen verbinden de Overeenkomstsluitende Partijen zich:
1. de totstandbrenging en handhaving van een zo hoog en stabiel mogelijk werkgelegenheidspeil, met het oogmerk een volledige werkgelegenheid te verwezenlijken, als een hunner voornaamste doelstellingen en verantwoordelijkheden te beschouwen;
2. het recht van de werknemer om in zijn onderhoud te voorzien door vrijelijk gekozen werkzaamheden daadwerkelijk te beschermen;
3. kosteloze arbeidsbemiddelingsdiensten in te stellen of in stand te houden voor alle werknemers;
4. te zorgen voor doelmatige beroepskeuzevoorlichting, vakopleiding en revalidatie en deze te bevorderen.

Artikel 2
Ten einde de onbelemmerde uitoefening van het recht op billijke arbeidsvoorwaarden te waarborgen verbinden de Overeenkomstsluitende Partijen zich:
1. redelijke dagelijkse en wekelijkse arbeidstijden vast te stellen, waarbij de werkweek geleidelijk dient te worden verkort voorzover de vermeerdering der produktiviteit en andere van invloed zijnde factoren zulks toelaten;
2. voor algemeen erkende feestdagen behoud van loon te waarborgen;
3. een jaarlijks verlof van ten minste twee weken met behoud van loon te waarborgen;
4. verdere vrije dagen met behoud van loon of een verkorting van de arbeidsduur te waarborgen voor werknemers die nader omschreven gevaarlijke of voor hun gezondheid schadelijke werkzaamheden verrichten;
5. een wekelijkse rusttijd te waarborgen, die zoveel mogelijk samenvalt met de dag die volgens traditie of gewoonte in het betrokken land of in de betrokken streek als rustdag wordt erkend.

Artikel 3
Ten einde de onbelemmerde uitoefening van het recht op veilige en hygiënische arbeidsomstandigheden te waarborgen, verbinden de Overeenkomstsluitende Partijen zich:
1. voorschriften inzake veiligheid en hygiëne uit te vaardigen;
2. voor de naleving van dergelijke voorschriften door middel van controlemaatregelen zorg te dragen;
3. zo nodig overleg te plegen met organisaties van werkgevers en werknemers omtrent maatregelen, bedoeld om de bedrijfsveiligheid en -hygiëne te verhogen.

Artikel 4
Om de onbelemmerde uitoefening van het recht op een billijke beloning te waarborgen, verbinden de Overeenkomstsluitende Partijen zich:
1. het recht van de werknemers op een zodanige beloning die hun en hun gezin een behoorlijke levenspeil verschaft, te erkennen;
2. het recht van de werknemers op een hoger beloningstarief voor overwerk te erkennen, behoudens uitzonderingen in bijzondere gevallen;
3. het recht van mannelijke en vrouwelijke werknemers op gelijke beloning voor arbeid van gelijke waarde te erkennen;
4. het recht van alle werknemers op een redelijke opzeggingstermijn bij beëindiging der dienstbetrekking te erkennen;
5. inhoudingen op lonen alleen toe te staan op voorwaarden en in de mate als voorgeschreven door nationale wetten of verordeningen, of vastgesteld bij collectieve arbeidsovereenkomsten of scheidsrechterlijke uitspraken.
De uitoefening van deze rechten dient te worden verwezenlijkt door middel van vrijelijk gesloten collectieve arbeidsovereenkomsten, bij de wet ingestelde procedures voor loonvaststelling, of andere bij de nationale omstandigheden passende middelen.

Artikel 5
Ten einde het recht van werknemers en werkgevers tot oprichting van plaatselijke, nationale of internationale organisaties voor de bescherming van hun economische en sociale belangen en tot aansluiting bij deze organisaties te waarborgen, verplichten de Overeenkomstsluitende Partijen zich dit recht op generlei wijze door de nationale wetgeving of door de toepassing daarvan te laten beperken. De mate waarin de in dit artikel voorziene waarborgen van toepassing zullen zijn op de politie, wordt bepaald door nationale wetten of verordeningen. Het beginsel volgens hetwelk deze waarborgen van toepassing zullen zijn ten aanzien van leden der strijdkrachten, en de mate waarin deze waarborgen van toepassing zullen zijn op personen in deze categorie, wordt eveneens bepaald door nationale wetten of verordeningen.

Artikel 6
Ten einde de onbelemmerde uitoefening van het recht op collectief onderhandelen te waarborgen verbinden de Overeenkomstsluitende Partijen zich:
1. paritair overleg tussen werknemers en werkgevers te bevorderen;
2. indien nodig en nuttig de totstandkoming van een procedure te bevorderen voor vrijwillige onderhandelingen tussen werkgevers of organisaties van werkgevers en organisaties van werknemers, met het oog op de bepaling van beloning en arbeidsvoorwaarden door middel van collectieve arbeidsovereenkomsten;
3. de instelling en toepassing van een doelmatige procedure voor bemiddeling en vrijwillige arbitrage inzake de beslechting van arbeidsgeschillen te bevorderen;
en erkennen:
4. het recht van werknemers en werkgevers op collectief optreden in gevallen van belangengeschillen, met inbegrip van het stakingsrecht, behoudens verplichtingen uit hoofde van reeds eerder gesloten collectieve arbeidsovereenkomsten.

Artikel 7
Om de onbelemmerde uitoefening van het recht van kinderen en jeugdige personen op bescherming te waarborgen, verplichten de Overeenkomstsluitende Partijen zich:
1. te bepalen dat de minimumleeftijd voor toelating tot tewerkstelling 15 jaar zal zijn, behoudens uitzonderingen voor kinderen die nader omschreven lichte werkzaamheden verrichten welke niet nadelig zijn voor hun gezondheid, geestelijk welzijn of ontwikkeling;
2. te bepalen dat een hogere minimumleeftijd voor toelating tot tewerkstelling zal worden vastgesteld ten aanzien van nader omschreven werkzaamheden welke als gevaarlijk of als schadelijk voor de gezondheid worden beschouwd;
3. te bepalen, dat nog leerplichtige personen niet zodanig werk mogen verrichten dat zij niet ten volle het onderwijs kunnen volgen;
4. te bepalen, dat de arbeidsduur van personen beneden de leeftijd van 16 jaar zal worden beperkt overeenkomstig de behoeften van hun ontwikkeling, in het bijzonder hun behoefte aan vakopleiding;
5. het recht van jeugdige werknemers en leerlingen op een billijke beloning of andere passende uitkeringen te erkennen;
6. te bepalen dat de door jeugdige personen gedurende hun normale arbeidstijd en met toestemming van de werkgever aan vakopleiding bestede tijd als een deel van de werkdag zal worden beschouwd;
7. te bepalen dat tewerkgestelde personen beneden de leeftijd van 18 jaar recht zullen hebben op tenminste drie weken verlof per jaar met behoud van loon;
8. te bepalen dat personen beneden de leeftijd van 18 jaar geen nachtarbeid mogen verrichten, met uitzondering van bepaalde in nationale wetten of verordeningen omschreven werkzaamheden;
9. te bepalen dat personen beneden de leeftijd van 18 jaar die nader in nationale wetten of verordeningen omschreven werkzaamheden verrichten regelmatig een geneeskundig onderzoek moeten ondergaan;
10. een bijzondere bescherming tegen gevaren voor lichaam en geest, waaraan kinderen en jeugdige personen zijn blootgesteld, te waarborgen, in het bijzonder tegen die gevaren welke al dan niet rechtstreeks uit hun arbeid voortvloeien.

Artikel 8
Om de onbelemmerde uitoefening van het recht van vrouwelijke werknemers op bescherming te waarborgen, verplichten de Overeenkomstsluitende Partijen zich:
1. te bepalen dat vrouwen, hetzij door verlof met behoud van loon, dan wel door passende sociale zekerheidsuitkeringen of uitkeringen uit openbare middelen, in staat worden gesteld voor en na de bevalling verlof te nemen gedurende een totaal van ten minste 12 weken;
2. het als onwettig te beschouwen indien een werkgever een vrouw haar ontslag aanzegt gedurende haar verlof wegens bevalling of haar ontslag aanzegt op een zodanig tijdstip dat de opzeggingstermijn gedurende een dergelijk verlof afloopt;
3. te bepalen dat moeders die hun zuigelingen voeden voldoende tijd daartoe krijgen;
4.
(a) de tewerkstelling van vrouwelijke werknemers die des nachts industriële werkzaamheden verrichten, te regelen;
(b) de tewerkstelling van vrouwelijke werknemers voor ondergrondse mijnarbeid te verbieden, en, zo nodig, voor alle andere arbeid die voor hen ongeschikt is op grond van de gevaarlijke, voor de gezondheid schadelijke of vermoeiende aard daarvan.

Artikel 9
Ten einde de onbelemmerde uitoefening van het recht op beroepskeuzevoorlichting te waarborgen, verplichten de Overeenkomstsluitende Partijen zich, zo nodig een dienst in het leven te roepen of hieraan medewerking te verlenen, die allen, met inbegrip van de minder-validen, dient te helpen bij de oplossing van vraagstukken met betrekking tot beroepskeuze en vorderingen in een beroep, met inachtneming van hun persoonlijke eigenschappen, alsmede van het verband tussen deze en de bestaande werkgelegenheid; deze hulp dient kosteloos te worden gegeven, zowel aan jeugdige personen, met inbegrip van schoolkinderen, als aan volwassenen.

Artikel 10
Ten einde de onbelemmerde uitoefening van het recht op vakopleiding te waarborgen, verplichten de Overeenkomstsluitende Partijen zich:
1. in overleg met organisaties van werkgevers en werknemers te zorgen voor technische en vakopleidingen waarvan een ieder, met inbegrip van minder-validen, kan profiteren, dan wel hieraan medewerking te verlenen, en toelatingsmogelijkheden tot hoger technisch en universitair onderwijs te openen, uitsluitend berustend op persoonlijke geschiktheid;
2. een leerlingstelsel en andere algemene voorzieningen voor de opleiding van jongens en meisjes in hun onderscheiden beroepen in het leven te roepen of hieraan medewerking te verlenen;
3. zo nodig te zorgen voor of medewerking te verlenen aan:
(a) doelmatige en gemakkelijk toegankelijke opleidingsmogelijkheden voor volwassen werknemers;
(b) bijzondere voorzieningen voor de her- en omscholing van volwassen arbeiders, voortvloeiende uit technische ontwikkelingen of uit nieuwe ontwikkelingen in de werkgelegenheid;
4. door het nemen van passende maatregelen het volledige gebruik van doelmatige voorzieningen te bevorderen, zoals:
(a) verlaging of afschaffing van alle kosten;
(b) verlening van geldelijke bijstand in daarvoor in aanmerking komende gevallen;
(c) de tijd welke de werknemer gedurende zijn tewerkstelling op verzoek van zijn werkgever voor aanvullende opleiding besteedt, aan te merken als deel van de normale arbeidstijd;
(d) in overleg met de organisaties van werkgevers en werknemers, de doeltreffendheid van leerlingstelsels en andere opleidingsstelsels voor jeugdige werknemers door het uitoefenen van voldoende toezicht te waarborgen, alsmede zorg te dragen voor afdoende bescherming van jeugdige arbeiders in het algemeen.

Artikel 11
Ten einde.de onbelemmerde uitoefening van het recht op bescherming van de gezondheid te waarborgen, verplichten de Overeenkomstsluitende Partijen zich, hetzij rechtstreeks, hetzij in samenwerking met openbare of particuliere organisaties, passende maatregelen te nemen o.a. met het oogmerk:
1. de oorzaken van een slechte gezondheid zoveel mogelijk weg te nemen;
2. ter bevordering van de volksgezondheid en de persoonlijke verantwoordelijkheid op het gebied van de gezondheid voorzieningen te treffen op het terrein van voorlichting en onderwijs;
3. epidemische, endemische en andere ziekten zoveel mogelijk te voorkomem

Artikel 12
Ten einde de onbelemmerde uitoefening van het recht op sociale zekerheid te waarborgen, verplichten de Overeenkomstsluitende Partijen zich:
1. een stelsel van sociale zekerheid in te voeren of in stand te houden;
2. het stelsel van sociale zekerheid te houden op een bevredigend peil, dat ten minste gelijk is aan het peil dat vereist is voor de bekrachtiging van het Internationale Arbeidsverdrag (no. 102) betreffende minimum-normen van sociale zekerheid;
3. te streven naar een geleidelijke verhoging van de sociale zekerheidsnormen;
4. stappen te ondernemen, door het sluiten van passende bilaterale en multilaterale overeenkomsten of door andere middelen, en met inachtneming van de in zulke overeenkomsten neergelegde voorwaarden, ter waarborging van:
(a) een gelijke behandeling van de onderdanen van andere Overeenkomstsluitende Partijen en de eigen onderdanen wat betreft rechten op het gebied van sociale zekerheid, met inbegrip van het behoud van uitkeringen uit hoofde van de sociale zekerheidswetgeving, ongeacht eventuele verplaatsingen van de beschermde personen tussen de grondgebieden van de Overeenkomstsluitende Partijen;
(b) de verlening, handhaving en het herstel van rechten op sociale zekerheid, o.a. door het samentellen van tijdvakken van verzekering of tewerkstelling der betrokkenen overeenkomstig de wetgeving van elk der Overeenkomstsluitende Partijen.

Artikel 13
Ten einde de onbelemmerde uitoefening van het recht op sociale en geneeskundige bijstand te waarborgen, verbinden de Overeenkomstsluitende Partijen zich:
1. te waarborgen dat een ieder die geen toereikende inkomsten heeft en niet in staat is zulke inkomsten door eigen inspanning of met andere middelen te verwerven, in het bijzonder door uitkeringen krachtens een stelsel van sociale zekerheid voldoende bijstand verkrijgt en in geval van ziekte de voor zijn toestand vereiste verzorging geniet;
2. te waarborgen dat personen die zulk een bijstand ontvangen, niet om die reden een vermindering van hun politieke of sociale rechten ondergaan;
3. te bepalen, dat een ieder van bevoegde openbare of particuliere diensten de voorlichting en persoonlijke bijstand ontvangt die nodig zijn om zijn persoonlijke nood of die van zijn gezin te voorkomen, weg te nemen of te lenigen;
4. de bepalingen sub 1, 2 en 3 van dit artikel, op onderdanen van andere Overeenkomstsluitende Partijen die wettig binnen hun grondgebied verblijven, toe te passen op gelijke wijze als op hun eigen onderdanen, in overeenstemming met hun verplichtingen krachtens het Europese Verdrag betreffende sociale en medische bijstand, op 11 december 1953 te Parijs ondertekend.

Artikel 14
Ten einde de onbelemmerde uitoefening van het recht op het gebruik van diensten voor sociale zorg te waarborgen, verbinden de Overeenkomstsluitende Partijen zich:
1. diensten welke door de toepassing van methoden van maatschappelijk werk kunnen bijdragen tot het welzijn en de ontwikkeling zowel van individuele personen als van groepen personen, alsmede tot hun aanpassing aan het sociale milieu, op te richten of aan de oprichting daarvan medewerking te verlenen;
2. deelneming van individuele personen en particuliere of andere organisaties aan de instelling en instandhouding van dergelijke diensten te stimuleren.

Artikel 15
Ten einde de onbelemmerde uitoefening van het recht van lichamelijk of geestelijk minder-validen op vakopleiding en revalidatie in beroep en samenleving te waarborgen, verbinden de Overeenkomstsluitende Partijen zich:
1. passende maatregelen te treffen voor het verschaffen van opleidingsmogelijkheden, gespecialiseerde instellingen van openbare of particuliere aard zo nodig daarbij inbegrepen;
2. passende maatregelen te treffen voor de tewerkstelling van minder-validen, zoals het oprichten van gespecialiseerde bemiddelingsbureaus, het verschaffen van gelegenheid voor beschutte arbeid en maatregelen tot aanmoediging van werkgevers minder-validen in dienst te nemen.

Artikel 16
Ten einde de noodzakelijke voorwaarden te scheppen voor de volledige ontplooiing van het gezin als fundamentele maatschappelijke eenheid, verbinden de Overeenkomstsluitende Partijen zich de economische, wettelijke en sociale bescherming van het gezinsleven te bevorderen, o.a. door het doen van sociale en gezinsuitkeringen, het treffen van fiscale regelingen, het verschaffen van gezinshuisvesting, en het doen van uitkeringen bij huwelijk.

Artikel 17
Ten einde de onbelemmerde uitoefening van het recht van moeders en kinderen op sociale en economische bescherming te waarborgen, treffen de Overeenkomstsluitende Partijen alle nuttige en noodzakelijke maatregelen te dien einde, met inbegrip van de oprichting of instandhouding van passende instellingen of diensten.

Artikel 18
Ten einde de onbelemmerde uitoefening van het recht op het uitoefenen van een op winst gerichte bezigheid op het grondgebied van elke andere Overeenkomstsluitende Partij te waarborgen, verbinden de Overeenkomstsluitende Partijen zich:
1. de bestaande regelingen zo ruim mogelijk toe te passen;
2. de bestaande formaliteiten te vereenvoudigen en kanselarijrechten en andere kosten welke buitenlandse werknemers of hun werkgevers moeten betalen, te verminderen of af te schaffen;
3. de regelingen met betrekking tot de tewerkstelling van buitenlandse werknemers individueel of gemeenschappelijk op soepeler wijze toe te passen;
en erkennen:
4. het recht van hun onderdanen om het land te verlaten ten einde op het grondgebied van de andere Overeenkomstsluitende Partijen een op winst gerichte bezigheid uit te oefenen.

Artikel 19
Ten einde de onbelemmerde uitoefening van het recht van migrerende werknemers en hun gezinnen op bescherming en bijstand op het grondgebied van elke andere Overeenkomstsluitende Partij te waarborgen, verbinden de Overeenkomstsluitende Partijen zich:
1. doelmatige en kosteloze diensten te onderhouden, dan wel zich ervan te vergewissen dat zulke diensten worden onderhouden, gericht op bijstand aan genoemde werknemers, in het bijzonder voor het verkrijgen van nauwkeurige voorlichting, en alle passende maatregelen te treffen, voor zover nationale wetten en verordeningen zulks toelaten, tegen misleidende propaganda betreffende emigratie en immigratie;
2. passende maatregelen te treffen binnen hun eigen rechtsgebied ter vergemakkelijking van het vertrek, de reis en de ontvangst van genoemde werknemers en hun gezinnen, en binnen hun eigen rechtsgebied gedurende de reis te zorgen voor doelmatige diensten op het gebied van de gezondheid en medische behandeling, alsmede voor goede hygiënische toestanden;
3. waar nodig samenwerking tussen sociale diensten, zowel van openbare als van particuliere aard, in emigratie- en immigratie-landen, te bevorderen;
4. voor genoemde werknemers die wettig binnen hun grondgebied verblijven, voor zover deze aangelegenheden bij de wet of bij verordening worden geregeld of onderworpen zijn aan het toezicht van bestuursautoriteiten, een behandeling te waarborgen die niet minder gunstig is dan die van hun eigen onderdanen wat betreft de volgende aangelegenheden:
(a) de beloning en andere arbeidsvoorwaarden en -omstandigheden;
(b) het lidmaatschap van vakverenigingen en het genot van de voordelen van collectieve onderhandelingen;
(c) huisvesting;
5. voor genoemde werknemers die wettig op hun grondgebied verblijven, een behandeling te waarborgen die niet minder gunstig is dan die van hun eigen onderdanen wat betreft belastingen op uit dienstverband voortvloeiende beloning, en wat betreft kosten of bijdragen verschuldigd met betrekking tot de tewerkgestelde personen;
6. zoveel mogelijk de hereniging van het gezin van een migrerende werknemer die toestemming heeft verkregen om zich op het grondgebied te vestigen, te vergemakkelijken;
7. voor genoemde werknemers die wettig op hun grondgebied verblijven, een behandeling te waarborgen die niet minder gunstig is dan die van hun eigen onderdanen wat betreft gerechtelijke procedures in verband met de in dit artikel vermelde aangelegenheden;
8. te waarborgen, dat genoemde werknemers die wettig binnen hun grondgebied verblijven, niet uitgeleid worden tenzij zij de nationale veiligheid in gevaar brengen of inbreuk maken op de openbare orde of goede zeden;
9. binnen de wettelijke grenzen toe te staan, dat genoemde werknemers zoveel van hun verdiensten en spaargelden overmaken als zij zelf wensen;
10. de bescherming en bijstand, voorzien in dit artikel, uit te strekken tot migranten die zelfstandig een beroep uitoefenen, voor zover deze maatregelen van toepassing kunnen zijn.

Artikel 20
1 Ieder der Overeenkomstsluitende Partijen is verplicht:
(a) deel I van het onderhavige Handvest te beschouwen als een verklaring van de doelstellingen welke zij overeenkomstig de inleidende alinea van genoemd deel met alle daarvoor in aanmerking komende middelen zal nastreven;
(b) zich gebonden te achten door ten minste vijf van de zeven hierna genoemde artikelen van deel II van het Handvest, namelijk de artikelen 1, 5, 6, 12, 13, 16 en 19;
(c) zich, behalve door de overeenkomstig het voorgaand lid door haar gekozen artikelen, gebonden te achten door een aantal artikelen of genummerde leden van deel II van het Handvest, te harer keuze, mits het totale aantal artikelen of genummerde leden die haar binden, niet minder dan 10 artikelen of 45 genummerde leden bedraagt.
2 De krachtens lid 1, sub b en c, van dit artikel gekozen artikelen of leden worden medegedeeld aan de Secretaris-Generaal van de Raad van Europa bij de nederlegging van de akte van bekrachtiging of goedkeuring door de betrokken Overeenkomstsluitende Partij.
3 Ieder der Overeenkomstsluitende Partijen kan op een later tijdstip door kennisgeving aan de Secretaris-Generaal verklaren dat zij zich gebonden acht door andere artikelen of genummerde leden van deel II van het Handvest, die zij nog niet eerder overeenkomstig lid 1 van dit artikel heeft aanvaard. Deze later aanvaarde verplichtingen worden geacht een integrerend deel van de bekrachtiging of goedkeuring te zijn en hebben met ingang van de dertigste dag na de datum van kennisgeving hetzelfde rechtsgevolg.
4 De Secretaris-Generaal doet van elke door hem overeenkomstig dit deel van het Handvest ontvangen kennisgeving mededeling aan alle ondertekenende regeringen, alsmede aan de Directeur-Generaal van het Internationale Arbeidsbureau.
5 Iedere Overeenkomstsluitende Partij dient te beschikken over een aan haar nationale omstandigheden aangepast stelsel van arbeidsinspectie.

Artikel 21
De Overeenkomstsluitende Partijen zenden, in een nader door het Comité van Ministers te bepalen vorm, tweejaarlijkse rapporten inzake de toepassing van de door hen aanvaarde bepalingen van deel II van het Handvest aan de Secretaris-Generaal van de Raad van Europa.

Artikel 22
De Overeenkomstsluitende Partijen doen de Secretaris-Generaal van de Raad van Europa met passende tussenruimten, op verzoek van het Comité van Ministers, rapporten toekomen inzake de bepalingen van deel II van het Handvest, welke zij noch ten tijde van de bekrachtiging of goedkeuring noch bij latere kennisgeving hebben aanvaard. Het Comité van Ministers bepaalt op gezette tijden ten aanzien van welke bepalingen deze rapporten zullen worden gevraagd en in welke vorm deze moeten worden ingediend.

Artikel 23
1 Ieder der Overeenkomstsluitende Partijen zendt exemplaren van de in de artikelen 21 en 22 bedoelde rapporten aan haar nationale organisaties welke zijn aangesloten bij de internationale organisaties van werkgevers en werknemers, die overeenkomstig artikel 27, lid 2, worden uitgenodigd zich te doen vertegenwoordigen op de bijeenkomsten van het sub-comité van het sociale regeringscomité.
2 De Overeenkomstsluitende Partijen doen de Secretaris-Generaal de van deze nationale organisaties ontvangen opmerkingen over genoemde rapporten toekomen, indien laatstgenoemden dit verzoeken.

Artikel 24
De krachtens de artikelen 21 en 22 aan de Secretaris-Generaal toegezonden rapporten worden bestudeerd door een comité van deskundigen, dat eveneens de beschikking dient te hebben over alle overeenkomstig artikel 23, lid 2, aan de Secretaris-Generaal toegezonden opmerkingen.

Artikel 25
1 Het Comité van deskundigen bestaat uit ten hoogste zeven leden, die door het Comité van Ministers worden benoemd uit een lijst van door de Overeenkomstsluitende Partijen voorgedragen onafhankelijke deskundigen van onbesproken reputatie en erkende bekwaamheid op het gebied van internationale sociale aangelegenheden.
2 De leden van het Comité worden benoemd voor een tijdvak van zes jaar; zij zijn herbenoembaar. Na een periode van vier jaar loopt echter het mandaat van twee van de bij de eerste benoeming benoemde leden af.
3 De leden wier mandaat na de eerste periode van vier jaar afloopt, worden onmiddellijk na de eerste benoeming bij loting door het Comité van Ministers aangewezen.
4 Een lid van het Comité van deskundigen, dat benoemd is in de plaats van een lid wiens mandaat nog niet is afgelopen, heeft zitting voor de resterende tijd van het mandaat van zijn voorganger.

Artikel 26
De Internationale Arbeidsorganisatie wordt uitgenodigd een vertegenwoordiger aan te wijzen, die met raadgevende stem de beraadslagingen van het Comité van deskundigen bijwoont.

Artikel 27
1 De rapporten van de Overeenkomstsluitende Partijen en de conclusies van het Comité van deskundigen worden aan een sub-comité van het sociale regeringscomité van de Raad van Europa ter bestudering voorgelegd.
2 Dit Sub-comité bestaat uit een vertegenwoordiger van ieder der Overeenkomstsluitende Partijen. Het verzoekt ten hoogste twee internationale organisaties van werkgevers en twee internationale organisaties van werknemers waarnemers te zenden, die zijn bijeenkomsten met raadgevende stem zullen bijwonen. Voorts kan het ten hoogste twee vertegenwoordigers van niet-gouvernementele internationale organisaties in consultatieve status bij de Raad van Europa raadplegen over aangelegenheden, ten aanzien waarvan deze organisaties in het bijzonder bevoegd zijn, zoals bijvoorbeeld de sociale zorg en de economische en sociale bescherming van het gezin.
3 Het Sub-comité legt een rapport met zijn conclusies, alsmede het rapport van het Comité van deskundigen, voor aan het Comité van Ministers.

Artikel 28
De Secretaris-Generaal van de Raad van Europa doet de conclusies van het Comité van deskundigen toekomen aan de Raadgevende Vergadering. De Raadgevende Vergadering stelt het Comité van Ministers in kennis van haar mening over deze conclusies.

Artikel 29
Het Comité van Ministers kan met een meerderheid van twee derde der leden die hierin zitting hebben, op grond van het rapport van het Sub-comité en na raadpleging van de Raadgevende Vergadering, tot ieder der Overeenkomstsluitende Partijen alle noodzakelijke aanbevelingen richten.

Artikel 30
1 In geval van oorlog of een andere noodtoestand, waardoor het voortbestaan van het land wordt bedreigd, kan iedere Overeenkomstsluitende Partij maatregelen nemen in afwijking van de in het onderhavige Handvest genoemde verplichtingen, doch uitsluitend voor zover de omstandigheden zulks absoluut vereisen en deze maatregelen niet in strijd zijn met andere volkenrechtelijke verplichtingen,
2 Indien een Overeenkomstsluitende Partij van dit recht om af te wijken gebruik heeft gemaakt, stelt zij binnen een redelijke termijn de Secretaris-Generaal van de Raad van Europa volledig op de hoogte van de getroffen maatregelen en van de redenen die hiertoe hebben geleid. Tevens dient zij de Secretaris-Generaal mededeling te doen van het tijdstip waarop deze maatregelen buiten werking zijn gesteld en de door haar aanvaarde bepalingen van het Handvest wederom volledig van toepassing zijn.
3 De Secretaris-Generaal stelt de overige Overeenkomstsluitende Partijen, alsmede de Directeur-Generaal van het Internationale Arbeidsbureau, op de hoogte van alle overeenkomstig lid 2 van dit artikel ontvangen mededelingen.

Artikel 31
1 Wanneer de in deel I genoemde rechten en beginselen en de in deel II geregelde onbelemmerde uitoefening en toepassing hiervan zijn verwezenlijkt, kunnen zij buiten de in deel I en deel II vermelde gevallen generlei beperkingen ondergaan, met uitzondering van die welke bij de wet zijn voorgeschreven en in een democratische samenleving noodzakelijk zijn voor de bescherming van de rechten en vrijheden van anderen en voor de bescherming van de openbare orde, de nationale veiligheid, de volksgezondheid of de goede zeden.
2 De krachtens het onderhavige Handvest geoorloofde beperkingen op de daarin vermelde rechten en verplichtingen kunnen uitsluitend worden toegepast voor het doel waarvoor zij zijn bestemd.

Artikel 32
De bepalingen van het onderhavige Handvest laten de bepalingen van nationaal recht en van alle reeds van kracht zijnde of nog van kracht wordende bilaterale of multilaterale verdragen of overeenkomsten welke gunstiger zijn voor de beschermde personen, onverlet.

Artikel 33
1 In de lid-staten waar de bepalingen van de leden 1, 2, 3, 4 en 5 van artikel 2, de leden 4, 6 en 7 van artikel 7, en de leden 1, 2, 3 en 4 van artikel 10 van deel II van het onderhavige Handvest gewoonlijk behoren tot het terrein van overeenkomsten tussen werkgevers of organisaties van werkgevers en organisaties van werknemers, of gewoonlijk anders dan krachtens de wet worden toegepast, kunnen de Overeenkomstsluitende Partijen dienovereenkomstige verplichtingen aangaan, welke verplichtingen zullen worden geacht te zijn nagekomen, zodra deze bepalingen door zodanige overeenkomsten of andere middelen worden toegepast op de overgrote meerderheid der betrokken werknemers.
2 In de lid-staten waar deze bepalingen gewoonlijk tot het terrein van de wetgeving behoren, kunnen de Overeenkomstsluitende Partijen dienovereenkomstige verplichtingen aangaan, welke verplichtingen zullen worden geacht te zijn nagekomen, zodra deze bepalingen krachtens de wet worden toegepast op de overgrote meerderheid der betrokken werknemers.

Artikel 34
1 Dit Handvest is van toepassing op het grondgebied van het moederland van elk der Overeenkomstsluitende Partijen. Elke ondertekenende regering kan op het tijdstip van ondertekening, dan wel op het tijdstip van de nederlegging van haar akte van bekrachtiging of goedkeuring, het grondgebied dat voor de toepassing van dit Handvest als haar moederland dient te worden beschouwd, nader omschrijven in een aan de Secretaris-Generaal van de Raad van Europa te richten verklaring.
2 Elke Overeenkomstsluitende Partij kan op het tijdstip van bekrachtiging of goedkeuring van dit Handvest, of op elk ander daarop volgend tijdstip, in een aan de Secretaris-Generaal van de Raad van Europa te richten kennisgeving verklaren dat het Handvest, geheel of gedeeltelijk, van toepassing zal zijn op één of meer in bedoelde verklaring aangegeven grondgebieden buiten het moederland gelegen, waarvan zij de internationale betrekkingen behartigt en waarvoor zij de internationale verantwoordelijkheid aanvaardt. Zij dient in deze verklaring aan te geven welke van de in deel II van het Handvest vervatte artikelen of leden in elk der in de verklaring aangegeven gebieden van kracht zullen zijn.
3 Dit Handvest is op het grondgebied of de grondgebieden als vermeld in de in het vorige lid bedoelde verklaring van toepassing vanaf de dertigste dag na de datum waarop de Secretaris-Generaal officieel van deze verklaring heeft kennis genomen.
4 Elke Overeenkomstsluitende Partij kan te allen tijde in een aan de Secretaris-Generaal van de Raad van Europa te richten kennisgeving verklaren dat zij ten aanzien van één of meer grondgebieden waarop dit Handvest krachtens lid 2 van dit artikel van toepassing is, nader te noemen artikelen of genummerde leden van kracht verklaart, welke zij nog niet ten aanzien van zodanig gebied of zodanige gebieden als bindend had aanvaard. Deze later aanvaarde verplichtingen worden geacht een integrerend deel te vormen van de oorspronkelijke verklaring ten aanzien van het betrokken grondgebied en hebben hetzelfde rechtsgevolg vanaf de dertigste dag na de datum van de officiële kennisgeving.
5 De Secretaris-Generaal stelt de overige ondertekenende regeringen en de Directeur-Generaal van het Internationale Arbeidsbureau in kennis van elke door hem uit hoofde van dit artikel ontvangen kennisgeving.

Artikel 35
1 Elk lid van de Raad van Europa kan dit Handvest ondertekenen. Het moet worden bekrachtigd of goedgekeurd. De akten van bekrachtiging of goedkeuring worden nedergelegd bij de Secretaris-Generaal.
2 Dit Handvest treedt in werking op de dertigste dag na de nederlegging van de vijfde akte van bekrachtiging of goedkeuring.
3 Ten aanzien van elke ondertekenende regering die het Handvest nadien bekrachtigt, treedt het in werking op de dertigste dag na de nederlegging van haar akte van bekrachtiging of goedkeuring.
4 De Secretaris-Generaal stelt alle leden van de Raad van Europa en de Directeur-Generaal van het Internationale Arbeidsbureau in kennis van de inwerkingtreding van dit Handvest, van de namen der Overeenkomstsluitende Partijen die het Handvest hebben bekrachtigd of goedgekeurd, alsmede van elke op een later tijdstip verrichte nederlegging van een akte van bekrachtiging of goedkeuring.

Artikel 36
Elk lid van de Raad van Europa kan wijzigingen op dit Handvest voorstellen door deze mede te delen aan de Secretaris-Generaal. De Secretaris-Generaal brengt de aldus voorgestelde wijzigingen ter kennis van de overige leden van de Raad van Europa, waarna deze voorstellen door het Comité van Ministers worden onderzocht en voor advies aan de Raadgevende Vergadering worden voorgelegd. Elke door het Comité van Ministers goedgekeurde wijziging wordt van kracht op de dertigste dag nadat alle Overeenkomstsluitende Partijen de Secretaris-Generaal hun instemming daarmede hebben betuigd. De Secretaris-Generaal stelt alle lid-staten van de Raad van Europa en de Directeur-Generaal van het Internationale Arbeidsbureau in kennis van de inwerkingtreding van deze wijzigingen.

Artikel 37
1 Een Overeenkomstsluitende Partij kan dit Handvest slechts opzeggen na verloop van een periode van vijf jaar na de datum waarop het Handvest ten aanzien van de betrokken Partij in werking is getreden, of binnen elke periode van twee jaar daaropvolgend; in elk van deze gevallen dient de opzegging met inachtneming van een termijn van zes maanden ter kennis te worden gebracht van de Secretaris-Generaal van de Raad van Europa, die de overige Overeenkomstsluitende Partijen en de Directeur-Generaal van het Internationale Arbeidsbureau hiervan mededeling doet. Een opzegging heeft geen gevolgen ten opzichte van de overige Overeenkomstsluitende Partijen, mits hun aantal nooit minder dan vijf bedraagt.
2 Elke Overeenkomstsluitende Partij kan overeenkomstig de bepalingen van het voorgaande lid elk door haar aanvaard artikel of lid van deel II van het Handvest opzeggen, mits het aantal artikelen dat voor deze Overeenkomstsluitende Partij bindend is, nooit minder dan 10 en het aantal leden nooit minder dan 45 bedraagt, en mits dit aantal artikelen of leden steeds de artikelen omvat die door de Overeenkomstsluitende Partij zijn gekozen uit de in artikel 20, lid 1, sub b genoemde artikelen.
3 Elke Overeenkomstsluitende Partij kan dit Handvest of elk der artikelen of leden van deel II van het Handvest overeenkomstig de bepalingen van lid 1 van dit artikel opzegggen ten aanzien van elk grondgebied waarop dit Handvest van toepassing is krachtens een overeenkomstig artikel 34, lid 2, afgelegde verklaring.

Artikel 38
De bijlage bij dit Handvest vormt een integrerend deel ervan.
Bijlage bij het Sociale Handvest

Behoudens het bepaalde in artikel 12, lid 4, en in artikel 13, lid 4, zijn onder de in de artikelen 1 tot en met 17 bedoelde personen slechts die buitenlanders begrepen die onderdaan zijn van andere Overeenkomstsluitende Partijen en rechtmatig woonachtig zijn in, dan wel geregeld werkzaam zijn op, het grondgebied van de betrokken Overeenkomstsluitende Partij, met dien verstande dat de genoemde artikelen dienen te worden uitgelegd overeenkomstig het bepaalde in de artikelen 18 en 19.
Deze uitlegging sluit een uitbreiding van overeenkomstige rechten tot andere personen door een der Overeenkomstsluitende Partijen niet uit.
Bijlage bij het Sociale Handvest

Elke Overeenkomstsluitende Partij ziet erop toe dat vluchtelingen in de zin van het Verdrag van Genève van 28 juli 1951 betreffende de status van vluchtelingen die rechtmatig woonachtig zijn op haar grondgebied, een zo gunstig mogelijke behandeling genieten en in elk geval een niet minder gunstige dan waartoe zij zich krachtens dit Verdrag heeft verbonden, alsmede krachtens alle andere bestaande en op de bedoelde vluchtelingen van toepassing zijnde internationale verdragen.

Deze bepalingen hebben geen betrekking op de betreding van het grondgebied van de Overeenkomstsluitende Partijen en laten de bepalingen van het te Parijs op 13 december 1955 ondertekende Europese Vestigingsverdrag onverlet.

Deze bepaling mag niet in dier voege worden uitgelegd dat clausules en feitelijke gedragingen ter beveiliging van het vakbondswezen zijn verboden of toegestaan.

Deze bepaling mag niet worden uitgelegd als inhoudende een verbod van ontslag op staande voet wegens een ernstig vergrijp.

Artikel 4
Een Overeenkomstsluitende Partij kan de in dit lid bedoelde verplichting slechts op zich nemen indien inhoudingen op de lonen hetzij bij de wet, hetzij bij collectieve overeenkomsten of bij scheidsrechterlijke uitspraken, verboden zijn ten aanzien van de overgrote meerderheid der werknemers, waarbij de niet onder zodanige maatregelen vallende personen de enige uitzondering vormen.

Artikel 6
Elke Overeenkomstsluitende Partij kan zelf het recht van staking bij de wet regelen, mits elke eventuele verdere beperking van dit recht in de bepalingen van artikel 31 rechtvaardiging vindt.

Artikel 7
Een Overeenkomstsluitende Partij wordt geacht aan de geest van de in dit lid genoemde verplichting te hebben voldaan indien zij in de geest van deze verplichting bij de wet bepaalt dat de overgrote meerderheid van de minderjarigen die de leeftijd van 18 jaar nog niet hebben bereikt, geen nachtarbeid mag verrichten.

Artikel 12
De zinsnede „en met inachtneming van de in zulke overeenkomsten neergelegde voorwaarden" van de inleiding tot dit lid wordt geacht onder meer in te houden dat een Overeenkomstsluitende Partij ten aanzien van de niet van verzekeringspremies afhankelijke uitkeringen het ingezetenschap gedurende een voorgeschreven periode verplicht kan stellen alvorens deze uitkeringen aan onderdanen van andere Overeenkomstsluitende Partijen te verlenen.

Artikel 13
De regeringen die het Europese Verdrag betreffende sociale en medische bijstand niet hebben ondertekend, kunnen het Sociale Handvest ten aanzien van dit lid bekrachtigen, mits zij erop toezien dat onderdanen van andere Overeenkomstsluitende Partijen een met de bepalingen van genoemd Verdrag strokende behandeling genieten.

Artikel 19
Voor de toepassing van deze bepaling wordt de zinsnede „gezin van een migrerende werknemer" geacht ten minste zijn echtgenote, en kinderen te zijnen laste die de leeftijd van 21 jaar nog niet hebben bereikt, te omvatten.

Het Handvest houdt juridische verplichtingen van internationale aard in, welker toepassing uitsluitend aan het in deel IV omschreven toezicht is onderworpen.
